tonight straight ahead. also congressman james comer with an update on the latest on the biden syndicate and the family business dealings. this is getting very interesting, the walls are beginning to close in on joe biden. we'll explain. but first, is biden in danger of losing the first two primaries, or the first caucus and the first primary in 2024? now, while he does hold a lead over the rest of the democratic field in national surveys despite a tougher than expected challenge from rfk jr. he is regularly now polling at 20, 21%. that's a real number. and marianne williamson is at 10%. that's a lot of democrats that don't like joe biden. new axios report saying the president is in danger of losing both iowa and new hampshire. now, this is self-inflicted after his team indicated he might not even appear on the ballot. biden wants the first primary to be in south carolina, obviously

to me a middle finger in the face of the first caucus state, iowa, the first primary state, new hampshire back in february with the help and the push from joe, the dnc capitulated, agreed to boot, you know, iowa, new hampshire, off the schedule to make room for south carolina as the first primary. now, remember, in 2020, how interesting, biden lost the iowa caucus and the new hampshire primary, both by pretty healthy margins, before securing the endorsement, very critical at the time, jim cliburn, powerful south carolina democrat and had a victory there, and now in typical biden fashion, he wants to rewrite the rules for his own benefit. ironically, he may have just cost himself victories in two very key states in the process opening the door for rfk jr. to get serious momentum and giving

growing concerns over his age and stamina and cognitive ability, the left may want to start looking for other candidates. look at this. according to a new axios focus group, this north carolina swing voters who backed biden in 2020, now they're saying his age is a serious issue, many saying that it may be too late for biden to ease their concerns and of course with joe's recent struggles and endless gaffes can you blame them. the 2-plus years joe has been in the white house have been characterized by one bizarre moment after another, constant struggling, constant gaffes. and during a dinner last night, well, he didn't exactly ease anybody's concern or worry. it was marked with the usual fights with the teleprompter. how do you fight with the teleprompter. half finished sentences and a rather ambitious infrastructure plan that made absolutely positively zero sense. take a look. you decide. >> billions of dollars in private sector investment even in districts, even in districts

that in fact you wouldn't expect. districts that are all over the map. it's already attracting that money, where members are, of congress, voted against the bill, we're still having it. i made a commitment. i said, like i said, to all my folks in the -- all americans in the state of the union address, i promise to be president for all the people. so i'll see them at the ground breaking all these folks, they call it the g7 billed back biden, build back better and we realized that got confusing so we don't call it that. what we call it is -- here's the bottom line, we're the ones that caused the problem, we have plans to build a railroad from the pacific across the indian ocean, plans to build in angola one of the largest solar plants in the world. i could go on but i won't i'm going off script i'm going to get in trouble.

closely. >> africa will have one billion people. >> our investments in africa, for example, there's going to be a billion people in africa very shortly. >> the global south, there are going to be a billion people in africa very shortly, one billion. >> sean: joey's very enthused about the prospect of africa's population reaching one billion people. we have one, one big problem. according to the un and their estimates, the population of africa at the beginning of 2021 was almost 1.4 billion. in fact, africa's population topped one billion all the way back in 2009 when joe became vice-president, a day i'm sure he does not remember. so with biden's endless struggles and growing questions about his age, stamina and cognitive abilities, why would he deny himself the chance to pick up delegates in iowa, new hampshire and is he now opening the door ever so slightly for

president of the united states, you are the de facto nominee. you think back to my remain for boss former president trump he was the president of the united states enormously popular one of the highest approval rating ever for a state president what did parties do, they canceled primaries saying we pledge our delegates to trump, he did not have a meaningful primary opponents, there were no debates because we had a de facto nominee. he's saying south carolina goes first and iowa and new hampshire saying not so fast. when has that happened when you have 52% of people saying we might not want you to be the nominee we don't want you to run that's a problem and we're seeing it play out. >> sean: i'll get into more detail with the desantis and newsome feud but clay raves, you look at joe biden, you see his cognitive abilities have deteriorated dramatically even in the short time he's been president, i can't think of a single policy that has benefited

