prosecutor who filed the u.s. charges against van der sloot is 2010. >> i had my doubts he would ever make it back to alabama to face justice for his crimes. van der sloot preyed on the emotions of a mother whose child had been murdered. van der sloot lied. there was no body buried where he said there was. and van der sloot was able to flee aruba to peru. >> bill: ted williams worked the case years ago. jonathan serrie has the news in birmingham, alabama. hello. >> the story is unfolding as we speak. the d.o.j. plane sent to peru to pick up van der sloot is on its way back to the u.s. and fox news digital has confirmed through van der sloot's attorney that van der sloot is indeed on board that jet plane. the process is in motion despite

his attorney's 11th hour efforts to block it. news photographers swarmed a police van as authorities escorted van der sloot from a maximum security detention facility in lima to the airport where he was handed over to u.s. authorities. van der sloot is serving a 28 year sentence for the 2010 murder of a business student from a prominent peruvian family. peru has temporarily surrendered him to face a trial for alleged financial crimes against the family of natalee holloway. she was last seen leaving a bar in aruba with van der sloot. in 2010, he was indicted for extortion and wire fraud for providing natalee's mother with false information on the location of her daughter's body in exchange for money. >> they still don't know what happened to their daughter but

he will be facing the family here on u.s. soil. it is somewhat a closure for the family. they may not get a murder charge but at least they'll face him in court. >> peruvian authorities agreed to allow u.s. authorities to retain custody, temporary custody of van der sloot not just for the financial crimes trial itself, but any appeals as well. bill. >> bill: jonathan serrie reporting in birmingham. more to come from there. thank you much. >> dana: want to bring in chris swecker f.b.i. assistant director and ted williams, former homicide detective. you know the story well and it's trudge africa the beginning. natalee holloway disappearance as you remember, chris swecker, you were there at the f.b.i. at the time. what were you told and what happened in terms of f.b.i. agents going to that area in aruba when they tried to find her? >> dana, in 2005 i was the head

of all f.b.i. criminal investigations. this case popped up on my radar. director mueller at the time was very plugged into it. he asked if we could send divers to aruba to dive for her in a cove that had high currents and a lot of shark activity. i think it is highly -- we thought at the time and we still do, it's highly likely that van der sloot met her at the casino, slipped her date rape drugs. she had an overdose incident with the drugs and dumped her body in the ocean. that's the working theory and i think it's a very strong working theory. but this case has had so many twists and turns since then as you well know. he was accused of human trafficking in thailand for a while. he has been in chile, back up to new york, finally arrested in peru for a murder of a young woman with a tennis racket down there. this guy is a serial predator.

>> bill: ted, you worked the story as well. did you ever think you would see this day? >> you know, i never thought i would see this day, bill and dana, i have to tell you, i wonder in beth and dave holloway, the mother and father of natalee holloway, thought they would ever see this day, the day that this so-called bottom feeder is on a plane in the custody of the f.b.i. coming to america to face american justice. this is a good day for justice in america, bill and dana. >> dana: chris, i want to show you this extradition timeline. you can see it has taken years, as we pointed out to get to this point. once he gets here to the united states and on his way on a plane right now, chris, what's the next step after that? >> he will be brought before a

judge in alabama and it when be an initial appearance there. the charges will be read to him. a bond will be set or maybe not. i doubt a bond will be set. the government would have to make a showing of why he shouldn't get bond. they'll be able to do that and then he will go to a local facility there until his trial if he decides to go the whole nine yards and go to trial, which i doubt he will. i think the evidence is pretty overwhelming. >> bill: let's talk about the wire fraud charge and extortion charge. apparently it came out of a lie he told prosecutors in peru about where her body was and that his father buried the body under a house. he essentially lured natalee holloway's mom into another devious plot and then admitted

he made it all up. >> you know when van der sloot is lying, that's when his lips are moving. this guy has lied and lied throughout this incident from 2005. yes, he did get $25,000 of the $250,000 he wanted to be able to tell them where the body was. he then took that $25,000. went to peru and while gambling there he met this young girl stephanie flores and he wound up killing her and he was given 28 years. this guy is a social predator, social deviant. i anticipate, bill and dana, they will also give him a mental evaluation right away when he arrives here in the states. he will also be assigned a public defender unless his mother, who is still alive,

>> bill: update you on the smoke we're getting from canada on the map behind me, we can tell you the number of active fires, 233 now burning 9 million acres in canada. most of it is in the western part of the country but the area that's getting all the attention here in the northeast and up and down the east coast and midwest are the fires in quebec and nova scotia. what is that doing? the northern wind that keeps churning around and throwing the smoke down in the northeastern section of our country and further south, too. in the midwest they are being affected as well. every state you see on the map

cities including new york city, d.c., philly and charlotte. already this morning more than 1,000 flights nationwide have suffered delays as a result of this ongoing issue. when you see these images, it is not hard to see why. not only is visibility a problem but there is major health concerns involving people breathing this in for too long, especially people with asthma or copd or younger children or older people. they will -- whether a cough attack or worse just overall trouble breathing here. you are noticing several major sporting events but state leaders are taking action. cancellations including several school districts over in yonkers, long beach and major sporting events. several games, including the yankees/white socks game and racing at belmont park closed.

