new york city mayor eric adams confirming the news in a statement to the associated press saying, quote: i appreciate d.a. bragg conducting a thorough investigation into the death jordan neely. i have the utmost faith in the judicial process. now that the grand jury has indicted daniel penny a trial and justice can move forward. penny has been out on a $100,000 bond after initially being charged by manhattan prosecutors were second degree manslaughter in the chokehold death of jordan neely. in new york, second degree manslaughter is defined as a class c felony and could carry maximum of 15 years in prison. this decision comes weeks after the deadly confrontation on the new york city subway. penny's lawyer says his client thought neely posed an immediate and possibly deadly threat to everyone on that train car. >> the standard in new york state is not -- you don't have to wait until someone physically attacks. you don't have to wait until somebody is lying on the ground or worse. the standard is whether a

reasonable person in my client's position would have feared -- would have feared imminent harm. >> todd: another defense attorney poor penny steven rayner responding to the indictment with this statement saying quote: we're confident when a trial jury is tasked with weighing the evidence, they will find daniel penny's actions on that train were fully justified. penny himself spoke out about the indictment earlier this week. >> the three main threats that he preeted over and over was i'm going to kill you; i'm prepared to go jail for life; and i'm willing to die. i was scared for myself but i looked around he was yelling in their faces saying these threats, i couldn't sit still the whole interaction lasted less than five minutes. some people say i was trying to choke him to death which was also not true. i was trying to restrain him. >> still unclear when penny will next appear in court. back to you. >> steve: todd, thank you very much. you know, apparently, according to the new york daily news, this

grand jury was seated and started hearing witness testimony two weeks ago it is unclear whether mr. penny appeared before the grand jury. although it would make sense that he did not because his attorneys on monday put out the videos where he essentially made his defense. the big question. >> ainsley: they wouldn't answer that question. wouldn't say whether or not he appeared. >> steve: well, it's grand jury testimony. do you end want to still the beans. >> brian: i don't understand why he didn't say my guy went there. >> steve: that's why they put the videos out on monday because he was essentially able to say what he wanted the grand jury to hear. >> brian: that would mean that he didn't go then. >> steve: we don't know. it's unclear if he went. made public square look it wasn't 15 minutes. it was less than five. everybody on that train thought this guy was going to hurt us in a bad way. >> ainsley: grand juries usually indict. 99% of them do. the standard of proof it is very low. one side.

usually an indictment follows and that's why they say you can indict a ham sandwich. when you are on a subway train and you can't get out because it's in between stops and someone is yelling "i'm going to kill you. i'm prepared to go to jail for life. i'm willing to die." older women on the train. moms with children. this is understandable that a man who fought for our country industry a marine vet, is he young. he is 24. he went up behind the guy and held him in a chokehold and i understand how a man would do that to try to protect all the women on the train. are we sad that he died? yes. of course. you don't want anyone to die. but this guy, many might think he brought it on himself by doing that. what do you think going to happen someone is going to step in. >> brian: this happens every single day. get on a train ask for money. some polite, some demanding.

intimidating. it's all a degree of mental illness and drug abuse. for those people like gavin newsom brought up the other night we have a homeless situation because apartments are so high. it's hard to get a studio. it's not a money issue in 99% of these issues. this guy, if you look at his past, walked out of a mental institution that his family put him in because you can't keep someone in after a certain age against their will. so, he was given -- he was getting the care that he needed. but, when you decide because maybe you are mentally ill you don't want that care. and i know what it's like, too. for the family to use burden. you have this person in your family assaulting people, arrested 42 times. you try to get them the help they need. they don't have insurance. when you finally get them into the institution, they can say okay, i'm out of here. and now we're the ones who are the prey for the mentally ill. and he steps up to protect others and now is he going to pay the price. >> ainsley: the family after years and years of trying to help that family member, it's tough love at that point. you say you are on your own.

i have tried. you are ruining our family. >> steve: worn down. >> brian: they know that. they know that their sibling, their family member is a menace. they know he is a danger. they have known that he just recently assaulted a 67-year-old woman who just happened to be sitting on a subway. and they disingenuously hire a lawyer and make danny penny the bad guy and fuel racial hatred in a country where race plays no role. so that i do not excuse the family for. they are looking to cash in. >> ainsley: lady on the train we interviewed. she is african-american. she said i told the cops. i stayed after and i said i witnessed what this man was doing and i think that penny is a hero. >> steve: the new york daily news says according to the new york police department source, five passengers on that train at the time called 911 saying neely was making threats to incorrectly reported he had a knife or a gun but, nonetheless, they had to get some help down there. and that ultimately is the problem. there's not enough e of the

