are they criminal? our legal panel will be here to debate it. we will kick things off with this fox news alert. >> sandra: a gruesome scandal unfolding at one of the country's top medical schools. fbi arresting six people for allegedly stealing donated body parts and selling them across the united states. >> this is positively macabre. among those charged, the former morgue manager at harvard medical school, turning it into a macabre marketplace for heads, brains, bones, even "silence of the lamb" style, skin, and leaving families wondering what may have happened to their loved ones. >> sandra: nate foy is following this, you've got our attention. how did investigators find out this was even going on? >> prosecutors say the group posted about it on social media.

more than that, labelled transactions on paypal with which body parts they were purchasing, like brains or head. for four years, they bought and sold stolen body parts donated for research. you see the former morgue manager, cedric lodge is accused of stealing body parts and driving them to his home in new hampshire where his wife, denise, is accused of selling them. prosecutors say this was one of their buyers, katrina, from salem, massachusetts, she runs a store called cat's creepy creations, dolls and bone art, and accused of visiting harvard medical school to select the body parts she wanted. >> the court documents said she went to the morgue to look at some of these. >> yeah, no comment on that. she's never been in trouble before and obviously this was very distressful, she wants to be home with her family. >> john and sandra, prosecutors

say she shipped human skin to this man of pennsylvania to turn that skin into leather. he separately accused of exchanging over $100,000 in online transactions with another defendant in the case. a statement from harvard reads in part, we are appalled to learn something so disturbing could happen on our campus. reported incidents are a betrayal of harvard medical school, and most importantly, each of the individuals who chose to will their bodies to advance medical education and research. now the u.s. attorney's office is still working to identify all the victims and then in turn tell the impacted families. the we'll send it back to you. >> sandra: all right, nate foy on that for us, thank you very much. >> john: goodness, goodness me. republicans taking the steps to begin the impeachment process against dhs secretary mayorkas, larry kudlow standing by to

weigh in on another biden cabinet member potentially in trouble. but first, we go to congressional correspondent aishah hasnie and how many potential targets are there here? >> hey, john, good afternoon to you. i think we are at about six now, that number could always grow, but so far house republicans have not quite landed on a single person to actually begin the impeachment process. but the most obvious choice we have been watching so far appears to be dhs secretary mayorkas. several house republicans have filed articles of impeachment against him and homeland security republicans as you saw yesterday launched that big official investigation, the results of which they will then send to the judiciary committee which will then apparently decide, make a final decision. representative lauren boebert has filed against president biden to take action on the

border, and going after biden and v.p. harris, filing articles against those two this week, not on the border, accusing the office to shield his family's business activities. and representative marjorie taylor greene even wider net, she thinks fbi director chris wray, attorney general merrick garland and u.s. attorney matthew graves should all be impeached as well. democrats think republicans don't have a single case here, they just think that republicans have impeachment fever. >> we need stronger border security, we need comprehensive immigration reform. these calls for impeachment are a -- >> senate republicans are kind of split about the whole matter. they want accountability, too, but any impeachment effort would most certainly die in a democrat-controlled senate. >> i think that one of the

advantages of doing impeachment, you get to have an investigation with it. >> i would be cautious about that. there are not the votes to remove president biden unless something new happens. >> graham making a fair point there. if there is an impeachment of secretary mayorkas, it probably would not happen until after august. more hearings. >> john: not a lot of time between now and then. >> sandra: a story maybe familiar to us by this point and involves a man by the name of john kerry. he won't reveal often he is using government jets. a watchdog group is filing a lawsuit against the faa saying the agency has stone walled records about pete buttigieg's travel. larry kudlow, needy say more, have at it.

