>> greg: we are all out of time! i love you, america! >> trace: welcome to america's late news, "fox news @ night." i'm trace gallagher in los angeles. and breaking tonight, we are getting more precise timeline of exactly when the titan sub imploded and if the u.s. navy heard the implosion even if they did not have conclusive evidence, why not make that information probably? we will talk about that as well as where the recovery effort goes from here and what this means for adventure tourism. in moments, we are joined by u.s. navy captain hartman curry and the code would with the

heritage foundation. but we begin with team fox coverage. marianne rafferty with key information on the five crew members including a fascinating connection to the passengers who sailed on the titanic but first the matt finn live with what we know about the implosion and the investigation. good evening. >> reporter: good evening. the coast guard says a report discovered a debris field from the imploded ocean gate sub just 1600 feet from the bow of the titanic 2 1/2 miles underwater. >> the debris is consistent with the catastrophic loss of the pressure chamber. upon this determination, we immediately notified the families. on behalf of the united states coast guard and the entire unified command. >> reporter: the coast guard said the sub did not collide with the titanic and the debris location appears to be consistent with the sub's dissent path. a coast guard admiral says sonar

buoys in the water for the past 72 hours did not detect any boom, indicating that sub may have been destroyed shortly after it initially lost contact on sunday. this evening, the navy now says it suspects it may have heard the sound of the sub imploded or explode on saturday. use defense officials tells fox news that the navy began using top-secret military detection system immediately after the titan was reported missing sunday. the acoustic detection since -- system picked up a loud boom and reported into the coast guard, raising questions about the timing of the mission and the possible banging sounds reported in the following days. congressman dan crenshaw says his officers was receiving conflicting information from experts including whether the navy did indeed hear an implosion or if it detected the sound of the titan hitting the floor. and why the few number of robots capable of getting to the titanic depth were not immediately deployed. >> these people who are contacting our office telling us

considering the uncertain nature of how sound travels underwater, depending on when and where the implosion occurred, where this transceiver was that the receiver was that may have picked up the sound and the angle of our arrival, you can't be absolutely positive. it is something that you're going to be telling the search team and you might be helping focused some of the search and some of the area. but to win out and say, hey, we heard an implosion. might have -- it turns out to be correct but it may not have been correct. we want to make sure that you are very careful in how you use that information because sometimes the wrong information or incorrect information can be worse than no information at all. >> trace: u.s. congressman dan crenshaw says that he was response was terrible and it really should have been an all hands on deck situation. listen to him, dakota, and i will get your response. >> what appears to be the case is epic failure in leadership. where exactly that leadership failure is, i'm not sure.

's heart is in this. there is a heroic nobility in responding to this type of crisis. you know, in a coldhearted situation, it is a 20-foot sub with five people aboard and we got creators and all sorts of things flying the waters involving, you know, thousands or tens of thousands of people. so you can take the entire military establishment and apply it against one problem, even one that gathered so much public attention. so my sympathies are with the crews that responded, the leadership chain, people trying to figure out, what is needed, contacting who might have that asset, stating that asset into the area and then getting into the water and operating it. you just can't do that on a

moment's notice it takes time, attention, notification, mobilization, although sorts of things. so i think he was off base in living such heavy criticism. >> trace: james cameron, the filmmaker who is behind "titanic," he became kind of a deep seam expert. he said this tonight. watch. >> they had lost tracking simultaneously. the only scenario that i could come up with in my mind that could encounter that was an implosion. then i watched over the ensuing days this whole sort of everybody running around with their hair on fire search, knowing full well that it was futile. >> trace: you kind of go back to that little things we have heard of the years remember the soccer team cocaptain critic they were in the cave. we do not know the early hours where they were but everybody, every country, everyone just flooded resources there. he think this was handled the right way from the beginning to end? >> well, considering the information that we have, you

campaign to protect the son of joe biden by delaying, divulging, and denying an ongoing investigation into hunter biden's alleged tax crimes. the whistleblower and irs criminal supervisory special agent gary shipley junior said decisions in the biden case seem to be influenced by politics, "those decisions included slow walking investigative steps, not allowing enforcement actions to be executed, limiting investigators line of questioning and even misleading investigators. however, there are democrats like hakeem jeffries who reject the allegations of favoritism for hunter biden saying such a suggestion, he said today about that, no, this is not serious. period, full stop. that is the democratic perspective, among many. trace. >> trace: kevin corke is live in dc. thank you. let's get some political analysis from professor, attorney ethan bearman and california gop chairmen --

team, and even hunter biden's lawyer and then they denied. they denied the ability to win do search words. they denied the ability to bring charges. this is unfortunately because all of americans are looking at this like there's two different systems of justice. >> trace: quoting here, the beltway? spent the week assuring the public that hunter biden's plea deal did not amount to special treatment. you can believe that or you can read the sworn testimony of internal revenue service investigators who say the opposite. is a glimpse the turns this week's into a joke. the justice department needs to provide answers and even if you are a democrat, by the way, going to see you, ethan. even if you are a democrat, you must be a little concerned about some of these statements being made by the whistleblowers. >> i'm not terribly concerned. particularly because the u.s. attorney himself for -- who is trumped appointed and president biden kept him on instead of firing everyone from the prior president. specifically said, i was not influenced by politics and nobody told me what to do on this.

