we go to new jersey with more of the former president's message. nate, good evening. >> trace, good evening to you. his first public remarks, or at least his first speech since his arraignment in miami this afternoon, former president trump defended his right to retain classified information. he said it is in the sole discretion of the president to keep their own documents, and he also took sharp aim at president joe biden for what he calls weaponizing the department of justice. listen here. >> this day will go down in infamy and joe biden will forever be remembered as not only the most corrupt president in the history of our country, but perhaps even more importantly, the president who together with a band of his closest thugs, misfits and marxists tried to destroy american democracy. but they will fail and we will win bigger and better than ever before.

described his mood today in miami as defiant. i would say that correctly characterizes his tone in this speech as well, and as of two minutes ago, it is now his 77th birthday. so no doubt he is enjoying that with his donors. he made a few jokes about that during his speech as well. we'll send it back to you. >> not a great birthday eve. nate foy live. thank you. let's bring steve in. as nate was pointing out, the former president spent much of the speech defending himself. what do you make of that strategy? >> well, tracy, look, we heard the president's argument there. he laid it out clearly. what i would like to do is take on the arguments we are hearing all the time. if you look at any other channel, you look at the establishment media, there are two things they say on and on and repeatedly. let's look at those arguments. number one, they say that when those of us who feel that there

has been injustice done talking about the treatment of hillary clinton or -- over her documents or biden over his and mike pence, and they say you can't say that. what -- that is what aboutism. what did trump do? you can't bring in all these other cases. hang on a second. it was jack smith himself, jack smith, when he made the announcement and unsealed the indictments, he said this is about equal treatment, equal justice under the law. he said that. that is at the heart of it. it is no what aboutism to say what happened with hillary clinton and her emails. that is absolutely the heart of it. the second argument they make is that national security was breached here. this is a terrible threat to national security, all these secrets. in the document which many people have pointed out, the most strong statement of their case before it is challenged, there is no accusation that

national security was deliberately jeopardized, no intent to do that, and no accusation that any harm was done. so what are they even talking about? and if they really meant it about national security, they would have said something at the time of hillary clinton's document issue, but they said nothing because they don't really mean it. it is all political. >> you brought up hillary clinton, and i want to bring this up too. this was the bizarro point of the night. cnn and nbc did not cover the president's remarks. jake tapper says the former president said dangerous stuff. listen to this and i'll get your response. >> the response we have seen in polling from republicans suggest that they are gonna stick with him, that it is more of a cult than a political party at this point, and they're gonna stick with their leader. >> the message here, steve, is that trump is dangerous and his supporters are a cult. i have 30 seconds to wrap us up. >> this is what they have been

saying since the minute he entered politics. they cannot stand donald trump. they cannot stand the fact that he took head on the group think, the policy group think that they have been agreeing about for years on china and on endless wars and on the border, he up ended all of that. they hate him for that. they hate him for who he is and how he behaves and the fact he likes to go to cafes like he did today in little havana or mcdonald's. they look down their nose at him and despise him and his supporters and that's what it is about. that's what is going on. >> they certainly hate him. steve hilton. thank you. appreciate it. >> thank you, trace. >> before trump spoke to supporters he had business in south florida, as you may have heard, namely being the first former president ever arraigned on federal charges. mark meredith is live outside the federal courthouse in miami. mark, good evening. >> trace, good evening to you. the former president did not say a word to the judge, but earlier today his supporters who were

outside the courthouse, they had plenty to say. they agreed with him and they felt the charges were politically motivated. trump is facing some 37 different felony counts as a result of this investigation. he pled not guilty to all of the different charges today, and he is questioning the validity of the charges which he says shouldn't apply to him because he is a former commander-in-chief. trump never made eye contact with the special counsel jack smith who is overy -- overseeing the investigation, but their paths will cross again. the prosecution said trump knowingly lied to the government and attempted to keep classified materials long after leaving materials and he shared the information in his poe -- possession with people without security clearances. while trump was digitally fingerprinted, he didn't have to get a mug shot taken. nor did he have to surrender his passport. instead, he was able to leave the courthouse without major restrictions. he has to limit contact with a handful of people the government is considering witnesses and we are waiting for that list to

come out. while most of the protests outside the courthouse in miami were peaceful, we did see one man, as you can see on your screen, try to race into the line of the motorcade. this was somebody dressed in prison stripes, black and white right there, and tackled by miami police. we are told he has since been arrested and unclear what charges, if any, he will face. but it is an indication of how surreal the moment was where you have somebody getting up to the former president in a jail uniform. the timing, trace, of the trial is unclear. the proceedings began today and we don't know if this would go to twraoeul and when we would see these daily interactions with the judge and with the special counsel's office. it is possible it could be kicked until well after the 2024 election. the timing is unclear on this one. we are looking to see whether or not trump continues to fundraise like nate was talking about off of this, or if he tries to change the story line. we heard a lot from him today. >> the timing is key. mark mare raw -- mark meredith is live in florida.

