you move on. think of other classified documents cases. that's what those guys did. people in high positions of power who said fine, you got me. i took the documents. here you go, misdemeanor. president trump is trying a different tactic and his first trial date august 14, 2023. buckle up for the summer. >> bill: let's get to the headlines as we approach 10:00 eastern time on this bullsy tuesday morning. >> dana: welcome to a new hour of "america's newsroom," here we go. i'm dana perino. >> bill: i'm bill hemmer. nice to see you, partner. we're joined by jonathan turley and bret baier with us now. bret, let's go to you. fox news can now confirm that hunter biden has reached a plea deal with federal prosecutors on two minor tax crimes and admits to a gun charge that will likely keep him out of jails with court papers filed today. bret, your initial comment reacting to this.

a story we followed for years it comes to what appears to be a conclusion at least on these two stories. >> on these two. good morning. i think you're right, that this really was not that big of a surprise. there were a lot of people who predicted that this may happen specifically on the tax charges and the gun possession charge. and that charge essentially goes away being diverted, the gun charge. the two misdemeanors he will plead guilty to. this does not stop the investigation into what else is there and the alleged bribery scheme the house republicans are going after pretty intently. i do think that this is another step in the road but one that was predicted and obviously it goes to the president saying he has faith in his son, he never believed he did anything wrong but you heard in that statement

from the white house they love him and he is essentially they want to move on. >> dana: they want to move on. can they move on will be the question. if the justice department has basically closed this and then you have congressional republicans moving forward and additional evidence comes to bear there will be that. unresolved question, bret, will be where did he get the money that led to the tax violation? and that gets to the question of influence peddling of which the republicans would need to be able to put forward evidence to make sure that's clear. maybe that evidence will exist and come forward. but the justice department, will that be over now? >> i think you have a lot of questions here and what does this mean for the delaware -- the u.s. attorney in delaware? what does it mean for this congressional investigation? republicans are not stopping. they have a lot of different evidence about bank deposits and they're following the money and

they continue to brief us and others about what exactly they are finding. and it is leading to something but it is taking time. think about this, this has been 5 1/2 years that we've been talking about these particular charges. so this is not the end. it may be just the beginning depending how legally this all goes. >> bill: on another matter here, a lot to follow. i wish we had a flow chart now. you have john durham on the hill today. he will be in private testimony. tomorrow we'll see him on the hill in public testimony. let's see where the questioning goes. there are a lot of claims about what durham found in his report. meanwhile another story that broke an hour ago donald trump has a court date. like that. august 14th, that's a monday, which by my count is nine days prior to the fox news debate in milwaukee, wisconsin. that case is moving quickly and

they will line up like planes on the runway at laguardia on a friday afternoon. also in august you could have the d.a. in fulton county, georgia, come out with her findings from the grand jury that was seated months ago. remember they've reached a conclusion. she said i will tell you about it when i'm ready and suggested late summer would be the date she would do that. yeah, again these cases are going to stack up against the former president quickly. >> yeah, just talking to him yesterday he is as defiant as he has ever been and believes this is all a political witch hunt. we went down the road of his talk about handling classified materials and what that means. i'm not sure his lawyers, after all of that, are happy that he went down talking about that -- those specifics. but he calls all of it a witch hunt and says he is going to fight it all. i don't know whether he will be on the debate stage in milwaukee but he will have a bunch of

things to deal with at the same time. >> dana: you had a remarkable interview with him last night. you covered a lot. more to come tonight? >> there is, another really significant chunk and full of news. we talk about covid, we talk about his opponents, including his focus on governor ron desantis, we talk about the economy, debt, and how he feels about things and how his family is dealing with all of this as well. >> dana: you also asked him about independent voters, women in the suburbs. we have that. let's play that and get you to explain what you think happened here. we don't have it, okay. it's a very good question, though. a very interesting answer. basically female independent voters who struggled with family finances and dealt with inflation, they feel unsettled and don't necessarily want biden to run for office again. they didn't vote for trump in 2020. what would president trump do

differently in 2024? >> you know, i thought that was a pretty straight forward question and i was trying to get to his thought process to a very vulnerable part of his voter bloc. he would have a tough time in a general election with that particular block and he went back to 2020 and the 2020 election saying he won the election and we had this back and forth on that that he didn't win the 2020 election. i thought it was an interesting answer. he thinks he is doing really well in the polls. but he does have a vulnerability on that particular issue. >> dana: i'm told the call is good. >> to the female independent voter in the suburbs. she is now against biden and disapproves of biden and wasn't with you in 2020 and so far a hard no for you in 2024. what do you say to that female

