"the faulkner focus" is up next. here is harris. >> harris: we begin with a fox news alert as we await a critical decision from the u.s. supreme court. affirmative action giving resources or preference or favor of certain people deemed disadvantaged. this kind of special treatment really from the 1950s and 60s, just popped up as a 2024 election battleground. it could be as monumental, we're told, as last summer's roe v. wade opinion.

the question at the center of the case in this day and age should colleges consider race when deciding who gets in and who doesn't? i'm harris faulkner. john wang is at the center of this mom -- he says it is hurting asian-americans in particular. wang graduated high school with a 4.65 gpa and scored 1590 out of 1600 on s.a.t. six top colleges denied him entrance. >> i got an 800 out of # hundred on math. 99th percentile. i got a 790th out of 800. the top tier schools were mit, princeton, harvard,

carnegie-mellon. they all told me it is tougher to get in especially as an asian-american. i took it as gospel. >> harris: a new op-ed says we better brace for impact on this one. whatever the decision is, it's bound to make waves just as with the overturning of roe v. wade. this could potentially lead to another summer marked by social unrest with defenders of race-based admissions pulling out the long knives for the u.s. supreme court. calling it inherently racist, end of quote. our chief washington correspondent mike emanuel with the important details we need to know before we discuss this story. mike. >> good morning. these are huge cases that could have a massive impact on higher education in this country. both harvard and the university of north carolina are being challenged at the supreme court in different cases accused of using racially-biased admissions criteria to keep certain students from attending some of the top universities in the

country. the high court's ruling could have a major political impact and societal impact reaching beyond academic institutions to hiring and other race over merit practices. john wang had nearly perfect s.a.t. scores. and yet was rejected by those six elite schools. he says he was warned it is tougher to get into college especially as an asian american. he is doing this on behalf of future generations of students. >> i thought a little bit about the consequences but i just think that it was an opportunity for me to fight for what i think is right and also fight for asian-americans that are younger than me. >> the debate over college admissions is being closely watched at the white house. the argument there is the biden administration has been focused on racial equity. >> the president has been very clear, the vice president has been very clear. there are real issues that we

need to address and look at and he has been able to deal with that, deal with those issues and racial inequality from the federal government. clearly there is more work to be done. >> with a conservative majority it could be a return to merit over other factors when it comes to college admissions. >> harris: i heard you say that word equity. we'll get into it here. thank you. leo terrell is in "focus" now, fox news contributor and civil rights attorney. let's start there. i think that people don't understand why we shouldn't love that word. equity is when you manipulate the outcomes. equality is when you give everybody access to rise and do what they can do with their merits. why are we at the highest levels of government like the white house now in your opinion, why are we so focused on manipulating the outcomes. >> because, the left needs to continue to play the race card. as far as they are concerned like you mentioned they think it is 1965 and 75.

they need to keep playing the race card. there is no need for affirmative action. you give people the opportunity to achieve and do hard work. this young man did hard work, achieved, but because of his skin color he will be denied. why? because of the equity gain. this left wing administration plays the equity game at the expense of hurting hard-working people. that is what's happening in these two court cases, harris. >> harris: the "wall street journal" editorial board is calling out the deception of affirmative action. highlights the pew survey that finds when asian-americans are shown the reality behind the euphemism opinions change. in the research half of asian-americans who have heard of affirmative action say it is a good thing. but when the broader question is asked should race or ethnicity factor in college admissions decisions, only 21% say yes.

why do you think that is, leo? >> because it is the manipulation and mindset that the left wing media has control over the public thinking that people are being denied opportunities because of skin color. harris, that doesn't exist. look at you, me, this country. is this country more diverse now 30 or 40 years ago? it is obviously yes. we have people of all colors in every aspect of government. by way, we had a black president. by the way, we have people of all different colors running the country. look at new york, chicago, los angeles. the race card is being played at the disadvantage of people who work hard, like this young man, who achieve and being punished base on skin color. i want to be very clear. this case should be stricken down by the supreme court. affirmative action is not everlasting. it should be terminated as of today. >> harris: there are going to be, because it is not a perfect

nation, there will be times when racism happens. if you throw that word around like water, when actual things come along people don't even know how to identify it nor how they feel about it nor how to adjudicate it. we only apply it when it sells. the same thing is happening now with asian-americans and i don't know if people understand why that is. what young john wang is saying is that there is a pre-disposed nature about people to think that asian-americans do better in school. then, leo, would that be that there is a pre-disposed to nature to think the rest of us can't read and write and rise in school? >> isn't that sad. we still live in a systemically racist society. ever since i've been a fox news contributor i am looking the find out what department in this government is systemically

racist. that's the mindset. we're instructing people of color we're not good enough so we'll help you. i reject that argument. and i think that what john wang and other asian-americans are feeling is they are being punished for hard work. and people of color, blacks and browns are being told you aren't good enough so we'll help you. i find it offensive. i've been a civil rights attorney for 30 years and went to ucla law school. passed the bar the first time and i don't understand why that mindset is still being applied in 2023. this is not 1955. >> harris: thank you for getting us started this hour. appreciate it. good to see you. wait, hold on. we'll handle this because this is just happening. marine veteran daniel penny is sharing his side of the new york subway choke death and some videos of the circulated. he complete not guilty to second