and now from a bombshell report from the u.s. senate. chuck grassley says a foreign national associated with the ukraine energy company and allegations against the former president recorded phone calls with then vice president biden and his son, hunter. the senior national correspondent is live in the nation's capital with more. >> evening, trace. the white house is reacting to the latest bombshell in the alleged bribery scheme involving the former vice president and current president. that all dropped on monday thanks to republican senator chuck grassley on the senate floor. grassley claimed one of the redactions in the 1023 form says a burisma executive has a secret audio recording of a conversation he had with both bidens. >> the foreign national possesses 15 audio recordings of phone calls between him and hunter biden. according to the 1023, the

foreign national possesses two audio recordings of phone calls between him and then vice president joe biden. >> a pair with the current president and 15 others with hunter biden. last week president biden laughed off the accusation that, you know, that he used his power to profit. and when he was asked about the recordings today, the white house press secretary, when she was asked, she had nothing new to add. >> is the white house aware of any recordings in which the president may be on tape speaking to a burisma executive? >> the president spoke to this, i think he was shouted a question about this at the thursday press conference, and i'm just gonna quote him and say it is malarkey. >> malarkey. if audio records do exist, former acting attorney general matt whitaker says it is a cataclysmic event that would phrof -- prove the biden scheme was to abuse his power as vice

years. he was studying this for 36 months and the government still won't tell us what is going on. >> speaking of the hunter biden investigation, cnn criticized the hunter biden probe. let's play the sound because this is coming from cnn. watch. >> this is preposterous. this has been pending, according to our reporting at cnn since 2018, five years. and by the way, this investigation is not the laptop. this investigation is a tax issue. >> yeah. that's the senior legal analyst at cnn. five years. it is a five-week investigation, leslie. >> actually, i agree with him on the time frame because when you look at this, and i know republicans are sad, but at the end of the day is did you lie about taking drugs? and did you report all of your income? it is a tax and gun issue. i just said, i agree with him on the timeline. i'm actually friends with him. i agree with him on the timeline

and that's when -- and i've said this before. when you don't have them moving quickly with hunter in that investigation and you have it move so quickly with the former president, it does look politically suspicious even if it isn't. >> you can see, shawn, why people don't trust the fbi or the doj. >> it is a sad state of affairs. i grew up trusting the fbi. >> it was a tv show, right? of course. >> but jack smith who has really disgraced the department of justice has seven months to put a case against the former president of the united states and a leading candidate, and david weis the one we don't know in charge of the hunter investigation and he has 36 months that he has been totally in charge of investigating it and there is no timeline. the chances are and most people believe hunter will get a slap on the wrist. >> leslie, final word to you. slap on the wrist? >> i really don't know. you know, i certainly have been wrongly accused by the irs by not reporting income, and it

took 9 years, but i was proof right that i didn't not report income. >> maybe a knock on your door the next few days. leslie marshal and shawn steel, good to have you both on. >> thank you. >> well, first up in tonight's real news round up, bud light is no longer america's top-selling beer. sales were down 24% as of last week. the title of top-selling beer brand in the country now belongs to ma -- modello. sales tanked after collaborating with transgender influencer dill srepb mull van knee. a shopping center giant is the latest company to leave san francisco mall. operator westfield will give up control of the san francisco center mall. this comes after more than 20 years in operation. westfield cited operating conditions in the city's downtown that have lead to a decline in sales. >> a san diego business owner interviewed numerous homeless

people on what it would take to get them back on their feet. one woman said it is a tough question because as low income earners they are, quote, spoiled with free stuff. this comes as the san diego city council tonight is considering a ban on outdoor camping. >> meantime, let's bring in fox news medical contributor, dr. mark segal. it is great to have you on. you look at the homeless issues around here. i know you have probed into this, but gavin newsom is saying he has taken thousands of people off the street. since he's been in office the number of homeless has increased by 13%. what's your take on all of this? >> you know, trace, you said last night with hannity that he takes ownership of this and responsibility, but what he didn't talk about, which is the biggest elephant in the room, is the mental health crisis this has caused. california for decades, as you know, is moving against any institutionalization at all. they only have five hospitals,

