[applause] >> trace: good evening and welcome to america's late news, "fox news @ night." @tracegallagher in los ang angeles. and breaking tonight, an unprecedented federal indictment against the former president. donald trump believe to 2034 gop prudential field by a significant margin has been indicted on federal charges related to the conspiracy of obstruction of justice and how he handled classified documents. we have team coverage tonight on the potential legal and political fallout. joining us onset here in los angeles, republican potential candidate larry elder, criminal

defense attorney and covering the breaking details, marianne rafferty. we begin with matt finn on precisely what we are learning about this indictment. good evening. >> former president trump is calling this a dark day for america and is responded to the reported indictments on truth social. >> i'm an innocent man. i'm an innocent person practicum after donald trump, organizing the justice department, organizing the fbi. we can't let this continue to go on because it is ripping our country to shreds. we have such big problems. this should not be one of them. >> reporter: it is not clear exactly what the former president will be charged with but sources told fox news he faces at least seven federal counts of obstruction of justice, conspiracy and illegal retention of classified documents. it is all in relation to trump allegedly storing classified documents at his photo at mar-a-lago home. you may recall last august, the

fbi made the unprecedented move of raiding that property. the national archives alleged trump took 15 boxes of presidential records with classified information to mar-a-lago. attorney general merrick garland later appointed jack smith as special counsel to investigate. as the first time a president is indicted on federal charges and it is the second time this year trump was indicted. back in april, president trump was also indicted in new york on 34 felony counts of falsifying business records. trump says he is scheduled to appear in court in miami on tuesday. trays? >> trace: thank you. spring and former deputy assistant attorney general john yoo. it is great to have you on. former president said this to byron york. let's put this on the screen. presidential records act is 100% clear. there was no crime committed. this is a simple thing. they could sue me simply to get things back. but every president took things when they left the white house and then they go after me criminally and don't think that people are going to stand for it. could they have handled this

seriously? >> i actually think the real threat to president trump is not for actually taking the documents. it is not something that is going to be cured civilly. the real dagger to the heart here is the claims of obstruction of justice. frames we think the charge of lying to federal officers. what is going to be the real heart of the case is that plans to allegedly got his lawyers to essentially lied to the grand jury, allied to the justice department about the claim that they had found all the classified documents and turn them over. otherwise, if it is not of those claims, then-president trump of his argument that he is being selectively, prosecuted when you compare him to how vice president pence has been treated, how president biden has been treated and especially how hillary clinton was treated by the justice department in 2016 when she set up her own server and cycle routes of classified information through it. and then apparently destroyed

records about it. i think he is -- has a good claim there. but that is not going to apply to the obstruction of justice. that is not going to apply to the lying to federal agents charges. >> trace: he said the obstruction goes away because the presidential records act makes the obstruction thing go away. he quoted saying, you can throw these papers in a fireplace if you want to bring a party and there's no objection obstruction because the presidential record acts allows you to have the documents. >> i think, look, i think the claim of selected prosecution is really went then-president trump and his lawyers are going to have to be making and the public form. it is not a good argument to make in a courtroom. he can't say, i'm innocent because you should have charged her. i think the other problem here in the argument is going to be, look, it does not matter whether you committed the underlying crime or not. still committed a crime when you lie through the government when he said, i did not have these documents. i did not have any classified documents.

you can still commit obstruction of justice by trying to prevent the government from investigating. now, this is not going to be an easy case for the government to make. they got to use the testimony of trump's own lawyer against him and they have to overcome one of the deepest, most traditional privileges in american law, which is the privilege of communication, between an attorney and the client. even if they go to trial, trump, appeals, maybe all the way to the supreme court, just on that fact that the justice department put the screws on trump's attorney. >> trace: or he can run on, you know, pardoning himself. i want to put this up, chuck grassley said, quoting here, doj indicts former president candidates from seeing the doj and fbi restricts access to unnecessary redacted biden allegations and they wonder why people think there are two standards for justice. the timing, is it coincidental to you? >> i think that jack smith, the special counsel here, is running on his own schedule.

