fast. reliable. perfectly orchestrated. the united states postal service. >> we are out of time. [applause] i love you, america! >> good evening and welcome to america's late news. fox news at night, i am trace gallagher in los angeles. breaking tonight was it spin or an out right lie? the white house told us reports of china having a spy based in cuba were inaccurate. now, comes the walk back. we have breaking information about those kids who survived a plane crash and went a month alone in amazon jungle. their grandmother gave them the key to survival. >> we begin with the count
9:01 pm
before president trump is facing a 37-count indictment. griff jenkins is live for us in miami. >> reporter: good evening. the former president is at his doral state this evening. sources tell fox news that he was meeting with his legal team ahead of tomorrow's historic court appearance. he's not made any public comments or didn't speak to the press when he landed. in social media posts and campaign stops over the weekend, he continues to rail over this indictment and paint himself of traces of victim and promise on truce social. i will appoint a prosecutor to go after the most corrupt president in the history of the usa, joe biden and the entire biden family.
9:02 pm
chris christie had this to say in a town hall earlier tonight. listen. >> he's shown himself and most particularly in his post presidency to be self-centered and consumed. he does not give a damn about the american people in my view. #. >> reporter: but other rivals are coming to the former president's defense. >> it reeks of political, politicalization all the way down. the most relevant statute to the actual alleged crimes. >> reporter: now, once the former president arrives here tomorrow, a little bit of what we can expect. he'll come to the federal courthouse to self-surrender and he'll be met by u.s. marshals and taken into custody and a mug shot taken though the public won't see it. we won't be handcuffed or jailed
9:03 pm
at any time. as for what we can expect outside the courthouse, we know from our sources, fbi have been monitoring divisive rhetoric but no serious or creditable threat is known at this time. we'll see what happens. certainly, we have seen a beefing up of security around the perimeter here. griff jenkins, thank you. >> with that, let's bring in ca carlos jimenez. a 37-count indictment has got to weigh on you. what was that about? >> well, look, nobody is happy to be indicted by the federal government but the president was not happy about it but at least on that day, the president was in good spirit. he was getting a lot of phone calls from around the country. people supporting him, calling
9:04 pm
it a travesty of justice and justice is not being equally applied. he shot a good round of golf and we had a good time. jonathan turly says the charges he acknowledges are serious. he also said this. watch and i will get your opinion. >> the department of justice lost the room. this is the most talked about indictment that few people have read. there is a reason for that. for many people, this is a pattern of conduct by president trump. for many others, it is a conduct for the doj and they don't go beyond that. >> he's right, the d oj is not high on the trust list these days. >> no, absolutely. when you see hillary clinton is treated one way and the president is treated in a different way. president biden is treated a different way when he had classified documents that he should have never had as a
9:05 pm
senator. yeah, a lot of people are looking at it and say we just don't trust this process right now. this is the same rumor. this is the same fbi, doj that started this whole russia collusion investigation and started leaking information to reporters. it all became circular for four years undermining president trump and his presidency somehow he was involved in russian asset and all of it turns outs false. anybody who thought about it, it was financed by the dnc and hillary clinton. wait a minute, most of this has to be baloney. yet, they perpetrated on us for four years. >> you brought up the biden document. biden deserves the same treatment for trump for his scandal and commissioner jim jordan should demand the special council and the fbi to produce a general description of the documents biden maintained.
9:06 pm
is it time we got information on what type of documents he was holding? >> yes, i do. i don't want to take that attention from away from the serious issues surrounding president biden and allegations of bribery and the millions of dollars have been given to his family. there is a lot of smoke coming out of the white house. as a former firefighter, i can tell you when there is a lot of smoke, there is probably a fire there. >> yes, congressman, thank you for your time. we appreciate it. my pleasure. >> well, president biden is recovering from a root canal procedure today. it may not have been the most uncomfortable part of his day. biden may have been caught on tape by somebody who allegedly paid him money. kevin corke is live in d.c. >> reporter: a root canal for

himself. that according to chuck grassley. grassley making that claim in a senate floor speech after fbi director christopher wray finally relented and provided lawmakers with a redacted file about a $5 million bribe claim to be continued. trace. >> kevin corke, thank you. >> the biden administration is walking back a statement it made a few days when it denied china was using cuba to spy in the u.s. matt finn is live with more on that. >> the biden administration was denying the wall street journal report that china is trying to build a spy nation on the island of cuba. the united states confirmed china had some types of
9:09 pm
eavesdropping -- he denied the report last week about china's spy station because he claims the information was not classified. >> just could not be more detailed and after the first story appears, we worked very hard to try to get some context downgraded so that we can provide over the weekend and we did that. >> now, antony blinken is pointing the finger at former president trump, alleging his administration failed to address china's spy station on cuba that could intercept u.s. electronic signals and communications from near by military bases. >> it is quietly taking steps to address counter intelligence in cuba and has slowed down china's effort. secretary antony blinken is scheduled to go to china next
9:10 pm
week. >> a lot coming out of this. let's bring in our senior fellow of china strategy, michael pilsbury. china was developing a spy base in cuba. it appears that is the administration was dishonest about that. it seems like, michael, we are walking on egg shells always afraid to offend china. what do you think? >> i think that's right, trace. there is a tradition that goes back to more than 200 years for bipartisan and foreign policies and honesty from the white house's spokesperson to the congress. the problem the biden people face now is this letter by the community mark warner and marco rubio attacking the white house
9:11 pm
for that they are covering up and demanding an explanation. frankly, this could get worse for the biden team. the chinese have a deeper relationship with cuba than we realized. this is a sensitive thing back in 1962, in 1962, you recall we almost had a nuclear war. this is a very dangerous situation that the biden team got themselves in. i don't believe admiral kirby that he didn't know what to say until a day or two later. >> you mentioned marco rubio, the florida senator had this to say. watch. >> it is not just there. they're all over the hemisphere. you are going to find the chinese are trying to find a presence there. >> when you look at cuba and alaska and trying to get on military bases. it seems like they're always in this aggressive push for information.
9:12 pm
>> well, worse case scenario is they are preparing for an attack on taiwan in the coming year or two before we get an improvement in the way we try to protect taiwan. if you are doing that then having a spy base much closer to us from key installations and washington, d.c. itself. that's the last step they have to take is ensure they have really good realtime intelligence information against the u.s. again, this is moving into dangerous waters. you would think president biden would be tough on china. it would take care of the biden crime family, quote on quote allegations. . he does not want to do that and now secretary blinken to china next weekend, it is a bad move. >> i got about 30 seconds left, michael. if china were to go into taiwan. do you think this administration has a plan a or b, etcetera?
9:13 pm
>> well, the good news is they have been exercising our forces. in japan and the philippines and the region, they have been sending ships in and out. they talked to several europeans and they are doing something driven by the pentagon. the rest of the administration does not seem to be onboard. you have all of these rhetoric coming out of janet yellen. if i were the chinese, i would think of using force against taiwan in the next year or two. trace. >> it is a great insight. michael pillsbury, as always, thank you, sir. >> thank you. >> well, tonight's real news, roundup. the special council sent a warning letter to karine jean-pierre. she was accuse of breaking the law limits political activities