mental health hospitals, servicing 7,000 people and you have 90,000 people in prisons, half of which according to their own records, have mental health issues. they are not getting treatment there. and now the prisons are trying to release people on the streets. where do you think they go? they go to homeless camps. they go to the er. what is the er supposed to do about it? i talked to the head of the er system in san francisco and she said there is nowhere to put them. they can stay for 72 hours, but then they go back out on the street. i think the biggest problem here is a mental health crisis. >> yeah. i want to put this up on the screen. this comes from the public policy institute of california. as of 2022, 30% of all people in the united states experiencing homelessness resided in california, including half of all unsheltered people, and the theme here is if you're incentivizing this, dr. mark, people are gonna come. there is a reason that a third of the homeless in this country are in california. >> that's right.

that's right. they are in homeless camps together. you mentioned san diego and they can throw money at it, but the camps come back. in san francisco, they are planting big plants, trace, but that's not gonna drive them away either. you know what everyone is talking about, which the governor talked about, but hasn't done. he is talking about $15 billion and where is the housing? where is the cheap housing for people to go to? it is not there. even the shelter system which in tremendous criticism, well deserved. at least it is a place for somebody to put their head at night. >> yeah. and it is very true. the problem is in california is we have kind of documented many times to build a bathroom, a 60-square foot bathroom in one of the suburbs of san francisco, it is like $1.8 million. it is regulations and everything, a lot of problems going on. 15 seconds, doc. >> i didn't even talk about the medical part of this, the waste, the garbage, the idea of infectious diseases coming. and again, the shelter system

has a lot of crime. there's a lot of crime involved in this, but we have to work on where they go and not, as you said, build a place where people come to be homeless. they come because the weather is good. that's the worst. the governor is not really taking ownership of this. >> we spend millions, tens of millions of dollars and the problem keeps getting worse. dr. marc siegel, thank you. >> a bill could result if parents losing custody of their kids if they don't affirm their child's chose engender. matt finn has more on a bill that could be state law. >> good evening, trace. the proposed state law could require that when a judge is making a decision in a child custody dispute, the judge has to consider whether each parent is affirming of their child's gender identity. critics say it opens the door to the possibility that a parent could be deemed unfit and potentially not be awarded custody if they choose not

toen -- to endorse their child's gender identity. the bill was written and approved by the california state assembly and the senate judiciary committee advanced it to the floor. democratic assemblywomen lori wilson co-wrote the bill. she is the mother of a transgender child and trying to downplay any controversy by insisting gender affirmation is just one of a myriad of factors when considering child custody. >> we should be affirming our children at every possible way and getting them whatever appropriate care they need, whether it is based on their gender, whether it is based on how their studies are in school. it doesn't matter. our children should be affirmed and this is saying you have to include gender affirmation as a part of that. >> at the state capital here in california, there are a lot of fired up protesters and parents today speaking out very much against these gender affirming bills. >> thank you for that, matt. and more on this story as we talk with one mom and attorney in california on what this could potentially mean for parents'

nice to see you. >> yeah, trace. this is an un-- un unbelievable story. it was 15 years they were looking for the rape suspect and they think they have their man. now outrage that the suspect will likely be free on bail. the corporate attorney has been charged with a string of rapes in the boston area that took place as far back as 2007, when he was likely a 19-year-old college student. he is now charged with raping three women after offering each one a ride home amount of fourth woman says she was attacked and sexually assaulted by him. the charges range from rape, kidnapping and assault and battery. after tphraoeding not -- after pleading not guilty last week, he is expected to post $500,000 bail. one of his accusers says she is fearful. >> you know, he could get away or he could do it to somebody else. it is just sad. >> the case had been cold until

new technology called investigative genetic genealogy proved quite fruitful. it compares the dna of a suspect with commercial genealogy databases. investigators were able to capture nilo's dna from utensils and drinking glasses he used at a corporate event. nilo's attorney says he will fight the case vigorously in court. he says, quote, it does appear the government obtained dna evidence from my client without a search warrant. the constitutionality of that action will certainly and most vigorously be challenged in court. now, nilo will have to wear a gps ankle monitor and surrender his passport, and of course he can have no contact with any of the victims or the witnesses. trace? >> anita, stand by. let's bring in the host of the new podcast, once upon a time in hollywood. we want to go over the counts, three counts, aggravated rape, two counts kidnapping and one

