about the student loan forgiveness program presented by the biden administration. the supreme court is set to apparently olaplex expectation is strike down that program, but the biden administration doesn't appear ready to give up. this is from the daily mail. job creators network president and ceo told the daily mail that the department of education is actively working on work-arounds to still get at least $10,000 off the debt of most borrowers without standing student loans, so while they may take a defeat from the supreme court, it doesn't look like the biden administration is ready to give up on their idea of student loan forgiveness. >> and it's our best educated guess on what the court is going to do but they did not seem to be big fans of this executive action the president took to just simply start wiping out student loan debt because we know when it gets wiped out it gets paid somewhere else. there are taxpayers in people who never went to college or took loans to go to college who are actually probably going to pay part of that debt, so it doesn't just disappear. the court is always very skeptical of executive action
5:10 am
that seems to be an over reach, they want to do what the branch es are each supposed to do and you quote from the daily mail and this organization is one of the plaintiffs in this case so they say the doe is trying to do something else that would still fall under the branch of executive action so it be very interesting to see what they might try to do. they could put this through a formal process that be sort of a rule or regulation but that would then be open to public comment. you know, we'll see. but these plaintiffs have vowed if there is a work around they are going to view again, maybe it goes right back to the supreme court. pete: shannon, you raise a great point. it seems so upside down so the executive branch isn't legislating. this should have been passednd then if the supreme court overturns it, we'll do it anyway are there any checks and balances? >> well, yeah, and think about this over the last couple of weeks you've had the house and the senate vote to stop the forgiveness program and that included votes by democrats.
5:11 am
some are up for re-election soon so they want to be on what they think is the right side of this but a lot of people feel like the presidents announcement he was going to drop the student loans or portions of them, even the washington post said it feels like, you know, you're pandering to certain voters out there who will benefit from this , so remember, if you were on a pause on your student loan because of covid, those payments are coming back in august because that was part of the debt deal they just hammered out but if you were part of this forgiveness program or you've applied for this you are awaiting on the supreme court but both the house and senate have said no, the president didn't have the right to do this so it'll be interesting if the court also says no, if an executive agency branch, you know, an agency that is full of bureaucrats who are not subject to the ballot box by any means, they operate without that same level of responsibility that elected lawmakers have and if they try to do an end run i do think it's just going to be more litigation. rachel: yeah, could be more litigation but could pay off at the ballot box. they have a bad economy.

pete: we're back with a fox news alert. a portion ofi-95 the major freeway across the east coast is blocked after a massive tanker truck fire outside philadelphia. video shows huge flames coming from the crash. a portion of the roadway even appeared to collapse. you can see at the top of your screen the blaze underneath the overpass. it's unclear how the fire started. no word yet on injuries we'll stay on top of this breaking story, and bring you updates but it could bring traffic on the east coast to a halt. rachel: wow. all right, well we have an emotional for america's favorite duck hunters, duck dynasty stars missy and jace finding a loving home for a baby boy they took in more than a year ago after his own mother could no longer care for him. will: duck dynasty stars joins right now. what a great story and a happy ending. glad to have you on the program this morning. tell me about both the process

of taking in this child and now finding a home. >> well, the process of taking him in was a very quick one because we did not even know he existed, until the phone call came from the hospital and said a baby has been borned and signed over to you. so we prayed about that for about 10-15 minutes basically and decided to say yes , and this little boy has changed our life. so even though he, right now, is in another temporary home, his mother is still working hard to get to where she wants to raise him and getting to that good place, but we are in his life as jayrock and lulu, and we even had him the last couple of days here so its been a real blessing to our lives and hopefully his too. rachel: you know, missy you and i are friends and i've been following through our phone calls the story of this little baby boy and you've been, you know, just what your family has

gone through in order to get to the place where he is right now. what would you say to an other family. i'll leave this to you jace. what would you say to another family, maybe they find themselves in a situation like this. maybe it's not exactly like a phone call from a hospital but a granddaughter who has, you know, an unexpected pregnancy and is unwed, or you know, these kinds of situations come up and sometimes, people say oh, it's too difficult and they go to abortion or other options that aren't as beautiful as the one you've chosen. >> yes, well we're champions of the sanctity of life and we're involved in various ministries trying to help people and that's what god called us to do but we've learned that if you're going to do that you also got to be ready for children that are born, thankfully, but they have no place to live, and so its been a real emotional time. what are we 15 months into this , and i tell you, its been

of the women who had gone through her program and then years later, unfortunately, was from prison, was pregnant, and they said, you know, what are we going to do and she didn't have anybody that would take the baby , and she said if you call this couple, of course the authorities oh, jase and missy robertson on tv? yeah, but when they called us we said yeah, we know her and we'll take the baby. so that's how it worked. rachel: i love a christian family that talks "the talk" and walks the walk and what a beautiful ending and missy and j ase, i can't say enough. will: you also have season two of duck family treasure on fox nation you moved from duck hunting to hunting treasure. let's take a quick look at jase, not totally giving up hunting, take a look. >> growing up in louisiana, you learn how to crawl, then walk and then put out traps. while i'm treasure hunting i'll
