felony firearm charge. his attorney says "it's my u understanding the five-year investigation is resolved. hunter believes it is his responsibility to take care of the mistakes he made during turmoil in his life." and a source says the investigation is officially open should new information surface. the white house has largely avoided comment on the case, pointing to an investigation led by a trump appointed u.s. attorney, that has not stopped reporters from asking questions about this. and indicted donald trump writes on truth social, the corrupt biden doj cleared up hundreds of years of criminal liability by giving hunter biden a mere traffic ticket. our system is broken. this is on a separate track from congressional republicans. congress republicans, they are

investigating the hunter biden -- hunter biden's family, and james comer, the chairman of the oversight committee says he's got information showing millions of dollars of payment to the biden family and something that he's going to continue investigating on the hill. back to you. >> sandra: rich, thank you. >> john: miranda devine, "new york post" columnist and fox news contributor. it's worth, miranda, starting off by repeating what rich said just then, competing statements from chris clark, hunter biden's attorney and the doj, saying with the announcement of two agreements between my client, hunter biden and the united states attorney's office for the district of delaware, it is my understanding that the five-year investigation into hunter is resolved. however, look at what the doj said in its statement, it had the very start words saying the investigation is ongoing. so, looks like hunter biden's

team is saying ok, that's it, we pled guilty an agreement on the gun charge, move on. but the real story is different than that. >> well, look, i think hunter biden's team is quite correct in that their man is off the hook with this sweetheart deal from the doj, and look, you know, pardon me for being cynical, but i think trust in the doj and the fbi is at such depths that we can only look cynically at the statement that the investigation is still ongoing. in fact, that would be a convenient way to stonewall the republican investigations, for instance, you know, if james comer wanted to find out what did david weiss's team in delaware do with that fd-1023 form containing allegations that hunter and joe biden had received $10 million worth of

bribes from ukraine. we would know that bill barr said that he handed that document and the information that had been assessed by the u.s. attorney in philadelphia, had handed that over to david weiss's team, and so what was done with that, and i think there are a lot more questions to be answered and let's hope that that investigation is still ongoing, not just a clever way to block any more inquiries from the republicans. >> sandra: miranda, as far as putting this all in context, you know, there are some reporting right now, according to law enforcement officials, that prosecutors had everything they needed to charge hunter with these tax and gun offenses dating back to 2019. which obviously would have been a completely different time and

before the presidential election. >> yeah, i mean -- it's just baffling why it took five years to come out with these little penny ante charges. it's quite incredible. we know from the irs whistleblowers that have come forward just recently that there has been immense turmoil inside that investigation going right back to the beginning of, you know, apparently gary schaaply, the irs supervisory agent, felt there was slow walking and obstruction from the doj the minute he took up that case, and he apparently gave explosive testimony a couple weeks ago to the house ways and means committee which for some reason has sat on that testimony all this time. it should be coming out soon, but it would be -- it would make sense that basically the doj

would want to slip out this plea deal with hunter biden before that testimony came out. it's a brazen move and it certainly gets the president off the hook when it comes to, you know, having to pardon his son if he faced any jail time. >> john: so the republican presidential candidates, miranda, weighing in on this, vivek ramaswamy says it's a joke, they are more scared than of, the real crimes are the audio tape from the ukrainian executive owner of burisma and the hundreds of millions kicked back to ukraine to make good on the favor. don't black friday the deflection, it's a smoke screen and nikki haley saying it only raises more questions, and double standard of justice, and more the biden family has to answer for. you don't have a lot of faith

the investigation would continue. what if a republican were to be president, oversee the justice department might things change. >> i think that would be a complete game changer. but you know, apparently this doj and this attorney general quite happy to be compromised and it's just extraordinary that after five years there is so little, and i noticed that an andrew wiseman, now a talking head on msnbc, tweet, first time tax offenders never go to jail, there's no problem. what about ellen wieselman, the trump corporation cfo who went to rikers island four months and kodak black, the rapper, went to federal prison four years on a similar gun charge, lying on a

report based on 96 hours. >> john: officials from the u.s. coast guard giving an update last hour on the search from the missing titanic submersible, a search so far not wielded any results. molly line is live outside the coast guard boston headquarters with the latest this hour. >> that really is the big ther no results oxygen. the coast guard says this is their top priority, a good many assets they want to be on-site are still moving to get there. and this is a massive, massive undertaking. assets coming in from multiple nations, canada, united states, the air national guard is contributing from new york, including some air assets. there really are capabilities hunting both above and below the surface, and rov hunting

underneath the water, sonar being used, the canadian coast guard has a cutter there headed to the scene, private research vessels are also headed to the scene. it's not clear what sort of assets and expertise they will bring to the table. planes up in a cycle flying out of st. john's, newfoundland, looking for the titan. should it surface, here is robert simpson on the air efforts. >> specialized to see things from the air. so given everything they have toit and if it's on the surface we are fairly certain we would be able to find it. >> those on board include scientists and adventurers, including stockton rush, the ceo of the firm that created it, and pretty big price tag, 250,000 per person for the eight-day expedition, customers referred