the american people, economic, foreign policy, not one. so what is he going to run on? i've got to imagine that the chatter behind the scenes in the democratic party is loud. oh, i can't believe this guy is going to be our nominee. am i wrong? >> no, you're a hundred percent right and it led to that fantastic question that you asked of gavin newsome, which is, how many times are you getting contacted right now and being asked to run? right? everybody wants for someone else to run and gavin newsome, if he really wants to be president, i think should make the move right now. because, think about it, if biden wins or even if biden doesn't win, he's going to have to figure out a way to get past kamala harris without being racist and sexist as a white guy. if you a choice right now and you're advising gavin newsome, i think if he ran, sean, and kayleigh, i think he would be the nominee. i think he would smoke joe biden. i think he knows it. if he waits, maybe he doesn't

think they are prepping gavin newsome, we talked about this before, sean. one of the most disrespectful things i've ever seen, gavin newsome showed up to visit the white house while joe biden was in europe and did a press availability. he rolled up his sleeves and kicked his feet up on the resolute desk and he was ready to be president. i've never seen that happen before. >> sean: clay, the moment was when he took the jacket and he flung it right over his shoulder. >> that's right. >> sean: and walked right in like, oh, i think i like this place. all right good to see you kayleigh thank you and clay thank you as always. we appreciate it >> now we turn to the biden family shady syndicate business dealings. now last week we had the bombshell report claiming the fbi is in possession of a document that is known as a 1023 form. that is an allegation specifically billion criminal bribery, a scheme between then vice-president joe biden and a burisma energy executive influencing u.s. foreign policy decisions.

now, remember, burisma is the ukrainian oil and gas giant. that's the board at burisma that hired hunter biden. he sat on that board for years, got a ton of money despite no experience in ukraine or the energy sector. now, early this week, senator grassley announced that the executive alleging the bribery scheme has 17 separate recordings of conversations between him and the bidens, including two specifically with him and joe biden. now today biden was asked why he was referred to as, quote, the big guy in the fbi informant 1023 file on the alleged scheme. as per usual, no answers. he just scolded a reporter as a lying dog faced pony soldier or something. >> why did the ukrainian fbi informant refer you to as the "big guy"? >> why do you ask such a dumb question. >> sean: meanwhile house

oversight chairman james comer says new biden bank records will show that the biden family accepted anywhere between 20 and $30 million from foreign nationals. we're talking about over a dozen countries including russia, china, ukraine and kazakhstan. now, the issue by the way of joe, hunter, burisma, ukraine and bribery are once again front page news. i felt tonight would be the perfect time to revisit then vice-president joe biden, after his vice-presidency, bragging about his time as vice-president, about how he leveraged one billion of your u.s. tax dollars to get that ukrainian prosecutor, his name is victor shokin fired in six hours and ukraine responded and fired him within six hours who turns on it was looking into corruption issues not only at burisma but who burisma was paying and that would be hunter

biden, a massive amount of money. this is joe biden bragging about the whole incident. pay close attention. >> i had gotten a commitment from poroshenko and from yachts yout yuck that they would take action against a prosecutor and they didn't and i was walking out and said we're not going to give you the billion dollars. they said you have no authority, you're not the president. the president said. i said call him. i said i'm telling you you're not getting the billion dollar. you're not getting the billion and i'm leaving, i looked, i'm leaving in six hours. if the prosecutor's not fired you're not getting the money. well son of a [bleep], he got fired and they put in place someone who was solid. >> sean: oh, solid. now, what was the result? hunter continues to get paid massive amounts of money after admitting -- remember, he did the worst interview a 50-year-old man ever did by going on good morning america and admitting he had no

experience in energy, oil, gas, coal or ukraine. take a look at this interview. what a disaster. >> there's been a lot of misinformation about me, not about my dad. nobody buys that. but buys this idea i was unqualified to be on the board. >> what were your qualifications to be on the board of burisma. >> i was vice chair of amtrak, i was chairman of the un world food program. i was a lawyer for one of the most prestigious law firms in the world. >> you didn't have any extensive knowledge about natural gas or ukraine itself, though. >> no, but i think that i had as much knowledge as anybody else that was on the board if not more. >> in the list you gave me the reasons why you're on the board you did not list you were the son of the vice-president. >> of course. >> what role do you think that played. >> i think it is impossible for me to be on any of the boards i just mentioned without saying i'm the son of the

