the rest. and now we learned that the deep state, the doj, the fbi, the irs interfered with the hunter biden probe. according to house ways and means committee chair jason smith there was a delay divulge and deny campaign. >> we have just released details a lack of u.s. attorney independence recurring unjustified delays, unusual actions outside the normal course of any investigation, a lack of transparency, across the investigation and prosecution teams and bullying and threats from the defense counsel. this was a campaign of delay, divulge and deny. whistleblowers say recurring unjustified delays pervaded the investigation including an authenticating a whatsapp message in which hunter biden demands payment from chinese officials noting that his father

is in the room. >> the delayed past the statute of limitations for some of hunter's crimes. they divulged by tipping off hunter's attorneys and they also denied a key search warrant. listen to this part. a whistleblower named gary shapley junior who oversaw hunter's irs probe became a whistleblower and testified that hunter biden's whatsapp message quote made it clear we needed to search the guesthouse at the bidens delaware residents where hunter biden stayed for a time. why did they do it? according to shapley assistant u.s. attorney in delaware leslie wolf said this. optics were driving factor in the decision on whether to execute a search warrant. optics. that was despite admitting that a lot of evidence in our investigation would be found in the guesthouse of former vice president biden. so they know where the evidence is, but they don't go get it.

she said there is no way we will get that approved. that is all according to shapley. shapley also said they wouldn't allow questions about the big guy and dad. i wonder why rex the doj allegedly denied david weiss's attempt to bring charges against hunter in dc around march 2022. they denied his request in the fall of 2022 to bring collards charges in california. they denied the status request in the spring of 2022. that would have protected him from justice department influence. merrick garland assured us in his senate testimony that he never interfered with weiss's work. >> the hunter biden investigation as i sat in my own nomination confirmation hearing is being run by and supervised by the united states attorneys for the district of delaware. he is in charge of that investigation. there will not be interference of any political or improper kind. i have pledged not to interfere

with that investigation and i have carried through on my pledge. i promise to ensure that he is able to carry out his investigation and that he be able to run it. and if he needs to bring in another jurisdiction he will have full authority to do that. >> that's a lot of assurances. did merrick garland lie to congress? the doj today claim that weiss had full authority. but we have questions. arkansas senator tom cotton joins me now. senator cotton, this is explosive. joe biden is in the room. what does congress do with this information? >> it's getting to the point were it's hard to be shocked by any corruption allegations against the biden family. these revelations are truly shocking that you had the highest reaches of the department of justice, the fbi and irs meddling in these career prosecutors and investigators work refusing to allow them to bring charges or charges that are appropriate for the statute of limitations would run out

refusing to allow them to oh get search warrants where there is evidence of crime. this text message of hunter biden saying he was sitting with his father trying to get money from a chinese communist official and that there would be severe consequences for those officials. these are all shocking revelations. i hope that the house would be able to call in all the supervisors who were involved in these decisions and have them explain it for themselves. obviously there is nothing from merrick garland because merrick garland is running the most politicized department of justice in modern times. but we have to demand answers from merrick garland and christopher wray the director of the fbi and janet yellen as secretary of the treasury who oversees the irs. >> we have to. senator cotton, at this point if you don't believe joe biden lied, he said i knew nothing about hunter's business dealings. if you believe that as george strait would say i have an oceanfront property to sell you in arizona. who could possibly believe that the evidence is in front of your very eyes and that joe biden did not tell a lie to the american

people over and over again? >> we have it right in front of our eyes today, the text message from hunter biden saying he was sitting with his father and threatening someone about what they would do if the guy didn't fork over the money. common sense has always said that. joe biden took hunter biden gallivanting around the world on air force to for 13 our trips and now he's doing it on air force one. does anyone believe that joe and hunter were not discussing what hunter biden was up to? why is he going to china? who is he meeting with? how is he coming up with this money? where is the source of the money that hunter biden is blowing on drugs and as this investigator revealed? those are questions that he was asking and there is a lot of conversation about it. these whistleblowers deserve to be heard in the supervisors need to give answers. >> senator cotton, i get that you are not in joe biden's head and i am not asking you to go there. that's a pretty empty place at times. but asking you to go there

