relentlessly attacking republicans and proposing big, liberal ideas like a new 28th on guns. newsom has shown america he's comfortable at the white house. remember his confident sleeves rolled up appearance while joe was out of town. now newsom is getting his message out to a larger audience by sitting down with sean hannity. >> do you think he is cognitively strong enough to be president? >> i have conversations with him all the time. yes. i have talked to him when he's been overseas. i've been on air force one, marine one, in the limo. >> you never answer my question directly. how many times has your phone pinged with people saying you need to get in this race. ruling he's not up to the job. it's a fair question. i'm asking. >> not answering. >> judge jeanine: well, you can catch the full interview with gavin newsom airing tonight on "hannity" on 9:00 p.m.

i would say you know, sean, not as many times as my phone paints from people telling me i'm crazy to sit down with you. lighten the moment. deflected and get away with it. you can even do that. it was a binder level answer. that was a dodge. they might have to yank him as a surrogate like they did eric adams. you've got to be quick on your feet and he's not. sean is going to rat tat tat. he's on radio three hours a day. you've got to have something better than that. in terms of biden's cognition, i've talked to people who have vending briefings with the president. they say he has good days. they say he has bad days. on the band-aids he's not paying attention at all. i've talked to the board negotiated with the president. he said he reads from the script. if you interrupt him he gets flabbergasted and the staff has to save save him. if he's not falling, he's falling asleep. if he's not falling asleep, he's hiding. he's not hiding, he's getting a root canal.

jesse's point, this is not where you thought he might give his first interview. certainly there's a belief, the intention in terms of his philosophy about politics. i thought one of the more telling moments, when sean asked about the homelessness issue which we'll see -- you'll see more of it tonight and he owned it. gavin talked about governor newsom talked about the challenges they're having. said there are things we should be doing better. >> judge jeanine: let's take a listen. >> the state has not made progress in the last two decades as it relates to homelessness. >> why? >> housing costs are too high. regulatory is too problematic. localism has been too impactful. people locally are pushing back against new housing starts and construction. i've been here for years. i can't make up for the fact in 2005 we had an historic number

was talking about less small, less pettiness. we will go to you. what about the issue, speaking of pettiness and smallness, that newsom goes around the country and trashes desantis. >> greg: again, it's to raise his profile. he has shown up -- if you are a lower level villain on batman, you try to get to batman's world by making fun of him and doing stuff like that. gavin is kind of like the riddler. he's not the joker. he is the riddler but he wants to be the joker. he's got to get under bruce wayne's skin as opposed to batman's skin donald trump. it's a waiting game on both sides. newsom is hovering around joe like a vulture over slow dying tortoise in death valley. maybe he'll make it. we don't know. in the meantime there's ten people in the waiting room on the republican side. they are also waiting for that

trump -- for trump to either drop out. 80% of democrats, this is interesting. 80% of everybody thinks their candidate should debate. most of them were democrats. that's pretty interesting. it doesn't seem like they care. it's a speculative thing. it doesn't look like they care. the lowest polling since the big bang. his mental decline is obvious. i compared him to a paper straw and a milk shake. it's worse than that. he's in big trouble. i think he's in big trouble but he doesn't act like it. with an attitude like that it'ss the most like it's a foregone -- to just believe he's going to win? that he doesn't have to worry? that the nomination is in the bag. it's like he's getting a lifetime achievement award. what does that mean? that raises a lot of suspicions. i'm sorry but it does. if you just know the dormitory about a thing. what is that telling you? if you just know you don't have

party. going to be substantially affected by the outcome. none of that is the case here so guys, deal with it. let's talk about the fact, who is on the southern district bench in miami and florida? so you've got five trump appointed judge and seven clinton-obama judges. let's face it. they want a clinton-obama judge and not a trump appointed judge. those are their options and that's the end of that. let's talk about the fact that how she was chosen, there is a wheel. it's the case in every federal court. they have a wheel. they pull a name out of a hat, it's that simple. the fact that she made a ruling on trump's behalf in another case is irrelevant. so let's talk about what we've got. we've got a case that's not only going to impact the prosecution. it will show the political nature of this prosecutor, smith. they want to get rid of the judge. i think we should get rid of the prosecutor, smith.

smith is a guy who's been rejected by the supreme court in an 8-0 decision that i talked about before. in his prosecution, overreaching prosecution of the governor of maryland. and the edwards case where a jury rejected his political stances. he's unethical beyond -- in terms of the courts and the response to him and the jury's response. judges have turned against him. courts have turned against him. let me make one more thing clear. he's a special counsel, not a special prosecutor. therefore everything he does has to be approved by merrick garland. he works under merrick garland. finally, let me say, why are they so afraid of this guy? there's no evidence trump destroyed or give away classified information and i'm not going to spend a lot of time on hillary. we know that james comey said that her evidence was hacked by other countries. >> greg: dana, anything else?

>> dana: not a ton. i think there's two things but there's a legal defense which we will finally learn more about tomorrow after he appears. then there's the political defense. we know what the political defense is an president trump is not shy about it. he's talked about it all began. other people to defend him. what's interesting. sean hannity asked governor gavin newsom about t this. the issue of homelessness, crime, liberty, education. talked about how 80% of people want to have a debate. they want to have a debate about those big issues but this issue. just because you can prosecute should you prosecute. but don't -- that's water under the bridge but now it's actually happening. previous people in this position have led to a misdemeanor and moved on. i seriously doubt that will happen tomorrow. we'll have to wait and see. he will speak to the nation after that.