to as mission specialists on board. hamish harding, u.k. billionaire, aviator, award winning pilot, the company tweeting pictures showing harding out at sea, and several of the photos writing the sub had had a successful launch and hammish was currently diving. french mariner, paul henry nargolet, he was named on a facebook post a day before the mission by hamish harding, and overnight, another company tweeted their company's vice chairman, shahzada dawood, along with his son sulaiman, the company noting contact was lost with their craft. i also had a conversation with the petty officer, chief petty

officer just before the press conference got underway, seeking a little more clarity on the timeline. they believe that the vessel submerged around 8:00 a.m. and then later on in the evening that the coast guard was notified around the 5:00 hour, so there was quite a bit of time that went by when contact was lost with the submersible before authorities and the big team and the big assets were brought in to bear to begin looking for the submarine and all of those missing on board. john. >> john: molly line outside headquarters in boston. >> sandra:former navy diver joins us now. what does through your mind as the hours tick by, what are you thinking? >> the complexity of the entire operation. thank you for having me on, and the depth alone makes this one of the most complex rescue

and/or recovery operations to be done in the water. and then the timeline, the fact that the system was designed for roughly four days of surviveability or four days of air and life support systems. that depth, combined witht scenario could have happened, an hour and 45 minutes into the descent and you lose communications with the craft, it could be because there was a widespread failure in the electrical system and you have lost all communications and then the craft becomes adrift, it's designed to pop to the surface by itself, and with the currents running in different directions through the depth, the midline and the surface, it could be anywhere out there, thousands of square miles of ocean. and then i guess the other

possibility, the reason why you lose contact, there's been some sort of catastrophic loss of integrity of the hull. >> yeah, those are all kind of critical elements. key systems on the vessel itself would be navigation, communication, life support, and i think clearly communication failed early and apparently navigation and propulsion is not working because it hasn't materialized anywhere, and i think -- and also given the time of descent, so an hour and 40 minutes, something like that, i would -- given all that information, i would think that -- i would be surprised if the submarine even made it to the wreck site. it probably had system failure at a depth prior to the bottom or prior to the wreck site would be my guess. so the submarine could be on or

around the wreck, which would make it very difficult to locate, given the fact that it's a debris field. it could be on the bottom away from the wreck, which would really be a needle in a haystack scenario. it could be somewhere on the surface, but that's unlikely. i've heard people talk about the emergency signalling device or somewhere in the water column, between the surface and the bottom, also unlikely. so, given everything i can ascertain at this time, it seems like a catastrophic event occurred on descent, i would think before they even made it to the wreck site. >> sandra: just, so many are holding out hope, right. you are told if they are alive and this vessel is still intact, that perhaps they've got 40 hours left of oxygen, it sounds like you can hold out hope at this point, many are. although the coast guard was

asked a very specific question about whether or not, if they actually did find the vessel, whether or not they could even save these people in time. here was the exchange a few moments ago. >> if you were to find the submersible at this moment, would that give you enough time to save these five people on board? >> yeah, i -- so -- i don't know the answer to that question. what i will tell you is we will do everything in our power to affect a rescue. >> sandra: perhaps we could put that question to you, then, robert. is there -- do you have any idea knowing what you know if they all of a sudden found this tangled in the wreckage of the titanic, if there's is even enough time left to save them? >> only one system i'm aware of that cooperate at that depth, it's a system operated by the supervisor of salvage, a system called curve 21 can operate at

20,000 feet, i believe there was an f-35 recovery in about 10,000 feet of water maybe a year ago. so, there is a system that could -- could search at that depth. it does have the mechanics to attach to the vessel in some capacity. ideally then that deep drone or that curve 21 would raise the stranded vessel to a depth to where divers could actually secure a lifting harness of some sort to bring the vessel up and over -- up and over the surface, or up and over the side. however, to deploy that system from -- to spin up the team and the system and then transport it to boston or, you know, whatever the port of embarktation is, and get it to sea and system check it, and depth, it's well outside

live up to it, dossier orchestrated by hillary clinton's campaign. and seeing the same thing play out with the presidential records act and indictment from joe biden's doj hand picked counsel of donald trump, and hunter biden, putting his leading opponent in jail up to 400 years for something an obama appointed judge said he had everything to do and the clinton sock drawer case in 2010, that clinton discussed military strategy and security, no difference other than it's donald trump. hunter biden getting a sweetheart deal from his dad's doj and talking about things democrats care about. illegal possession of a firearm under abusing substances, sad, and then tax fraud. making millions of dollars and not paying taxes, and probably