but look, the problem is that the justice department is under attack by members of congress, by republicans because it is deeply embroiled in politics. because it is trying to resist investigations from the hill. if jack smith ever released the charges tomorrow or next week, probably would be coincidental with lots of other things that the fbi is fighting about and look, this is all bringing the integrity of the justice department into question. i would have said, if you want to raise doubts about prison term, don't charge him with a crime. let the people decide in the next election. that is how we have done everything for the last 230 years. this is the first time the justice department has ever indicted a former president ever indicted a major party's candidate for the presidency during the campaign season. >> trace: yeah. john yoo, thank you. now for political impact let's bring in one of the former president's revels, 2024 gop prudential nomination, larry elder. larry, your thoughts on what happened today, first and

foremost? >> it is a double standard. i mean, as has been pointed out, hilary had an unsecured server in her basement's receiving classified information, lied about passport information, destroyed documents that were under subpoena. you have got joe biden having documents in four or five different places. he was not, president. he did not have the ability to declassify stuff. and if he had stuff in his garage, unsecured. and you have got all these allegations against hunter biden. i think the investigation now for 5 years. i think o.j. simpson, find the killer, before we conclude the hunter biden investigation. >> trace: fair assessment. kevin mccarthy tweeted the following. today is a dark day for the u.s. it is unconscionable for a president to indict the leading candidate opposing him, joe biden kept classified documents for decades. every american who believes in the rule of law stands with president trump against this grave injustice. house republicans will hold the

brazen weaponization of power accountable. and that is the whole thing is you are not just indicting a former president. you are indicting the leader of the opposition party. this is one of those things where they talk about the banana republics. >> that is why. this is the kind of stuff you see in a third world country. it is completely totally outrageous. it won't pass the smell test. all it is all it is going to do is energize the base and make donald trump even more likely to be nominated. maybe that is even what they want. i believe, trays, that donald trump will be nominated and win, i thought it was a slam dunk. i would not be running. i think that substantial people have trumped arraignment syndrome maybe they will be -- there -- there will be a taxing. it is not fair to him. a substantial number of people in the suburbs who will not go for the man if he walked on water and if he did, they would say he can't swim. >> trace: and how do you run an election when you're trying to, you know, adhere to a court document? >> you tell me. that is why i think the judges will likely postpone this so it won't be going in the middle of

a campaign like that and talk about the election interference. this is just outrageous, completely outrageous. >> trace: yeah. saying the following year, it would be much easier for me to win this election if trump were not in the race. i stand for principles of politics. i commit to pardon trump on 2025 and to restore the rule of law in our country. he did most of the candidates feel like that. i know asa hutchinson does not. chris christie, possibly does not. are you kind of on the same camp on that? >> i'm in the same camp as most republicans about this outrage. it is a double standard, as i said before. is the biden people, if the term people, from family had done one fraction of what the biden family is accused of doing, we would be marching on washington. iit is such an interesting. >> trace: so you are worried about the power of the doj in this case. absolutely. we found that because of the twitter files, with the doj was doing to suppress the extent -- covid. we saw with the former cia into officials did interesting that.

consider the unusual nature of this. this is all happening as the former president leads the current president, pretty comfortably in some polling. in fact, in the latest harris poll, i think it was like 47 to 40. >> they are trying to destroy the reputation so they can win an election. that is just as bad as doing any of the other things that have been done over the last number of years and especially during the 2020 election. >> kevin: and this, of course, from louisiana steve scalise. let's be clear about what is happening. joe biden is work in i his department of justice against his own political rival. this sham indictment is the continuation of the endless political persecution of donald trump. stove the question remains, however tonight, trays, will independent voters sensing perhaps in equity in the tournament of law and unfairness begin to move toward the former president or will they given the drama say, enough is enough.

that. your thoughts on what the governor said. >> now is not the time for political candidates to be haggling with their political consultants and arguing over what is advantageous to their campaign. now is the time to stand with the american people, to stand with donald trump every republican running for president has a responsibility to condemn this corruption because it is not just about donald trump. this is about a system of justice that is targeting these 74 million people who proudly voted for to track in the past election as well. they have targeted mobs and that's showing up to school board meetings. they have -- they are targeting catholics and christians, going to -- showing up to worship. the lord in charge, this is not okay. and a nation that has a department of justice that does not seek to promote justice and law and rather seek political opponents will not stand. >> trace: karoline leavitt, going to have you on. thank you. >> thank you.

