>> bill: you can't forget it. he will be out there. coming up in about one hour joran van der sloot will be before a judge in birmingham. alabama. julie banderas is in for harris, "the faulkner focus" starts right now. happy friday, folks. we'll see you on monday. >> julie: we begin with a fox news alert. 18 years after the disappearance of 18-year-old natalee holloway prime suspect joran van der sloot is set to be arraigned on u.s. soil. the charges said to be extortion and wire fraud. natalee's family will come face-to-face with him in years. this is "the faulkner focus", i'm julie banderas in for harris faulkner. the dutch national was temporarily extradited to the u.s. from peru where he is

currently serving an unrelated murder sentence for 28 years. he arrived yesterday at the airport in birmingham. you can see several f.b.i. agents escorting him from the plane. he was held at hoover city jail overnight. new video shows him arriving at the federal courthouse earlier this morning. van der sloot allegedly tried to sell natalee's mom false information on the location of her daughter's body in exchange for a quarter million dollars. beth holloway's attorney says emotions are law. >> she is basically overwhelmed by whole situation. she had a whole spectrum of emotions. on the one hand she was ecstatic that van der sloot was on u.s. soil, u.s. authorities, u.s. justice system. but it is still like pulling a scab off an old wound. always pain there and it's a painful reminder of what she has been through. >> julie: jonathan serrie joins

us with the latest. >> i remember that you were part of that early team that went down to aruba. when i first arrived on the island in 2005 when natalee was reported missing there was a sense of disbelief. people did not want to believe that some violent crime could take place on this normally relatively quiet, popular tourist destination. some residents speculated that natalee simply ran away but her mother, beth holloway, suspected foul play from the beginning. politely but persistently kept the pressure up on joran van der sloot and his parents. aruba authorities never charged him seen leaving a popular tourist bar just before she disappeared during her 2005 senior class trip. five years later he allegedly approached natalee's mother with an -- he allegedly gave beth holloway false information in

exchange for a down payment of $25,000, pocketed the money and fled to peru and there he met another young woman in a casino and murdered here five years to the day of natalee's disappearance. after pleading guilty, a judge sentenced him to 28 years if prison but peru authorities granted the u.s. temporary custody of van der sloot so he can be tried for his alleged financial crimes against the holloway family. author and former f.b.i. agent ken strange says if the case reveals additional information about natalee's disappearance he could face more legal trouble in the u.s. beyond his current federal charges of extortion and wire fraud. >> this could eventually lead to additional charges if they receive further information. that certainly can be the case. >> strange says that he expects that van der sloot will plead not guilty at today's

arraignment, in which case the case would go to trial and he says that may not happen for as long as a year from now. julie. >> julie: wow. thank you so much. we have ted williams on deck former d.c. homicide detective, defense attorney and fox news contributor. thank you so much. i have been covering this case since it happened in 2005. i know the family. met joran van der sloot. the guy is a creep. he never owned up to that and then he teased the family to lead them to believe he would lead them to the body. he took $25,000 as a down payment. where does it go next? >> it goes where, julie, it is now here in birmingham, alabama. it goes to a federal court. joran van der sloot will appear before a magistrate judge here

in the federal court here in birmingham. he will be given a public defender. he will be arraigned. he will be asked if he pleads guilty or not guilty to the extortion and wire fraud charges. i suspect he will plead not guilty and at that stage it starts the trial procedures here in birmingham, julie. >> julie: do you see there is any deal presented to him, any deal on the table whatsoever? beth holloway will be there and she is hoping for some kind of justice. obviously justice was never served for the death of her daughter. >> i don't think there will be any deal. i will tell you why. because you cannot trust joran van der sloot. he lied in 2005, he lied in 2010 to the authorities, and he

continues to lie throughout this case. so i don't think the authorities can trust him. to be candid, julie, i also investigated this in 2005 and on and i do believe, unfortunately, that van der sloot and perhaps others took natalee's body out to the sea and that is where she is at. i do not believe under any circumstances that she is -- her body or remains would be on land there in aruba. >> julie: i agree with you. i've been all over the island and see where search teams have searched for her. his father was a sheriff. very connected politically on the island of aruba. he is dead now. the evidence is obviously gone. now the question is, is there ever going to be actually any kind of justice for the family? if he is, in fact, charged and he is convicted of these charges, what does that do to his current sentence right now

where he is sentenced to 28 years for the death of a 21-year-old peruvian college student? >> what will happen is, because peru temporarily extradited him here to face these charges, he will have all appeals here taking place and after that he will go back to peru to serve the remainder of those 28 years. and then he would be brought back here to the united states to serve any sentence that was handed down here. i do believe, julie, also, the evidence is overwhelming and that there will be a guilty -- that a jury will find him guilty here in the states. >> julie: the guy doesn't care. he is a sociopath. one picture he is detained before they head off to the airport and actually smiling while he is being held and detained in chains by the f.b.i. obviously this guy does not care about the fact that he is now