i am pretty confident that when he was leaving the vice presidency in 2016 that he thought it was finally time that he could get some of that money as well. that's why you see e-mails out there talking about holding 10% for joe biden. this has never been about hunter biden and hunter biden's troubles. it's always been about what hunter biden and other members of the biden family have done to trade on joe biden's name, office and influence. >> hunter biden is front and center. i think joe biden has made the calculation that it isn't going to stick to him. hunter biden is leading joe biden around ireland and is at the state dinner right now. has joe biden made the calculation? i will keep hunter front and center and the american people won't care. >> i guess you could say that joe biden has gotten away with it now for 50 years. look what happened earlier this week. hunter biden got a slap on the wrist. they let the most serious crimes lapse under the statute of limitations. they didn't even charge any crime related to corruption or

remember him? and an unusual move and having no evidence of russian collusion obama's intel community unmasked general flynn's identity in a phone call with a russian counterpart completely destroying his constitutional rights. they did it because he suspected he might have violated the logan act. it's a 200-year-old law never before used to prosecute an american. in january 2017 an internal fbi document found that flynn was no longer a valid viable candidate for investigation. but wait, here comes trump hating disgraced fbi agent peter strzok. he wasn't giving up. he said to keep the case open. a few weeks later peter strzok headed over to the west wing where he interviewed michael flynn. before he did, an fbi agent scribbled down on a note before hand what is our goal? truth, admission or to get him to lie so we can prosecute him are get him fired? it sounds like a set up.

the fbi assured flynn that he didn't need a lawyer. we are just going to have a chat, they said. that chat turned into a crime of lying to the fbi just as the initial fbi note had suggested. the only crime michael flynn had committed was incurring the wrath of the deep state. so the deep state needed to create a process crime. the case was eventually dropped by the department of justice. but the fact remains two tiers of justice if you are hunter biden the deep state cover up your crimes. if you are michael flynn, they invent one. matthew whitaker is the former acting attorney general and joins us. matthew, good to have you. how can you deny at this point the two tiers of justice? are you astonished by this explosive hunter biden investigation? >> i am. there is so much to unpack. you and the senator did a good job covering some of it. the example of the two-tiered system of justice is really the individuals. it's not the celebrities.

we have heard their names. it's the individuals whose names you will never know who went to prison for similar crimes. remember, this investigation was managed very carefully from maine justice it appears with the really preventing investigators from looking at real evidence from getting behind where this money came from. it was a slow walk and delay until finally most of the money hunter made from these illegal business deals from the influence peddling were passed the statute of limitations for the tax crimes. now based on everything that i know about how the system works, i think hunter biden will go in front of a magistrate judge like if you had got a speeding ticket at a national park because he is only pleading to misdemeanors. the diversion agreement is an agreement between the u.s. attorneys office and the defendant. this is a very strange case the way it is being handled. >> because we know about this foul play, if you will, can this plea agreement be undone at all?

is there any power a judge would have? >> a judge would have power on a plea agreement, but again, as i have thought about this today, these are two misdemeanor tax failure to file charges. and so, that would typically be handled as part of the misdemeanor document. obviously a district district court judge could take that case over themselves and decided. in a typical plea arrangement in 11 c1 see where a judge has to approve it got would be the entire federal system. right now the way that this has been set up appears to me and my experience, kayleigh, that this is intentionally being made in this manner so the federal judge might not be able to undo it are reject it. >> on that point there were some reporting about a judge that would oversee this case. the judges name was maryellen, a trump appointed judge. she is just overseeing the gun component of this, the felony and diversion agreement that

might not stick to him? >> that is the question that we have to wait until the plea happens in july to see who is the presiding judge. if it is that judge and a trump appointed judge, certainly she will look at the entirety of the facts. to your point, one of the things the judge will consider as other similarly situated defendants. in the federal system everyone should be treated similar no matter who their father happens to be or what their political connections are. based on my experience in doing many of these cases as a u.s. attorney, i know that similar cases have been punished a lot more than what the current deal is for hunter biden. >> you have a long history. it wasn't just acting ag for trump. you were a u.s. attorney in the bush administration. have you ever in your time they are seen a case where an irs agent, the guy leading the case, overseeing the case, says i need a search warrant and someone says sorry, optics? >> you are right.

american schools are failing according to a new report. middle school test scores are falling faster than any time in the past 50 years. parasitic teachers unions and left-wing administrators have taken over and they don't want to help students. one teacher's union executive in virginia defended the learning loss. that was associated with remote learning. you remember the covid edicts, the school shutting down. she defended them by saying they made everyone, quote, equal.

