2:37 am
that's unreasonable. when that timeline goes down to maybe a minute or two or less, that is certainly something that becomes more favorable to mr. penny. >> now we are looking at being a defense attorney creating your defense was that a good idea for daniel penny to come out to the interview? >> absolutely not no criminal defense attorney in the world once the client to speak. i say there's a golden rule and that's not to get out in the court of public opinion. you say what information you have that the prosecutor is not entitled to get because the defendant has the right to remain silent every statement you make can now be used against you and i think he said some things that were not good for his defense so i don't think it's a good idea. never a good idea. always remain silent. >> this statement from the new york mayor adams, he said i appreciate the da conducting a thorough investigation into the

both of those men on the train. mr. penny should not have been put in that situation and mr. neely should have been in the hospital. he should have never been on that train threatening to kill people terrorizing innocent law-abiding taxpaying new yorkers on a train and mr. penny is white and mr. neely is black.[indiscernible] from the mayor, from al sharpton because it was a if it was a black on black crime, the passengers on that train. and he said we are going to. do you think that lawmakers will learn anything new that hasn't already been reported? >> probably not. i mean, it will be a chance -- look, it's going to be a pretty explosive hearing. the republicans are going to go after durham pretty hard. democrats will skate around the issue and try to deflect and move otherways to claim nothing happened. my biggest problem with this and this goes back to the time i was in congress as well. how do you claim as was just said a scathing report about the fbi but, yet, wrongdoing was done but nobody held accountable for it. the part that frustrates americans on so many levels that the fbi seems to continually take care of its own. this will be one of the big things you will hear in this hearing. >> joe: for americans sitting at home who don't fully understand how congress works and how it works with the judicial branch when we talk about accountability from, my understanding, all the way down to possibly the hillary clinton actually paid for this original dossier a how do you follow
2:57 am
that? where does the accountability come from and what are the efforts of the house? how does that play into accountability happening? >> well, i think the biggest thing, joey, we could spend the next two hours discussing the things talking about with hillary clinton, james comey, you know, strzok, page, mccabe. it's all there. mccabe is one who was actually fired by the fbi for doing the things durham basically talked about lying and withholding information and cnn hires him. it's like, you know, this is just a problem. what the house can do is bring out other questions and see if durham will say well, why didn't you charge here? why was there not? again, some of that will be maybe new information. a lot of it will be regurgitated information we have already seen in the report. is he very good probably at sticking straight to the report. but what it will do is, again, highlight this issue. one of where the real accountability will come is if the house takes action through the budgetary process or something else to actually affect change at the fbi. i think that's what's got to
