so you can rise from pain like a pro. icy hot pro. very >> greg: we're out of time, thanks to kt mcfarland, jamie lissow, joe machi, kat timpf. i love you america. >> trace: good evening and welcome to america's late news fox news at night. i'm trace gallagher in los angeles. and breaking tonight, special counsel john durham testifies that big red flags were ignored by the fbi in the trump russia probe. in another hearing, former college swimmer riley gaines lashes out at new policies that force women to shower with and compete against transgender athletes. but we begin with just a few hours until that missing sub runs out of oxygen. we are now being told that new equipment that could actually help lift the missing sub is now

on scene or close to being on scene. retired us navy captain armon joins us with the latest on search and rescue but first to matt finn on how crews are working to find the source of underwater noises that have been detectd the. matt good evening. >> good evening trace. the u.s. coast guard says a canadian surveillance plane picked up some type of underwater sounds yesterday and again today. but a coast guard captain says they cannot confirm reports that those sounds were happening in 30-minute intervals and also could not confirm those sounds were banging or tapping. the coast guard captain says the recordings were turned over to the u.s. navy for analysis and underwater robots were sent to the area where those sounds came from. an ocean science expert, who's assisting the coast guard said the noises sound like banging but could have come from various sources including a nearby ship. tonight some of the world's best data analysts are determining

whether the sounds might have come from the missing titan sub. >> the noises have been described as banging noises but again they have to put the whole picture together in context and they have to eliminate potential manmade sources other than the titan. >> reporter: and tonight the coast guard says the subs dwindling oxygen supply is estimated to potentially run out in a matter of hours, testimony. the five people in the missing sub are believed to have some type of small food rations and more information is piling up about the dire safety warnings ocean gate received about its sub. and the ceo who's on that missing sub previously expressed his concern that the sub could get caught in a net or ravine on its way up but said he was willing to take risks. >> if you just want to be safe don't get out of bed. don't get into your car. don't do anything. at some point you're going to take risks and it is a risk reward and i think i can do this just as safely by breaking the rules. >> reporter: the search area is now the size of connecticut and

the number of search vessels is expected to double from five to ten by tomorrow morning. >> trace: it has captivated the country matt finn let's bring in retired navy captain and expert armon kirdy. great to have you the. we don't know if it's banging or tapping. do you think the search teamings focus too much on the noise and not so much on other things and the noise may have been detrimental? your thoughts. >> good evening trace right now it's the only lead we have. they can do two things at once, as mentioned analyze the recording to determine whether it was manmade or natural signal trying to triangulate to see if it was heard by more than one platform and looking for that while at the same time they can be listening in other parts of the ocean. the surface vessels can be using their radar, the c 130s out there can use their radar and visual searches. so it's all of the above at this point. >> trace: right now a vessel

before robot capable deep see en route and vessel with exploration robots or exploration robot could arrive any minute. how important is that to the ongoing search? >> well, if you have an idea, a rough general idea say within a square mile where that came from that's where you want to send these remote operated vehicles. i don't know if they have any kind of active sonar but they have lights. the best you can do is have a location where you might have this return and send these rovs and frankly hope you get lucky that you come across the submarine if that is where the sound was actually coming from. >> trace: i wonder why the search area they're saying twice the size of connecticut 12,000 square miles. why so big. it was over the titanic, what could happen that could make it drift that badly. >> as the vessel's going down it

has a three dimensional system that knows where it is on the plain on the earth's surface. once it lost power, we have to remember that the ocean current flows in different directions at different speeds at different heights. so for every hour that goes by, that vessel, if it is floating somewhere in the water, it could go one mile, two miles in one direction. so imagine a circle that is gradually growing and getting larger and larger, and that's the area you really have to kind of focus in on unless it's stick somewhere on the ocean floor. >> trace: this is colin taylor, he went on the missing sub last year. he had this to say. watch. >> i know that they've heard knocking, which is navy protocol when a sub is in distress. ph nargeolet on board is ex navy i'm sure he is there every 30 minutes knocking on the titanium dome on the submersible. >> trace: i played that sound bite because captain you told us

