evening. >> hi kevin. former president trump has been posting an avalanche of attacks on his truth social today criticizing president biden, the fbi and ripping special counsel jack smith, who led the investigation. donald trump writing about smith quote this is a man who caused the lowest catastrophe with the irs, one of the evangelicals and great americans of faith. the us had to apologize and pay major damages for the deranged lunatic did. his wife is a tramp hater just as he is a trump heater. a deranged cycle that shouldn't be involved in any case having to do with justice. earlier today special counsel jack smith, formally enough the 37 counts against trump. >> the laws that protect national defense information, are critical for the safety and security of the united states, and they must be enforced. violations of those laws put our country at risk.

>> today, prosecutors unsealed the indictment against former president trump. alleges he intentionally stored hundreds of classified documents at various locations and said his mar-a-lago home. prosecutors also claim, there's an audio recording from july 2021, at trump national golf club in bedminster, new jersey, revealing former president trump allowed a writer, publisher and to members of his staff to look at the department of defense plan of attack document. part of the indictment reads quote the unauthorized disclosure of these classified documents could put at risk the national security of the united states, foreign relations, safety of the united states military, and human sources and continued viability. a sensitive intelligence methods. allies have been attacking president biden alleging he is behind trumps indictment and is a political hit job for joe biden to take on

his opponent. earlier today, president biden was asked about the indictment, but did not address it. >> president biden, have you spoken to attorney general merrick garland, yet? >> no comment on that. [inaudible] >> today, two of trumps top lawyers parted ways with the former president after the indictment. kevin? >> and today in la, thank you. let's get some insight into the legal jeopardy the former president facing from a couple of former federal prosecutors. jonathan fahey and joe marino. jonathan, i want to be with you. before we chat, i want to share with the folks at home, the former trump attorney or basically a trump attorney but not representing in this case, we listen and then react on the other side, take a listen. >> president trump as a former president united states is subject to the

presidential records act. it is something that congress has decided, to make presidents and former presidents specifically subject to, rather than the espionage act. this is something were most importantly, jack smith's team has a completely legally wrong, by charging crimes that quite frankly, don't apply. >> especially when you consider what happened in the clinton document case. it seems to be the big argument here in washington, jonathan, people say how can you hold president trump to one standard when you didn't hold president clinton to the same standard when apparently, he had documents in a sock drawer. >> exactly. those are going to be the questions. is not just about the equal justice under the law. special counsel made a statement about the law applies to everyone, but has to apply equally and it has to apply equally because we have president clinton's issue that will

get the hillary clinton issue she was treated differently than president trump. there is really an open question whether or not this presidential records act is what will govern, or the espionage act. and then when things really been tested of the maybe the one case. >> this is a really tough once for some because some they will say, we have a conversation, it isn't exactly apples to apples. what president trump did was intentional versus what say, president clinton did which was more or less, personal tapes. thus the argument i've heard.how would you view this? >> it has been tested, there wasn't such uncharted territory here. look, we heard jack smith talk earlier today, and is talking about how it is so vital that we treat national security documents so carefully, and in the intelligence community and military. he ends up saying, but it's gotta be equal law for everybody. you're listening to him and say, where's the self-awareness? seems like he is walking

into the fact that you are thinking wait a minute, hillary clinton, bill clinton, mike pence, joe biden himself. and yet, only one of them is facing charges. i'm not trying to minimize what donald trump is facing here. it's a real case. but it is very hard to say, this case is so different. if the law applies to everyone, it applies to everyone. >> i think you make a really good point. jack smith has reputation, jonathan, obviously an extremely experienced, but really try to shreds by the expert precourt in a previous case, 8-0, he hasn't had the best luck in some of these high-profile cases. >> will be saving this yeaa heavy-handed approacis not like the looked upon by courts. he's being treated differently than other people and the approach taken here is quite different than what appears to be taken in the biting case, instantly, hillary clinton standards, which it should be the standard here. which jim comey laid out

hometown, finally to have justice served, it is just surreal. >> arriving at the courthouse under heavy police escort, bend the slope not the five, pleaded not guilty to federal counts of expression and wife are strumming from a 2010 indictment. investigators say the dutch national solicited 1/4 of $1 million from natlie's mother with a promise to reveal the location of her daughter's remains and circumstances of her death. but he allegedly provided her false information, pocketed a down payment she'd given him, and fled to peru, where he was arrested for murdering another young woman he met at a lima casino. randall slope pleaded guilty in the case and is serving a 28 year sentence but proving authority is granted he is temporary custody so it they could place trial in the financial crimes case which legal experts say is nellie's family believe may uncover more evidence and her still unsolved disappearance. >> good eventually lead to