>> trace: meantime, let's pretend legal specifics of former president trump's notice to appear in federal court in miami on tuesday. marianne rafferty joins us live with those details. mary anne, good evening. >> reporter: good evening. all that indictment has yet to be unsealed, the justice department officials have yet to speak publicly on the matter as well. former president trump is providing these logistical details about his arraignment on truth social for he says i have been summoned to appear at the federal courthouse on tuesday at 3:00 p.m. he goes on to say that reporters are already flocking through the courthouse where the existence of a grand jury is only recently come to light. a second grand jury is also been investigating trump's handling of classified documents. also hearing from witnesses at the direction of special counsel jack smith in washington, dc, for months now but ultimately prosecutors have decided that florida, where the documents were allegedly mishandled in trump's mar-a-lago estate, it would be the appropriate place for these charges. also notable that the jury pool could be more favorable to the truck in his home state. now, trump told fox digital in

an exclusive interview tuesday -- thursday evening that he will plead not guilty in court and maintained that he is "totally innocent." now, as far as where truck will be doing between now and two takes off his court appearance, he has two previously scheduled campaign events that for now remain on the books. i mean, he is coming out strong. >> trace: he is. marianne, thank you. let's bring in t defense attorny and litigator vic. great to have you on. i want to get your take on that. is miami a better venue. >> beyond a shadow of a doubt. absolutely is. but let's not forget how we get here, right? we get to the presentation to the grand jury and that returns what we call a true bill. the interesting thing about a grand jury is we call it kind of secret as a defense practitioner and being in court all the time, we consider to be sacred. but specifically, the prosecution and the federal indictment that they are seeking does not have the obligation to present all the good evidence on the other side. such as the reliance on the

attorneys, the attempt to cooperate and the other attempts to solve this and put it down to something less than criminal. >> trace: what about the potential records act was does that play into this at all? i will play a soundbite. i want to get your take on the presidential records and how much influence that has on this. >> it has a lot of influence but let's not forget what the charges are in this case. it allows the president to make unilateral decision to consider certain things to be private. however, when a document is considered to be classified, then the entire subject matter around that classification stand, then becomes classified as well. which means that everything that has to do with that subject matter previously determined to be classified is now with a classified compartment. so with -- what that means is at a certain point in time, the president has protection. but the president according to the presidents will say this. yes, you can declassify. but you need to ask for permission and you need to go to

the process. the presidential powers on the other hand, granted by the constitution, say, i'm the president. i can do what i want with the items that are in my possession. >> trace: let's play this. jim trusty says the presidential records act allows the president to do pretty much anything and avoid obstruction. watch. >> so when you have the presidential records act depends where you have the classification as a defense, then there's really nothing, i mean, he could have had a party throwing stuff in a bonfire and it would not be obstruction. >> trace: with a bonfire and no such thing is obstruction. >> let's be realistic about it. yes, in the microcosm of letting something become part of the public eye and the public preview maybe that is not obstruction. but the obstruction that is levied in multiple counts in this indictment may be as simple as i'm asking you for something, trace. and you are not giving it to me as the department of justice. you are obstructing my goal to get justice in the furtherance

of the investigation. i would not put all my eggs in the basket of obstruction of justice is destruction of the materials. perhaps we can consider obstruction of justice as just not cooperating. >> trace: what about the fact that, you know, mishandling of documents, right, is that something you think, well, the prosecutors have put themselves in kind of a narrow path here because it didn't joe biden mishandled the very same kind of documents? i mean, didn't mike pence mishandled the very same type of documents? it is one of those arguments. >> as you just told us, he hit the nail on the head. it does not matter. within the four corners of the legal case, you can change both the facts and the law. you cannot challenge the fairness of the system. that is something that is already statutorily dictated by congress and on the way down. so the fact that there may be a thousand other potential defendants who committed the same crime is available -- irrelevant. i remember one of my first cases in the southern district as a

we were just talk about politics in the break. this is all about politics and there's a couple of trains of thoughts on this. one is that, in accord with the democrats really want is they want to push for doing this because they want to push the president, the former president out of the race altogether and the other thought is is that they want to make sure the former president wins the primary because they believe they can beat him in the general. which side do you come down on? >> that is my theory, trace was, i believe the democrats want to come to be the nominee. i think they believe he is the only one who can really -- they can really beat. i think virtually any of the other nominees will be able to beat biden. biden is underwater on every issue, whether it is gasoline prices, inflation, you name it, he is underwater. and i think they want to drive up president trump's anchor because base loves to rally around him because they feel that he is being mistreated. he has already set up fundraisers on this. so i believe that the democrats would love to run against donald

trump again. if. if i do not feel that way, trace, i would not be in the race. my feeling is that at some point, the voters in the primary are going to realize they need to rally around someone who is -- the wake the democrats did when bernie sanders won the nevada caucuses, one brief shining moment, self-destruct democrat socialist. front runner. jim clyburn then endorses joe biden on the eve of the south, nonprimary provided when the primary. all the other candidates rally around biden. he gets to the finish line. that is what i think the republicans need to do it eventually to whose name is other than donald trump. >> trace: i don't want to put words in your mouth, but we are saying is the biden campaign fears everybody on the gop side except for the former president. >> that is exactly how i would put a picture when i want to get back to you, vik bajaj. we were talking about the concept of the handling of the documents and george washington university professor jonjon turley fox news contributor had this to say about that is handling charges.