independent suburban voter who feels that way to win her back? >> first of all i won in 2020 by a lot, okay? let's get that straight. i won in 2020. if you look at >> that's not what -- are you going to go -- this is how you tell that independent suburban woman voter? >> i think we're winning very well. >> dana: he thinks he will win women voters. a lot to be seen between now and then. >> bill: i want to put a couple points what we're talking about there. a lot of plates in the air we're trying to keep track of. july and august is the likely fulton county georgia indictment. in january you have the carroll trial. march a manhattan criminal trial and all that comes after the appearance on the federal case on august 14th that we mentioned. i want to shift gears for a

moment here, bret. john durham will be on the hill. what john durham concluded among many other things is that when he was told that hillary clinton in 2016 was going to put this story out there connecting trump and russia to sort of cover up for her email issue and the scandal happening along that campaign, that john brennan, head of the f.b.i. at the time, went directly to barack obama and joe biden, c.i.a., i'm sorry, and informed them of what was happening there. he noted the lack of curiosity. john durham will be in the headlines for the next day and a half. the f.b.i. just now preempted his appearance came out with a statement. the conduct in 2016 and 2017 that special counsel durham examined why leadership has taken corrective action.

had they been in place in 2016 the missteps identified in the report could have been prevented. one more line. this report reinforces the importance of -- the f.b.i. now is getting ahead of what will be a very public story that john durham is about to tell the american people and congress. >> which is really important because think about this, bill and dana, we have not seen much coverage at all of the original durham report. we covered it all throughout and covered it when it came out in full. but really didn't get oxygen anyplace else. and now with durham testifying on the hill being questioned about the specifics inside, there are a lot of people that may be learning this for the first time. but what is found in those pages is very troubling for the leadership of the f.b.i. or was and now the f.b.i. is trying to say that's fixed. there is a lot of people on

capitol hill who question that. >> dana: what do you think the rest of the republican field will do in reaction to your trump interview, if anything? >> i saw the desantis team put out some clips from the interview. i don't know. there were parts of the interview where the former president really excels in laying out his foreign policy, tonight he talks about the economy and why he says it was a success. i do think in talking about handling of those documents and the indictment specifically, he may have stepped in it a little bit in from a legal standpoint. i don't know from a political standpoint how much that affects things. his supporters seem to believe he is the guy that can take on inside washington. >> bill: we do have our first reaction from the former president. he says the corrupt d.o.j. gave

hunter biden a traffic ticket. our system is broken. that's the initial response. >> bill: he talked about that last night. he believes the two-tier system of justice is in full effect and it is an effort to take him out as the chief opponent to joe biden. >> bill: look forward to the second part. quick work there. so as we balance all this stuff let's bring back jonathan turley to take us through what we missed. welcome back to our coverage. when is hunter biden before that judge? when does the plea deal happen and become official? >> we'll get more information once we have additional filings in the court. this is a relatively minor case so it can be handled relatively quickly. but that's going to be really the controversy here. for critics, this is going to

reinforce the view of a two-tiered system. the majority of americans polled believe the indictment of donald trump was politically motivated and constitutes election interference. the level of distrust that the public has with the department of justice. this won't help for the average citizen when it came to trump they rolled out a b-52. this will look like a crop duster. you have the son of the president who is at the center of one of the greatest influence peddling scandals in thinks re history. that's saying a lot in washington, d.c. and he will walk away with a couple of misdemeanors and gun charge that they can likely expunges. it won't sit well and raise a couple of questions for folks on the hill. one is, was the u.s. attorney in

delaware given full authority to investigate the influence peddling aspects of hunter biden's work? he was getting millions of dollars that he should have been paying taxes on but it's the way he raised that money, who it came from that is the most damaging for the biden family. there will be another aspect of this. if this is indeed closed, then the department of justice will have less of an ability to refuse material to congress because they will not have an ongoing criminal investigation involving hunter biden. >> dana: we have a new statements from the oversight committee chairman james comer. i want to read it to you. he says let's be clear, the d.o.j.'s charges against president biden's son, hunter, reveal a two-tiered system of justice. hunter biden is getting away with a slap on the wrist while growing evidence reveals the bidens engaged in a pattern of corruption, influence peddling

and possibly bribery. these charges against hunter biden and sweetheart plea deal have no impact on the oversight committee investigation. we won't rest until the full extent of president biden's involvement in the family schemes are revealed. professor, do you think it is possible that as hunter biden's new legal team was looking at the evidence that was coming out of the house oversight committee's investigation led them to tell hunter biden he would be best advised to take these pleas now because it could only get worse? >> absolutely. a year ago i wrote a column that i was seeing evidence of what they call in the construction field a controlled demolition. the way you take down a scandal is to control it. to confine it, to reduce the charges, things like misdemeanors. i said it was very likely the plan was to have a couple of misdemeanors on taxes and a gun charge that would not require