last night that is standard operating procedure. so if this sub is lost somebody is in that thing if they're still alive and banging on it so it coincides with the noise. do you think it's just random noise? some say it could be fish. what are your thoughts on that? >> you know, there's just no way to know. it could be some kind of underwater seismic activity. it could be a function of water flowing over an underwater feature that is just creating some kind of verbal noichlts there's no way to tell without analysis. but the great thing about acoustic analysis is can you take something that sounds very incoherent and say i have no idea what this is and you can gradually remove surface noise, background noise because they're very incoherent but the sound you heard might be more coherentment so getting rid of the background noise and matching it with what you might have in your acoustic libraries saying it's a 75% chance it's this or 80% chance it's knocking

or some sort of clanging noise of metal on metal. >> trace: great analysis. we will get back to you as news breaks. captain great to have you on as always. thank you. >> thank you. >> trace: meantime the special counsel who investigated the origins of the trump/russia probe said the fbi had no legitimate basis to open that investigation and john durham's testimony on capitol hill got downright ugly as democrats stood their ground on some bogus claims. the senior national correspondent kevin corke is live in dc tonight good evening. >> reporter: good evening trace. special counsel john durham testifying that the cia, all the way back into 2016, received intelligence that suggested that hillary clinton had approved a plan to tie then candidate donald trump to russia. intel that the fbi then ignored. as part of a riveting day of testimony offered by the special counsel. durham also detailed inappropriate behavior among democratic party officials, u.s. intel agencies and the media,

all in an effort to get the russia probe off the ground, adding that the fbi has a few agents that have apologized to him for their handling of the probe, even as he confirmed he saw bias among keogh officials in charge of the investigation. >> i've had any number of fbi agents, who i've worked with over the years, some who are retired, some are still in place, who have come to me and apologized for the manner in which that investigation was undertaken. >> reporter: pretty incredible stuff. still, democratic lawmakers did all they could to distract from the cold, ugly facts dished out by durham today, slamming him and questioning his integrity. >> your reputation will be damaged, as everybody's reputation who gets involved with donald trump is damaged. he's damaged goods, there's no good dealing with him because you will end up on the bottom of a pile. >> my concern about my reputation is with the people who i respect and my family and my lord. and i'm perfectly comfortable

with my reputation with them, sir. >> trace: the mic drop. the special counsel, however, did not recommend any new charges against individuals or, quote, wholesale changes about how the fbi handles politically charged investigations. that is, of course, despite strongly criticizing the agency's behavior throughout. trace. >> trace: kevin corke live for us in dc. kevin, thank you. >> now let's bring in a member of the house judiciary committee republican representative from south carolina, russell fry. congressman great to have you on. how did you think durham did today? >> i thought he did incredibly well held up under pressure and outlined very succinctly and clearly the findings of his 300 page report and doing this, quite frankly, despite the personal attacks that were coming from the democrats. he held up very well, smooth sailing as far as unveiling, just keeping to the facts of

this i think was really important for him and on that front he landed at every punch. >> trace: it's interesting because i want to play this sound bite from gerald nadler mainly because it's kind of pre positives truss and i want your response on the other side. watch. >> mr. durham never found what he was looking for, he cannot dispute a single conclusion in the mueller report. he cannot prove a magnificent deep state conspiracy and cannot say that the fbi investigation into the trump's campaign many ties to russia never should have happened. >> trace: i say pre positives truss because it's dishonest he knows crossfire hurricane was bogus. >> ranking member nadler unfortunately started this year off saying we were imagining a border crisis. so you take these things with a grain of salt. here you have a 300 page report that if you read it outlines very clearly how biassed the fbi leadership was. all the things laid out

succinctly the guardrails that were not followed, the protocols ignored, the inability to corroborate evidence or interview key witnesses. he talks about this very clearly. and if ranking member nadler had read the report he would have seen those things, too. >> trace: yeah. i want to bring this up because before adam schiff was rebuked today by the house speaker, i mean, it looked like he had just won the bronze star for heroism. they were chanting his name congressman. they were giving him high fives and hand shakes and hugs. there is no shame anymore. it's just unbelievable what we saw on the house floor today before the 26th congressman in the history of this country was censured. >> no, i think the timing of this was remarkable because adam schiff for years lied to the american people. he used his position on the intelligence exitee to peddle

these lies constantly, and he got busted for it. and durham, you know, there were several exchanges today with him. durham held his own but continued to highlight how adam schiff frankly failed the american people and continued to perpetuate this false narrative. burned all types of money through investigations because of adam schiff's actions on the intelligence committee. so this was the right vote for the house of representatives. >> trace: and he will use that censure to fund raise to try and get dianne feinstein's seat. congressman thank you for your time we appreciate it. >> thank you trace. >> trace: remain for college swimmer riley gaines an outspoken voice for the rights of women and girls in sports was back on capitol hill criticizing potses that protect transgender athletes and discriminate against women. ashley strohmier is in new york with the latest on this ashley good evening. >> reporter: hi trace. the national debate over whether transgender women should be allowed to compete in women's sports made its way to capitol hill today.