count assault with intent to rape. one of the victims said, quote, there it is on the screen, i waited so long to have my day in court with him, and now the fact that he is able to go back to his life and walk around for a year and he could get away and he could do it to somebody else, it is just sad. sad and kind of stunning. what are your thoughts on this? >> absolutely. first and foremost, my thoughts and prayers go out to these young women to go through something like this, so horrific and so horrible. when we look at it from a legal standpoint, we have to understand that a person in the law is innocent until they are proven guilty in the court system. he is out of jail right now. it was up to the judge to make a determination if he was a flight risk or not a flight risk. if he should stay in jail during the time before he goes to trial or should be out of jail. ultimately it will go to trial and the jury will come back based on the facts or evidence. >> they have to assess threat

level, right? >> absolutely. that's a good point as well. flight risk as well. they have taken away his passport from what i've heard, and shraoully -- absolutely that is one factor the judge considered. >> you were talking about the defense, the utensils and the defense will argue that. >> what is interesting the way they were able to obtain his dna. they followed him to a dinner and they took his drinking glass and his utensils and they got the dna that way. his attorney says that is unconstitutional. what do you think? >> that's an interesting argument. we have to look at how this first started. allegedly a family member did a 23 and me and did some dna testing as well. because of that dna testing he became a person of interest and they started surveillancing him, and allege -- allegedly he put some aou 10 -- utensils he didn't use, and he got rid of it.

therefore he had no longer any responsibility to do anything. it wasn't their fault forgetting those items. stkpwraoeu -- >> daniel penny could be indicted tomorrow and he said this yesterday. watch. >> some people said i was trying to choke him to death, but that's not true. i was trying to restrain him. there is a clear rise and fall of his chest indicating he was breathing. i was trying to keep him on the ground until the police came. i was praying the police would come and take the situation over >> a lot of talk and jordan neely was accused of -- was killed and penny charged with murder. >> that is based on the facts of the evidence and we'll have to see. he is of course inthat -- innocent until proven guilty. if he is indicted that's when under new york law, that's when the trial happens and he could potentially face three crimes.

ice cream. she scooped it out with her bare hands. the shop owner says it cost $24,000 in damages. >> my initial feeling that it was just a rollercoaster of erosion -- of emotions, anger and why would my own community do something like that? >> meantime in atlanta, police confronted a shooting suspect with a gun and told him repeatedly to put his hands in the air and get on the ground the suspect refused, so they tried to tase him. it didn't work. when the suspect turned his back, one officer saw his chance and body slammed him from behind. police took the gun away and the suspect into custody. coming up, a mom who is an attorney joins us live with more on this calf -- on this california bill that could result in parents losing custody of their kids if they fail to affirm their child's chosen gender. but first, nuggets fans took to the streets to celebrate last night's win, plus this woman didn't exactly pass her driver's

a saturday class in the fall. see, schools are out for summer, so noncompliance penalties get bumped to september. common sense says here is the thing, this was a math class. when did pride videos become mandatory viewing in a public high school math class? if a student hadn't videotaped the whole incident, would we know that pride videos were now mandatory viewing in math class? did common sense mention that in california public schools, test scores in math are at a three decade shilo certainly everyone has the right to produce, distribute and view political, social and cultural videos of their choice, but can you make those videos compulsory for 10th grade students? common sense thinks maybe math teachers should subtract activism from algebra. it may equal proficiency. and earlier we told you how parents involved in custody cases in california are concerned about a proposed bill they fear could label them as

abusive if they don't affirm their child's gender identity. let's bring in mom and attorney from california for good governance, laura powell. here is the california assemblywomen who was pushing this bill. listen to her and i'll get your response. >> it is not talking about medical issues in any relation. it is talking about what's in the best interest of the child. so this particular bill adds the very important factor that affirming a child's gender identity is in their best interest. >> lori d wilson is saying so parents don't know what is best for kids. kids know what is best. what do you think about this? >> those statements she made were really confusing. she talks about how you have to affirm a child no matter what. today at the hearing that was held she said by firm, she meant supportive.

she said you must tell the child if the child thinks i am a different gender you say that's true, and that's not something i think is good parenting. if you listen to the whole statement she talks about how she has a trans child who i believe is now an adult. clearly she thinks she handled it well and she knows how everyone else should parent. >> yeah. and that's the whole thing. she's saying, listen here, i did it and this is the way it should be handled. the bill doesn't specify the age of the child. we could be talking about 6 and 7-year-olds, and it gives affirmation the very same weight as physical abuse or neglect. >> yeah. she used the example of a 7-year-old, and we also heard today there was a rally at the capital, and there was a man i became acquainted with who is fighting for custody of his three-year-old and the mother has changed the child's name and refers to him as a girl and