much, if any, jail time. that is what happened. now the thing is, i don't necessarily disagree with the tax charges being misdemeanors. the question is the scope of the investigation. we are talking about millions of dollars the house oversight committee is tracking. they have suggested there is no evidence that the department of justice actually saw some of this evidence. so the question is why? did the justice department seriously investigate the influence peddling scandal? even though it's the favorite form of corruption in washington, it spins off crimes because you have to conceal it, because it is corruption. and it is not clear the department of justice vigorously looked into that. >> bill: so professor, thank you. want to get back to david spunt with the official reaction from the department of justice. the official statement i should say. nobody on camera.

merrick garland is overseas on a trip in europe. david, back to you for what you have from the d.o.j. >> we won't hear from the attorney general merrick garland. he is overseas at the hague and in sweden previously scheduled. he was briefed along the way about this investigation. this was not a special counsel situation. david weiss is a u.s. attorney appointed by donald trump, the former president. the reason he was kept on to deal with this hunter biden investigation because the garland department of justice didn't want to show favoritism. we won't hear from merrick garland or anybody at the department of justice on camera about hunter biden. i'm reading a little more dana and bill, from this document filed today just hours ago.

this is the count on the taxes. it says during the calendar year 2017 the defendant robert hunter biden who was a resident of d.c. received taxable income in excess of a million and a half dollars, 1.5 million on which tax beable income there was owing to the united states income tax in excess of $1 hundred thousand. he was required by law to pay on or before april 17, 2018, to the i.r.s. at hartford, connecticut. knowing and believing the foregoing robert hunter biden, his legal name did willfully failed on april 17, 2018, in d.c. and elsewhere to pay the income tax due. so that's -- we're talking about 2018 here. we are going back five years now, over five years, five years just a couple of months ago in april just to give you an idea how long this investigation has gone. count two during the calendar

year of 2018 back in 2018 the defendant, who was a resident of d.c., it says let me just look at this and says while knowing and believing all of the foregoing robert hunter biden did willfully fail on or about april 15, 2019, to pay the income tax. we are looking at dates of 2018 and 2019. also that illegally possessing a weapon when authorities say he lied on that form. but as far as a court appearance that is murky and sketchy and not clear right now. i'm told that it is possible hunter biden does not appear for several dailies potentially even several weeks. at some point he will have to make an initial appearance and enter a plea in court. that's the way that it works in the u.s. justice system. but it doesn't appear he will be walking in a courthouse with

handcuffs placed under arrest or anything like that. >> bill: good work, david. back with you momentarily. >> dana: john levine from the "new york post" is here now. thank you for coming in and sharing the breaking nulls and your thoughts about it. your initial reaction. you've covered this story inside and out. >> we're six years later and ended up with two misdemeanors and a felony gun charge. there is a pre-trial intervention for that. it's a long time for two basically parking tickets here. i don't -- i also notice these are guilty pleas, his legal defense came to some agreement with the department of justice to plead guilty. i wonder what larger crimes the department of justice agreed not to bring as a result of this guilty plea? we know he was under investigation for very serious money laundering. i know the foreign corrupt practices act was mentioned as jonathan turley mentioned earlier many crimes that could

have spun out from the larger influencing peddling store eave that we won't see now. this is a long time for two also misdemeanors and no jail time. >> dana: guy benson said that twitter democrats loudly proclaim their passionate commitment to gun safety and tax fairness and after an investigation that dragged on for years the biden d.o.j. handed a no-jail deal to a repeat tax cheat who also lied on a gun purchase form whose last name is biden. >> president trump's old cfo at the trump organization was sent to ryker's island because he didn't report taxes on a company car and trump gave free tuition to his kids. that kind of stuff and sent to ryker's island. a terrible place in new york city. the amount of incredible punitive response toward one side but then the other side seems to have one escape after

joe biden's grandchildren. what are joe biden's grandchildren doing? >> it says during calendar year of 2018 under count two he received taxable income in excess of $1.5 million. is he paying the taxes on $1.5 million? and is that it? >> i thought tax fraud was a felony last time i checked. >> dana: the democrats -- >> that's the first question. that's a lot of money to not pay taxes on and to get a parking ticket. >> dana: how does it play into the other legal issue that hunter biden is dealing with, the questions in the case with his daughter, the mother of his daughter in arkansas? because one of these issues is he is fighting back saying i don't have the money that sthe is expecting me to pay for child support. >> well, you know, it could perhaps strengthen his case. this is not going to go to his

financial benefit. he will pay some kind of restitution to the government that will negatively impact his finances. he has been able to make use of friends to cover his expenses. kevin morris, an attorney in california who is his friend paid over $2 million of his old tax bill. kevin morris's plane flew him to his court appearance in arkansas. i'm sure he can find the money he needs to take care of his issues. >> what was he doing to make one.r5 million? >> that's the 10 million question really. obviously during so much of the period he was earning this income he was an active crack addict and alcoholic. there is no reason to be earning this kind of money when you are in that kind of a state. by his own admission if you read his autobiography when he was on the board of burisma the 83,000

