and it's very, very damming. and this idea of presenting trump as a victim here, victim of a witch hunt is ridiculous. nate: now, mike, president trump's attorney says trump has done nothing wrong here and she dismissed the possibility of accepting a plea deal. she also claims the former president has solid legal footing to defend himself. here she is on fox news sunday. >> an indictment is a one-sided document. he has a defense. the defense is real. he had the presidential records act which only he has in play. hillary clinton didn't have that, biden didn't have that. nate: president trump said on the campaign trail that he believes this indictment is helping polling as well as his fundraising numbers as he seeks the candidacy in 2024. trump will stay at his resort tomorrow ahead of appearance in miami federal court at 3:00 p.m. on tuesday.

mike. mike: nate foy live in beautiful bedminster, new jersey. thanks very much. for more on this historic indictment of former president trump joining me live in studio attorney and partner at ice miller llc, tim is former federal prosecutor and sec trial attorney. tim, welcome, great to have you. >> thank you, mike. mike: let's look at the charges against former president trump and i'm curious how you assess this case. >> this is a detailed indictment as attorney general bar reform said a few moments ago. it's a 49 count -- 49-page indictment, 37 counts. the government goes in great detail. this where we call speaking indictment. the government puts more allegations than legally required to and i think, mike, intended to anticipate and foreclose defenses that the government is expecting the defense to raise. mike: trump stored boxes containing classified documents in various locations tat mar-a-lago club including in a

ballroom, bathroom and shower, an office space, his bedroom and a storage room. here is the former crazy on this case. >> you're dealing with crazy lunatics. using the same corrupt doj and same corrupt fbi and attorneys general and local district attorneys to interfere in our application at a civil that our country has never witnessed before. mike: what does this indictment say about the government strategy? >> the indictment says, mike, is that the government wants to show, number one that the state of mind that's required existed. there are specific facts in there alleged, of course. there are text messages, there are photographs and great amount of detail of what was said and what was done. the government is trying to make sure that the defense of, hey, i didn't know, is not going to be

-- isn't going to carry the day. in addition, the government is trying to show that the president actually had involvement in this. in other words, he packed the alleged, he packed the boxes at the white house. there's an allegation that aide walton sent a text message that the president is tr trying to te out materials out of the boxes, text message sent to trump family member. mike: disappearance of natalee holloway. what about this case? >> this is not about the murder. you recall that natalee holloway went missing back in 2005. her body has never been found. and van der sloot has not been charged with any crimes related directly to her murder rather he's charged with extorting his mother, her mother, rather, and having a wire fraud scheme in

which he told the mother that he would provide the details of where her body is located in exchange for $250,000. she ended up providing in advance $25,000. some of which by the way by wire transfer. mike: okay, so in addition to being cruel, that's also a crime, right? and so this guy by all accounts is not a good guy. he's already in prison in perú on another murder. how does all work between the two different countries? >> right, he's already serving a significant prison time -- term in perú for murder of unrelated victim and by the way he got additional 18 years recently for running a cocaine ring while in prison. so there's an extradition treaty between the united states and perú. under that treaty he's been brought back to the united states specifically the federal court in alabama to face the two charges, wire fraud and extortion. he will remain here throughout

the duration of the case including post trial appeals and only then will he go to perú to continue serving out innocence there. mike: there's no suggestion 18 years later that van der sloot is going to cooperate, right? >> that's right. he's been frankly defiant from day one. i don't believe he will change his tune at this point. his lawyers indicate that there are defenses and they intend to raise them. wouldn't be surprised if this case goes to trial. mike: a day in court and hope at some point she will get some answers? >> they provide some degree of closure, i suppose, for the victim's loved ones. it is a day in court. it's not going to be a murder conviction, of course, those aren't the charges but at least there's some level of justice that, i think, the family members are going to look at and say, hey, we are at least being heard.

mike: he's got this case in perú, the murder case, he's got a drug case you were telling me about as well. now this case in the united states, so all indications are he's not going to be running around free any time soon? >> that's right, he's going to spend significant amount of future in prison. he's 35 year's old. he may some day see the light of day but it's going to be a long time. mike: it's amazing, i remember the story so well 18 years ago. hope the holloway's get some justice at some point. tim belevetz, thank you for your time. you're looking at live i images of in i95, emergency service to shut down parts of major highway, huge interstate connecting the east coast of the united states, the intense flames caused part of the road to collapse. let's go to cb cotton live with the latest updates. >> monday morning's commute will