laws. wasn't that long ago you could ride a subway in peace but you can't anymore. what will the daniel penny defense team have to do at trial. brian sat down with lexy rigden and she said this about what lies ahead. >> ripping off his jacket saying he is going to kill people. the more people who testify for daniel penny in the trial who say i was terrified. he simed like a threat and probably i'm thankful that daniel penny stepped in the better it will be for him. indictments as we have been seeing when all the high profile indictments you can indict a ham sandwich. i'm not surprised he was indicted. the standard is very low. simply reasonable cause to believe a crime was committed. 12 out of 16 or 23 people. the jury is going need to be than news to convict him. >> steve: prosecutors have to try to convince the jury that mr. penny new by using that chokehold he was going to kill

[laughter] >> ainsley: you think? >> steve: keep in mind, it was last september, 33 republican senators asked merrick garland to elevate the u.s. attorney for delaware by the name david weiss to special counsel. of course he has been involved in this hunter biden thing for five years and, of course, last september, they passed on that. so they are not going to do anything. >> ainsley: there is so much here. so much has come out. ukraine. he goes to ukraine, the president does when he was vice president. evidence threatens to withhold a billion dollars in u.s. aid if the country doesn't fire that top prosecutor who was investigating burisma's owner while his son was sitting on the burisma board and then three days later there is a christmas party and hunter and the rosemont seneca executives are there at the party. how do you get away with all of this?

an institution and the department of justice, the two heads need to look the american people in the eye in front of god and country and tell them the truth. and until that happens, this isn't going away. >> brian: people are not going to settle for not knowing. >> steve: unless as we have heard for decades we're in the middle of an investigation. he was talking about the current attorney general. but the past attorney general, bill barr was on with bret baier last night. and he had -- he was talking -- bret asked him about that 10:23 form. and bill barr said, you know, i was attorney general at the time. he said i sent it out to three u.s. attorneys' offices who briefed them on the information. and he said it's been four and a half years. it's stunning. but, he said, to be fair to the office, current one, if you have a money laundering scheme involving foreign banks and bank places like china and ukraine, then it's going to take a long time to sort it out. but he didn't know what was happening, he said. but he kind of tipped his hand,

it sounds like they are looking into money laundering which takes a long time, which could be the explanation. if the doj is going to indict hunter biden or members of the wind family, the sooner they do it the better. a lot of people are thinking there is a two tiered system of justice. >> ainsley: he admitted to firing that top prosecutor in ukraine. and then they are alleging that he said i'll withhold a billion of u.s. tax dollars from your country if you don't fire this guy? then this next allegation you give me $5 million in exchange for policy. >> brian: right, so we have to see that and also where the tapes are. if there are tapes. they very well could be in ukraine. if they are in ukraine, they're going to be really tough to get out. rudy giuliani, i believe, tried that it didn't go well. ended up in impeachment. >> steve: james comer was asked on another channel about the tapes. the allegation of tapes. and he was asked when can you confirm that the recordings are legitimate? and he said, james comer said "i

maybe the most troubling stat youth homicides more than doubled during johnson's first month in office with the bloodiest memorial day in the city has seen in seven years. 53 shot. 12 killed. so what does the mayor have to do to say about this? it could be summed up in four words. stop talking about us. our next guest pushing for the opposite. he lived on a chicago roof for nearly a year to highlight violence gripping his once great city. project hood, founder and executive director corey brooks joins us now. pastor, you have a new mayor who wants to be left alone. is that the right approach? >> i have been saying through the rahm emanuel administration and lori lightfoot and now mayor johnson the right approach is we need to talk about it. it needs to be discussed. nothing we should be saying it's in our house and keep it between us. no we need to discuss. this colleague is one of the greatest cities in the world so the issue of violence is very important, what we need do is make sure that we have a

theories about governing, then when they actually get the job and see the theories go bust they change. any sense that this mayor will come off his theories? >> well, you know, it remains to be seen. it's early in the administration. so we still have some time. the summer is going to be a telltale sign of what is bound to happen because normally in chicago, the violence is crime goes up that's why it's important for organizations like ours project hood do what we can and not depend on government. we are depending on government to solve our problems. we need project hood at the grassroots dealing with the crime every single day. at the end ever the summer come back and ask me that same question. >> brian: pastor, these young men and women need something to do. evidently little to do boys and girls club. recreational activities. anything put in place to give them alternative to gang activity? >> we are building a $35 million community center. to say a lot people that may seem like a lot.