fox weather's nicole valdez is? washington where we saw many events postponed yesterday. looks like the fog is finally lifting. >> julie, good morning. thankfully much better news to report here. i do want to point out there are still air quality alerts in effect for the d.c. area. something to pay attention to especially if you are part of the sensitive groups of people who may be a little bit more impacted by poor air quality. yes, those very scary air quality index numbers have dropped drastically over the last 10 to 12 hours or so. now, you are seeing here we are at the national mall looking at the washington monument. you aren't seeing is the very gross-looking haze we had seen for much of the day on thursday. you have clear skies, you can see the sun. people are taking advantage of the improved conditions, walking around, having a picnic and

bringing families outside. let me show you what d.c. looked like yesterday. a view of our nation's capital thursday. much more bleak. smoke from more than 100 fires that are still burning in canada filled the air yesterday. thursday d.c. schools and d.c. areas schools canceled field trips and all outdoors activities keeping students inside as much as possible. the national zoo closed its doors, city parks closed, even the washington nationals game pushed two weeks as air quality remained a major health concern. today as fears subside many of the closures are being or already lifted. d.c. now down to a moderate air quality index of 67 compared to this time yesterday when d.c. was seeing readings of 293. very unhealthy air, dropping several hundred points in a 10-hour window. a much better sign of what's ahead this weekend. >> julie: thank you so much.

this. the former president is golfing at his club today and new video of that taken from a chopper as he plays at his course here in bedminster. the president is teeing off. the indictment marks the first time ever a former president has been criminally charged by the federal government. the indictment is still under seal. sources tell fox news trump is charged with seven counts including obstruction of justice, conspiracy, making false statements and illegal retention of classified information in violation of the espionage act. fox news is independently confirming reports that prosecutors have an audio tape where he admits he had a classified document on a special attack on iran. jack smith's investigation dated back to early last year. the raid of his home and agents recovered documents the d.o.j.

requested from the former president. trump wrote last night i'm an innocent man. the biden administration is totally corrupt. this is election interference and a continuation of the greatest witch hunt of all time. make america great again. president trump also told fox news digital that he believes the timing of this indictment is meant to cover up reporting about president joe biden allegedly receiving a $5 million payment from a ukrainian gas company executive. this indictment comes as president trump separately faces state charges in new york for his role in a hush money payment to stormy daniels on the eve of the 2016 election. the former president is also facing investigations regarding january 6th and his efforts to overturn the election results in georgia. back out here live the former president is set to appear in miami federal court at 3:00 p.m. tuesday. the white house does not have an official comment but president biden did say that he has never

pressured the d.o.j. to bring any charge. we'll send it back to you. >> julie: thank you so much. there is an op-ed in the "washington post" highlighting just how serious and unprecedented this indictment is. the country has crossed into daunting new territory. we've been close to the brink before. nixon and clinton were exiting the public stage. something more steerous by the government want led and wants to lead again asserting the former president is a felon. matt whitaker joins me now. first of all, did you see this coming down the road? all of it, just the classified documents is one thing because we know that biden had them, we know pence had them. they were forthright with them. it is the deceitful actions that the government is accusing the president of by trying to hide the documents before they were collected that is the problem here. >> yeah.

it is good to be with you. one of the things that i think when the raid on mar-a-lago happened, my experience is that was a serious moment. but i think this is a really sad day. this is the third example in three straight elections where the department of justice has tried to target donald trump or otherwise influence an election to the benefit of his opponent. i look at what the rule of law stands for and one of the major tenets of the rule of law is consistent application. you point to examples whether it's joe biden or whether it's hillary clinton or whether it's mike pence, in each case they all have their nuance but the most important thing in all of this is that the department of justice makes sure we all understand why these cases are distinguishable and why joe biden and his special counsel isn't proceeding with as much speed as we have in this case against donald trump. but i know that the president will continue to fight this, as

he does a lot of these other charges that have been made against him. in the case of the russian collusion hoax we saw the durham report suggested should that case have never been opened but never any evidence there. >> julie: i want your reaction to the news prosecutors have an audio tape from the summer of 2021 where trump allegedly admitted having a classified document in his possession about a potential attack on iran after he said that any material taken from the white house after he left office had been declassified. what is your reaction to that? is that going to hurt his case even further? >> one of the things we should expect out of the indictment is a speaking indictment. even though no one has seen it but we've heard based on the notice to appear that it contains seven counts including some charges of false statements.

it will be very interesting how much detail. i would expect this indictment will go into a lot of detail about the evidence that the government has. it may even talk about some of these -- this tape that allegedly exists. but at the same time, i think there is a bigger question. that question is, what was the motivation of the department of justice to go after donald trump for these charges? there is an inconsistent appears to me application of the statutes as it relates to donald trump vis-a-vis other nationally known figures. >> julie: he is also the only one running for president. and things seem to be moving very quickly. so that would be why the president is accusing president biden of perhaps speeding this along. the president denied having any involvement. i want to play tape from former attorney general bill barr. he lays out to the left's last hope to indict trump. trump taking the documents isn't really his biggest problem.