come with headaches as people are told to stay away from the area. this happening in one of the country's oldest and most traveled routes. officials telling fox affiliate, tanker truck caught fire in i95 in northeast philadelphia causing the north -- the northbound overpass to collapse. now all north and southbound lanes are closed in this area for about 3 to 4 miles. emergency dispatchers were reportedly notified before 6:30 this morning, firefighters arriving to the aftermath to assess the damage with portions of the northbound lanes reduced to rubble. the fire was under control around an hour later, 7:30 a.m. this morning u.s. secretary of transportation pete buttigieg saying federal resources are going into action to offer any assistance that usdot can provide to help with recovery and reconstruction. local officials are telling people to brace for a long haul and getting this interstate fixed. now as first responders learn

more about the scope of the damage, they're pointing the finger at the initial truck fire for creating this messy situation. >> it's a lot of heat. a lot of heat, probably very hot. i don't know -- we did get reports of heavy black smoke when i got here it was heavy black smoke and fire. it was very, very intense heat. >> and right now there's no word on any injuries. officials say scale of this damage means there could be weeks of repairs and, of course, mike, that means hiccups for travel plans. mike: cb, thanks very much. new york flight bound for los angeles diverted to uth after technical problem on board only to have the air slide accidentally deploy inside the plane once on the ground injuring a crew member. jeff paul is live with more. hello, jeff. jeff: we just heard from a delta spokesperson regarding the incident.

they tell us there was no emergency landing as some outletting are reporting and nor was it diverting due to slide being deployed but they tell us in, part, delta flight 520 operating from new york j.f.k. to los angeles diverted to salt lake city due to a maintenance issue while on the ground the same aircraft slide was deployed by accident. delta says one crew member was taken to the hospital but after doctors checked them out they were released. the flight reportedly left new york around 7:00 a.m. at some point in the middle of the flight they made announcement they needed to land in salt lake city to sort out maintenance issue. but when ready to depart utah one of the slides deployed without warning while the plane was still at the gate. we spoke with aviation expert and here is how he describes what it would be like inside the plane when that happened. >> the slide on the planes is designed to deploy rapidly and

nearly six weeks. officials have revealed 13, 9 and 4 and just 11 months old lived off of casaba flower pulled from the plane and fruit that is were luckily in harvest season. the older ones were skilled in navigating the amazon. on friday the four were located and hoisted onto helicopters. that rescue took place about 3 miles from where the small plane that they had been traveling with mother, pilot and co-pilot where they crashed on may first. the bodies of the adults were located in the wreckage but the children were not there sparking intensive search operation that included over 150 military soldiers and volunteers from the indigenous communities. groups that are usually at odds. dogs also assisted this search as crews were led by footprints and items left behind. you can see the diaper there. the voice of the children's grandmother was played from helicopters directing them to

issues for president trump as he tries to get the nomination again is his energy and his tax and economic policies f those can somehow be at the forefront, then he can go a long way the blunting the opposition that he has for the nomination among other players who are trying to get more conservative than him or try to take the mantle of the nomination away from him. mike: matt, trump 2024, what have you seen and heard so far? >> well, obviously the big orange elephant in the room are the indictments, that's going to have impact probably not in the republican primary because seems like primary voters have discounted but impact in the general election. the other thing i would say about biden, for all of the rhetoric that trump uses about biden is the fact that he has passed 7 bipartisan bill that mitch mcconnell and mccarthy

supported and congress has supported and gotten a lot done in 3 years including recently with republicans in control of the house. mike: to be fair, a lot of democrats saying they prefer somebody else. that -- >> that is true. trump is the big boogie man for democratic voters. mike: let's play florida ron desantis out on the stump. >> democrats have playing for keeps. if they are able to sweep, win the white house, win the house and the senate they are trying to get power for generation so we have a lot of work to do. mike: how has desantis looked on the circuit so far? >> not too bad. he's making distinction between him and the president, president trump that is and bringing out issues and one of those things

that he will have to do with pence, take the message to the grassroots, to iowa, new hampshire, south carolina and find a way to build a presence that is something not trump so that they can somehow volt to some kind of national stage after those first primaries are out of the way. mike: matt, your impressions of governor desantis so far? >> seems a little wooden to me. i should know because i've worked with wooden candidates in the past. look, he also didn't get off to a great start. i mean, he was very wishy washy about the war in ukraine, ridiculous launch with twitter and he's focused on things that while it gets applause in republican primaries are not the things that swing voters really care the most about. this kind of war on woke that he talks about, isn't the thing that people are thinking about when they are sitting down for dinner at fight. mike: former vice president pence is in.

