something like this where the weather literally goes from 85 degrees to 71 immediately and then clouds are rolling in like a steam engine and next thing you know 20 minutes later it was like baseball size hail falling from the sky. >> a crazy day for sure. it has been rough. >> dana: the dangerous weather was not limited to the southeast. take a look at this. >> bill: lightening crack wood bridge, new jersey. lightening striking a man working on a soccer field. a police officer saved the man's life. >> dana: severe weather stretching from wichita to orlando. 20 million people in harm's way. the story is not going anywhere. neither are we. we'll keep you updated throughout the morning. there is a major update in the

daniel penny case. a grand jury indicted the marine on one charge of second degree manslaughter. whether neely posed a threat to the safety of other passengers and if penny used excessive force to subdue him. >> good morning. a grand jury deciding there is sufficient evidence to move forward with charging daniel penny. the 24-year-old will head to trial facing the prospect of up to 15 years behind bars if found guilty. the marine veteran is accused of recklessly causing the death of 30-year-old jordan neely after penny held him in a choke hold on may one. penny says he put neely in a choke hold after he made violent threats to passengers on board the train that scared everyone. penny says he was acting in self-defense and tried to restrain neely until police arrived. penny's attorneys say they will

aggressively defend their client and confident a trial jury will find his actions justified. >> the standard is whether a reasonable person in my client's position would have feared -- would have feared imminent harm, and the reality is, that it wasn't just my client who expresses how terrified he was by jordan neely's actions on the subway train that afternoon. >> neely was mentally ill on the city's top 50 list of homeless people at risk and a criminal rap sheet 42 arrests long including four charges of punching people. his tragic story is emblematic of larger safety issues on new york subways. tuesday night a man harassing passengers on a subway train punched a woman. her boyfriend stabbed the alleged harassing who died from the wounds. the boyfriend has been arrested and charged with manslaughter.

his attorney is telling fox news, telling us this morning that he believes this is a clear case of self-defense and comparing it to the daniel penny case. we'll follow that. >> bill: seems to happen every week at a minimum. bring in jonna spilbor here. the mayor came out with a statement moments ago. i appreciate d.a. bragg conducting a thorough investigation in the death of jordan neely. when the d.a. first brought charges i have faith in the judicial process now the grand jury indicted daniel penny a trial and justice can move forward. for you, jonna, what is the question at hand? >> well, the ultimate question is going to be whether this -- daniel penny's crime was justified. did he have a reasonable belief he was in imminent threat of harm and did he use reasonable force. that is the ultimate question that's going to be put to the jury. i am looking at this indictment,

bill, as a silver lining. why? because this case is now going to be brought before the spotlight for a much longer period of time, which is going to give his defense team and others like us in the media a real chance to look at a couple of things. number one, what is the right of self-defense in new york? the justification. when does it kick in? why does it kick in? number two, how did we get here the light needs to be shown on untreated mental illness and why it was -- jordan neely was allowed to be on a top 50 watch list, code for he is a dangerous guy, and nobody does anything with it. what do you do with the list? if somebody is on a top ten most wanted list criminally people look for the person to get them off the street. jordan neely is on a top 50 mental illness list and people

are waiting to add more people to the list? we need to shine a light on all of this and we have an opportunity to do that in the defense of daniel penny. >> dana: also this case is going to get a lot of media attention. last night the headline caught our eye on yahoo, ex-marine indicted in death of jackson impersonator. that's one way to look at it but not full and how much will it matter the media attention on this case? there will be a ton of it. >> i think it is going to matter a lot for that reason. one of the things that came to light, i'm not sure if daniel penny testified in front of the grand jury. i will bet he didn't. the report was he held neely in a choke hold for 15 minutes. that was worrisome from a legal perspective. that could be deemed unreasonable. but we now know from the defendant's own mouth that's not the case. it was five minutes.

we also know that neely was threatening to kill people. when you talk about whether an action is reasonable, if someone is threatening to kill you, you are justified in using deadly force. penny will claim he didn't intend to use deadly force but would have been justified had he in the face of someone making threats and acting as if they can kill you. you don't need a weapon to be deadly. that's not the issue. the fact that he wasn't armed should have nothing to do with whether the right of self-defense kicked in here. >> bill: this is a story that will capture the imagination of the country when it goes to trial and speak to a lot of things a lot of people are talking about in america today. more on that later. a case in pennsylvania, a woman accused of goading her boyfriend into suicide. she is 35 years old. westmoreland county, her attorney says i do not see it fitting a criminal charge such as aiding a suicide.