york post. serving a shirtless man and later down the hospital. the attacker is reportedly a person with a long rap sheet and police are charging him with murder. that's the city of denver where a business owner was on the phone with no one but a man camped outside when he was attacked with a machete. the office manager talked of days early. in fact, tried to talk to the city to get help earlier. this left the owner with a deep cut to his skull and a dozen stitches. manager says he spoke to the homeless man a couple of days before the attack. >> -- it disturbs our business in a response to me, leave me alone or -- >> pretty crazy, as i mentioned, please are charging him with the attack. however, the attacker syllables and will see how

far they can wrap that up. in california two would-be thieves attacked a 75-year-old male with pepper spray in his own garage. what appears to be one of those follow home robbery attempts. despite being pepper sprayed at point-blank range. and he chased them off his property with some help from his landscapers who heard his screams for help. this crook waltzed into the lobby and banana drill. spewed fuel everywhere! then lit the place up. flames going all over the place. thankfully, it didn't cause major damage or injuries. the suspect ran out and apparently, escaped in a blue suv. please tonight are said to still be searching for him. the murder rate here in the nations capitol is skyrocketing once again. in fact, there be 100 murders in dc so far this year. police say, is the earliest the city has hit the century mark in some 20

let's talk about the seemingly counterintuitive piece of legislation with the author of the upcoming book, what's killing america. inside the radical left tragic destruction of our cities, is my man on the west coast, jason rants. i don't have to tell you that crime everywhere is an absolute devastating problem. you just heard in the report there, love to get your reaction to it, the nations capital, the seat of this country is democracy, is under assault, with 100 murders already. >> we are seeing the surge continue across the country. it is not just dc as you know. i think part of it is in large part because of the defund movement while i think there been some lawmakers who have walked some of that back, and have taken different direction. if you expect this kind of culture of lawlessness to just change overnight, or

because you sent out a treatment said okay may be the defund movement was wrong, that's not what's going to happen. it's going to take years, possibly a decade before we start to see a true change in course because still, at the end of day no matter what you do with the police department, you still policies that go easy on criminals. and they know this. they know if they commit crimes, the inclination from the left is not to put them in jail, but to put them in a restorative justice program at some point, we start to commit low-level crimes, they escalate and escalate and escalate, until unfortunately, they could lead to homicide. >> is just an awful situation, not quite the 80s but certainly, not good right now. let me get reaction to something else that i was just noticing. the human rights council, actually out with the statement, i want to share with you and get your reaction. this is a reaction to perhaps, the park that have been happening -- boycott that have been happening in the lgbtq q community pretty so we officially have a -- sweeping

statehouses this year. it goes on to say, more than 75 anti- lgbtq plus bills have been sundered to law this year alone, doubling numbers which was the worst year on record. i'm curious what your reaction is that because when people say anti- lgbtq plus legislation, they're not being terribly specific jason, your thoughts. >> no, they're not. it's shameful and partisan. i hope every single person involved in the decision, i hope you realize what you're doing. simply calling something anti- lgbt legislation simply because we say, you have a right for a child to go through a surgical procedure to change their gender. sorry, that is not controversial and that's where the vast majority of americans are. the fact that they say this is the first time in their history that theyhave done that , is rather telling. you may determine that things are worse now, then

were stored. they were not secured. and you can't say they were secured. and to your point kevin, he said, a president can declassified document any point but he wasn't president anymore and said i did not declassify this. these are war plans, i did not declassify, they are secret and then he showed them to someone. it is open and shut, violation of the espionage act. you can argue whether i should have been indictment will be very hard for him to defend himself. chris said that you were going to formally say the espionage act, and i'll tell you why. this should never have gone criminal so the argument i'm hearing, some attorneys i spoke with because the argument they make is, if you want to go espionage act, we have a ton of people that will be subject to this, as a presidential records argument and they're saying that each and every shouldn't have got to this point but if there is a recording will be very difficult to overcome. the question remains, what happens if it comes to that? very quickly only sure asa hutchinson 's statement. i think you'll find this interesting may we have 10 seconds on the backside v. donald trump sections from
