deadly confrontation on the subway. penny's lawyer said his client thought his life and others were in danger. >> the standard in new york city, you don't have to wait until someone physically attacks or is lying on the ground or worse. the standard is whether a reasonable person in my client's position would have feared eminent harm. >> ashley: penny spoke out earlier this week, watch this. >> the three main threats he repeated over and over, i'm going to kill you, i'm prepared to go to jail for life and i'm going to die. i looked around and saw women and children, he was yelling in their faces, saying threats, whole interaction, less than five minutes. people say i was trying to choke him to death, that is not true, i was trying to restrain him.

>> ashley: it is unclear when penny will appear in court. >> carley: bring in brian craigpool, what are your thoughts on this indictment and what are the chance daniel penny will get convicted? >> carley, great to be with you. i'm not surprised by the indictment, that is lower standard issue just reasonable cause penny committed a crime. the manhattan da has a hard haul ahead. it will be really difficult for him to secure conviction in this case for two big reasons. number one, we live in dangerous times. i'm in l.a. and we had one teenage girl killed by a homeless person. she was getting off a bus, i'm sure the same danger in new york city. jurors view homeless people in a different way, more dangerous

situation. penny's lawyer said, you can't wait until something to intervene. it will be hard for a conviction, daniel penny himself. you heard him speak. he'll be at forefront of this defense. he will testify and humanize what happened in the subway. he is very articulate, a former marine veteran and jurors will perceive him as a hero. >> todd: bigger picture, you eluded to it. what does this say about human instinct to defend yourself when attacked? to me, this is a grand jury and i understand only the prosecutor puts forward evidence in a grand jury. when you hear they indicted him, that sends a message, if you defend yourself or others, your life could be ruined. >> this case is bigger than jordan neely, this is public

safety interacting with mental health and the question we have to ask ourselves, are we going to intervene when we see a dangerous situation? how many times have we seen videotapes across the country of kids getting beaten up at school, kids getting assaultd and nobody jumps in to intervene to help. that is the question this jury will have to struggle with. penny jumped in. he didn't wait. you heard his comments. jordan neely say, i'm going to kill people, throws his coat off. he will argue, i had to jump in, i saw kids in the subway. >> carley: toxicology report has not been released publicly. do you think that information was made available to the grand jury? >> that's a great question. i was going to get to thattin po. i don't think it was made

available to the grand jury, usually takes 30 to 45 days for normal toxicology report to be processed. he died on may 1. what is in the toxicology report and i think penny's lawyers will argue causation. surprised they have not done independent autopsy. delirium happens when somebody passes adrugs. i'm not saying jordan neely was on drugs, if toxicology shows high level of drugs in his system, penny's lawyers could potentially argue might have been another cause of death, for example, a heart attack. see what is in there in terms of ligature marks and were bones

miami. he has very, very little power. he got elected by a total of $20,000 people. he does have the gift of gab trying to fool people in thinking he is the big city mayor. the big city mayor is the mayor of miami-dade county is a strong mayor and represents about 2.8 million people. >> do you view this as audition for v.p. >> is he not qualified to be v.p. is he not qualified to be anything. he is under -- right now he is under fbi investigation for doing some outside work with a developer. i mean, he has all kinds of trouble. and, again, he fools a lot of people into thinking that he is a lot bigger than what he really is. and, again, i wouldn't even waste my time with him. he is just -- he is a fraud in my estimation. >> carley: well, he filed the paperwork yesterday. he is going to be making that big speech later today. we will let the american people decide how they feel about the mayor of miami. in the meantime, i want to ask you about this attorney general merrick garland was asked yesterday about his role in the

trump indictment if he had any hand in indicting the former president on these 37 counts. not a lot of clarity in his answer. take a listen to what he had to say. >> so, as you know, i can't talk about particular -- particulars of this or any other ongoing criminal matter. as i said when i appointed mr. smith, did i so because it underscores justice department's department to oath, independence and accountability. >> carley: congressman, there is a special counsel but he answers to the attorney general so there are questions about impartiality here. >> there is no impartiality here. can you hear it in his voice is he a little nervous about answering the question. he obviously had a hand in the entire affair i'm sure joe biden the president of the united states had a hand in it too. this stinks to high heaven. all politically motivated. taking out your biggest rival.

the individual that is on track to become the flop knee of the opposing party. yeah, this doesn't -- this doesn't smell right. and i'm sure that mr. garland had a hand in this entire affair. >> todd: how can congress make sure that the biden special prosecutor acts with the same sense of urgency as the trump special prosecutor. >> we can't. you know, the justice department works for the president of the united states. and that's just the way it is. we have oversight but, look at what we are trying to do. trying to get that 1023 form from the fbi that said that joe biden took bribes from a burisma executive. it took, you know, heaven and trying to move heaven and earth try just to get a document that is unclassified. all right? and we can't even see it. so, look, they are stonewalling. all of the biden administration investigation. there is smoke pouring out of the white house. we need to get to the bottom of that. that's really where we need to
