3:00 p.m. eastern and we expect the former president to plead not guilty either today or in a separate formal arraignment. we'll find out. much of the republican party has been rallying behind trump. >> they are trying to utilize the d.o.j. as an influence operation within the campaigns within elections. >> america is seeing a double standard. perhaps president trump should have gone after hillary clinton. he didn't. should joe biden be allowed to aggressively go after the former president? >> i think president trump has not been treated equally like everybody else in this process. >> harris: 2024 challenger nikki haley has reversed course. >> two things can be true at the same time. one, the d.o.j. and f.b.i. have lost all credibility with the american people. the second thing can also be true. if this indictment is true, if what it says is actually the case, president trump was incredibly reckless with our

national security. >> harris: so why trump, though? and not biden? plenty of comparisons to be made. a trove of classified documents found in one of president biden's offices, others inside one of his delaware homes. even inside his garage where he parks his corvette there. the former president making this promise if he wins re-election in 2024. i will appoint a real special prosecutor to go after the most corrupt president in u.s. history, joe biden. the entire biden crime family and all others involved with the destruction of elections, border and country itself. end quote there. jonathan serrie reporting from us from miami. jonathan. >> just before his 3:00 p.m. first appearance hearing in federal court mr. trump is expected to turn himself in voluntarily to federal authorities for fingerprinting and photographing. no photograph will be publicly released to the public, though.

in a radio interview, mr. trump gave sort of a preview of what we might expect in the hearing. take a listen. >> the judge is going to ask you tomorrow how do you plead. are you going to say anything beyond not guilty? are you going to make a statement in court tomorrow? >> no, i doubt it. i will just say not guilty. i did nothing wrong. presidential records act. not even a criminal event. there is no criminality here. it is ridiculous. >> officials with the city of miami say they have a layered plan that can be deployed incrementally depending how big crowds outside the federal courthouse become. >> in our city, a, we obviously believe in the constitution and believe that people should have the right to express themselves. but we also believe-in-law and order. >> mayor suarez is seriously

considering a run for the gop nomination for president which would put him in direct competition with mr. trump. he didn't want to talk about that as a news conference yesterday saying for now, he is focused on the safety of miami residents during this event at the federal courthouse. harris. >> harris: jonathan, thank you. one former trump attorney outlined how the former president could win and could fight the charges against him. some of his advice, pursue aggressive discovery. look into prosecutorial misconduct. get the attorneys' notes excluded. a former u.s. attorney and former federal prosecutor and executive director of the criminal justice reform group called right on crime. good to see you, brett. plan that could work. one was to strike those notes by the prosecutor. how would that work and why is

that key? >> well, it was fascinating to me to see in the indictment that a lot of the evidence that was outlined is the result of communications with his attorneys. i imagine there will be a substantial fight over privilege. the government's position is going to be that privilege doesn't extend to criminal behavior, but it is not so clear-cut in this case. i have think it will be a difficult issue especially for this judge. >> harris: that's interesting what you are talking about is client/attorney privilege. undermine the process that produced the indictment. those very conversations that you are talking about were spoken about in what the president could do to fight this. if it's attorney/client privilege how can you tell then a grand jury and use that against trump and say oh, if he wants to fight that it makes him look guilty.

it is pretty circular. >> it is. one important point is what was presented to the grand jury? a motion called a bill of particulars, i would imagine his attorneys are going to file. that would allow them to see what was presented to the grand jury. and did they present privileged material? did they present exculpatory material that they're obligated to do? depending on their strategy they have a lot they can attempt to do at the beginning of the case. >> harris: i do want to take a look at this from republican presidential candidate vivek ramaswamy spoke on president trump's indictment speaking live moments ago. let's take a look. >> the indictment by the federal department of justice against donald trump. that document wreaks of politization. how are we going to hold the biden department of justice accountable? i submitted a freedom of

