penny -- do you think danny penny saw black and white when he was sticking up for people on subway train? >> i don't think danny penny saw through the lens of black and white. he saw a citizen being accosted. not only mr. penny, but you had other people in that subway car that assisted in holding down jordan neely for the protection of those common citizens. and it begs the question of where is the social contract affording us the protections we should have as common citizens. >> brian: now dead 36-year-old career criminal devictor, 36 years old, this happened on the one train. so, darren, you are highly skilled law enforcement official. you are on a subway. you have seen these two cases. something happens today. and people watching right now see a crime taking place, someone being abused. are they better off walking away or helping out, judging what these two men who did the right thing in my view did?