a hearing on lgbtq silver rights senators heard from former collegiate swimmer turned activist riley gaines who described her experience competing alongside trans athlete lea thompson. >> ncaa forced me and my female swimmers to swim, to share a locker room with thomas a 6'4" 24 year old male equipped with and exposing male genitalia. let me be clear about this. we were not forewarned we would be sharing a locker room. no one asked for our consent and we did not give our consent. >> reporter: gains also refuted the claim of another hearing witness, human rights campaign president kelly robinson said biological males don't always have a significant advantage over biological females. robinson pointed to an article about some men claiming they could beat serena williams in tennis. >> it's just not the case. she is stronger than them. >> both serena and venus lost to the 20 3rd male ranked tens

unified school district's final board meeting of the year last night. it was the first meeting since june 6th when we covered those violent clashes. as the board voted on lgbtq issues, last night one person was arrested outside and inside the meeting the district superintendent announced her retirement effective next week. >> well, a new report from the university of california says that almost half of the state's homeless are over the age of 50 and lost their homes because they couldn't keep up with the bills. california accounts for some 30% of the nation's homeless population. ♪ >> the fox news at night common sense department still trying to process a plan laid out by chicago ace new liberal mayor johnson. a $25 million program to cover the cost of rent for illegal immigrants. the money would come from both city and state taxpayers. mayor johnson says it's all part

of chicago being a sanctuary city, which is odd considering last month chicago's former mayor lori lightfoot said chicago did not have the resources to handle an influx of migrants. but now brandon johnson says, quoting, "as a city we commit to take care of each other and provide all of our neighbors with the resources they need to 35." and if johnson runs out of resources, you know, money, his liberal allies say he should simply cut finding from things like police. common sense thinks now might be the time to remind the new mayor that while he's looking out for people who are in this country illegally there are plenty of u.s. citizens living in chicago who are paying their own rent but they keep getting shot. as we found out last weekend when several dozen were shot and a dozen of them died. common sense thinks the mayor is spending a lot of time trying to keep people living indoors, when maybe he should spend more time trying to keep people living.

meantime as china pushes back the state department has doubled down on president biden's remark that his chinese counter part is a, "dictator". watch. >> we won't hesitate to call out areas where we disagree or be blunt and forthright about those differences and of course one of those areas the president and secretary have been clear about is the differences between democracies and autocracies. >> trace: let's bring in former trump foreign policy kiron skinner. great to have you f he called president xi a dictator. saying it was irresponsible and extremely absurd. what's your take on the remark. >> i agree with the first that it was irresponsible given that the biden administration had basically begged its way to the china meeting that the secretary of state just had this week. and for mows they've been trying to have this meeting after having cancelled an earlier

meeting due to the surveillance balloon that china had over our country. so once they got to china, there was an attempt to get some minor steps moving, like reestablish communications, no major strategic dialogue, some agreements on stemming the tide of the precursor chemicals for fentanyl. why put all of of that in jeopardy? we already know that he's a dictator. it's been said before. this wasn't the best time. it's the best fit in terms of rhetoric or statement or description, but not the best time, especially when you're already working really hard on your own to get something moving. and while there, remember, just this week blinken walked away with no commitment to a strategic die long. >> trace: right. >> just the opening of communications. >> trace: except to say he did not support independence for taiwan. speaking of china slumping

standards in military the chief of the air force bass said quoting, based on my travel and conversations with airmen of all ranks i have noticed a common concern regarding standards. history shows that when standards erode, military capabilities and readiness decline. this is not a time for military readiness to not be in full effect if something should happen. >> so military education is just a reflex of what's happening in civilian colleges and universities. so i think this is a larger category of what's happening in american education. where we see standards being lowered consistently in colleges and universities, in military academies. and this has been on the march for about a half century. as we've moved away from any commitment to studying the west and western education, western values, classical education, i think we've seen, you know, just