information act request, a demand to the biden department of justice, demanding what did biden tell jack smith, what did biden tell merrick garland, is if they do not comply with the law in the next 20 business days, then we will sue them in federal courts at our campaign's expense to get to the bottom of those answers. >> harris: vivek ramaswamy announced he will send a letter to other republican presidential candidates asking that they promise to pardon biden if elected and if they don't plan to do so, he said they should be on the record about that and of course ramaswamy has already said he would do that first day, if necessary. brett, your reaction. >> you know, i applaud the position. i think it is correct that we want transparency. d.o.j. will be able to hide for quite some time emails between attorney general garland or communications between attorney

general garland and jack smith. this will not be something we get our hands on very quickly or easily. those lawsuits are important but right now the real focus needs to be on why did they bring this case under the espionage act when they know they have to prove the intent to harm the united states or to contribute to a foreign adversary's ability to gather intelligence on this country? that intent does not seem to be anywhere in that indictment. right now the focus has to be on the legitimacy of this indictment against president trump. >> harris: you agree quite a lot with what his former attorney has laid out here. let's go here. it is an op-ed that says the uproar over former president trump's indictment ignores how federal secrecy gone wild is spawning a caste system that

portrays our democracy. the feds create trillions of pages of new secrets and the system ab solves any official that creates new secrets. they are likely committing more crimes than citizens will ever know. brett. >> you know, harris, when reagan was president, there were a few thousand criminal statutes. there are now over 300,000 criminal statutes and regulations with criminal penalties. we have become a criminal state. if a prosecutor like jack smith has the intention to go after someone, he can do it. there is enough gray area and there is enough statutes out there to build a case against anyone. you take what happened with biden. if i wanted to put individuals in the grand jury who moved some of those classified documents that he had, if i want to interview his family members and i want to build a conspiracy

>> the 1023 produced to the house committees redacted reference that the foreign national who allegedly bribed joe and hunter biden allegedly has audio recordings of his conversation with them. these recordings were allegedly kept as a sort of insurance policy for the foreign national in case that he got into a tight spot. >> harris: just so you know, that 1023 is that form that christopher wray, the director first said they couldn't find and under pressure, the threat of being held in contempt of congress he decided to let the committee see it. james comer within hours of what grassley just said subpoenaed biden family associate and former burisma board member for a deposition this friday.

oversight claims archer helped negotiate biden's overseas business deals. before issuing that subpoena, republican lawmakers went after the f.b.i. for what they call clearly a double standard. >> we on this committee have very deep concerns about the two-tier justice system we have right now. if your last name is biden or clinton, you get to live by a different set of rules than americans who are targeted simply because they are patriotic americans who happen to be republicans. >> harris: congressman jim jordan chairman of the house judiciary committee and the weaponization of the federal government subcommittee great to see you in "focus" today. what do you make of the finding potentially there are 17 tape recordings out there? what are you hearing on the hill? what are you discovering? >> again i think it underscores why we need to make this document public. understand where the f.b.i. has been. first they wouldn't acknowledge that this 1023 form exists. a form they created and put the

form together. first they wouldn't acknowledge it exists then it exists but you can't see it. oh, actually we'll let the chairman and ranking member and then the full committee see it. let the country see it now that we have from senator grassley the idea there are 17 tapes. by the way, i think it is ironic. i remember when director comey said i hope there are tapes that exist when he was talking about his conversation with president trump. turns out there are tapes. just not the one mr. comey hoped that existed. make this document public is the key so the country can fully see what's going on. >> harris: why wouldn't they? it is not classified. from what i understand, obviously i haven't seen it, you haven't seen it, but if it's not classified, have you seen it unredacted? >> good point. i have seen it but it is redacted. that's another question. not a classified document, why would they redact that section?

