if you listened and played it during your monologue. he said i can't discuss those grand jury matters. that's a clue to me that it is quite possible that he had his team had discussions with those individuals' attorneys. they made it abundantly clear if you serve my client with a grand jury subpoena, my client is then going to claim the privilege, means the fifth amendment privilege. at that point rulings of engagement. in order to compel someone to go before a grand jury you have to afford them and give them immunity and certainly he did not want to do it. so, basically he gave everybody a pass. that is not what should have hand in this particular case. >> jesse: all right. so, he didn't push it and now everybody is paying the price. what about the democrats who go out there and just light everything on fire and keep telling lies? what are they in on with the fbi that we don't know about?

i mean, look, jesse. the #th floor, someone needs to go up to the seventh floor of the fbi headquarters and they need to padlock the seventh floor. they need to completely remove all of those executive staff members from the director down and he made it very clear, his buzz words were sobering. sobering is another way to say shocking and then he said hold anybody accountable. so he made it very clear no training, no revised policy, no implementation of new procedures. that's not what he clued us into. he said our lack of holding people accountable is not going to change the fbi as it exists today. that tells us unless we are prepared to completely overhaul the fbi from the top down, we are going to live with the existing state of affairs as basically the fbi is going to be able to snub their nose at the general public just get away

out in the press how did that make you feel and your former client ja rule feel. >> i haven't spoken to jeff about that. we don't know what the final outcome is yet. sentencing has not yet occurred. court, once this plea is presented to the court will have to consider the sentencing factors in 18 usc 3553 and part of that will be how to make this crime a deterrent for other people. >> jesse: are you saying that there is a chance that this judge doesn't go along with the defense agreement and she hits hunter with prison time. >> is it feasible? absolutely it's feasible. in federal sentencing, it is solely up to the judge,not like state sentencing where we make a deal okay we are going to agree to three years, if the judge he agrees with it we can go forward. the sentencing factors are considered by the judge. the individual's background is considered. a sentencing report will be developed. and out of that the judge will

investigation that hasn't been started yet. but, if i were these members, where i would start looking at is, one, who is he talking to and what way did he actually breach and potentially long-term damage our national security which is something that he definitely did do. but, also, two, remember, he was fundraising off his official position privy to information that most members of congress don't have. and so i think that they are going to take all of that into account. and i'm going to definitely stay in touch with him to ensure that he is not getting a slap on the wrist. i think if we voted to send one of our own to ethics for investigation. he is no better and after reading the durham report, jesse, i don't even get past page 8 before i realize this guy needs to be held accountable and that is what started this whole process. >> jesse: you got more accountability than john durham. so congratulations and thank you for holding someone's feet to the fire in congress. we need more people like you. >> thank you. ♪ ♪