you are fired up about that. >> they are stonewalling, we know that, and the freedom of information people say he has at least 18 private planes and he won't fess up. elaine chow who had that job in the trump administration took seven planes and she did fess up, which is very nice. buttigieg should be riding his bicycle across the country, his favorite thing. >> sandra: that's what he wants everybody else to do, elaine, and what the taxpayer on the hook for with the flights. >> seven flights, buttigieg, 18 flights, that's a minimal. and last night, president biden unleashed to the league of conservation voters, he wants a new railroad from the pacific to india. the pacific ocean crossing into the indian ocean. it's 8,000 miles, i did my homework. a google map on it. 8,000 miles and i think they should ride bicycles if they get it.

if you build this railroad it would have huge carbon emissions. you have to dig stuff out and bring in steel rails and they'll wreck everything. and the other thing is, biden told the league of conservation voters that the united states was the sole cause of carbon emissions. he said that the u.s. is the biggest emitter in the world. now, that is a lie. that is a pinocchio, bottomless pinocchio. you look at any chart on this subject, united states has the lowest carbon emissions of any of the major industrialized countries. that's point number two. the point number one. point number two, we have the largest reduction in carbon emissions of any major economy around the world over the last 20 years, ok. and number three, china and india and saudi arabia and

others are the largest emitters on the planet. so, why they would say that, i don't know. except they are obsessed with climate change and always factually incorrect. time and time again. and this is another example of this. so, you know what, i could be ok with the railroad if they could figure out how to do it, that's not the least of it. buttigieg, they are all hypocrites, john kerry flies in fancy private planes. >> sandra: he says his message is so important he has to fly the planes. pete buttigieg on the many times he's called to address climate change. >> going to be more frequent, more extreme events in our lifetimes, that means cleaner air every day and doing our part with the climate challenge. we changed the climate between 2010 and now, and not in a good way. so, yes, we can and must act to

>> sandra: border crisis showing no signs of stopping. greg abbott bussing migrants to a new sanctuary city, while chicago looks to find housing for thousands. john cornyn is standing by, but first mike tobin is live on the ground in chicago where the city has set up a makeshift shelter at an abandoned school. mike, how are residents reacting to all of this? >> well, they are certainly in the neighborhoods not entirely happy about it. but this is a nationwide problem. we have the flow of migrants across the border and have to go somewhere. the latest was dropped at union station in los angeles just like they have been dropped in new york, philadelphia, d.c., and here in chicago. now, the texas governor says border towns are overwhelmed by the migrants. as we see in chicago, big cities

are having trouble absorbing them as well. bussed up from texas, no place to stay, gonzalez is one of the people sleeping at a police district in chicago. he says he was told there were no jobs in los angeles, and it was easier to go to chicago. with police districts overflowing, the city has moved some 4500 to new shelters around the city, like woodlawn school in the troubled south shore. luis says neighbors got no warning. >> they kept it secret on purpose. the only reason they spoke up on it because then we had the news media here. >> city council approved $51 million to help migrants. locals wanted that money to combat poverty and violence. >> that money was to be routed into the communities. >> others are raising money for the new arrivals. >> they are here, they are helpless and they are human, and

so i just think it's not only christian thing to do, but the human thing to do. >> one city alderman tells me of the tens of millions city council approved, no one can really see how the money is being distributed. i talked to a venezuelan man sleeping at one of the police districts, he says he is staying there despite the fact he found work because he cannot get an apartment because he's undocumented. back to you. >> sandra: live from the windy city, john. >> john: texas senator john cornyn. your governor greg abbott is continuing to share the burden, sending the first bus to los angeles, a sharp reaction from mayor karen bass says it was a despicable stunt, he is using them as pawns, this did not catch us off guard nor will it intimidate us.

