sources, the grand jury has voted to invite daniel penney, the marine veteran will now face trial for the choke hold death of jordan neely, 30-year-old homeless mentally ill man that witnesses say was threatening passengers aboard the new york city subway last month. we don't know the exact charges that he is being indicted on y yet, but he was facing a second-degree manslaughter charge. this grand jury had been hearing evidence and witness testimony on this case since may 31st. they weren't considering whether penney was guilty or not guilty, but rather whether there was enough legally sufficient evidence and reasonable cause to believe that a crime had been committed here. the bar for indictment is low, he only needed 12 of the 23 grand jurors to vote yes to indict, and they have, there will now be a trial. the manhattan district attorney alvin bragg said they believe there was enough evidence. witness interviews, photos, videos, in this case, to prove

that penny recklessly caused the death of neely by keeping him in the choke hold even after he stopped moving. which of the 11 days d.a.'s office to charge penny and the charge came only after days of protests in new york city come from activists who are testify s grand jury, which would have been a rare and bold move, but fox news learns that penny did not, in fact, testify to this grand jury. penny's attorneys did release video clips to the press a few days ago in which the marine veteran defends himself saying he and fellow passengers were scared of neely and he only meant to restrain, not kill, jordan neely. if he is found guilty in a trial, he faces up to 15 years in prison if, in fact, the charges second-degree manslaughter charge. >> dana: bryan llenas, thank you. just days ago, daniel penny was speaking out and defending his actions. when he claims neely was making threats.

>> the three main threats he repeated over and over was "i'm going to kill you," "i'm prepared to go to jail for life," and "i'm willing to die." we were all scared. mr. neely was yelling these passengers faces and they looked terrified. the reason why there is no video at the start of the altercation is people were too afraid getting away from him. >> dana: penny also saying the incident had nothing to do with race. >> some people say that this was about race, which is absolutely ridiculous. i didn't see a black man threatening passengers, i saw a man threatening passengers. a lot of whom were people of color. a man who helped restrain mr. neely was a person of color. and a few days after the incident, i read in the papers that a woman of color came out and called me a hero. i don't believe that i am a hero. but she was one of those people that i was trying to protect. >> dana: so this news just breaking. greg, to get indicted in alvin bragg new york, you have to try to stop a crime from

happening. >> greg: makes sense. by the way, penny is wrong, it is about race. that is what they are going to make it in the media about, race. i think the indictment is expected. this is a political case because we have politicized safety. the hard left has politicized safely fearful you can no longer defend yourself and no longer defend others because the person you are defending against his "homeless, mentally ill person." never mind he is also a violent, self-destructive felon who beat women and children. the spin will always be homeless, mentally ill, black man. and the only villains in these stories are going to be white. even though a black marine would have done the same thing as penny did because marines tend to do the right and the risky thing. and speaking of risk, we are really lucky that we will never have to be in this situation where we have to choose between saving the lives of others and a murder charge or a manslaughter

charge. but we should also be lucky that someone like daniel penny will be there because we are too check it or not to do what he does. people were grateful for his actions. one way to prevent this whole thing from other actions, alvin bragg should really think about this when he goes home at night may be locked up, maybe lock up in a prisoner in a hospital deranged felons, like the deceased. if you don't do that, then we need some sort of transparency. everyone who comes into contact with a person like that needs to know that. so if you are willing to let them out, these -- these wild, deranged people into the general population, then we have a right to know that, and that means if you want to give them the freedom, it should come with a blinking armband or a blinking ankle bracelet, right, because at least they are free vehicle that will suffice. a similar incident just happened this week and it is happening a lot, people trying to step in because you have brazen,

unstable individuals terrorizing people and the cops are either not there or their hands are literally metaphorically tied, once you take away the right to defend yourselves, after paralyzing the police, what do you expect? >> dana: i want to give credit for this phrase because it was not mine, paul morrow, who you have seen on the show before, all of the shows, he said, jesse, this is one of those cases where it's about class, not race, and it is the uber class versus the subway class. you have people do take the subway who know what it is like an have to deal with it every day, and so when this does goes to trial, if it does, the jury f his peers will be people who are made up of either a mix of those are probably more people who ride the subway daily and might be sympathetic. >> jesse: and the uber class used to be the subway class, but the subway is too dangerous, so now they are paying more to ride uber. >> dana: yep. >> jesse: they will probably erect a statue of neely. why not? he is a deranged, violent drug