degree manslaughter. what you are watching are some of the protests happening saying that jordan neely died as a victim and basically working this out in the media, if you will. a grand jury is set to decide if daniel penny will be indicted on that charge of manslaughter. before they do that, though, he is speaking out in the videos i mentioned his attorneys have just released. let's watch. >> the three main threats he repeated over and over. i'm going to kill you. i'm prepared to go to jail for life and i'm willing to die. i was scared for myself and i saw women and children. he was yelling in their faces saying these threats. i couldn't just sit still. the whole interaction lasted less than five minutes. some people said i was trying to choke him to death. which is also not true. i was trying to restrain him. >> harris: it is amazing because people did -- i don't know, we weren't there, leo, you and me. five minutes is not 15. if they roll on it, it will be easy to look at the time code on the cell phones rolling and

match it up with the facts. what do you make of what daniel penny is doing defending himself publicly? >> brilliant move. i want to be clear about this. the only reason why this man is being charged because of his skin color. the race game. look at all the deaths happened in the subway i'm glad he is speaking out. i'm glad he will speak at the grand jury and glad he will testify. he has a story to tell along with the other eyewitnesses who saw what happened. this man had every intention to defend himself and to defend the rights of others. he is only being prosecuted because of his skin color and this is again is the left wing media. a black victim allegedly and a white suspect. that's what the left wants to create and that's why you see the protests in new york. >> harris: the witnesses back up some of what the former marine is saying because they say yes, this person was, you know, yelling threats. they saw him as an imminent danger and so on and so forth.

when you are saying like we just talked about. racism can and does exist but will the left take a look at it when it looks like this? and you say this is a case of racism. quickly last word from you. >> absolutely. here is the other part about this. look at the people who helped him. look at the people who also assisted this man. a person of color helped restrain jordan neely. isn't it a shame the democrats need to place the race card to try to remain in power? they're trying to divide the country and it is insulting to the american public. >> harris: these two things the left doesn't have enough room for in their playbook. he is white but he is also military. again, your last word. >> absolutely. you know what? that man is a hero and he sacrificed and saved a lot of people from harm and also

today and will meet with lawyers and discuss a new florida-based legal strategy and all this comes after a busy weekend on the campaign trail. take a look at videos from speeches that he made in georgia and north carolina over the weekend at the g.o.p. conventions there. he called the indictment baseless and ridiculous and calls it election interference. trump is the first former president ever to face federal criminal charges. prosecutors say he was personally involved in bringing classified documents from the white house to mar-a-lago where documents were found in a storage room as well as a bedroom, a bathroom, and a ballroom. prosecutors say on multiple occasions trump showed people who did not have security clearances military information, for example, in the summer of 2021 in bedminster he is accused of showing four people a plan of attack put together for him by the defense department. weeks after that prosecutors say he showed another person a map related to a military operation.

the former president claims this indictment is helping his 2024 campaign. he reports a boost in the polls as a well as a boost in fundraising. we saw similar reaction in april when he indicted on state charges in new york. so back out here live you have seen the former president's plane waiting for him at newark. he is expected to arrive at the airport within the hour headed the miami, his arraignment in miami federal court is at 3:00 p.m. tomorrow. after that he comes to bedminster expected to make a speech before the american people at 8:15. wednesday is his 77th birthday. >> harris: thank you very much. new concerns over security and they involve communist china. the white house has just confirmed beijing did team up with cuba to set up a spy base just 90 miles from south florida. an administration official says

china continues to grow more aggressive. >> harris: what do you make of what's going on in cuba? it's a communist nation. the communists will get together and do what they do. >> that's right. the real issue here is cuba is broke and china is coming in with billions of dollars to buy this facility or essentially rent this facility so they can have greater access. what people need to realize is from that perch 90 miles into the caribbean in the gulf of mexico, cuba is going to be able to sur veil some of our most sensitive military and space facilities all along the southeast corridor of the united states of america and watch us pretty closely. >> harris: one other thing i went on a cruise before the

pandemic hit. we could see cuba from some of the balconies on the ship. it was 90 miles away. if we can see them, they can see us. they have access to a lot of american citizens should they want to leave that island. i never thought of it that way. now that i know there is spy base there i'm more sensitive to how close our proximity is. u.s. supreme court set to decide at any moment. they have to do it by the end of june. any moment now on president biden's $4 hundred billion student loan hand-out. democrats are getting pretty nervous. court's conservative majority is expected to decide against the plan. the democrats want a backup to cancel the loan. biden's team hoping they won't need a backup plan. >> he drew a line in the sand to protect the student loan relief

program. our hope is the court finds it legal and we're able to provide the relief to people before they have to start making payments again. >> harris: you are watching this and on judiciary. what do you see in terms of the outcome for this? >> well, we anticipate and i think all the democrats here that i've talked to anticipate the supreme court will set it aside as being unconstitutional action on the part of the biden administration. the way he did it was totally unconstitutional. that needs legislation in order to do that. in fact, i think that's why they -- the biden administration agreed to basically take a 90-day deferment and start payments in august. there are people who don't have a schedule to pay it back. so this is a huge, huge, expensive problem and i don't know why this is such -- other than a political issue for the democrats and the left.
