syria, including a number of contractors as part of operation inherent resolve. their noncombat mission is to advise and assist local forces to root out the so-called islamic state. >> steve: as we get more information we will pass it along to you. in the meantime, 6:02 here in new york city. and another fox news alert. former president donald trump is set to plead not guilty later today to 37 charges over his handling of classified, top secret documents, many of which were found at mar-a-lago. >> ainsley: the city of miami is ramping up security now as police are bracing for large protests on both sides. >> brian: wow. jonathan serrie is live outside the federal court in miami with the latest. jonathan, what's around you? things are pretty quiet right now. mostly just media out here. the morning is young and we anticipate there will be protesters out here throughout the day. certainly something that law enforcement is prepared for.

the hearing expected to take place around 3:00 this afternoon he's awaits this hearing? former president trump is staying at his dural golf resort. when he arrived yesterday, there was a mix of protesters and supporters gathered outside. some of the protesters holding a sign that read lock him up. but, mostly supporters out there want them even flying all the way from calvary. these supporters believe mr. trump is being unfairly targeted. as for the former president's legal strategy, here's what he told radio host howie carr. >> are you going to make a statement in court tomorrow. >> i doubt it. i just say not guilty. i didn't do anything wrong. nothing wrong. presidential record act. there is no criminal event. there is no criminality here. it's ridiculous. these people, look, they're using it as election interference. they are using it to get

the media cannot bring cell phones or other electronic equipment in the courthouse federal courts do not allow cameras in the courtroom. several media organizations had petitioned the judge for an exception to allow photographs before the hearing because of the historic nature of criminal charges against a former president but that request was also denied. bark to you guys. >> ainsley: so jonathan, reporters like you down there will have to go into the courtroom, listen to what happens in these rooms. there's going to be an overflow room for reporters if they can't fit in the original courtroom and run back outside in front of cameras like we are seeing today? >> yeah, exactly. it's like the supreme court when they do the running of the interns reporters or producers inside that courtroom and figure out a way to quickly get out to

the disseminate the information but it's not this live feed from the courtroom like you see in state trials. >> steve: we just heard him say to howie carr that he is going to say not guilty so that's not going to be a surprise. jonathan, real quickly at 3:00 he will surrender and be processed. he will be arrested. as is historically the case, when you are arrested, you are -- you are handcuffed and you get a mugshot. are either of those things going to happen today? >> i'm told he will be electronically fingerprinted. as far as the handcuffs, no, there is not going to be dramatic photo op. or anything like that. it's just a very matter of fact and we expect to be very brief hearing. as you heard the president say on that radio interview mr. trump plans to plead not guilty. >> steve: he does. jonathan, thank you very much. you are going to be very busy.

national in case that he got into a tight spot. the 1023 also indicates that then vice president joe biden maivelg involved in burisma employing hunter biden. it's clear that the justice department, the fbi haven't nearly had the same laser focus on the biden family. special counsel jack smith has used a recording against former president trump. what is u.s. attorney weiss doing with respect to these alleged joe and hunter biden recordings that are apparently relevant to the high stakes bribery scheme? >> steve: so, what's interesting about this and there you have got some allegations about joe biden and the biden family, you would think that all that information that he just mentioned, essentially he said that all that is detailed in

this 1023 that members of congress and the oversight committee got to see last week. but, the problem with that is apparently those parts, according to mr. grassley, were redacted. and so essentially what he was asking from senate floor for is unredacted copy so see. no member of congress has actually seen. this the way grassley knows it, remember the whistleblower who went to the members of congress, grassley and comer and people like that and said, hey, get your hands on the fbi fd 1023 because it incriminates the bidens. and so because there's a human confidential source who has worked for the fbi for a very long time, he says he overheard this ukrainian make these allegations. they are unverified but at this point but the key is chuck grassley says give us an unredacted copy. >> brian: 17 tapes.

okay. pretty important. audiotapes proving what the allegation of the whistleblower. 17 tapes. two with joe biden. evidently demanding $5 million, not 50,000. and telling them to hire his son hunter. pretty big deal for a guy who says i know nothing about my son's overseas business ventures. pretty significant. why would the fbi redact something about 17 tapes? why would they not want to know? why would it be in their interest not to have people know that there are 17 tapes involving the former vice president and current president? >> ainsley: good question. redact the names don't redact the information. >> steve: if it's in there. >> brian: chuck grassley and his credibility is out there. and i like his credibility. >> steve: whistleblower that it was in there we should point out we don't know for sure that it's there. >> ainsley: that's true. if it is why did they redact that. >> brian: to say it on the senate floor makes me pretty secure that he thinks it's there. and it's his reputation which he