what's your take on this? >> i'm glad the mayor has finally gotten to paying attention to the problem. maybe she can pick up the phone and call president biden or his administration and get them to enforce the law which would stop the influx or at least mitigate the influx of millions of people across the border. this is something my state and local border communities have been putting up with alone for a long period of time. this is a federal responsibility, and these are cities that by and large advertise themselves as sanctuary cities, but apparently they don't really mean it. >> john: in fact, let's put a list up on the screen of the cities that the governor of texas has been sending illegal migrants to. washington, d.c., north carolina, chicago, philadelphia, denver, los angeles, sanctuary cities. but d.c., i think the point was to send them where the lawmakers are hanging out. here is what the mayor of one of those cities, chicago, said

about that. >> when we use human beings and put them on display to score a point, that is unconscionable and it's one of the most wicked forms of existence. >> john: brandon johnson, the new mayor of chicago. but what, senator, in your mind is the difference between governor abbott sending to cities across the nation, profess to be sanctuary cities and the federal government doing the same thing. >> there's no difference and you know, to me this -- there's a bigger scandal that overshadows all of this, and that is the 300,000 unaccompanied children that have come across the border, been escorted to sponsors in the interior and the biden administration can't even tell you where they are, what's happening to them, whether they have been trafficked for sex or involuntary labor or being abused or neglected. and this is part and parcel of the biden administration refusal

to enforce the law at the border and now they want to complain about the symptoms or the second or third order consequences of it. they are not willing to do anything about it. >> john: you are taking on the cost of higher education, introducing a series of bills, put them on the screen designed to lower the cost of tuition. rather than read through all of these, one of the big provisions here is that colleges have to be transparent in what the actual cost of loans will be to a student. how do you believe these plans could lower the cost of college? >> well, this is a better way to approach it than the biden administration, which is saying they are going to cancel student debt, even for people who can pay the money back as they agreed to, but put that on the back of taxpayers. but we don't believe the current system does help students understand what their financial responsibilities are, what the

sources of money may be to help them deal with the debt, and there needs to be responsibility on the part of the colleges themselves to counsel students when it comes to choosing their course of study so they know they can get a job in a field that will make them enough money to pay the loans back. and right now the cost of education, higher education, which we all support, of course, has gone up with the easy money offered by the federal government but that ultimately comes on the backs of the taxpayers. we think there's a better way to focus on personal responsibility, but there has to be some transparency and some responsibility on the part of the colleges and universities, too, when it comes to the course of studies these students pursue. >> john: at the same time that you are trying to attack the overall cost of college on the other side of the political aisle, bernie sanders and jayapal are reintroducing

legislation to make it free. comes off the back of taxpayers. bring the two sides together? >> when the supreme court rules on the biden overreach on forgiving student loans here in the next few weeks, my hope and expectation is that they will find that he exceeded his authority in doing that, and that act was invalid. maybe that will bring democrats back to the negotiating table where we can come up with some common sense ways to make college more affordable and accumulate less debt so individuals who are financially stressed can actually navigate the system. but right now what the president is offering is a purely political pitch to younger people saying i don't care what you agreed to, we are going to move this obligation over to the taxpayers. >> john: sure great if he could find a fair way to make college less expensive, parents and

wealth fund, they want to get involved in golf and better off together, so own roughly 20% of the new pga tour, i imagine some of the tour events will be different. a couple things they added. you can wear shorts, blast music, it's 54 holes. if you make the tournament, no cuts. i'm not sure what's going to be meshed in, but now all the players are not only playing the majors, looks like they will play the tour and jim, i guess you heard also that the saudis said we'll pay the other players some money that we paid the players to jump to liv. >> sandra: up on the screen, the times of london headline, saudis are set to compensate pga tour loyalists who turned down liv golf. you are talking about massive amounts of money and look at the amount of money the pga has beefed up their purses. jim, this is the democratic senators in the letter to ag garland, saying the liv deal would make a u.s. organization

mcelroy said he felt like a sacrificial lamb. at some point you have to cluf the labor in this, and the labor is confused. the people don't come out to see the organizing committee, they come out to see the guys or women shoot at the hole. and right now it's mass chaos. guys turned down hundreds of millions to stay loyal to the pga and the saudis say they will compensate them. but a wide gap between those who took the money and those who didn't and welcoming those back into the locker room, the guys will be fined and go in front of the board and have to have some kind of remuneration to come back and play the pga tour. it's a mess, nobody knows what's going on and anybody who says they do is lying. nobody knows what's going on. and if the 4 or 5 folks do know, they should share it with us.