air quality alerts are in place important the highlighted regions. new york, detroit, philadelphia, washington are the big cities with the worst air quality in the world according to iq air. let's bring in dr. marc siegel professor of medicine and fox news contributor. what would you tell your patients to do today? >> when bill talked about the -- in california when they see the wildfires it blows off quick because of the way the winds go on the pacific ocean. here we are seeing it locked in. i'm in d.c. where the air quality is 317. new york 185 which is why you were able to see some of those buildings. anything over 100 is a hard arid. 317 is what i was feeling in new york yesterday. for health use this, a n95 mask if you're outdoors. in areas where there is a lot of this, especially if you have

underlying asthma, copd as nicole said or respiratory problems. i talked to dr. frank adams, the author of the asthma source book and he said he is concerned about young children. concerned about this building up and also something that i hadn't heard, the risk of infection. lower airway infection increases because you don't fight off infection as easily when the particles get in there. the tiny particles are the issue in the smoke we're most concerned about. >> bill: we have the side effects on screen here, doctor, it covers everything. headaches, runny nose, coughing, stinging eyes. what's not on that list? >> let me break this down for you. the stinging eyes doesn't worry me. a sign you have been exposed. i hear from a lot of my patients headache and fatigue. people are getting fatigued walking around in this. if you have trouble breathing,

yesterday. >> dana: it looked like that for sure. we'll keep an eye on it for everybody and things will clear up soon. >> bill: get back to play ball as well. the legal stakes getting higher for donald trump. federal prosecutors have notified the former president's legal team he is now the target of a criminal investigation into the handling of classified rial. the question now is whether or not an indictment is looming. maybe. andy mccarthy, former assistant u.s. attorney. good morning to you. don't know what biden's status is. pence was cleared a week ago. what is the difference in this case if everyone has been doing it, andy? >> well, in law enforcement parlance, bill, target means somebody who is likely to be indicted. i imagine the other people you mentioned pence is now a closed case. biden may technically be the subject of an investigation. that means the grand jury is merely looking and it is not clear whether he will be charged

or not. when you get told you with a target it is a virtual certainty you'll be charged. >> dana: jesse watters asked me this last night. what would that look like? if a former president of the united states and a current candidate to the president of the united states again is indicted, then what is the procedure? does anything different happen or does he turn himself in like he did last time a few months ago in new york? >> dana, this is so unprecedented i think that anybody tells you they know exactly how it will play out is either delusional or not telling the truth. the fact is we just don't know. we've never been through this before. what i think will happen is that there will be coordination between the f.b.i. and the secret service so it will be similar to the coordination probably better because it is all federal, but similar to the coordination that went on when former president trump surrendered in manhattan on the

state charges. so here presumably this is going to happen in washington where the grand jury is set up. this seems to be something they are pitching as a grand jury obstruction case as much as a document retention case. so what i presume will happen is the f.b.i. will work in coordination with the secret service to arrange a situation where former president trump would be allowed to come to court and be processed like anyone else who gets charged. >> bill: the "wall street journal" reported earlier in the week another grand jury is convened in florida. a question of whether or not it could be prosecuted in washington or -- i don't know what the difference is. but what would rise to a guilty offense? is it i'm not giving this to you? it's none of your business. or i have proof that i showed a classified document to a friend of mine who was staying at mar-a-lago. what could it be, andy?

>> the gamut it runs is -- there is a series of offenses that run from the very serious dealing with people trusted with classified information and then give it to enemies of the united states in order to harm the country to a low-level offense that applies to most people that this comes up with in government where they exhibit gross negligence in mishandling the information such as storing it in an unauthorized place, taking it out of the place that is the safekeeping area, allowing it to be seen by somebody who is not authorized to see it, losing it, you know, just getting it destroyed or transmitted to the wrong place. those are all negligence offenses. they are prosecuted criminally because the people involved are trusted with access to classified information. so along with that comes the obligation to follow the rules

for handling it. then in this particular case, the way they have portrayed it, especially since biden's problems with classified information emerged in january, it seems to me that what happened is the justice department shifted on trump from concentrating on document retention to concentrating on obstruction of the investigation and grand jury. what they are looking at is the representations in particular that were made in june of last year when based on information from former president trump his lawyers gave a package of 38 documents to the f.b.i. telling them that those were the only documents in his possession that bore classification markings and then, of course, we know two months later they do the search warrant at mar-a-lago and find another 100. >> dana: andy mccarthy, do you think the justice department is keeping the white house informed? >> yes, but i think it's being done in a very discrete way.