semi friendly county will have a chance to get out of washington, d.c. or new york so he might -- when the jury was seated he might think that there might be a sense of fairness there but today motions will be filed. what are you going to be looking for from the prosecution? well i'm looking to see, brian, whether or not online speculation is right and whether the department of justice will surprisingly file a motion to detain the president that is keep him in custody during the pendency of this trial. i don't think they will. but, lots of people have wondered whether they would. and if they do file a motion to detain, it would give them a little bit of leverage as the judge allows him bond but then sets some very strict conditions. the judge could restrict his travel. could restrict his communication. could make him wear an ankle monitor. all sorts of things could happen at the hearing this morning if the department does file that motion. >> brian: so now we are going to see the defense. and the defense has not had their day in court literally. and they are going to put some motions in place that these

witnesses were pressured. that you forced an attorney to turn on their client. that you have top secret documents that is defense if you are going to charge them with doing things that are irresponsible with these documents tell us what is in them which would make jack smith possibly pull them back is that a scenario you see? >> yeah. that can happen, brian. there is going to be a lot of constitutional motions. i don't know whether the defense will come in with the motions today or whether the judge will give them a few days to file. it could happen either way. but i do expect there to be claims that the president can't be charged under the espionage act as all because the constitution gives him inherent authority to classify documents without the documents the charges would file if is he constitutionally entitled to possess those documents. he you really just then have the grand jury charges and try to be obstruct a grand jury investigation. it's going an interesting motion practice over the next few weeks to see what the defense files in the case.

choice growth at charter schools vs. traditional public schools from 2014 to 2019. here is what they found. the typical charter school student outpaced the public school peers total performance reflecting 16 more days in learning math and actually 16 more days in learning reading and six days in learning math. in the urban areas the results were even better charter school students seeing nearly a full month of additional growth in both reading and math. all this leading the studies director to say, quote: this is not a fluke. the charter school sector has improved across the country. so, here to react to this study is corey deangelis a senior fellow american federation for children and he has been a voice for charter schools for years now. good morning to you corey. >> good morning, thanks for having me. >> good morning, thanks for coming on. what is your reaction to this looks like students are doing better more math and reading. >> it doesn't surprise me. charter schools have a tract

their customers, parents and families, so they have to do a good job. compete in the marketplace unlike their competitors which happens to be monopolistic government run school system. under performing charter schools shut down. under performing government schools well, they just get more money each and every year because they can say they are failing because they don't have enough money even though we have thrown more and more funding at the problem and expecting different results in the current system charter schools are knocking it out of the park. >> ainsley: public schools could learn a lot add more reading and math days to the curriculum. a statement from the united federation of teachers until charter schools start admitting -- until they start admitting and keeping all students, particularly the children with the greatest needs, comparisons like this study are pointless. do you agree with that? they are not accepting everyone so we can't look at studies like this. >> government run schools discriminate on the bailiffs of zip code. k45r9er schools if anything are more public than the traditional public schools because they have

to accept students using random lottery. and there are some evaluations that do use random lottery as a technique to use a gold standard evaluation, for example. one in new york city by donee and freyer published, i believe, in 2015 found that winning a lottery to attend a charter school in harlem children zone in new york city reduced incarceration for male students by 100 percent. and reduced the likelihood of teenage pregnancy for female students by 59%. >> ainsley: that is awesome. >> rigorous studies finding the same results. >> ainsley: funny you mentioned charter school said his uncle ran that school and parents would come to the line when he is telling them who was accepted. he said we have 300 students and only three spots and some parents would just start crying because they wanted the best for their children. you wrote an op-ed for fox news, it and it's titled this is the headline you won't believe who this year's school choice mvp is and you named randi weingarten the inadvertent winner. tell us why.

>> yeah, i would like to thank you randi weingarten the teacher's union overplaying their hand pushing to keep the schools closed and showing true colors and inadvertently doing more to advance the concepts of the homeschooling more than anyone could imagine. fought to keep the schools closed. lob idea the cdc to do so and families got to see what was going on in the classroom and started to understand that a lot of these institutions were indoctrinating their kids with leftist ideology. the parents want the schools to focus on the basics, math, reading and writing, not focusing on indoctrination as opposed to -- they want them to focus on education. instead and so they have pushed for school choice. all across the country and just two years we have had six states go universal on school choice allowing all families to have access. and it's continuing even further. so this is a great win. >> ainsley: really quickly, corey, in the next election what are you looking for in a candidate, many someone pushing charter schools and school
