now, as he atwhats process. as he arrived yesterday, his motorcade was greeted by a handful of protesters mixed in with a group of supporters. one of those supporters flew all the way from california to be here. at dural mr. trump has been meeting with his legal team in a radio interview he gave a preview of what to expect are you going to make a statement tomorrow. >> no, i'm just going to say not guilty. i did nothing wrong. presidential records act. it's not a criminal event. there is no criminality here. it's ridiculous. these people, look, they are using it. it's election interference. they are using it to get elected. >> according to an abc ipsos poll, 47% of american adults believe the charges against mr. trump in this case are politically motivated. 37% do not.

but the same poll found 48% believe the former president should have been charged with a crime in this case. 35% do not. in anticipation of protests outside the courthouse, killer law enforcement officers have been brought in. miami city officials say they will adapt their strategy based on the size of the crowd. they say they are prepared for 5,000. they say they are prepared for 50,000. but, either way, they say they expect no major problems. now, inside this federal court building, the judge has banned reporters and other members of the media from bringing smart phones or any other electronic devices in. several media organizations had petitioned this judge, to allow a small number of cameras to take photographs before this afternoon's hearing. the judge denied that request as well. saying that allowing photographs would undermine the massive

trial. so if they are going to make that motion, it's hard to imagine. >> ainsley: who would make that decision the magistrate judge? >> brian: i guess. >> ainsley: jonathan goodman will preside over the arraignment today. is he rejected the media's request for access. >> steve: given everything, i downtown that's going to happen. it's interesting, a number of the president's 2024 republican opponents are starting to criticize the former president, tim scott said yesterday this is a serious case with serious allegations. nikki haley said if this indictment is true, president trump was incredibly reckless with our national security. asa hutchinson over the last number of days has been calling for donald trump to end his campaign. vice president pence has said trump tried to force him to choose between the constitution ands former president. and then chris christie had a town hall over on another channel. >> ainsley: they are running against him.

>> steve: like i said his opponents for the republican primary. chris christie was asked can you name the most egregious criminal count against trump? he said no, i can't. because there are so many. >> ainsley: it has been interesting though because in the beginning some of them were careful to criticize him because he had helped them out in the past. >> steve: that's starting to tthaw jim jordan focused on it joe biden. joni ernst two systems of justice when it comes to trump indictment. >> brian: ron desantis laying low said two tiers of justice. along the vein he was talking. meanwhile gavin newsom had a surprising reaction in my view of the indictment. he talked about this with sean hannity. >> donald trump. >> trying for years. >> sean: i would be negligent if i didn't get your reaction to what happened in the news. >> sad. and i say that as an american. i can imagine. >> sean: are you friendly with him? >> as you know, i didn't a closed first. i had an open hand we had incredible relations during covid. he was incredible.

taxes. i thought the most farcical answer he gave is the homeless answer the prices are so high i might as well live on the street and buy a tent at dick's sporting goods rather than go into $1,000 apartment. very few people are on the streets because they can't afford it. a lot of them are choosing to live that life, to check out, go off the grid. other mental illness and drug abuse. and what he has done is say come one, come all. he made this a sanctuary for homeless. he actually said that in speeches. now he wonders why this is happening. >> ainsley: spaces shoot up and not get in trouble? we had it in new york that they provided clean needles for people who wanted to shoot up instead of doing something about the problem. and sean went out there, to do this interview. and they like each other very much. they just have different opinions on their policies. >> steve: do you think? >> ainsley: he talked about french laundry and gavin newsom owned it he said yeah that was stupid. i shouldn't have done that.

looked at these programs and just said, hey, that is so easy to scam and they did. >> that's right. some of it was literally by design. early in the pandemic. congress passed a series of laws creating new and expanded unemployment and business benefits that they i brought down guards. they said the money needs to get out now and we in some ways not concerned about who is going to get it as the big as the fraud is in the tower you think the number is bigger. >> your viewers have probably used to it. the a.p. found something around $400 billion in misspending. but there have been repeated reports from inspects general and other accountability experts and others along the way that more and more of these losses are uncovered, a spectacular

report comes out with a very large number. these numbers keep getting bigger. so the # hundred billion dollars that was found by the a.p. is still like lay conservative number compared to what we're going to find in the coming months and years. >> steve: that's just crazy. i understand there were international crime rings involved as well? >> that's right. some experts think as much as 70% of the losses in terms of unemployment benefits were stolen by international crime rings including those affiliated with the governments of russia and china as well as in nigeria and romania. >> steve: and then there were americans who were so audacious, i know you told me during the commercial, about a rapper who sang about how much money they stole. >> right. so, this gentleman whose name nuke fizzle who is behind bars did a rap video how easy it was to rip off the california unemployment system paying out both state and federal unemployment checks what you would expect dollars flying all over the place.