because i tell you what happened. that section is the same section where the source is talking to the foreign national and the foreign national said you better stop dealing with the bidens. the foreign national said nothing to worry about because we've used so many different bank accounts they'll never catch us and also we never paid the big guy directly. that's the thing that stood out to me. the second time we've heard that term. this document, this 1023 was together in june of 2020. the first time we heard the term was october of 2020 when the "new york post" reported on a business partner of hunter biden. now you have a business partner of hunter biden saying using the term 10% for the big guy and you have the person paying allegedly paying joe biden saying we never paid him directly. that's significant. both sides of the equation talking about the big guy. it raises the fundamental

question if the big guy isn't joe biden, who is it? >> harris: who is bigger? it has to be quick. i want to move on. was the information about the 17 recordings as far as you could tell under the redacted blacked out part or did you know? >> i didn't know. the first i knew about it is when senator grassley said it yesterday. when i went through it, i didn't see anything about that. what stuck out to me is the reference to this term that we've now seen twice. >> harris: that's interesting to me. it is unclassified. if and when the public gets to see it, i hope it is not redacted. that they get to see exactly what is pointing to everything. they wouldn't even let you see that. you got close to the document. a "washington examiner" editorial headline reads biden family business needs its own special counsel and cnn analyst outraged over the doj handling of the hunter investigation. >> this is preposterous and pending according to our

reporting since 2018. five years? this investigation is not the laptop. this investigation is a tax issue. did hunter biden declare his income. five years? that's a five-week investigation. >> harris: he makes a point there. >> yeah. and actually this is what i think the special counsel is for. when there is a definite conflict. i don't know what's the bigger conflict when the president of the united states and justice department is looking into his son and alleged activity with the president himself. so that's probably warrants a special counsel. the country is getting tired of these special counsels. i saw what the mueller investigation was like and jack smith is up to. no idea what mr. hur is up to with the biden classified issue. the situation where there is a definite conflict with the administration. so maybe in fact it is warranted. >> harris: you know, it is so

interesting when you say this should get its attention but also expeditious ajudd indication. you heard jack smith with regard to trump. we'll push for a speedy trial. wouldn't you want to push for speedy justice in either case particularly for somebody who can still hold the ability to do whatever he wants with the nation? >> right. it's what you said earlier, harris, the double standard. the american people have common sense and they see it. think about it. you have a classified document concern with clinton, biden, trump. three people involved in the same thing. only one gets prosecuted? how is that justice and fairness and equal tee of the law. how does that make sense in our system where it is supposed to be equal treatment under the law? that's what is so frustrating to the country. >> harris: i can't tell you how it makes sense. it doesn't. it just doesn't. listen to what house democrat

the country an additional four years. by the end of his second term he will be 86 years old. i think if you look at some individuals who may have a grand parent or a parent alive that is in that age, most of them will probably admit, even those who like joe biden that they wouldn't want their parent or grand parent leading the country. it is why when you look at most polling data democratic voters, younger ones are skeptical about joe biden having a second term and interested and open to someone else. 28% of democrats say they are willing to vote for a third party candidates. >> there is no question the president is old, right? there is also no question the top -- >> harris: you didn't say aging. >> let's call it. there is no question the top contender for the gop is also old, right? you have two old guys running for office and we're having this conversation about age seeming to lean more on the president

and the white house versus the top contender for the gop. with all that being said, i think you have to take a look at how debates work. it would be one thing if mary anne williamson or kennedy was getting a bigger percentage of the vote. they're 1 or 2%. why would you debate somebody so low? nikki haley will make the adult table in republican debate. >> harris: i have to jump in. if you are going to cite the 20% go right ahead. >> that's not accurate. rfk is around 20% within the margin of error. you brought up donald trump and a lot we can debate about trump whether you like him or not. former president is out there showing he can stand in front of a crowd for two hours and give an articulate speech. whether you agree with the message or not. >> the president of the united states is out every single day.

