>> harris: former president donald trump is now aboard his plane, about to depart to miami, florida, where he's scheduled to appear in federal court tomorrow afternoon, 3 p.m. eastern, to be exact. when he arrives in the courtroom, he'll be in a place no other former president has stood before. facing federal counts, 37 of them, relating to mishandling of classified documents. trump denied any wrongdoing and
9:01 am
mocked it over the weekend. americans are revealing their thoughts on the indictment against trump with a new abc poll finding nearly half of americans, 48%, agree with the department of justice charges. 35% disagree with the case against trump. however, that same poll found that nearly half of americans believe the charges against trump are politically motivated. guess it depends which team you are on if you like the charges or not. hello, everybody, you're watching "outnumbered," i'm harris faulkner here with my co-host kayleigh mcenany, here with lisa boothe, host of kennedy saves the world podcast, saving us all, kennedy herself and jason chaffetz, author of
9:02 am
"the puppeteers." jason, your thoughts? >> jason: begs the question, why didn't the president give the documents back? i'm telling you comparison to hillary clinton and joe biden, i was chairman of the oversight committee, i issued subpoenas and preservation letters and hillary clinton bypassed federal record act on the same day she started her senate confirmation hearing. untold number of people without security clearance had access to the documents, some so classified, i as chairman could not go back and read them because they were that sensitive. >> harris: some papers biden were accused of or they took, they haven't done all cherrypicking, you have to go through 1850 boxes at delaware university they pulled. some documents, he took when he
9:03 am
was a u.s. senator, that's against the law. >> jason: absolutely against thellow, you are not allowed to take one document, joe biden took uncounted documents. why didn't they go in guns ablazing. >> harris: don't we know? i think we do. kennedy. kennedy there are differences here between hillary clinton. anyone seeking presidency, if they mishandle documents, they should be prosecuted, should be equal of the law. you are right. the differentiation are the conspiracy and obstruction charges and those are the one that have 20 years each and why peez facing so much time, not just having the documents.
9:04 am
what struck me was specificity in the indictment and i wonder if that was to contrast with the bragg indictment we saw in new york city, which was so incredibly vague and this one on the other hand laid out in such great detail. >> harris: or skill, one has has more skill doing that. vivek ramaswamy, who is running for president and for gop nomination this weekend took the media to task over coverage of the former president's indictment. let's watch. >> with due respect, it is shameful i as a competitor in this race have to ask questions the media is not asking. the media is to hold the u.s. government accountable and we are doing the bidding of u.s. government. ask the question, get to bottom of what biden told garland, if the same shoe fits the other foot, do not take their word
9:05 am
now, get to the bottom and restore journalism in this country, that is missing is getting to the truth. >> thank you. >> harris: what vivek ramaswamy is showing, this is now a gop primary issue and it may come down to money, who can raise the most, as far as he's concerned, he's ready to pardon the president on his first day in office should he get elected. >> kayleigh: why aren't journalists asking what the attorney general knows? it is the key question. here is why. we got rid of independent council stat uts, independent, a special counsel is not. i talked to a former doj official who said special counsel report to the attorney general, you can go back and look at code of federal regulation that say significant moments are reported to the attorney general. we're at a most, our country is divided and this will divide it further, we need to hear from
9:06 am
attorney general merrick garland. he need to hear from chris wray, if we don't after this indictment happens, i will have serious questions as to why, particularly when you point out polling, it shows cbs, republicans 61% say the indictment won't change their view, 14% says it makes their view better. you asked half the country who views one way through political purview and we need to hear from the attorney general of the united states. what i'm picking up from what you are putting down, lisa, if you take infusion of support for trump and add to that, third of the base, what does that mean? how does that translate to politics? >> lisa: the biggest frustration for conservative is unequal application of the law, we have all seen and witnessed under the biden administration. probably helps in the primary, i feel it hurts him in the general
9:07 am
election and that is the concern. if you look at the abc poll, 38% of americans have a favorable opinion of donald trump. 31% have a favorable position on joe biden, so equal in that. we are living in time of bias in the media, time when fbi is interjecting itself and fighting an unfair fight heading into the 2024 election. my belief is that democrats want to make this entire election on one man, about donald trump. if that is what happens, we lose in the general election, then we're not focusing on issues that matter to the american people. making choice between two men versus issues driving the conversation. >> harris: how is that any different than his four years as president and he still got stuff done. this media took him on at every account, if not them, being impeached by democrats on the hill.
9:08 am
>> lisa: of course he faced uphill battle and worked against the odds, sadly a lot of what he's done has been reversed, it is changed next time you get another president in the mix. i worry, i want this election to be about more than two individual people. i want it to be about issues facing the american people. so many americans are suffering, whether the economy or looking at things happening along the southern border that is impacting all of america. when you make the election about one person, perhaps more people don't like him than like him, that harms us heading into the election. >> harris: interesting, it will help in the primary, does it grow the tent and let us drill down to things that matter. i want to get to you, jason, i want to put this out. democrats scoffing at the idea that trump could be elected if
9:09 am
found guilty and talking about impeaching trump if elected again. look, it's eric holder. >> the notion you could have a trial, defend it be convicted, win election and sworn in as president whenever it happens, that seems inconsistent with our notion of fairness of the rule of law. that point, i hope impeachment proceeding might be considered, considered and brought and ultimately he would be removed from office. the notion a convicted felon would serve as president of the united states is absurd. >> harris: it is founding principle, innocent until proven guilty. they are not getting that? >> jason: pretty rich in someone who believes in law, he was held
9:10 am
in contempt of law, eric holder, the law says shall be prosecuted for district of columbia and they decided they shall think about it and decided not to. that is an absurd notion. again, i think they're trying to win this case in the court of public opinion. it is not about the rule of law for them. that is why they released the photos the way they did, those were gra tuittous at best. look at photo of the spilled box making it look sloppy and zoom in on it, it is newspaper clippings and pictures of the picture. nothing classified. >> harris: former president pointed that out on truth social. >> jason: they released the oop before the indictment, they are fighting in the public's mind, they want to defeat him and can't on the merits, they want to fight him and make sure he does not become the next
9:11 am
president. >> harris: we have to go. >> lisa: helps in southern district of florida, jury of -- >> harris: that at least means there could be playing field that is more even with cannon in there. south florida is key here. >> lisa: i live there, yeah. >> harris: might be why democrats are thirsty to get a change of venue. >> jason: they will not have a trial before the election. >> harris: we'll see. okay. california governor gavin newsom sits down with sean hannity. nothing was off limits, we'll get into it next. hey all, so i just downloaded the experian app because i wanted to check my fico® score, but it does so much more. this thing shows you your fico® score, you can get your credit card recommendations, and it shows you ways to save money. do so much more than get your fico® score. download the experian app now.