♪ >> brian: welcome back, everybody. the biden state department blaming the trump administration following reports that china is building a spy post in cuba. the deflection comes after the white house dismissed those reports as inaccurate. gillian turner joins us live from the white house. gillian? >> hi, brian. the white house now seemingly confirming that china has been operating a spy base inside cuba for years or at the very least that they have been trying to as you mentioned. the admission came from john kirby yesterday at the white house briefing. just four days after he had publicly completely shot down reporting about the spy base all together. take a listen. >> we are as forthcoming as we should have been given the nature of this information. sadly, not everybody seems to take it as seriously as we do because clearly, there's a source or sources out there that think it's somehow beneficial to put this kind of information into the public stream. >> gillian: former director of national intelligence john ratcliffe says there was no such

operation on former president trump's watch. >> the idea that this kind of surveillance platform was present and being allowed is just, you know, is just absurd. >> gillian: yesterday in the briefing john kirby appeared to imply that perhaps the problem was that trump administration intelligence officials just misread the tea leaves. >> john ratcliffe said that the allegations there was a chinese spy base in cuba under the trump administration is not true. what do you say to that? >> , allegation. >> what do you think we should take away from that? >> all we can say is that it's our assessment that the previous administration would have had access to the same intelligence that we did. >> well, the administration so far has no plans to curtail good faith engagement with the chinese government. just recently the director of national intelligence, secretary

of defense, the national security adviser all spoke to their chinese counterparts and the secretary of state tony blinken himself is headed to china in just a few days. brian? >> brian: all right, gillian. thanks so much. can't get an candid answer even from an admiral. appreciate it. same pattern, not true, is true. blame the previous administration. we will bring that up with the former cia director and secretary of state, bestselling author mike pompeo coming up in about one hour. meanwhile, to a fox weather alert. colorado rocked by thunderstorms that brought damaging hail and pouring rain to parts of the state yesterday. stunning footage from colorado springs shows floodwaters turning roads into rivers. let's check in with senior meteorologist janice dean for the fox weather forecast. janice? >> yes. good morning. we have the potential for stronger storms from the rockies across the southern plains in toward the southeast the next couple of days. let's takes a look at the radar and i will show you where we have several severe thunderstorm warnings in effect for parts of texas. around the dallas area. and we have this set-up right

now where we can see the potential for strong storms not only today but through wednesday and thursday. for some of the same areas and there's your forecast. so, the heat is on for parts of texas. much of the state of texas where we have this set-up not only for severe storms but high pressure bringing in the heat for at least seven days so dangerous heat. record setting heat for places like san antonio, corpus christi, houston, texas, up towards dallas where we will flirt with 100 degrees and with the heat indices a lot warmer than that dangerous heat. people encouraged to stay indoors. a lot of folks say it's hot in texas usually this time of year. it's early and it's going to be long lasting and if you have got record highs, for texas, then you know that this is potentially dangerous situation for the next few days. look at dallas. so the average is around 91. we're going to surpass that 100 degrees for the next few days as we get into friday and through the weekend and even into next week. of course the heat is the

our son jasper. >> ainsley: joining us now is the host of that show danielle trotta. hey, danielle. >> good morning, great to be with you again. ainsley: what a sweet story. she approached you and she said my husband just lost his dad. they were wanting to restore their old truck that's been in the family for a long time. and they just never got around to doing it. tell us how you cage into the story and then did you restore the car? the truck? >> yeah. so, after john's father suddenly passed away, they were in the midst of restoring the truck together. and when john was a little boy, he remembers his father driving this 19 # 50 f-1. it was his daily driver and john remembers when he was a kid climbing along the bench seats and there were so many great memories, so, when he became an adult, he and his father jerry started restoring the truck together. suddenly, tragically, jerry died in the midst of that restoration. and so his wife, kelly, john's wife, called me and that's where