virginia governor glenn youngkin ran against the corrupt education establishment and won. he joins us. welcome welcome, governor. >> good evening and thank you for having me. this is just another example of what the left liberal progressive establishment is trying to do to our children. we watched randi weingarten come out and advocate for keeping school shut win in fact they needed to be opened. in virginia where we had democrat rule that lowered expectations and standards for our kids year after year, they combined and we are seeing the results. in virginia's own testing last year we saw that in fact our fourth grade kids had the largest learning loss in the nation in reading and math. combined closing schools unnecessarily with the fact that expectations had been lowered and we have a whole generation of kids that are behind. we have to go to work to catch them back up. >> we do. i believe a lot of voters have seen you, seeing what you are doing, and support what you are

doing. a republican on the issue of education is almost unheard of. and winning virginia. virginia is a state that no presidential candidate on the republican side has won since george w. bush. you won the state. you had endorsements in your primary race this week. you are 10 for 10. your candidate is winning by 18-point margins, 40-point margins. el centro was the issue of education to those victories? >> it's going to continue to be central. let me remind you that in fact virginia was a state that was completely blue and education has always been a topic that republicans have kind of shied away from. we ran right to it because of course loudon county became ground zero for parents rights and for breaking through the established standards that the school unions get to dictate what happens in schools. this is now the top issue across not just virginia, but i think america. this year we have our own

midterms, our primaries were a great moment for us to once again reclaim education as a republican stronghold. we are going to carry it all the way through to elections in november. this is no longer just republicans against democrats. this is virginians and eventually it will be americans who much prefer the fact that republicans are standing up for our kids and empowering parents versus democrats who are just in lockstep with the teacher's unions and randi weingarten. >> one question i have is the achilles heels of the primary. it was a huge night for you and i don't want to take it away from you. but the only pro-life democrat lost the race. abortion is a key issue. my eyes are open to the political realities on the issue. how do you message on that issue as you head into the general elections in the fall? >> well, of course, in virginia just three years ago there were debates on our general assembly floor controlled by democrats to

pass constitutional amendments that would enable abortion all the way up through birth and paid for with funding from the state. that virginians think is too extreme and expressed it in 2021. they want fewer abortions, not more. after the supreme court ruling came out we came together and really felt we could bring people together around a bill to protect life at 15 weeks. i believe that is a place virginians will come together. this is a moment for us to make progress on this issue. i look forward again to getting our legislators to hopefully bring forth a bill to protect life at 15 weeks this next legislative cycle after we hold the house and win the senate. >> worth remembering your predecessor ralph northam won. we will never forget that statement. final statement for you. if you win in the fall, which you could, you could take back the senate from the democrats and have unified republican control and was previously a

blue state of virginia. remarkable to think about. the question becomes are you waiting on the sidelines for 2024? there is a lot of people saying run, youngkin, run should that happen in the fall? >> it's a humbling question and i am always reminded that 40 years ago i was taking out trash and washing dishes and having to have a moment where people are considering that topic for me is truly humbling. let me just be clear. i am focused on virginia. we are going to win our senate back this year and hold our house and continue this big transformation. a state that was blue and was really lost and people thought was gone forever we have turned red and have had great success in pushing forward an agenda to cut taxes and back the blue and power parents. we are growing and it is working. it's not just republicans anymore that are recognizing. that is what it is so exciting. i look forward to the fall and

number two, they refused to defend title ix. this was a historic law 50 years ago and was championed by an amazing congresswoman from hawaii, patsy mink. yet they have in their lack of a defensive title ix shown as they are not interested in protecting women or girls. they are not interested in protecting their rights to equality in sports, which is the heart of this historic legislation. and frankly they are trying to change our language. this was very evident in this johns hopkins university lgbtq glossary where i could not believe it when i read it. they defined a as a non-man attracted to non-men. even in that definition they refused to use the word woman. that is where this is such a bigger issue than sports itself. they are trying to change our language which is how we see the world. it's how we communicate to each other. they are trying to erase women as a category of people.

republican. he said where did you hear it? i saw it with an influencer on tiktok. it is starting to work with my kids. >> i love to hear that. it is indispensable for the next election. another question for you is this candidate pledged to enter the debates the edge you have to support the nominee. i totally agree with you on principle. kristy calls it a useless idea. trump, i don't think you will get him to sign the pledge. do have to do away with the pledge in order to not have one person debating themselves? >> that's the republican party nomination in the pledge is staying. anybody who wants to seek the nomination of our party should pledge to support the voters. if you go through this process and take time on the debate stage and you are going to be there, the number one pledge should be called to be to fight in. at the end of the day we have to be united in one thing. joe biden is destroying this country. his policies are making our families less safe. we are less prosperous under him. crime is rising, schools are failing.