>> bill: it's 10:30 in new york. hunter biden reaching a deal with federal prosecutors in that tax and gun matter. he will plead guilty to two minor tax crimes and admit to the facts of a gun charge. two years probation. so that's the deal they worked out. we've been waiting for this for some time. david weiss u.s. attorney with a statement made the announcement also in addition to that announcement, dana, he said the investigation is ongoing. what investigation? what aspect of the investigation? that's what we have on hunter. >> dana: other news as well. rescue crews expanding their search into deeper waters for the missing titanic submersible that disappeared on sunday. the vessel has less than 50 hours of oxygen left.

a rescue would be one of the deepest underwater recovery missions in history. let's bring in new york congressman and former navy submarine officer brandon williams. wonderful to have you. i was hoping to wake up this morning and hear the news they found the vessel and everybody had been brought to safety. that's not the case. what do you think about the scope and scale of the search right now? >> well, it's very hard to find the needle in the hay stack. you can't look using light because there is no light down at that depth. so the only way that you can find something is by listening and there is no better listening platform than america's nuclear submarines. >> bill: they've never had a case like this where they have had to go this deep and rescue people. so you have devices that can go up to 20,000 feet deep. i don't know how long it would take to get them into position and do this.

but you are really in a race against time right now and you understand that given the oxygen limitation, sir. >> it is oxygen but i'll tell you, as we learn with apollo # 13 it is also carbon dioxide, what we breathe out becomes poisonous. the ocean can be very cold. down where they are, i don't know exactly the temperature. we called it sea water injection temperature. often in the mid to low 30s. and so just staying warm would be very, very challenging in that environment. any sub mariner that is trapped in the ocean certainly has my attention and sympathies. >> dana: what can the families hold onto right now given that there are so many resources being brought to bear, including the incredible team at the u.s.

coast guard? >> well, the thing that i would focus on again forgiving i'm a nuclear engineer, you have to find them first. the best way to find them is by listening. you can cover much greater ground. anybody in that position would be banging on the hull making noise and transmitting that out, which sound travels much further in water than in air. so being able to listen for any sounds of human activity would help us pinpoint them so that then we can focus on recovery efforts of either getting an unmanned dsrv down there so we can maybe render assistance or attach a cable, i don't know what resources they have on the rescue ship. but these are the things i would focus on. the number one mission is location. >> bill: you are really good

with these answers here. let me try one more for you. this may sound foreign to us here. there is no gps underwater. not like you put in an address. they take text messages from the ship on the surface of the water and telling them which direction to go to lead them toward the wreckage of the titanic. you lose communication one hour and 45 minutes into this. you would think the submarine reestablishes communications or the submarine would resurface and fix the problem. that didn't happen. >> if it's bobbing on the surface they can excellent airborne radars that can locate something like that. if they had an electrical problem and lost their ability to communicate, that would -- they could be bobbing in the

ocean. there is no gps underwater or no radio signals that i can tell you that for sure. you can navigate under water. sound is the only environment and way you will be able to locate these folks unless they are right on the wreck itself and able to look right at the wreck itself. but keep in mind that when you are under water and you have all your lights on, you are only seeing maybe 100 feet in any direction. so it is like -- you are not able to see miles and miles. it is very, very narrow scope unless you have a side aperture radar and mapping. that's very special equipment and takes a long time to get it on site. >> bill: if i could on the question of time, the submarine is 22 feet long, right?

it is not huge. but to get to the titanic you have to go to the depth of 12,500 feet. if you drop in the water at 6:00 a.m., how long does it take to get there? >> well, i wish i knew. you are not going through any sort of decompression. you are sinking like a stone. so i don't have exact data on that. even so, maybe it's hours. >> bill: the reason why we ask that question is because maybe they had reached the site or maybe they were only halfway there. i don't know what that answer is. >> if there were only halfway there, then you end up drifting. and that becomes a much more difficult problem. i called the navy. i'm the only nuclear marine submarine -- i implored them to have one of our submarines be out listening. the best way to cover the most