push-ups every day, shave my head, put my life on the line, to defend all of these people, and this is the thanks he gets? he comes back and protects people the way he was doing in the marine corps and a slovenly prosecutor or political reasons tries to put this guy in prison. this is a miscarriage of justice if it goes down like this, and i hope everybody on the republican side makes that promise. >> dana: we don't have yet at least answers to a couple of things. i don't believe, jessica, we have seen the toxicology report of neely which might be good for everyone to see and it will come out with the jury, and also, penny had every incentive to fight this. his next court appearance is june 17, just a few days away. he could see time behind bars and this goes against him. you will see, perhaps, a landmark case in new york city. just because of the climate we are income of the crime situation we are in, and now, every once in a while, a case

like this comes around. >> jessica: there will certainly be a lot of interest in it and i think they set up to 15 years in prison, which is a really long time, but in defense of alvin bragg bringing charges and having to bring this to a grand jury, a man is dead. right? if this had been some sort of attack and jordan neely, when he was put into the recovery position, popped up and the cops came and they took him away, that would be one thing. but someone did die, and judge pierro, when we are talking about this, pointed that out, it obviously makes it more complicated to just go, daniel penny is a hero and walk away because there is one who is no longer alive as a result of that. whether his life is as meaningful to some people as a former marine, someone who served our country, i am not want to make that kind of judgment, this is someone who had a tragic life, we know what happened to his mother, chopped up and put in a bag, found on the side of a highway, it was in the top 50 most at risk list for homeless people.

had beaten up older women. so i happen to think, this goes to trial, when this goes to trial, they will rule in favor of daniel penny, that he did see a threat that he was protecting people and that it is a tragic mistake here, but you can't just ignore the fact that somebody died. and act like you should just put a metal on him and walk away. >> jesse: he didn't call himself a hero. >> greg: i'll call him a hero. >> katie: i would give daniel penny a medal if i was on that train. >> dana: there's one more thing. there were two people who assisted penny at the time. where they witnessed as the grand jury? are they going to be charged, as well? >> katie: we don't have the details of what the grand jury decided but we have not heard that they are also being charged as accessories to this situation. you know, jordan neely died as a

result of his behavior. he died because he was on the train threatening to kill people and people like daniel penny decided and the two others that they were not going to be the ones who were victims of that and they were not going to allow innocent women, possibly children, elderly people on that train to be victims of what he was threatening to do. and now he is being punished for it. and it is interesting to watch the argument play out and how the left sees heroes in jordan neely and giving people some kind of pass for this kind of violent behavior because they are mentally ill or had a tough life, and that is what alvin bragg thinks, that is how his whole criminal justice philosophy, that is what it is built on. versus daniel penny, who served his country, on a train, sees people being violently accosted with words and threats and decides to do something about it, and the thing that this will result in is more innocent victims of crimes because nobody wants to be charged with

do you think independent white voters when they hear the democratic president call them racist and call the country racist, do you think that turns them off? >> jessica: i don't think that is what he is doing. i think that acknowledging that there still exists systemic racism and challenges for black and brown people in this country doesn't make it that white people are bad. it is just we are a work in progress and there is still more work to be done and that is what they have been trying to emphasize. their agenda for black americans has had a lot of wins, we have right now the lowest black on employment, but lower than the levels when trump was there, i know that is what you are about to come back with, the highest level of -- it didn't even work. you are still talking somehow. highest level of black entrepreneurship in 26 years, investments in hbcus, 100 million for black small businesses. >> dana: why are the numbers down, then? >> jessica: approval versus intent to support is also very different. they are not being given another viable option. and donald trump did perform better than black voters than

any other republican. it looks like is on his way to be the nominee. we will see when his indictment trial comes into all of that. there is something really crucial that republicans keep doing that is a major turnoff to the black community, and that is insulting kamala harris. so, you don't take someone who is so meaningful to that community, and say that she is a diversity higher. >> jesse: weight. can i speak for the black community first? >> jessica: no. >> jesse: allow me the floor. >> greg: he is 1%. >> katie: no one is getting it to you. to be have johnny go out to the community two times a week and they do not support kamala harris. speaking very broadly there. >> jessica: if you have one of the highest achieving black women in the country, now made it to the vice presidency, and republicans and people who talk about her on air say she is a

attorney general of california with that community and what she has decided to do now. >> jessica: but she was rallied around -- go >> katie: it out the strategy by the bidee vice president to use juneteenth as not a moment where they can say, wow, we had this amazing reconciliation in the country, we have moved forward together, how can we capitalize on all of the gains we have had? and yet they use it as a way to divide people, to act like we have not gone forward in this country. the final thing is that she keeps talking about, in her speech, that freedom is under assault and that it is for racial purposes in states across the country. she is talking about border integrity laws, and as you mentioned, dana, in georgia, they passed one and claimed it would disenfranchise black voters. black turnout went through the roof, it didn't disenfranchise anybody and it took away stacey abrams campaign talking point because it didn't turn out the way she claimed it did.