but if the prosecutor himself is saying, that is not what happened here, then the whistleblowers sounds like somebody who has an agenda, not the attorney and prosecutor. >> trace: moving on to politics know, congressman will hurd jumped in the race today. let's listen in. >> i believe the republican party can be a party at the talks about the future could not the past. some of like me, dark horse candidate can pull this off. you can't be afraid of donald trump. too many of the candidates in this race are afraid of donald trump. >> trace: i mean, there's 12, right? obviously, it could go a lot higher than that. do you think he is -- is he a true competitor? >> absolutely. and i think all of these candidates are going to be making their case. we have an embarrassment of riches when it comes to the republicans. former cia eight-member and turn congressman in a border congressional district, he is absolutely a formidable candidate. he is going to have to make his case to the republicans all across the country.

reverent meantime, of the other side, you have joe manchin and, i mean, he could take some votes away from joe biden. here is joe manchin. watch. >> everyone is trying to find this -- democrat and republican party have gone to extremes. if you can have a movement that brings people back, showing there's a tremendous support for the sense of centrist middle. >> trace: joe manchin is in the middle and the problem with that if you are a democrat, ethan is used to take those away from the guy who is a little further to the left, joe biden. is an issue for democrats who say this is a bad -- st >> and i think joe manchin -- but i do agree -- if he does yeah, i see that as -- anyone who is going to take votes away. joe biden has shown himself actually to be a centrist, with the chips at the inflation reduction act. these are by partisan infrastructure bill. bipartisan support on some of these and then republicans want to take credit for them anyway. joe biden has brought manufacturing back to united states in a way reviews

include small businesses or big hotels. mayor breed says it is because of "shifting shopping trends." interesting because when nordstrom announced that was leaving, it did not say a word about shopping trends. it blamed "the deteriorating situation in san francisco." apparently stepping over syringes, stepping in human feces and getting robbed tends to downgrade the shopping experience. mayor breed says the remedy is to demolish all that empty retail space and build housing. so if common sense has this right, people are afraid to shop and eat in union square but they can't wait to live there, even with no place to shop or eat. next time the fbi releases its and will crime stats, common sense wants you to forget about the numbers on murder, , and robbery and look closely at shopping trends. let's bring in california

from when back to the top story, the catastrophic implosion of the submersible near the wreckage of the titanic. many legal questions are being raised and we expect to see plenty of losses relating to this tragedy. let's bring in criminal defense attorney joseph talley. great to have you on here. if you give consent, everybody is asking, if you give consent to a dangerous activity like going down 13,000 feet in a sub, it does not relieve the company

of liability? >> not always. there's an assumption of the risk, which is an old common law term which does believe people even if they are negligent from liability because someone assumed the risk. you have to know the risk and you have to voluntarily assume it. however, if there's operational negligence, if the company was cutting corners, if they had an aversion to safety protocols, then that was not covered in the waiver. and therefore, they would be vulnerable to a lawsuit. >> trace: interesting because cbs reports the following. lawsuits and industry experts had raised serious safety concerns about the project years before the sub's disappearance. in 2018, a professional trade group warned that oceangate's experimental approach to the design of the titans could lead potentially catastrophic outcomes which brings up the next question which is, if they want the company, i don't care how many waivers you signed, if they want this company that they were facing some kind of danger

and they just do the awarding of, what does how does that change the equation? >> it makes the assumption of risk, it makes the waiver null and void. so you could say, listen, this was designed affect -- the effective. it was negligent in its design and that was not in the waiver therefore the waiver does not cover us. >> trace: then you go back to this because former passenger, his name is mike reese and he said the following, that is always looking. it is in the back of your mind before you even get on the boat, there's a long waiver that mentions that anyone page and that is what he keeps saying and that is what others keep saying. listen, they made very clear that you sign these waivers and they say, you kind of know it. they explain it. to give you a tutorial. here is what you are in for. going to take this long and it is one of those things. why would you even have a waiver of the first place if there's a way for attorneys to get around? >> so that law is meant to be flexible. so we building, if it is rigid, it will collapse during an earthquake.
