rare diseases and cardiovascular conditions, for generations to come. so, everyone can meet their moment. because your disease doesn't define you. so, what will? novo nordisk. driving change. >> we begin with this fox news alert, special counsel john durham is testifying on capitol hill for the first time and explaining his findings after a year's long investigation into the trump-russia probe. the f.b.i.'s lack of factual evidence to investigate the matter before the 2016 election.
9:01 am
this is "outnumbered." i'm harris faulkner and here with my co-hosts and joining us today, ainsley earhardt, fox news and contributor and show, . special counsel report on the trump-russia investigation detailed the f.b.i. failure to adhere to the rule of law and claims the bureau had no basis to launch the probe in the first place. >> on july 31st and my view based on the investigation, there was not legitimate basis to open as a full investigation. an assessment is something that needed to be looked at, gather information such as interviewing the people who provided the information and checking databases and other intelligence agencies and the standard kinds of things you would do in an investigation like this. >> durham explained how multiple
9:02 am
f.b.i. agents apologized for mishandling the trump-russia investigation. >> mr. durham in your report and here today, you said your findings and conclusions are sobering. could you unpack a little more what that means? why do you say sobering? >> let me give you some real life views on that. i have had any number of f.b.i. agents who i have worked with over the years, some retired and some still in place, who have come to me and apologized for the manner in which the investigation was undertaken. i take that seriously. >> kayleigh? >> let me start by quoting jonathan turley. some of the congress men are being very unfair to him. what i found so interesting, summer of 2016, the f.b.i. gets
9:03 am
information that comes in that hillary clinton may want to connect trump and russia. you get this information, what do you do with it? do you give it to the court, the lawyers, agents? no, he doesn't. wouldn't you think if you had relevant information you would give it to the agents looking into it? the agent when she found about it, agent one was emotional and disturbed and let go from the casey eventually. this is why people don't trust the f.b.i. to the tune of 60%. they said they fixed everything back in 2019. what about the c.i.a.? they were soliciting signatures to go on the memo to cover for the biden laptop after the so-called reforms took place. >> we know they didn't fix everything because look how hard the head of the house oversight committee had to fight to get a single form recently. >> exactly. >> that f.b.i. form, 1023 which
9:04 am
reportedly shows the 17 recordings of joe biden and so on and so forth and the mystery bribery dealings, allegations only, but why do they have to fight so hard if everything was fixed at the f.b.i. >> and block everything out of the two forms he went to view yesterday. >> adam schiff has told fox news, he was talking getting censured this afternoon, he says he's going to wear that as a badge of honor. watch this. >> i take it as a badge of honor because this says that i'm effective. they go after people they think are effective and expose the corruption of the former president and led the first impeachment trial of the former president to the first bipartisan vote in u.s. history and i'm proud of that work and would do it again. >> talk to me about this day. you have john durham testifying on the hill and adam schiff about to get censured and wears it as a badge of honor.
9:05 am
>> i have to underscore what a deflection that is. that's a spin. that is someone wearing an arrest, a conviction as a badge -- there's nothing about facing for the second time censure for a sitting congressman or senator to be proud of. think about, it's the second highest disciplinary rebuke below expulsion. he is to appear in the well of the house chamber and receive a verbal rebuke from representative mccarthy i would sort of find funny but for the circumstances that are frankly fr tragic. he didn't discuss bringing america through a nightmare as explained. think about him sitting through how many radio shows and cameras and in the esteamed house of congress and spread false hoods and claimed he had evidence and didn't have. now instead of defend himself,
9:06 am
here's what i meant -- he has a talking point for msnbc anden pats himself on the back. >> we call it a montage. >> this is as clear evidence to collude with the russians. the russians offered help, the campaign accepted help. the president made full use of the help. there is clear evidence on the issue of collusion. there's ample evidence of collusion. >> when i was watching this this morning, i thought they're not giving him a chance to talk. the democrats were so unprepared. schiff would say things and interrupt him. there were other democrats on the panel that were spreading false information like they always do and asking -- no, that is not exactly what we were investigating. no, that is not true. we should do a montage of those comments. democrats don't want trump and that's what we're seeing today.
9:07 am
they are putting their thumb on the scale and trying to turn this -- they did it in 2016, they did it in 2020 and trying to do it in 2024. they'll do whatever it takes. when you ask them, they say trump is not good for the country, he is so wrong, they will do whatever it takes to take him down and now americans have no faith in the inst institutions. that's why tim scott wants to replace and rebuild the f.b.i. and doj. they said trump colluded for years. we reported on that for years. hillary clinton, the dirty dossia. four times the court lied about this. she had classified information on the server, comey admitted that. she destroyed the evidence and it is such a double standard. >> the line she destroyed the evidence. it is like matlock rolled in.
9:08 am
it is wow. i want to go to something else and get your response. so durham on the hill today as you know, ended up talking about how confirmation bias played into this. watch. >> can you describe that for a moment? how did confirmation bias play into this? >> confirmation bias has to do with human tendency to accept things that we already think are true and reject anything else. in this instance, there are any number of significant red flags that were raised that were simply ignored. if there was evidence inconsistent with the narrative, they didn't pay attention to it and didn't explore it and take the steps that should have been taken. >> wow. >> there's a simpler word for confirmation bias. it is lie. so adam schiff knew this in the intel community, obama was briefed and knew it was wrong.
9:09 am
biden current president, then vice president. it is really a lie. schiff is effective because he drives the narrative, wears his badge of honor for his voting base and not talking to any one of us on the couch or undecided americans. he's talking about his next senate run or first senate run and talking about not just getting trump out of office but all republicans. the democrats are willing to lie, cheat and steal to get wherever and adam schiff and all of them followed this line after they were briefed behind closed doors, having the facts, there was no collusion. carter page, others that took the brunt of this, so many americans and the abuse of the courts. over 278,000 warrants. i want to know who is in the warrants. >> why doesn't this matter to democrat voters?
9:10 am
>> there's a hard core part of the base that will go no matter what. if you're fed the line rep repeatedly, maybe you can go back to it confirms what they want to believe. it is easy to believe. it is harder to go against -- as human beings we have a belief structure. it is hard to go against it. you don't want to believe it. the easy part, if you are wrong and somebody presents the facts, own it and say you are wrong and adjust course. that is why they don't change. and there are some who want to drive the anti-trump but really it is about america. we have to go beyond trump to all of america. >> the hunter biden story, we did this last week or -- i think on friday. all the big networks were not reporting on it. 291 minutes on the trump indictment. democrats didn't know before the election. >> they are amplifying the lie. >> they know what they have been