the department of justice is leaving that trump appointed attorney, u.s. attorney for delaware in position so that they can continue on with this investigation and all of the implications of this case have been through that u.s. attorney, appointed by donald trump. this plea arrangement is with the trump appointed attorney. so, there is no bias, this is not joe biden's department of justice, the attorney general is not joe biden's attorney, or personal attorney, what we are trying to do as democrats in this administration, especially, is to restore hope and faith in the department of justice through this process. these are very different cases with regards to what donald trump has been charged with and what hunter biden has accepted responsibility for and pled guilty to. >> sandra: garrett's response to that, and ahead of the durham testimony, conduct in the 16 and 17, in 2016 and 2017 that special counsel durham examined was the reason the current fbi

leadership already implemented dozens of corrective actions. had they been in place in 2016, the missteps could have been prevented. report reinforces the importance of ensuring the fbi continues to do its work with rigor, objectivity and the american people expect. moving on to hunter biden reaching the plea deal in the tax and gun case you referenced, garrett and the charges filed, the white house response is that the president loves his son. many are saying this is just a slap on the wrist. here is kevin mccarthy on how he believes this plea actually will help the gop investigation. listen. >> this does nothing to our investigation. it actually should enhance our investigation because the doj should not be able to withhold any information now saying because a pending investigation. they should be able to provide chairman comer with any information that he requires.

sea after going down for a tour stop in the titanic. >> are there any other resources that dod can provide that would be able to aid with the search or is it just a problem of distance and time and possibly vessels to go deep enough to help. >> the dod is assisting in search operations. as of yesterday, there were two c-130s, flights over the area. by later today an air national guard c-130 will also join the search and conduct a search flight over the area. by the end of today, committed three c-130s search and rescue flights. the navy has been in touch with the coast guard and is working to provide personnel such as subject matter experts and assets as quickly as possible. but i don't have anything further to read out as the navy and coast guard continue to

remain in touch on this issue. >> john: as we heard from captain jamie frederick earlier this afternoon, despite all of those efforts, nothing has turned up so far and it could be that the submersible is out there on the surface of the water somewhere bobbing around, it could be hundreds of miles from where it first started drifting on the currents, or it could be at the bottom of the ocean, we don't know. nobody has any idea. but complicating it, sandra, again is they don't know where it was when they lost it. that's the biggest challenge. >> sandra: and over 7600 square miles searched and that is ongoing. just hours after secretary of state antony blinken left china, a bombshell report dropped in the wall street journal. u.s. officials saying beijing is eyeing a military training facility in cuba which could put chinese troops on america's doorstep, just 90 miles south of the florida coast. edward lawrence on this live from the white house.

what exactly are we learning here? >> yeah, sandra, the wall street journal is reporting the talks for those -- for that military training base between cuba and china, the talks are in the advance stages but have not yet concluded. the biden administration has further reached out to representatives in cuba to stall that deal, trying to tap fears of giving up cuban sovereignty. the white house refusing to officially comment on this. representative michael waltz says it stems from a weak foreign policy and representative mike garcia calls the secretary of state an enabler. >> our adversaries have seen time and time again under biden they get rewarded for their bad actions from the colonial pipeline hack and putin gets a summit with biden afterwards, to what we are seeing right now with blinken in beijing after harassing our ships, our planes, breaking into our bases, putting spy bases in cuba, the spy balloon, our secretary of state goes over on bended knee. >> it's a dangerous thing to

skills developed in the military that serve you not only in future employment opportunities but as a citizen, and what we are seeing right now, not only do we have fewer and fewer kids who are interested in serving the military, creates a serious national defense issue, but the military has served as a vehicle for advancement in our society, and today young people are hearing narratives from both sides of the spectrum and being discouraged to serve, and you know, for the past 15 years we have honored literally thousands of kids across the country, and we continue to try and encourage young people to use the military because 75% of them are only going to serve for four years, but to use that experience to do better in their civilian and improve our society. >> john: you know, post-9/11 there was a huge surge in recruitment, much based on patriotism in the wake of the attacks on the twin towers and the pentagon. but lately the recruiting has been down, and several branches

of the military have missed their goals, mostly you are right because of low unemployment among the target audience, a smaller pool of young people who are qualified to serve, and declining public confidence in the military. but you argue if a young person goes in the military now, later on in life when they are in their 30s and 40s, that experience will benefit them greatly, not only have a leadership perspective but also monetarily. >> absolutely. all the stats will show people who served in the military and then go on to college will complete their degree sooner. earn money, more money over the course of their lifetime. and again, develop a network of individuals across the country that will benefit them throughout their career. >> john: you cite studies that show enlisting in the army increased annual earnings by almost $4,000 over two decades,

and military recruits take career paths they never would have thought of prior to military service. and you talk about javier galvan, what was his story? >> individual who created the american dream by enlisting in the marine corps. a person that did not know what he wanted to do, perhaps did not have the resources because he was an immigrant, went in the marine corps, out of the marine corps and became a physician. and if i had a dollar for every story like that, i could probably retire tomorrow. but again, historically, the military has been that ladder, been that venue for people who advance, to give them access to the american dream and now young people are hearing from both sides that it's not a viable option. when i said 75% of kids who go in the military only serve four years and then they pursue their dreams. it's still a very viable option.
