part of an agreement that includes hunter biden pleading guilty to misdemeanor tax offenses and reach an agreement with prosecutors on the felony charge of illegally having possession of a firearm as a drug user. the rich and powerful and system of justice for everybody else. >> there are more questions than answers. this plea deal does have all the makings of an avoidance of any jail time. more importantly it was an evasion of the more serious allegations facing hunter biden and the biden family. so it is historic in the sense that the president's son is going to plead guilty to criminal acts. it is going to be very controversial for critics. i think for many, this is going to look like you ticketed the

getaway driver after a bank robbery. >> harris: civil rights attorney and fox news contributor tore leo terrell is with me now. before we get to you, i want to begin with fox news correspondent david spunt who is now at the d.o.j. david. >> harris, this investigation into hunter biden began half a decade ago, five years ago. it is not an exaggeration. right now we have three charges, two misdemeanors, one felony charge against the president's son listed on the court papers as robert hunter biden. the charges filed in u.s. district court in wilmington, delaware. biden has agreed to plead guilty to the tax offense charges and enter into a pre-trial diversion agreement for the firearm charge. according to the court document biden received more than 1 1/2 million in 2017 and 2018. he owed $1 hundred thousand in federal income taxes each year bust did not pay those taxes on

those years. on the gun charge in october of 2018 he had a firearm despite knowing he was addicted to drugs. sources say he lied on a federal form. president biden halls said he is proud of his son and loves his son. the president is in california today in the same state where hunter biden now calls home. though this was filed in the district court of delaware. no comment from the president. a white house spokesman said the following to fox news. the president and first lady love their son and support him as he continues to rebuild his life. we'll have no further comment. james comer not happy about this says huntser biden is getting away with a slap on the wrist when growing evidence uncovered by the house over-- they had influence peddling and possible bribery. a new statement from chris clark. biden's attorney saying it is my understanding the five-year investigation into hunter is

resolved. i know hunter believes it is important to take responsibility for these mistakes he made during a period of turmoil and addiction in miss life and looks forward to continuing his recovery and moving forward. important to point out david weiss said the investigation is ongoing. so chris clark says he believes it is his understanding the investigation of five years is over. d.o.j. deliberately in the at the same time says the investigation is ongoing. no details there. there are possibilities that the investigation is looking at some of the business deals that's house oversight republicans are looking at. they claim they have been in contact with the department of justice to give some information. it appears the tax and gun portion is resolved. but what the other part is we

republicans from getting documents. just imagine if they would have said case is closed. they would have had no excuse, the department of justice, for providing those documents to house republicans. now they say it's ongoing we have an investigation. that provides a roadblock against the republicans from subpoenaing those additional documents and very shameful. this deal is a deal because hunter biden is the son of the president and a democrat. it is a two-tiered just advertise system. >> harris: i said rich and powerful versus everybody else. in this instance the most powerful. >> harris, look at the letter brief written by david weiss. it is so vague. he had income in excess of 1.5 million. what does that mean? excess of 1.5? what jobs was he doing in 2017 and 2018?

is finally out on the campaign trail. and low and behold, with the great timing of this, the only question that he can be asked now is what is your reaction to your son getting off on a couple of misdemeanors and talking maybe about a felony? >> this is choreographed by the democratic dnc. he is in california. merrick garland is out of the country and basically you get a letter brief and that's it. with the cooperation, harris, of 95% of the mainstream media they'll downplay this significantly. there is a durham testimony today. they are trying to diffuse and downplay the hunter biden charges as if okay, case closed. this case is not closed by any stretch of the imagination, harris. >> harris: this is coming from the "washington post." biden representatives have said that hunter biden previously paid back the i.r.s. what he owed. so they are treating this almost

vessel. so it is going to be a very uncomfortable experience. >> harris: brett sadler, a navy veteran who has been on many submarines and from the heritage foundation. this is a submersible so it can't take off and come back on its own the way a big submarine can. what are the challenges right now? >> well, a couple of the things that strike me is the fact that once they lost power or they knew they were in trouble deep under sea there was no emergency beacon received on the surface that would have confirmed the location, which leads me to the worst possible situation that somehow it gotten tangled or trapped in the wreckage of the titanic. that's probably the worst case scenario. trying to rescue it is hard in that case. >> harris: that's interesting. they went down to see that. i only know what i've seen from

the movie titanic. these things under water then continue to move around. so whatever was attached to that titanic that sank isn't just sitting there frozen in time. >> no, absolutely not. while the corrosion of the hull is maybe slow, it is actually succumbing to age but there are also undersea currents and that submersible only has a max speed of three knots. currents are near that. it could be pushed from where it was launched. >> harris: we showed the five pictures of the people on board. the ocean gate ceo stock ton rush. i want to talk about him specifically now in terms of what we know about the company and going down there and what he might be better prepared to feel what they are feeling. can you tell me what it would be

like to possibly be 2 1/2 miles under water? it is cold, you are running out of oxygen and if you are panicking at all, are you using more oxygen? >> absolutely. the best thing to do if you are in a situation like this, the closest modern example was the russian submarine that sank in 300 feet of water back in 2000. sailors survived in conditions that were leaky, high humidity. very cold and their oxygen level went down gradually over time and you lose your energy. the best thing to do to prolong the time to survive like that is try to rest, reserve your energy, try not to lose control. have people go to sleep. but you will only buy yourself hours. optimism needs to be high and focus of the mission of finding where the submersible is. >> harris: how cold is it down there? >> it can be 0 degrees celsius

or below that. you feel it through the hull of the submersible. if they have electrical power the temperature inside can go from being hot to unpleasant to cold and very uncomfortable as well. >> harris: that's interesting. you said celsius, freezing, 32 degrees or less in fahrenheit. i want to say this. here is what we know about the titan submersible. it is 22 foot carbon fiber and titanium craft weighing 21,000 pounds and you mentioned top speed of 3.35 miles per hour. can take five people as deep as 13,100 feet. no on board gps system. directions from the surface vessel it launched from. the surface vessel said it

didn't know where it was when it lost communication an hour and 45 minutes into the trip. >> yes. that tells me that very likely they reached the titanic or got to the depth at which the titanic was at. if everything was going according to plan as they descended to the wreck. it is not uncommon for not knowing the exact location from when you have a wire or cable connected to a submersible you know the precise location unless it's at a known location for the ship. they didn't get that message. they may never have reached the titanic wreck site. >> harris: we're reading the way they are communicating had been previously via text message. it is not like a submarine then. it doesn't have the ability to communicate the same way? >> there is quite a lot that is