there is no coercion, or methods or means. can you explain the estranged boyfriend and what this case is all about and what it might oleate patly mean? >> this is a very, very sad case. the defendant here is actually a horrible person but the issue is going to be is what she did illegal? it's actually what she did was send texts to her -- the father of her child. they were horrible texts, harassing and mean. as a result, he ended up killing himself. but the statute in pennsylvania regarding assisted suicide doesn't fit. it is a square peg in a round hole. it is geared toward a doctor situation where this is not. this is like the michelle carter case where she was convicted of manslaughter when she was texting her boyfriend and

encouraging him to commit suicide in a car in a parking lot and he actually did. while what she did in this case is harassing and horrific, i doubt it will rise to the level of assisted suicide. >> bill: state law in pennsylvania says a person may be convicted of criminal homicide for causing another to die by suicide only if it by force, duress or deception. >> dana: get to chicago where they're struggling to find shelters for thousands of incoming migrants seeking asylum in the sanctuary city there. many are sleeping in police stations, shuttered ymca and abandoned schools. the migrants were bused into their neighborhood with no warning at all. mike tobin reports from chicago. >> during this immigration chaos more than 10,000 men, women and children come to chicago.

of them, half are still homeless sleeping in shelters or police districts. the fed has sent money, the state has allocated money. city council approved $51 million to aid the migrants. no one really knows where that money has gone. they just know it is a big mess. bused up from texas with no place to stay. this is one of the people sleeping at a police district in chicago. he says he was told there were no jobs in los angeles and it was easier to go to chicago. with police districts overflowing the city has moved some 4500 to new shelters around the city. cardona lives there and the city dropped off migrants. neighbors got no warning. >> they kept it secret on purpose. the only reason they spoke up on it then we had the news media here. >> city council approved 51 million to help migrants.

locals wanted it to help violence. >> in order to build rehab facilities because chicago is a narco town. >> others are raising money for the new arrivals. >> they are here, helpless and they're human. so i just think it is not only the christian thing to do but the human thing to do. >> this is not just a chicago problem. we have fresh video of bus loads of migrants arriving in los angeles. sent to d.c., new york, philadelphia and reports of moldy food, crowded rooms and cold showers. one venezuelan in chicago said he found work but can't get an apartment because he is undocumented. back to you. >> dana: thanks for the update. >> bill: there is affirmative action, immigration, student loan forgiveness on the docket awaiting major supreme court rulings that could come down soon. >> dana: look at this. the gop field is growing yet again.

i do think we have some very good debate criteria that you have to be at least 1% in three national polls and also have to have 40,000 small dollar donations. i do think it will be a hurdle for some challengers. >> dana: is 1% easy to do? >> i don't think it is that easy to do with some of these folks who don't have national name. d. it will be a challenge for them before august. >> dana: won't be a challenge for hemmer as he announces 11:50 today. we'll do a fox news alert on that. this is what the dnc said about francis suarez, as the field keeps growing there is not a dime worth of difference between these extreme self-serving candidates. what about the range of diversity? >> we have such a great field from mayors, to governors, to former presidents and former vpt. what are we talking about? we are talking about a nation in decline right now.

we have inflation, high gas prices. i filled up today. the prices at the pump are sneaking back up. a border that's open, a crime crisis, a fentanyl crisis, kids dealing with massive deficits coming out of the pandemic and most americans feel like joe biden is failing them. so republicans are getting on the stage -- they will get on the debate stage and contrast what we put forward as our vision for america. the much brighter future for many americans than what they're seeing right now. >> dana: the recent quinnipiac poll. donald trump is strong and far ahead at 53%. desantis 23 and the rest you can see. i wanted to show you this. this is what is most important to registered voters. economy and preserving democracy, then abortion. then you look at amongst republicans economy, preserving democracy and immigration. and then amongst independents

the crucial group to swing the election. economy, preserving democracy and abortion. president trump's indictment has taken up all the oxygen in the last week or so. these candidates are having a hard time how to get in the news talking a lot about political correctness and woke culture. not hitting amongst the group we just talked about. primary voters but not overall. do you think the republicans are in a good position to deal with the primary that will be nasty no doubt and to come out the other side and be able to talk to general election voters in order to win? >> i think a lot of these polls are also showing right track, wrong track. vast majority of americans feel like our country is not going under the right direction under joe biden. that's a critical point as you are going up against an incumbent president that is very unpopular. it is important to talk about the economy as people are hit so

hard by inflation and groceries and gas are up. people want to talk about pocketbook issues because it is harder to live every day under the biden administration. i do think they will be able to get on the primary stage, get through the nomination process and then be able to talk about the issues that the american people care about, which i think are reflected in the polls. >> dana: what's the respellings to your proposal last week that republicans need to bank every vote in early voting? >> it has been really strong. we have to bank votes early. we can't expect to make everything up on election day or every voter will be able to get to the polls on election day. there are always crises or things that can happen. we need to use that entire period of time. text to get involved in that. we can't let the democrats get a head start. rnc is leading the initiative and work with candidates and want every presidential candidate to adopt it as well. it will be critical for winning in 2024. >> dana: great to have you on

number one concern. it hits everybody. we all feel it. the federal reserve is trying to tamp down on inflation raising interest rates and may raise interest rates again in the future. i want to go back to a little blame here. why do we have rising interest rates and inflation at 4 to 5%? i blame the fed for printing far too much money right after the pandemic. we're talking trillions of dollars here. i also blame biden for spending so much money right after the pandemic. add it all together and we were spending and printing trillions of dollars and that's why we've got the inflation today, which is, as you say, the number one concern of investors and ordinary people out there. >> dana: stuart, what do you think about the way they communicated it yesterday? i know it's so important for the signals to the market. does it feel like they know what they're doing? or i'm sure they know what they're doing more than i do.