watch this. >> this was a fairly simple case. the mar-a-lago case. it can be done relatively quickly. if i had to bet, i think there will be an indictment here on that basis but it is not going to be because he took the documents or even had the documents for a while. i think it is because they believe that he acted deceitfully once the government tried to get the documents back. >> julie: the president is saying he is innocent and calls it the boxes hoax. the boxes of documents in his mar-a-lago home and some of them were removed and so the accusation here is that the person who removed them was, in fact, former president trump. >> yeah, again, they have evidence in their possession that makes them believe that their set of facts is what happened. i think the hardest thing for someone like me who has been a u.s. attorney and knows how these decisions are made and the

influence that not only the special counsel but also the attorney general has in these roles is that so much of this goes to a discretion question, goes to a judgment call. and when you have this trump derangement syndrome that pervades the current department of justice, i'm not sure that they are objective in making these decisions. because again, their boss is ultimately on a collision course in 2024 to go against donald trump. >> julie: speaking of that judgment call, i want your reaction on this. the gop sees this as a conflict of interest in the trump indictment. senator ted cruz reacting with this. the weaponization of our department of justice against enemies of the biden administration will do enormous damage to the rule or law and have a lasting impact. senator josh hawley saying this. what is that going to look like if d.o.j. inditties this guy on the eve of a presidential

election but the current president is charged with nothing? your thoughts. >> that's exactly the point. the whole idea of the rule of law is consistent application. and if you are using it as a political weapon and going after political opponents there is a heightened level of not only judgment and discretion but also a heightened level of explaining to the american people why you are doing this. we have not heard any of that. we'll learn more in the indictment. i have not seen anything in this case that suggests that joe biden, through his attorney general mer i can garland, don't have their fingerprints all over this and influenced these charging decisions. >> julie: all right. matthew whitaker, thank you for talking to us. we appreciate it. have a great weekend. so democratic presidential canned robert f. kennedy junior wasting no time taking his campaign where president biden and his border czar have barely gone.

i think why the f.b.i. was stonewalling the congress, stonewalling james comer, was because they didn't want to answer the next question, which was what did you do about this credible source that told you that joe biden was paid $5 million? i think the answer is, they did nothing because if they actually investigated this, the f.b.i. would have called james comer and said here is the document, mr. chairman. let us brief you. we'll tell you what we did to investigate. they would lay that investigation out and mr. chairman, we found nothing. feel good that joe biden is clean and this was a false allegation. they didn't do that. which means they actually didn't investigate it, right? i think another question, julie, is joe biden has given the ukrainians $120 plus billion. what ukrainians known about the pay for play potential scheme between joe biden and burisma, and are they using that to get american tax dollars to go into ukraine and fund this war?

country? this is huge. i know we're talking a lot and other media out lets about the trump indictment and so did we. we are talking about a sitting president that could have been involved in something extremely scandalous. >> i think it is not a surprise that the information about donald trump being indicted comes out on the same day we learn about this document and joe biden potentially doing business criminally with ukraine. the media is not about telling the truth or investigating stories. they are about a political movement. they are there to defend joe biden and attack his biggest opponent donald trump. so they are not about putting this out. by the way, they spent four years on a false story of russia collusion leaked by the f.b.i. and d.o.j. nothing came of it and they never apologized. i think we have to recognize it for what it is. they don't give a damn, julie. they don't want to inform you.

canada. it happens every single year. this time it just happens to be much greater. then, of course, there is a high pressure system on the west that is funneling it into the united states. again, i don't know where politics have a place here. >> well what's happened is that bureaucracy has got in the way. you're right. this is a great example of what we need to do exactly to say get away from politics and focus on practical solutions. this shouldn't be controversial, right? this is how we used to do it going back hundreds and thousands of years. you would have people who understood the forest, who understood fire is a natural part of it and keep the forest thinned. if you have fuel accumulating there are fire. the facts are clear. we don't need to be ideological about it. these days the democrats have gone so far to the left everything is ideological. everything is part of their obsession with this climate

extremism and in the end people lose out because in the real world, the facts are just forgotten. >> julie: californians have said we're dealing with it for years and more often and a lot more vast. >> exactly. california is the worst example of that extremism on climate and the environment that has let our forests, a huge pa portion of our land become so overgrown when the naturally occur fires happen they cause huge problems up and down the state dwarfing what they try to do is to reduce emissions. in 2020 the emissions from wildfires in california were greater than all of the reductions in emissions for nearly 20 years previously because of their climate policies. it doesn't make any sense. >> julie: not much does these days, wouldn't you agree?