let's bring in mark and bob. mark, to you first. this is a case where the district attorney says that she drove her ex-boyfriend to suicide, that she basically aided and abetted in the suicide. take a look at some text messages and we will, they certainly are heinous, but do they amount to a crime. >> when you take a look at them, and if it's true, i have no reason to doubt it, it is heinous is a perfect word, atrocious is a perfect word. if this were a civil case on the basis of his estate suing, i could see the liability there. i just have real hesitation as to whether you can attach criminal liability for manslaughter presumably here or some other type of felony crime because i think at a certain point there is -- the argument

is going to be that there could have been a number of circumstances of the fact that he was suicidal preexisting is something that arguably would break the chain. so, it's a tough, it's a tough case to look at. i certainly don't second guess the d.a. for bringing it. but i have my doubts as to whether there is criminal liability. >> john: we saw a photo of kevin metzger and his daughter on his back, he and roich had this child together and what she allegedly texted him in one of her texts. i hope for the child's sake that you do kill yourself. she would be better off not even knowing you. she also told him that she would have sex with her new boyfriend on mother's day "while your daughter calls him the new boyfriend daddy." bob, by -- bob, what do you say

about this? >> it comes down to the facts and the question becomes from a legal point of view, words are protected very strong under the first amendment. however, as we know you cannot yell fire in a movie theater and the courts have routinely, especially in the michelle rt caer case you may recall back in 2017, that went all the way to the massachusetts supreme court, they indicated that when you were incentivizing or cajoling somebody to commit suicide in a poor state, the harassing conduct could be considered involuntary manslaughter in terms of aiding and abetting a suicide. as you have indicated, there are horrible text messages here, probably the worst being i'm going to have my boyfriend call him daddy, and he kills himself two days before father's day. this is the kinds of conduct, i'm queasy to punish speech but

some does go over the line, and they believed it was extraordinarily harassing. >> john: we talk about the text messages, and sent her ex-boyfriend a video of her having sex with this other fella, and then this text, says go kill yourself, you aren't a real expletive human. anyone who sends a text like that is a horrible human being. but does it amount to a crime? her attorney says this, my god, if we prosecute people for sending harsh texts to one another versus verbally communicated -- so mark, if you are in a fight and scream things at each other, it's probably not prosecuteable. what's the difference in a text message? >> it's a good point he makes.

how many times at least growing up when you got angry with somebody, you heard somebody say go drop dead or i hope you kill yourself. there's got to be more, got to be context. i think what tilted towards prosecuting this case was they are going to show that she knew or had some knowledge that he was suicidal and that she intended to do this, and you have to show the causation element, you have to show the speech crossed the line. i have a real hesitation as to when you start going down that path when you are able to say ok, this speech, it just gets up to the line but this speech doesn't. it's a very, very precarious position to be in. >> john: and what the westmoreland district attorney said about this, mr. metzger may still be here today if those messages did not influence and encourage him to take his own life. there's no evidence of a preexisting condition here

mentally or that he was suicidal in what she says, bob, do you think that that would be key to this case, that if roich knew he had suicidal ideations and she was pushing him over the edge? >> yeah, absolutely. it's very, very important as to what her motive is. in this particular case it does not look good for her. she is literally telling him to commit suicide and then saying horrible things about not only her relationship with him, sending sex tapes over. and the biggest thing, i want you to kill yourself, your daughter will never see you again, somebody else will be calling daddy, she knew he was in an emotional state and that criminalizes the conduct. that took it over the line. >> john: well, it's -- it's a really stunning case here that we've got, and something we will keep watching. great to have two high powered attorneys like you two weighing in on this as well.