the communications seem to be a little strange. >> they've made a mistake. printing too much money and now they are playing catch-up and have to explain themselves. there is a whole cottage industry out there, dana, called fed watchers. there must be 10,000 people in the country employed solely to look at what the federal reserve is doing. you're right, they don't always have a clear picture of exactly what's coming down the pike. the same old story and like it for years and years. the fed watchers wait for the big day, we get the result, the market reacts and we go on as normal. that's how things are and they aren't going to change. >> bill: the white house from yesterday. big topic, if joe biden wants to get reelected the economy has to be sound. listen to this exchange runs 30 seconds. watch. >> does the white house have a reaction to the federal reserves decisions on interest rate hikes? >> as you know -- as you know,

we do not comment on the fed's actions. >> i will try one more time on the fed. is there concern the fed is -- inflation is still high and above that 2% target. >> i won't comment on that. the fed is independent. >> i don't have a question about the fed. >> happy to take one, though. the answer is pretty consistent. >> bill: dana used to have the job and says she is right in terms of not commenting. inside the federal reserve decision you seem to have a split as to really what future holds, stuart. that's what you were hitting on a moment ago. >> that's true. half the federal reserve board members, half of them want more rate hikes in the future, at least two. we got the pause now the month of june going into july, pause, no rate hike from the fed. after that when we come to

mid-summer, half the board wants more rate increases down the road. that's what has a lot of people worried. if we get another couple of rate increases later this year, and if we get increasing or continuing inflation, you've got a nasty picture looking at it. the white house doesn't want it because if you've got higher rates continuing inflation, you will have a slowing economy and that's the last thing the white house wants right before an election. i wouldn't want the job of white house spokesperson at this point. >> dana: those questions are easy. you have to learn 100 ways to say no comment on that question. on all the others i do wonder. >> bill: can we do this every day? >> if you're not careful. >> dana: great to have you. good to see you. >> thank you so much. >> dana reads sports. >> dana: bill, i want you to meet the washington commanders newest player, goldie.

that's some hospital robe. bet it closes in the back. >> bill: you're right about that. want to get to this story in california. there is concern as drug overdose deaths soar in that state. rick campbell is a police officer in oceanside near san diego for more than ten years. he warns the situation is dire and words can't describe the horrors he has seen. you wrote a piece in "newsweek" that got our attention. amazing points. we had governor newsom on with sean hannity talking about homelessness and a number of reasons was why. one was a housing shortage in california. i don't know if you necessarily disagree with that. but two points you make about drug use, rick. you say i believe we have a massive drug addiction crisis and no longer any tools to force anybody to change. what does that mean? >> so in 2000, california passed a proposition, prop 36 where we

decided that people who are arrested for things like meth, heroin and cocaine should have an opportunity to do treatment rather than go to prison. and it set up drug courts in california and they would facilitate that process. so if people were caught simple possession for meth, heroin or cocaine, they would be offered the option for treatment via drug court rather than going to prison but they had this felony charge hanging over their head. it was kind of like instead of all carrot begging people to stop using drugs and use treatment there was also kind of a stick there, which was necessary to motivate them hey, i don't want to go to prison for six months is what they would usually do here. and they could take the offer of treatment and then in 2014 we passed proposition 47 where all those felony charges for drugs

were reduced to miss demeanors and now police can simply write people a ticket. they can't book them into jail when they have drugs. in san diego county i have been told by my officers who are still in the oceanside police department, my friends, rather, that the district attorney in san diego county isn't even filing charges for things like possession of drugs or being high in public. so there is a huge problem. >> bill: the drug court may have looked good on paper but in practical use and reality it has been a failure. that's the case you are making. a lot of people look at the video and think how could a city find itself in a situation where the homeless crisis is just out of control? it is true all over california and portland and seattle. this is the line you use. you say most of people in those tents have what they want in

life, cheap, easy access to meth and freedom. how did you arrive at that? >> yeah. so i was trained to recognize people who are under the influence of various types of drugs and i spent years, over a decade arresting people for being under the influence and using these drugs. and then they would be drug tested and my instincts would be verified. when i drive around oceanside now i continually see people who are under the influence of primarily meth. heroin knocks them out but meth is still very prevalent here. i see them in these camps. there is some open air drug use going on near the hobby lobby and starbucks that we have here in oceanside. somebody was shot a couple weeks