vice-president of the united states. >> if your last name was not biden do you think you would be asked to be on the board of burisma. >> i don't know, i don't know. probably not. i don't think there's a lot of things that would have happened if my last name wasn't biden. >> sean: now the big question, because we're asking questions now about whether or not joe biden was bribed when he was the vice-president. so, now that joe biden was using his position as vice-president, your one billion tax dollars to shake down ukraine to keep paying his zero experience son a fortune, well, i ask, is that a quid pro quo? what did hunter biden possibly do to deserve all of that money? is this influence peddling? is it possibly something one might describe as a bribe even? house oversight committee chairman james comer joins us now with more. when they were going after to impeach donald trump over a phone call where he basically is saying, now i expect you to be more responsible with taxpayer money, et cetera. okay, we that tape of joe biden then, we played it. we had the tints view with hunter biden. nobody paid attention. how would you describe joe biden leveraging a billion dollars to get a prosecutor in ukraine fired, and his son continues to get paid, how would you describe that? what words would you use? what adjectives? >> it's unimaginable. i can't think of a worse thing that a president in history has done. this is a president who has a history of using foreign aid and leveraging for his family's benefit. look at that form 1023 sean. it dated back to 2017. it said that the oligarch paid joe biden a bribe of $5 million. he called joe biden the big guy.

and he said that investigators would have an impossible job of ever tracking that money down because they were going to launder it through various different banks and shell companies. that's exactly what we've proven on the house oversight committee. and then you have the tape that you just played from 2017 where joe biden admitted to leveraging foreign aid tax dollars. so the fbi knew this all along yet they never investigated this one time. thankfully now the house oversight committee is. >> sean: let me stay focused on the first incident then we're going to bring it up to where you are in your investigation. okay, joe biden leverages the billion, he gets a prosecutor fired, used our money to do it, and his son continues to get paid. his son had no experience. he's getting paid a lot of money. and my question is, is that a vice-president of the united states of america taking specific actions for the financial benefit of his family? because that's what it seems like to me.

otherwise, why would any vice-president give a rip about a prosecutor in ukraine? they wouldn't care about it, would they? >> no. >> sean: what? >> i think it is, sean. and you look back, why did joe biden volunteer, during the end of the obama administration, to fly around and hand out foreign aid checks? and to talk about foreign policy? look, we tracked down the money in romania, less than two weeks after joe biden left romania in air force two his family started getting wires through shell companies that were launder back down to bidens, less than two weeks after he left romania for foreign aid. so everything we found in romania is consistent with what this fbi 1023 form alleges that the fbi had. >> sean: okay. now, and you estimate that nine biden family members were beneficiaries including grandchildren being funneled

money through these shell corporations, fake llcs. let me ask you about that. you say about between 20 and $30 million between foreign nationals, is that true and what do we know about 17 tapes, do we have them? do you know who has them. >> well, with the money, first of all, we've already tracked down a little over $10 million. we're pretty confident, from other sources, that that number will grow to beyond 20 million and it could be more if you factor in the president's brother who dealt mainly in the middle east. we haven't even gotten to him yet. with respect to the tapes, look, it mentioned in the fbi form that the oligarch had 17 tapes of biden, two with joe biden accepting the bribe, that he used that as an insurance policy. >> sean: this oligarch was a high-ranking member or owner of burisma? >> yes, that is exactly right. >> sean: have you had any contact with him? >> unfortunately, nobody's had any contact with him for the

last three years. you know, the msnbc makes fun of me when i said that there are a lot of people that were involved in the biden shenanigans that rb currently missing. but with respect to this oligarch, we think we know where he is, he just hasn't been seen in public in a long time. but we're following the money. we've subpoenaed bank records last week that are coming in as we speak that we're hopeful that will show some more signs of some influence peddling in countries including ukraine. this is what the biden family has done and they've never been investigated seriously until the house oversight committee became a republican majority and we received a gavel in january. >> sean: i believe the tape of joe biden we played and the tape of hunter proves that that was influence peddling. i think that in and of itself. congressman comer, thank you >> coming up, the feud between ron desantis and gavin newsome

