mcenany, here with my co-host emily compagno, fox business anchor and co-host of "the bottom line," dagen mcdowell, and cheryl casone and "fox and friends" weekend's pete hegseth. we are live outside the federal courthouse in birmingham, alabama. jonathan. >> jonathan: hi, joran van der sloot was brought to the federal courthouse you see behind me, earlier this morning. we expect the arraignment to get underway momentarily, will joran van der sloot will answer the federal charges of wire fraud and extortion. legal experts are expecting he will plead not guilty, in which case this case will go to trial, possibly within a year or maybe a little bit later. the charges stem from allegations dating back to 2010,

when joran van der sloot allegedly approached natalee holloway's mother telling the missing woman's mother that he would reveal the location of her daughter's body in exchange for a quarter of million dollars. after receiving a down payment of $25,000 joran van der sloot provided false information. no body was found and then he left arubba and went to peru, where he was accused and ultimately pleaded guilty to the murder of another young woman. he is still serving 28-year sentence in peru, but peruvian authorities allowing him temporary extradition to the u.s. to face charges indirectly related to the natalee holloway case. we'll let you know what comes out of this hearing, we're still on stand by.

back to you. >> kayleigh: he pleaded not guilty, we are just learning it. >> just learning it from you, but not surprised. legal experts were saying he was likely to plead not guilty. he's been appointed a public defender, who will represent him. it may be a year before the trial gbegins. >> kayleigh: emily, not guilty we heard from jonathan, what can we expect, how much time can this guy get, who allegedly murdered but being charged for extortion? >> emily: could be maximum of 50 years tacked on to 28 years he's serving for murder of stephanie flores and additional years for drug trafficking, he was convicted of, as well. >> kayleigh: the murder of flores, there is that and the

natalee holloway murder, for which he has not served time or been formally charged. putting both into context, what will be allowed in on either of those? >> emily: zero evidence on extortion and wire fraud cases, of conviction of murder and the fact he's prime suspect in the natalee holloway. that is important. he was just appointed a federal public defense attorney. this is in contrast to the very chatty prior attorney of his, the defense attorney in peru for the stephanie flores case. he has been communicative with the press. that is not currently his representative. that is not something the u.s. justice system does without evidence. this point it is wire fraud and extortion, maximum of 25 years.

>> kayleigh: 25 years, justice perhaps for natalee holloway's mother. paul, your thoughts on the not guilty plea? >> i think it was expected. he doesn't have a whole lot to lose. public defender and advising him. one thing outside the box we should consider in the back of our minds, he has a card to play. assuming he is the guilty party, relative to natalee holloway, there is the chance that a plea deal could be worked out if he were to disclose what happened that day in aruba all those years ago. we would expect a trial and that is likely to happen and clearly everybody involved in the justice system would like to see mr. joran van der sloot die in jail because his track record probably suggests that he is at least a danger to women out

there. there is the possibility that he does ultimately reveal what occurred and how it occurred potentially giving the holloway family greater closure than just locking him up. >> emily: paul, we know court has been adjourned, less than five minute preceding, which is typical at the federal level. what do you make of the argument that the peruvian conditions are far worse than the incarcerated enjoy here in the united states. would it behoove joran van der sloot to enjoy the process and file motion after motion and try to soak up the benefits of being part of the u.s. criminal justice system rather than having to go back to peru? >> that highlights what a novel case this is. you don't see this often. he is locked up in peru and

being extradited here to stand trial and face american justice and then going to be returned to the other nation's jurisdiction to complete his sentence there. what it comes down to, there are political considerations between the two nations, governed by treaty, mutual legal assistance treaty worked out between the doj, authorities and peru authorities. what joran van der sloot would like is immaterial. he is delay and throw motion practice at litigation before trial, delay beginning of the trial, but this guy is going back to peru, because equity involved between the two nations, despite how serious the crimes are, those equities are larger than this one individual case. he may think he has it made in an american prison, something you don't hear often, he is

going back to the peruvian system. >> kayleigh: he could get 25 years in the united states and he has 25 in peru, doing the math, this convicted killer could get out, this is not a life sentence, by any stretch. >> jonathan: it is not, he owes 16 years on homicide in peru, plus what he got for supposed involvement in drug smuggling operation in a peruvian jail. i think the idea here aside from the fact american justice wants to bring to bare what justice was not able to accomplish. which is to get him accountable for what he did to natalee holloway. even if you stack the charges high as you can go here, you are right, chance he gets out in his 60s and that is a concern. that is assuming he behaves in both the peruvian system for what he has left there and the

i've went through that freshman year. i was so happy to win and i've talked about this before, so happy we won the college world series, but i didn't feel joy. i didn't know what to do the next day and following week. i didn't feel fulfilled and i had to find christ in that. i think that is what makes our team so strong is that we're not afraid to lose. it is not the end of the world. we worked our butts off to be here and we want to win, it is not the end of the world, our life is in christ and that is all that matters. >> yeah, i think a huge thing that we've really just latched on to is eyes up. you guys see us doing this and pointing up, we are fixing our eyes on christ and that is something like they were saying, you can't find fulfillment in outcome, whether good or bad and that is why we are steady in what we do and our love for each
