roles that exist for good reason like the unspoken rule that you don't try to put your political opponents in jail by weapon icing the doj at intel agencies against your political opponents and the follow-on norm that during legal proceedings you don't leak it's of evidence to the media to try to convict someone in the court of public opinion. this may have been what happened today in the trump documents case run by special prosecutor jack smith cnn somehow claims it got its hands on a tape recording of donald trump saying allegedly he has a secret pentagon document about attacking iran. several sources told cnn the recording captures the sounds of paper rustling as if trump was waving the document around even those not clear if it's the actual document that's another norm blown into a thousand pieces and at this point we have to assume democrats will stop at nothing to turn this election into their favor regardless of what's happening to the economy, foreign policy, the border, all of it.

it's not about pursuing a full application of justice or the rule of law this is about winning a bare knuckles brawl for the future of the country. so tonight i want to be clear. no conservative with a real chance of reaching higher office is going to escape this unbridled assault. this is not about trump. it goes way beyond him so you agree with democrats on the perpetual wars, the open border or rolling over for china. you agree with all of that? and the trans agenda as well and generally you will be safe if you will be targeted otherwise the new norm is submit or die. but just as they did during covid i think the democrats are underestimating the tolerance of the american people for this banana republic style of approach to governance and to

the legal system. we certainly don't pay taxes to support policies that we don't like and that don't work and then are turned against us. there is a growing multiethnic coalition forming across this country of people and parents who were organizing and unafraid. and they will use every legal avenue they see fit to protect their children so they are not used as guinea pigs for cultural marxists running our school protect the economy, the savings all of it. because of what's happening in our country. we did not ask for this battle but we did not we will not sit back and let them run this country into the ground without doing anything to turn it around. trump or no trump this country has to be saved. they are after him though we don't know how it's going to play out but if we don't beat them politically it will be all of us who are targeted those of us who don't comply. joining us now is the former white house press secretary and fox contributors.

let's start with you speaking of warm busting we could see trump convicted by his chief political opponent and doj and yet still somehow win the presidency.could that be something that might happen at the end of all of this given how this is unfolding? >> if you think about it this could be the first time in our nation's history were we have a judicial case settled by a referendum of the people. donald trump indicted. if he is convicted donald trump first action will be to pardon myself joe biden or whoever he runs against will say donald trump deserves to be imprisoned and if he is elected that's the only way he gets out of prison. this election could hinge on that question, i am not sure who side that benefits the most that could be good for the democrats because with the

biden's weaknesses of the issue was about joe biden, republicans are likely going to win. this could be the first referendum of a court case decided by the republic. >> obama cia chief john brennan one of your favorites, he thinks republicans are sending a message of those who were standing with trump tonight. watch great >> i find it totally outrageous that republican members of congress today are continuing to embrace trump and trash the department of justice i find that outrageous. they are sending a message throughout this country and around the world that calls into question the system of justice in this country. >> those who were questioning the timing and the process by which this is done, they are they threat to democracy. you see the where this is going.

>> he lied to congress he lied about spying on congress he should have been held in contempt of congress it should have gone to jail and this is a joke of the case there is no love lost between me and the former president but when it comes to this case it's an absolute joke it's ridiculous. this is a situation where jack smith comes out there and he could not talk for three minutes about this case it's an absolute insult to anybody and when it comes to the historical precedent. we have never had a former president indicted for anything because we understood the standard had to be very high and in this case it is clear that the doj and the fbi under joe biden had been a weapon i step against the political enemies of the democratic party in a way that is on precedented unacceptable evolves to have everyone evolve fire district of any benefits they might have received and i can't believe my

taxpayer dollars are going to go and fund these people for the rest of their lives that that insult to every american who believes we ought to have any kind of fairness and when you read this indictment it reads like a bunch of sloppy behavior that easily could have been resolved with a series of meetings and was weapon eyes because the former president of the united states who the doj and everyone else involved in this law-enforcement state is weapon eyes against because of their hatred for him and everything he represents. >> i think what we have seen president trump has said explicitly that they want him off the political playing field if he went away this would go away and rachel maddow was saying basically the same thing say the silent part out loud. i want to play this back to back. >> i'm the one they don't want to run against. please take them out of politics.