>> if i was on the biden legal team, i would be very uneasy right now to hear that there are mishandled accounts. joe biden mishandled material for much longer period and many more locations than it did president trump. so if i was biden's because like i would be a little bit and easy. that is one of the reasons there is going to be one of the first things we look to, is how they threat this nato. >> trace: is what he is talking about is what we talked about which is the one about his impact what about biden? what about parents and what about these other guys who had that document? we were addressing that. does it does does he make a fair park there? >> no, it does not change my argument because you have different approaches by both of these defenses. in other words, former president trump has his defense which is my power, i can do what i want with it. i don't need to ask for permission. i'm sticking to those guns. other similarly situated who have been found with potentially

classified documentation in unsecured areas, they are cooperating. they are saying, they are saying, hey you know it? this may have been a mistake. i don't believe that this is something that changes my opinion because the approaches are so markedly different. one, purely rests on the constitutional presidential power. the other does not address that issue. it is, i may have been wrong. but we are cooperating. >> trace: nbc -- nbc news reporting that attorney general merrick garland did not approve these charges. is there any world in which he takes the attorney general of the united states did not approve the charges of going after the first indictment ever, federal indictment ever of a former president? >> trace, this is my face when i'm trying not to smile or laugh, okay? absolutely not. this is the attorney general of the united states. , anointed mr. smith to be the special counsel? one answer would be darling. so of course he has to give the final blessing. you have to kiss the ring so to

speak before it goes public. i just would not spend a dollar or any kind of investment on that theory that he does not have a horse in this race. >> trace: but it has become a very big political football the fact that there is very little trust right now in government. very little trust in the fbi. very little trust in the doj. the biden documents are given to the oversight committee today. they look at it and boom, three hours later, indictment. >> it is also special counsel investigating, trace, that handling of the biden classified documents. what is the status of that investigation. what will we find out about that? why is it taking so long. >> trace: yeah, it is a precaution. and that is the whole thing, is, when do we get to the indictment? one today hope this indictment, you know, it has been, we know there are several accounts,] we know we are picking and cherry-picking some of these accounts. there are some things and we don't know, but we kind of have an idea who is leaking but we don't know when the indictment is going to be unsealed. is going to be at 3:01 tuesday

afternoon. >> yes, it will be. and shortly after president trump makes his way into the courthouse, the court will have to order it to be unsealed unless there are co-conspirators that maybe still on the run, let's say and not apprehended or not having made their appearance in court. it will be unsealed and an interesting point of this is they have alleged a conspiracy. the reason why that is so important is the conspiracy allegation in federal court room requires over -- to be delineated on that paper. so if it tells a story that may give us better light as to what the crux of the obstruction charges are. >> trace: what do we take away from this, larry? your final thoughts. >> 's final thoughts, trump, popular among the pace. more likely to be nominated and rally around him. fundraise off of all of this. >> trace: they are already fundraising. we are getting e-mails right now. are you surprised? as i said before, because of trump and not his fault for the most part, there are so many swing voters for whom this is going to be just another nail in the coffin. i cannot vote for this match too

and ban surveillance from buying so-called weapons of war. critics are wondering why a governor is into federal issues so are we. the united states and cuba are denying the wall street journal reported that china is planning to build an electronic eavesdropping facility on the island of cuba. the alleged spy facility would allow the chinese to listen to u.s. communications throughout the southeast. where there are many military bases and also allow it to monitor u.s. ship traffic. the pentagon says it is aware of the precarious relationship between cuba and china but claims the report of a spy station is not accurate. a conservative group that pushes back against school curricula in beliefs harmful to children is now being classified as an extremist group and the moms for liberty have plenty of company. here is correspondent molly l line. >> reporter: are going schools are now on the front lines of

hatred and violence. the southern poverty law center is dubbed a dozen parental rights organizations as antigovernment extremists. and the center's annual report. moms for liberty has highlighted for harassing teachers and school officials, joining other organizations branded anti-lgbtq, neo-nazi, and anti-immigrant. on the law center's head. >> we are letting it kind of roll off our back are back innocence because it is just ridiculous. when you look at the people listed at the top of the southern poverty law center's website, those that are considered in their hate group, it is members of the kkk. day to legal advocacy but based multiple defamation lawsuits for its hate labeling. a conservative nonprofit family research council, a longtime target of the splc has launched a petition calling to investigate the center for anti-conservative bias. noted in florida in 2021 moms
