>> we begin with a fox news alert in one hour special counsel face house lawmakers for the second day in a row. >> today he will testify before the judiciary committee as members are seeking answers of the fbi handling of the trump russia investigation amid accusations of political bias. >> fascinating to see what happened yesterday. we are live from capitol hill where we expect them to arrive
5:01 am
soon will probably get some photos? t to good morning to you. the judiciary committee less than an hour we will see the former special counsel testifying after durham testified behind closed doors with the intelligence committee congressman mike turner says he got information from durham that could be helpful to fix the problem within the fbi. here is what he told you this morning. >> mr. durham is identified to the issue if there was misconduct under the fbi and department of justice reviewing the issue pursuing donald trump imagine those two years we lost as a country and what happened to the trump presidency as a result of the basis allegations this is misconduct and political bias the other aspect of what we are worried about at the fbi. >>reporter: we expect durham
5:02 am
to arrive people are lining up outside the room this will be his first time testifying into crossfire hurricane examining the origins in the justification of the fbi probe donald trump and his alleged context with russia. the durham final report concluded the fbi had no actual evidence for launching the multiyear investigation but did not find politicalization. meanwhile democrats are calling for the agency to learn from its mistakes here is chairman counterpart. >> we have had both with the clinton investigation the e-mails and the crossfire hurricane investigation in the recent past very sensitive investigations. who knows where it will go in the future but we have to learn from mistakes made to make sure americans can have confidence in prosecutorial power of the federal government and fair elections.
5:03 am
>>reporter: expect to hear about the different way in which candidate hillary clinton was treated as opposed to donald trump. and now this is quite to be quite a heated hearing at 9:00 o'clock. >> they say is different behind closed doors traditionally but the ig report did not find politicalization and the special counsel durham did not find politicalization but confirmation bias. which means you have a preconceived notion and you look for things to backup your thought. if you believe he colluded with russia you only find things that look like collusion with russia. i don't think either of those report said there was no politicalization. so what is the truth as you see it? >>reporter: i perceive it
5:04 am
does not matter so much but we will hear from special counsel durham and the ranking member on this committee democrat nadler will drive hard on points like that. but here is the big picture that there were some reforms allegedly made at the fbi that has not resulted not balancing what many see as a system of justice. we will hear that like dirty laundry this morning. we will see a lot of clashing between republicans and democrats in an open setting which is different from whatever happened behind closed doors yesterday. ainsley: thank you so much. now to the hunter biden pleading guilty to misdemeanor with his tax filings t1 it is

5:08 am
and now the new york post does a very good job to say this is a gun and the president signed with no trigger discipline we have the prosecution under the biden administration that gave him a sweetheart deal kodak black who is a wrapper his attorney practicing law over 26 years says he has never seen someone have a weapons charge and a tax charge and not do any prison time. ainsley: used a different social security number when he tried to get a gun. even wesley snipes. >> so joe biden is totally cool locking of you and your loved ones when you break the law and passing aggressive law from the federal standpoint

5:12 am
they don't even mention the treasure trove of information in the laptop? also five years of investigating and no jail time? brian: but the international business deal trading on his dad's influence he just stops. not a drug addict who bought guns and could not get the software for his taxes but he ended up a family enterprise ended international business deals with romanian and ukrainian representatives as well as china. politico actually does a story about the legal jeopardy of the international business deals. it misses a few things saying he did the deal after joe biden was vice president. he was traveling on air force to while traveling. in between the russian investigation that should not have happened and the laptop
