it'sage election interference at the highest level. i'm an innocent man, i'm an innocent person. this is warfare for the law and we can't get it happen. we can't let it happen. our country is going to hell and they come after donald trump, weaponizing the justice department, weaponizing the fbi. >> peter: special counsel jack smith has not indicted anything. one count under the espionage act. obstruction of justice. obstruction or falsification of records and conspiracy and false statements. president trump's legal team tried to stop this from happening but jim trusty said to have a good relationship with this special counsel could not convinces doj to ignore the evidence they think gives them a strong enough case to charge.
4:03 am
>> there is no reason in god's green's earth anyone should trust the information bubbling up from the special counsel's office to the attorney general. we have uncovered significant misconduct. there is substantive defenses that are fantastic. the presidential records act means this entire thing is not in a criminal setting. that's a statutory scheme about document retention and relinquishing to are a cifers that are has no criminal penalty. so the idea that you can be doing armed raids and even criminal grand jury subpoenas is ludicrous. >> peter: president biden says he did not know about this indictment and from a practical point of view, there is reason to believe him because we know president biden really wants to run against president trump again next year. and so it's unlikely he would want to do something that would potentially general dyes his chances of a rematch back to you. >> brian: it does weaken him, peter, to have these seven indictments and have this be side tracked and pull him off

4:08 am
aware we have so much trafficking of children. they are removing -- they have to. these are -- unless they have every child sex case solved in our state of florida, then they should have time to do this and they don't. we are one of the top in the country, guys. that's what they are doing. these agents could be dedicated to that yet, they are going after donald trump and i don't think it's a coincidence now because of the 10:23 that's out. >> brian: let me ask you something. the fact that it's in florida gives the president hope because in washington, he got 5% of the vote. in florida, he wins. is there a better chance, you think, of a fair trial jury pool? >> yeah, you read my mind, brian, absolutely there is. and do i think they wanted it in florida? of course not. they wanted it in d.c. see -- legally, to tie this in, they had it in d.c. initially
4:09 am
they can say he left the white house with the documents in washington, d.c. now that he got down to mar-a-lago, i think, again, i think really what they are going for is saying that he moved the documents. it's obstruction. and, it's going to be an interesting legal argument if the documents were moved. he had the right to the documents. did he have the right to move them? did he have the right to hide them from them if that's what they are claiming? and so, yes. florida is going to be a much friendlier jurisdiction. our judges are going to be much -- it's sad when you have to decide whether a judge is going to be fair. isn't it? justice is supposed to be blind but, yes, in florida we're going to have much better judges. >> ainsley: january 6th could be in d.c. >> steve: pam, we were speaking a moment ago about after the bi-lat meeting with the prime minister of the u.k. said steve nelson asked a great question and got an answer from the current president regarding, you know, bribery.

4:11 am
just like everything else yet, again, they are coming at donald trump with 1, 2, 3, 4, punches, every angle, every pretty much state in the country i think they can go after him, they are going to can go after him. you know, we all talk about all the time weaponization of our courts, weaponization of our law enforcement. and, you know today, truly or if he really is indicted, i believe he will be in florida, it truly is weaponization the ultimate sense, guys, because there are so many violent crimes out there that they should be investigating and my guess is those real fbi agents out there don't want to be doing. this they want to be investigating the real crimes. >> brian: evidently they are not investigating anything on hunter. they are not investigating anything on the whistleblower with the credibility. that's what william barr said. don't believe jamie raskin. i sent it over to delaware. i didn't close the case. so he is doing his adam schiff impersonation. i think it throws off a lot of

people. how could this guy be saying something. two people looking at the same document and have totally different conclusions. hopefully he has called out and credibility destroyed. one quick thing. take a look at some of this video, texas so desperate to stop illegal immigrants from crossing into their state they put their own operation lone star and now put inflatable border right in the middle of the rio grande in the eagle pass sector to make it obviously more difficult to get across. what do you think of this resourcefulness? does this have a problem legally? >> no. i think greg abbott is doing what he has to do. i think all of the law enforcement officers in texas are. i was an attorney general with greg. i have known him many years. imagine what that state is going through. as the result -- the federal government has turned texas into the wild, wild west. letting these people cross our border. and when i say these people, they are not vetting these people to see if they have drugs on them. to say see if they are terrorists coming into our country. after 9/11, i truly can't
4:13 am
believe that we are seeing this in this modern day and age happen. yes, they have to be resourceful. they have to do what they can to protect texas. they will continue to do that. and, frankly, every federal agent should be on that border right now instead of investigating donald trump and that's one of the reasons we are so concerned about human trafficking once again in the state of florida. because these people are flowing in to our country through the borders. texans aren't safe. floridians aren't safe. none of us are safe until our border is secure. >> steve: it's too bad that texas has got to do that because usually that's the purview of the federal government. >> ainsley: looks like spikes on the yellow ones. >> steve: it's kind of crazy. can i ask you one more question before you leave. when you talk to president trump, why did he want to keep those documents? why not just give them back? is it worth going through all of this? now he has all these legal fees and be in court. why not give back the materials? >> yeah, ainsley, i'm not his attorney. i haven't spoken to him about his legal case. but, again, remember, we have a