♪ >> sean: california governor gavin newsome refused to answer my question last week about how many people are asking him to run against joe biden in the primary, and how many times a day his phone it getting pinged saying gavin you've got to run. that tells me the answer is likely a lot but governor newsome did go after governor ron desantis. during the sit-down i offered to host a two-hour debate between the two governors and i hope that happens.

[inaudible]. >> you know, it's interesting. he's got huge problems in his state. i mean like huge problems in his state. we all know that. he has a real serious fixation on the state of florida. i mean i think it's just bizarre that he does that. but i would tell him is, you know what? stop pussy footing around. are you going to -- are you going to throw your hat in the ring and challenge joe? are you going to get in and do it or are you just going to sit on the sidelines and chirp? so why don't you throw your hat in the ring and then we'll go ahead and talk about what's happening. >> sean: i really want to host that 2-hour debate. anyway meanwhile california as that continues, we have

disturbing new legislation, listen to this. it would now allow courts in the state of california to consider whether or not a parent acknowledges their child's, quote, preferred gender identity during custody cases. translation, if the state thinks you're not woke enough or you don't take their position or agree with them, you will be at risk of losing your child to another parent that would validate whatever the child identifies with, or, at a minimum, you will be at a distinct disadvantage for thinking differently than what the state is demanding. wow. here with reaction, she is the host of outnumbered, cohost emily compagno, fox news contributor tammy bruce. let me get this straight. you know, we have a lot of states no-fault divorce, you don't hold anybody accountable. so if you have a young child and says i want to identify as this sex or this sex, and if you're a

parent that says okay, i think you're a little young for this and maybe has a different position, that parent is now at a decided disadvantage for getting custody? >> that's right, and keep in mind too how this is being framed. the bill's author in part says no one is out to get your kids, no one is out to force your kids to be anything they shouldn't be, she says, it's about protecting children caught up in the family court system from a parent that is antagonistic or non-affirming. so listen to that language. what they are saying is that if you refuse to affirm this young child's whim of a decision or if that other combative parent uses it against you, you are all of a sudden considered antagonistic when you know it is about you protecting your child. so they're saying it's no big deal, they're saying it's one of many factors we also know the california court system absolutely hides behind these rules. it removes any discretion from the judge's chambers and enables them essentially to say, well,

my hands are tied so therefore you, parent, that refuses to play into this ridiculous craziness all of a sudden you've lost your child. so do not listen to them when they say it's not going to be weaponized because it absolutely will be. >> sean: this is scary tammy. what if people for religious beliefs, standing on their religious principles? is that a violation of freedom of religion? and in the idea that the state thinks or a teacher thinks, when they have a captive audience of young children, that their values should supersede the values of parents, mommy and daddy are not potted plants. they're actually the parent. their values should not be contradicted by a bauer crated or by a teacher. >> exactly [cheers and applause] >> and this is the -- never underestimate what the left is doing and that's exactly the point. this is the excuse. this is the alibi to continue to cleave children away from their parents. another bill making its way through california that would say that a minor is allowed to

get psychotherapy or therapy without the parents knowing. which means suddenly you've got agents at the state or people who are appointed, who are saying, of course, that they're better or they know or they should be the final decision for what's going on in your family. and why stop at this decision? why, if you're going to say that a minor can make this decision and should just, because the state says they should be believed, it opens the door, this unlocks the door to every other kind of personal decision including religious decisions that the state may determine is harmful to a child. so this is really a first step and it is so dramatic, people have got to realize, whatever the left says they mean it, and there is always a long-term framework when it comes to what it is they're doing. >> sean: why did joe biden say they're owl children, they're not your children, they're our -- no, they're not your children, they're my children, keep your values to myself, that's my job. teach them to read, write, do