>> harris: williamson is getting 9%. whatever you are looking at between 16 and 20 for rfk junior and 8, 9. that's almost a third of the fifty away potentially away from this candidate. this person who wants to be president and 86 when he leaves. i want the move forward. governor newsom last night refused to answer a question about jumping into the 2024 race as a challenge to president biden. let's watch. >> do you think he is cognitively strong enough to get president snow >> i have conversations with him all the time. >> how many times does your phone ping a day that you need to get into the race because they don't think he is up to the job. >> i see where you are going. i'm not answering. >> under any circumstances would you get in the primary? >> no. he have is a man of decency and character and proud of the

president. >> harris: is it me or did he look surprised he would get that question? doesn't he have people prepping him? we ask everybody that. i asked my neighbor that the other day. i'm kidding. reverse order. your response. >> i think newsom won't run. if you look at the president's legislative accomplishments one would say he is very effective and in the debt ceiling negotiation he worked across the aisle. >> harris: took him 97 days to put other people at the table. we didn't have to come to the brink. he just needed to go to the table. >> let me cross-examine this. the speaker of the house attempted to have negotiations with the president towards the end of january and the beginning of february, number one. number two, richard and democrats may want to cite the point the inflation is receding or jobs are low. when you look at statistics and data wages have not met the

unemployment rate. you have a significant percent of the country working crappy jobs and can't pay for basic necessities. a smaller percentage said i won't look for a job at all because the long hours i have to work are not equivalent the wages i need to survive. i would rather rely on government assistance. when you talk about that -- >> that math doesn't match. >> harris: we're calling each other relatives. okay. >> i do senior him to be a brother, a good friend. that math doesn't match. >> it does, richard. >> no, it doesn't. we've seen inflation go down beyond with the president the lowest unemployment numbers and see wages increase. when you get $15 an hour to work at mcdonalds tells you we see an increase in wages across the board. >> harris: 1.4% under trump. we couldn't get clear to that. >> he also had a global pandemic

and since then we've seen 3.9% unemployment rate now. >> harris: government watch doc says karine jean-pierre -- this is the hatch act is a law which limits political activities by federal employees. clear like one sentence there. here is the moment that the watchdog says she broke the law. >> unfortunately we have seen mega maga republican officials who don't believe in the rule of law. they refuse to accept the results of free and fair elections. >> harris: well, she is no stranger to the act. it is her go to when it comes to dodging reporter questions. here is just a taste. >> the hatch act, the hatch act. zbliem owe covered by the catch act. i'm covered by the hatch act

that i'm happy to say we believe in the rule of law. i will be very careful from here, as you know, we're covered by the hatch act. we follow the hatch act in this administration. >> harris: she says it so often how do you spell that again? it's losing its meaning. >> i know karine jean-pierre. she is a good person. we may differ on policy. the reality is here many individuals on the right and left have violated the hatch act. in my opinion here, harris, i think we need to have an outside counsel that observes this stuff and attempts to make an effort to enforce it. i'm not in favor of favorite sis many depending if it's my party or the opposite party. if you are in a government role, you have to be very careful about crossing that line and particularly having an impact or influence on voters and their thoughts about the individuals on the opposite side of the political spectrum. >> harris: richard. >> i tend to agree. the reporting is sound. the press secretary received a

are like 90-10 or 95-5 in favor of a separation of sexes when it comes to competition. realize the difference between the majority there of democrats, which now oppose this, harris, every single democrat member of the house of representatives and every single democrat senator actually opposed what the majority of democrats now support, which is women against women and men against men in athletics. it is the democratic party itself wildly left wing to where americans are. espn itself. they said lia thomas was a star of women's athletics, this man who decided to become a woman. they put that in and had an advertisement saying that he, when he became a she, was worthy of commendation.

the "new york post" i heard snippets of her speech. meaning the one in new york you just watched and i honestly feel inspired by her courage to speak up. we're trying to speak up against what the oppressive government is doing. in reaction on twitter was fierce. that speech was hijacked with false anti-semitic rhetoric. when did graduation commencement speeches turn into anti-israel rant? we reached out to the community college in california for comment. your response. >> i think anti-semitism has often become the province of the left wing in this country. i think both of these speeches are emblematic of that trajectory. the fact that the democrat party doesn't condemn opinions like these when you are calling israel an apartheid state is a totally laughable and absurd accusation. i don't have a problem with her ability to say it but i think democrat party should speak out