let's play him. >> new beginning for life but it would require new leadership in the white house and in the republican party. mike: does its time to turn the page work, terry? >> not so far. mike pence has run a very well-oiled machine of a campaign up to this point. his launch went pretty well and he's got some good surrogates out there talking on his behalf but he doesn't have the electricity of a trump or the social agenda, the woke agenda isn't quite so much as a center oh piece of campaign as you see with ron desantis. mike pence is an interesting alternative. the constitutional argument for his candidacy is very strong but he's appealing to very conservative voters in iowa and new hampshire who are evangelical voters and that gives him a strong chance to make a name for himself in that early state. mike: what have you seen from the former vice president? >> i don't know, ideology is not

what's driving republican voters anymore. it may be that it used to but now they don't even have a platform in the republican party when trump was running in 2020. they aren't running on ideas or issues and running on ideas and feelings and feelings all directed for or against donald trump and then for against this woke war that desantis is waging. i'm not sure that mike pence can generate a lot of feeling. >> i think that the relationship primary voter is legitimately looking for a nominee that can win the election in november and there are people in this party that are convinced that donald trump if he's running against joe biden has a pretty good shot at winning. the problem is in the light of the indictments the conventional republican, the establishment republican simply can't think of a way that joe biden could win the general election and that's why ron desantis sounds sort of a fire alarm. if we don't choose somebody besides donald trump, then we

are going to be out of power for a very long time and republicans especially establishment republicans are very concerned about that. mike: okay, so president biden is going to get out and do some 2024 activities. what are the expectations as he's launching that? >> look, i think one thing that biden has not done yet is convince people that all the things he's gotten done are going to really matter in their lives. that's going to be his priority over the next year is making that case. i think we are pretty much done with legislating. they'll have to do things to keep the government open but look, with divided government you're not going to get much in washington. he needs to get out and show people that the things that he passed with infrastructure bill, the chips bill, the bipartisan pieces of legislation are really going to make a difference follow people's lives and their communities. they've been promised that time and again by politicians of both parties. this is actually one of the first time it's true. he needs to make sure they know that. mike: by getting out there, does he need to counter the he's too

old argument? >> oh, yeah. he will have to convince the people that will coalesce around him that he's a winner and he's going to be able to take the reins of four more years to finish what he started. joe biden has some strengths. he has the power of incumbency and passed at least will flow money throughout this country and infrastructure bills and in other ways. so he isn't -- he isn't the weakest candidate in the field and what we need to do is have the strongest candidate in the field to take on all of that influence and power that he has being the incumbent president of the united states. mark: any alarms about cornell west or rfk, jr.? >> look, i'm spending a lot of my time trying to convince that folks that know label not the run third-party candidate against biden or trump. anybody running as third-party can do damage to the incumbent. we are more worried of financed

under control. how do you assess the fires, mike, and what are the causes? >> so this year is unprecedented. i don't like the use that word but really it does apply in this situation. right now we burned the area equivalent to new hampshire and vermont combined and we are just beginning our fire season much of canada is covered by snow until the spring, until april and it's just got off to a very fast start. there are 3 ingredients for a wild fire to occur and this applies to canada, united states, australia, wherever. first you need vegetation, we call it field, needles, leaves, grass, trees, how much, how dry, important aspects and second ignition, lighting and people. people dominate the causes in the spring in canada and lighting dominate in the summer. third, you need that hot, dry windy weather and we had

record-breaking heat out west in may and we saw record-breaking amount of fire in may. and, you know, for those folks who live in new york city, my heart goes out to you because you're breathing out chemical and the thing is you live in new york city, the likelihood of your place burning down to wild fire is essentially zero. but, you know, fires from a thousand miles away in northern quebec can come down and create that -- that chemical soup, postpone baseball games but more importantly it affects our health and the more we know about smoke the more reno how hazardous to human health. mike: 427 active fires across canada, are resources running a little short? >> we are resource limited. you know, we share resources across the country and also united states has been helping out a great deal as firefighters

from south africa, mexico, australia and it's winter down in the southern hemisphere. it's a good time for them to come up. the united states has had fairly quiet season so you are able to help out but with so many fires, you can't fight them all. we just don't have enough resources so you have to pick those that are the most threatening to communities. it's easy to give numbers but it's all about the impact, i mean, hundreds thousand of people have been evacuated in canada and, of course, the smoke has impacted tens of millions of people. so it's been an eventful year and once again, we are just beginning our fire season up here. you know, like june and july are prime time for fire and these fires, they are huge. some of them are like 20 times the size of washington, d.c. and they are going to burn for weeks and months and we are in a little bit of a quieter period

now if we get the hot, dry windy weather again they will flair up and the smoke will go wherever the wind directs, could be back to eastern seaboard or across atlantic to europe, it's hard to say. smoke forecasting is difficult. it's more difficult than weather forecasting because you the weather and the fire to handle and you're seeing the imagery there, it was just, a smoke front, okay, canada is great for shipping hockey players, cold fronts and now smoke front. i'm sorry, folks for sending all the smoke down there, but fires are natural and we have to learn to live with them. so it's a multifaceted issue and we are going to need a multiprong approach. there's no quick fix here. we have to learn to live with fire and unfortunately the smoke. mike: we love your hockey players, your beer and you're generally friendly people but we could do without the smoke. >> i agree. i don't like it either.