>> you have to wonder if the justice department is considering if there is some political solution to this criminal problem. do they consider as part of a potential plea offer something that would prescribe him from running for office again. >> if he said i am done with this really go on much longer? >> first of all this should be seen as a day of hypocrisy should go down in infamy. how can they go after donald trump for this and indict the man when hillary clinton did very similar things including the destruction of evidence including top-secret information in her home. what's the difference? the difference is the obama administration in which hillary clinton served essentially gave a pardon to hillary and the obama doj declined to prosecute because james comey told them to and she should have been prosecuted. she would have been prosecuted he would've had consistency but they can't go after donald trump when they can't go after hillary clinton. go ahead.

there is sloppiness here president trump, no president should have taken classified information and number two if it's brought to your attention there is classified information, the answer is to return it immediately and he should have done that. i don't think it's a crime.i don't think he should be indicted for but this is a fact of what happens when you have a sloppy administration thinks he can just declassify anything they did not follow the rules and that's one of the reasons he's on the hot water he is in. it is important. >> but just to disagree slightly i think the reason he is in hot water, we understand, is not because of the sloppiness is because as you know, if you violate these rules and the deep state the law enforcement they are friendly toward you they will give you every opportunity to make up for it to file the right forms and reiterate things >> but if you're on the

the lady doth protest too much methinks why is it the first thing on jack smith's mind is tried to claim this is the equal application of the law because he knows it doesn't it's going to be open to that kind of protest right away the indictment itself is a speaking indictment for public consumption it's a clever but very sick attempt at putting forward their position. i said last night that almost facetiously that they would charge under 18 usc 793 would not have to confront the classified document or declassified issue and in the indictment they allege classified classified classified but they charge under the statute they don't have to prove that i am telling you today is just not clinton should have been prosecuted joe biden must be prosecuted under 790 3e if this is the government theory. all that's required is the retention of national defense information very broadly construed all the documents he

has you can be sure there is national defense information and he knew better if anybody knew better. >> in terms of this indictment and your reaction to its issuance in a statement from mr. smith today. >> i think david is right. this is a classic speaking indictment. i don't think they should be allowed, but they are allowed. i use them when i was a prosecutor and the whole point of it is to basically release information to the public in detailed form that you normally wouldn't be able to release. nothing unethical about it and was very well done i say that as a question of professional admiration. it sets it out in almost novelistic fashion it doesn't speak to the issue that other

people have talked about including you of the unequal treatment of donald trump but it does do a good job of setting up the government's case. >> i want to play a moment from andy mccarthy today on fox about part of trump's defense. >> i have personally never been blown away by his claim which his lawyers won't repeat it in court and there's no documentary evidence of that he declassified everything it wouldn't be a defense in an espionage case because the espionage app doesn't speak about classified information that speaks about national defense information. >> is he correct about that? >> is a little bit wrong. but yes that's why they charge under 793 e. so they don't have to deal with that issue. this is a very defensible case there are different defenses of different elements for sure.

i think some past decisions are going to come to haunt them. language that would have led president trump to believe he was entitled to do what he did including something in my mind that triggers a double standard by judge amy jackson a trump hater from 2012 it talks about the broad discretion of a president with respect to presidential records and personal records. there's a lot to discuss. >> you heard jackson talk about he is going to be pursuing a speedy trial. still being fair to the defendant etc. do you feel like with all the motion practice that's going to take place here that it could ever be resolved with the election and if not what does this do to our presidential election cycle and substantive issues this nation is facing a clearly legal question obviously. >> is very unlikely to be resolved before the election if the former president trump's legal team says they need more

time. if they decide to do what ted stevens defense team did he was indicted fairly shortly before an election and he demanded because he wanted to be cleared before the election to go forward and it was a disaster for the department of justice because they withheld exculpatory information so i don't know what is going to be made but if they want to delay it i think it will be delayed beyond the election. >> on the switching up of the legal team trustee is out he was on the show last night i am surprised they didn't have one of the top litigators in southern florida who is seasoned in this arena. and locked in and ready to go. what is your theory on that? >> there are a number of issues going on behind the scenes but

candidates is the business model. the audience is so far deranged and insisting that the hosts obsess over this anti-trump of session they are feeding their audience with that as well. >> i think there is a serious point to be made here about public trust in our institutions you have to have trust that law enforcement is going to fight without political bias. the same rules that apply to hillary should apply to trump and to any other republican and fairly or unfairly half the country thinks the intel agencies have been weapon eyes. how serious a problem beside the partisan issue how serious a problem is that? >> it's a big problem we see that some of the leading institutions like law enforcement and the fbi have ratings that approach 50 percent they have to be 70 or 80 percent they have to have national respect for both sides

the most radical climate priorities if you could explain that for us i would really appreciate it tonight. >> it is pretty simple the national oceanic and atmospheric administration is the charge of weather stations across the united states but the problem is they are not maintaining and my study is going to visit hundreds of these stations across the united states showing their improperly cited. there's a simple rule about the placement of these stations compared to where they are supposed to be there supposed to be in pristine areas like in a field somewhere what we have found in parking lots, we have found there next to brick walls we have found there next to exhaust vents for air-conditioners and all sorts of things my study last year following up from what i did in 2009 shows the problem getting worse. 96 percent of the weather stations used to measure climate by the national oceanic and atmospheric administration are compromised in these stations read warmer than the