former drug czar but i know you're also a student of history and i wanted to get your take on the china deteriorating relationship with the united states because of that reason. not only are we talking about this training facility, there have been weather balloons and then you have president biden calling president xi a dictator. what's happening here in your estimation? >> yeah, well, they're very aggressive obviously and it will be less than a hundred miles with military force. let me give the education angle on this because 60 years ago, when the russians were in cuba and we had, you know, the scare there, people were in panic. people at universities, just reading about harvard that year, people went home. there was worry that it was the end of the world, the war. what do you see now? i see a lot of shrugging of shoaled shoulders. who cares.

a lot of america's place in the world it's frightening. biden's frightening but people also not taking it seriously enough, we're not getting the critical mass. these people mean us harm. and, by the way, i was just talking to a colleague, they're weak. i mean, there are real weaknesss in the chinese economy, their social policies have been ridiculous. we could take them down with more aggressive policies but not with the nonsense talk we're getting from the president. anyway i just wish people would pay more attention to this because they'll be at our doorstep. that's really serious. >> trace: yep. they exactly will. i want to move on to this recent gallup poll because the numbers are somewhat astonishing. the question is are you satisfied or dissatisfied with the way things are going in the united states and look at the number, satisfied 18%, dissatisfied, bill, 81%. i mean, what do you make of the

dower mood in this country. >> the mood is ugly tmood is downward. people are feeling a sense of decline. i mentioned slughrugging of shoulders earlier, we talked about that, i talk about these things, you and i talk about it with people and they say, i don't know, i just watch netflix. obviously there's some objective realities here of the economy, i mean, inflation, the price of things, and the fact that we just don't -- you know, we're not a strong country. people don't realize that not having strong leadership translates into the body politic. it really does. so that's part of the dissatisfaction. we've been a very successful nation but i think the next few years will test whether this nation, as the words go, will long endure. >> trace: you are, of course, the education secretary. math and reading scores, bill, among american 13-year-olds are at the lowest level in decades. the associated press reports the following, quoting, students at all achievement levels saw

decreases but while stronger students saw slides of 6-8 points, lower-performing students saw decreases of 12-14 points the results show. and this, by the way, has very little to do with the pandemic. >> yes, that's right. i'm glad you mentioned that. this is not covid. these scores were going down before covid. we stopped doing what works. we stopped doing what we knew was effective in the early 60s which was our peak performance in many ways. we were doing the right things. you remember, things like recitation and memorization, these have been, you know, trashed and thrown out. these things worked. you know, you can hire people today, they cannot multiply eight times seven in their head. they cannot do it. i remember standing against a wall having to do it over and over again. so we abandoned what works. i want to say particularly in reading. reading is the fundamental thing. if you don't read, and read well, your life chances are very

>> trace: first up tonight's california crime roundup, a 60-year-old man simply trimming his trees in an oakland neighborhood was shot dead monday evening when a car passing by fired a single shot. he went to a neighbor's house collapsed and died. neighbors and local officials say they're in shock. >> there's no way he could have been careful. how are you careful trimming your tree? how are you careful wash your car? >> there's not like he had a rolex on. what would prompt anybody to shoot him. >> we're definitely shaken. >> it just feels like oakland's really lawless. >> trace: oakland police now looking for three suspects >> a thief in san francisco targeted this corner shop twice in one weekend and destroyed all the windows. all for some alcohol and five bananas. of course the damages will cost the owner thousands to repair, not to mention the cost of

our fair share of resources from the state where we send all of our funds now. it is a process that we're looking at first to research the options and make sure that we quantify if we're getting our fair share or not. >> trace: are you saying that, if you got more money from the state, that maybe the mindset would change? if the state sent you more resources and money maybe san bernardino's county mindset would change and they would be happier staying? is that kind of what we're dealing with here. >> the board of supervisors is starting with the research process. they have a request for proposal to a research firm, which is what the citizens voted for, research whether or not we're getting our fair share. then they're having a community meeting set up very soon where they want citizen input. a little bit different than when the submissions started which is great. then they work the various
