clinton. president clinton taped conversations he had with other foreign leaders for eight years. what did clinton do with these tapes? clinton took them home to chappaqua and stuffed them in a sock drawer. these tapes were about as highly classified as can you get. these conversations president clinton had with heads of state about war, about national security strategy. about nuclear posture. did bill clinton declassify these before he took them home toe chappaqua? no. he took them home and he stuffed them in the sock drawer. judicial watch sued for access to these presidential records then a judge, appointed by barack obama, ruled that these are bill clinton's personal tapes and nobody can have them. not judicial watch, not the national archives. no one. quote: the decision to segregate personal materials from presidential records, is made by the president during the president's term and in his sole discretion. since the president is completely entrusted with the management and even the disposal

of presidential records during his time in office, it would be difficult for this court to conclude that congress intended that he would have less authority to do what he pleases with what he considers to be his personal records. that's it. case closed. a president, former president, has sole discretion on what he determines to be his personal records. tapes with foreign leaders or documents related to foreign leaders. donald trump can decide what documents are personal and what are presidential. he can sift through them and return what he wants to the archives. classifications have nothing to do with any of this. don't get bogged down in the classification game. the president's records fall under the presidential records act, clean-up is not a criminal statute. nothing about this document drama is criminal. every president when they leave office takes things back home with them. some documents go to the archives. some stay at the president's office and house and then some

go to presidential libraries. all presidents negotiate through lawyers with the archives what's personal and what's presidential, what stays and what goes. this happens every time. and it's never led to a raid. it's never turned into a crime until the biden administration turned it into a crime george p.w. bush's records ended up in a strip mall between a chinese restaurant and bowling alley. bill clinton didn't just have tapes in his sock drawer. he had docs in a car dealership in little rock. george w. bush stored his in a warehouse in texas. and obama kept his at a defunct furniture store right across the street from m.d's. 30 fbi agents didn't show up. the wives didn't have their underwear drawers rummaged through. trump's lawyer should have filed a motion last spring, immediately, once he got a subpoena and argued these records are personal under the

presidential records act. in fact, at the end of this case, president trump will be able to argue for joe biden to return these personal documents back to mar-a-lago. mar-a-lago is where the former office of the presidency is. which is funded by taxpayers and protected by the secret service. everybody knows this is all about stopping trump before he can beat biden in the election. rachel maddow straight up admitted it. >> whether part of the issue here is not just that trump has committed crimes but that trump has committed crimes and plans on being back in the white house do. they consider as part of a potential plea offer something that would prescribe him, pro-subscribe him from running for office again? >> plead guilty, promise not to run against biden and we won't throw you in jail. the biden administration wants to throw donald trump in prison for 100 years. 100. they want a former president of the united states who got more votes than any other incumbent in american history to die in

time and they found another set of stolen classified documents, did biden's attorneys represent to the justice department that they did a diligent search and turned over all the documents? how did the fbi find these document? how is that not obstruction of justice for real espionage? vice president didn't have writes to these records he wasn't a president. >> jesse: you know federal prosecutors here. you have been in this zone before. there has to be prosecutors that can't celine at night because of this. this is really disgusting. >> jesse: going to bret on that, mike? >> the old adage, jesse is the beauty is in the eye of the beholder, right? in this instance the indictment is in the eye of the prosecutor what we have is as a prosecutor that the facilitated the conclusion he already reached. imagine it's this easy, jesse. this is how you would do it. you would interview several people that were surrounding the house or were in the garage and

saw the core investigated and the documents who were at his, you know, foundation and saw the documents who were in rehoboth and ask if they removed the document. as soon as you got that information, knew you had a conspiracy. once you have the conspiracy, you would see how they didn't come forward with the information soon enough so then you would charge obstruction. i can make the case for obstruction for conspiracy and for 30 plus, hundreds of plus counts for each document against biden, against hunter biden and everyone else that was part of that episode and that chapter. it's really in the eye of the beholder. >> that's what we are watching right now a biden emphasized and led doj be that's after a political opponent and doing it under the guise of legitimacy. >> jesse: advance this, mike, for us. you are going to have this case go down in florida how long it going to take? what are the chances on appeal? what are the chances he skates

after the first go around? how do you see it? >> the judge is very fair judge. the democrats will attack her say she is a trump appointee. she got substantial democrat support during her confirmation. that blows their argument right out of the water. this the government goats control the prosecution i hope that the trump legal team moves for dismissal the indictment on the sufficiency of the legal arguments. i don't know if they are going to be able to get it kicked early. it might have to go all the way through the process, the conviction, the appeal to the 11th circuit and maybe even to the supreme court but i imagine that the supreme court would reverse this conviction because the presidential records act clearly controls here. jack smith knows about getting reversed by the supreme court. he got reversed 8-0 when he tried to take out the last republican presidential candidate bob mcdonald of virginia.

prison, we learned about a document the fbi has been sitting on for years joe biden has been selling out our country for cash. sources tell fox news digital that ukrainian businessman at burisma paid joe biden $5 million in bribes while he was vice president. what was the bribe for? to fire the prosecutor investigating burisma. here's the smoking gun. burisma emailed hunter asking for a list of deliverables from high ranking u.s. officials in ukraine with the ultimate purpose to close down any cases against burisma's founder and former president. there it is. laid out as clear as day. burisma says fire the prosecutor. biden fires the prosecutor. burisma says paid joe biden 5 million for it. what do you know biden bragged about it. >> we are not going to give you the billion dollars. they said you have no authority. you're not the president.

bribery. let's ask former congresswoman and democratic presidential candidate tulsi gabbard. i mean, at this point they should have dropped these articles. you have got start an impeachment investigation if you are going to crack the rest of these bank records because that's where the money is. >> yeah, jesse, you know, there's no question in my mind that if these allegations are true, of course he deserves to be impeached. but even more than that these are criminal actions and he should be in jail if he is found guilty. but i think, you know, i look back to the trump impeachment proceedings and we got it ask ourselves important questions here. number one is what are we hoping to accomplishment if impeachment is to occur? is it to get rid of joe biden in that's the case. the reality is democrats in the senate they are not going to vote to impeach joe biden and so what will happen then as a result? wall-to-wall coverage of impeachment proceedings, a partisan exercise that will take up all the oxygen and distract away from the very real issues
