at's treatt-e-d.com. >> greg: we're out of time. thank you to erin perrine, tyrus , kat timpf and our studio audience. >> trace: good evening. welcome to america's late news, "fox news @ night." i'm trace gallagher in los angeles. breaking tonight, moscow is on full alert including tanks in the streets as russian generals are now accusing a russian mercenary group of attempting a military coup, and the man leading the rebellion claims he has support from conventional russian forces. this could change the war in ukraine in an instant. the senior foreign affairs correspondent greg palkot is live in kyiv with the breaking information. greg, what are we learning? >> reporter: trace, first, it's 7:00 in the morning here.

it has been a busy night here. 20 russian missiles fired at this city. most were shot down, but there was death and destruction, but you are right, it was even busier across the border. experts are saying this is the biggest internal challenge to russian president vladimir putin since he started this war. russian officials claiming the fogner group mercenary chief yevgeny is launching a coup, an armed uprising against the government, specifically its military leadership and is demanding his arrest. all started friday morning when yevgeny blasted the whole bases and conduct of this -- basis and conduct of this war. later, he launched one more threat against the government saying his 25,000 men would leave ukraine and take on the regime. all night, we've been watching incredible scenes of russian military rolling out to protect moscow and a key city to the south and then columns of the

trucks, tanks, armor and troops rolled into the city marching around and with barely any fight at all reportedly taking over the important military headquarters, police, security, city hall despite russian choppers and planes in the skies. and according to reports they're not done yet, trace. there are new reports that another column of forces heading up the highway towards moscow itself. clearly, the russian government will not let this stand but so far, officials have been letting it happen. russian president putin is said to have been informed of all the action. remember, again, they were close allies of putin and the forces played a key role in the war here. he's been allowed to mouth off a bit about war strategies but clearly, trace, on this day, he's well overstepped his bounds and he's politically rocking

moscow like something that's happened in the last -- like nothing that's happened in the last several months. the white house says it's keeping an eye on things, and i promise you the officials here in kyiv are watching as well. back to you. >> trace: as is the world. greg pat -- greg palkot, we'll get back to you. colonel davis is joining us now. the russian leaders are saying this is an attempted coup. you have on the other side yevgeny saying no. no. no. it's a march of justice. what do you make of this, colonel? >> this is the most bizarre thing i've ever seen in my lifetime. even the crazy things we've seen in this war so far, this way blows the top off of anything. the thing about yevgeny, he's been acting erratically for many months. he would sometimes attack the leadership of the country. then he would say, ok, everything's going good.

we're suffering from shelled hunger. the other side is saying, we don't see evidence of shell hunger. then things ramped up where he now starts accusing the russians of working -- the government of working against him. and, of course, you just heard from greg palkot there, it deteriorateed from there. >> trace: they're moving into russian territory. that's got to be one of the things where even if you don't think this is a coup, you've got to think something is up. this could lead to armed conflict inside russia. >> that's the big concern with russia. i think the reason why you haven't seen them take any military action right now is because even some of yevgeny's allies in in the ministry of defense, they're trying to talk him down. i think they want to try to avoid any bloodshed. if that news is right and it's headed right towards moscow, i'm very sure they won't allow it to

enter the city so it's going to be a very tense day. >> he said a bunch of things but he also said this, "the evil embodied by the country's military leadership must be stopped. the scum will be stopped." he's accusing russian forces of actually killing many, many of his personnel on this. >> he's been making other bizarre claims in the last 24-48 hours. i mean, he claimed the russians were running away from the front, that they abandoned a certain city that's about 20 kilometers behind the front which clearly there's no truth to this so it's really bizarre what he's claiming. a lot of things just aren't lining up in any way you look at it. >> you've got a military perspective on this. what's the next move for both sides? >> moscow will do everything they can to resolve this at the prigozhin level. if they could talk him down,

they'll consider themselves ok. it'll be disaster on their war effort if they shoot on each other. not only will it give the ukraine a huge boost but it'll be completely demoralizing to the russian army. >> hard to believe that yevgeny prigozhin will gate free pass on this but we'll see. colonel, thank you for coming on. we appreciate your time. >> thank you, trace. >> trace: in the meantime, we're getting new information about the tragic end of the titan sub including what caused the sudden and massive implosion dr. man will join us in a few moments on the science of diving a sub into the abyss. matt finn is live into the investigation into exactly what happened. matt, good evening. >> good evening, trace. national guard's investigation into the titan's catastrophic implosion is ongoing right now. the coast guard says they're collecting data from the debris field 2 1/2 miles under water. sadly, the coast guard commander says there's no guarantee they'll find the victims.

>> this is an unforgiving environment on the sea floor. the debris is consistent with a catastrophic implosion of the vessel. >> the coast guard says those apparent banging or tapping noises that were detected earlier this week were not consistent with the location of the debris field and now the navy says it suspects it detected a loud boom consistent with an implosion shortly after the tyson sub went missing. titanic director james cameron who is somewhat of a dive expert after visiting the wreckage many times is ripping ocean gage for dodging safety. >> ocean gage is not doing what they should be doing.

>> ocean gage says it's grieving deeply and asking for privacy for the families, trace. >> trace: thank you. dr. man, great to have you on -- hooman, great to have you on. i was watching you tweet about this as it was going on in the past several days. each time this sub goes under, you're saying, look, you're stressing it even more and you don't ever really know the breaking point. >> exactly, trace. so you have a sub that's made of a weak material that's not good at compression but good at being stretched, namely carbon fiber, that's not good with a vessel like this. it was tested repeatedly. the problem with repeated testing with a vessel that doesn't have a new one to send under the sea afterwards, each time you test it, you could get cracking and loss of the compresssive strength. it takes one more time to go underneath the water for the entire thing to implode. that is what seems to have

happened. >> here is an nyu aerospace engineer professor. let's listen to him and get your response. >> this wasn't just a clear descent t just really dove or dived into the bottom. the impact may have caused the disaster. you'd be crushed to death 400 times more than the atmospheric pressure. disintegrates rapidly. >> there's been speculation about how the pressure might have imploded this but there's the chance this thing was going down too steep and hit the bottom of the ocean and something happened there. do you have thoughts on that? >> i think, trace, the only way to really know is for them to recover the debris and analyze it. i'm sure if they do, that'll yield some clues but it sounds like even if this thing had been built to withstand that kind of pressure, even a small amount, as you heard this other gentleman saying, 400 times the

atmospheric pressure, human body could withstand 70 times at most so you're talking orders of magnitude morning more than that. -- more than that. it's impossible for anyone to survive. >> you tweeted about this. in part, you can drop a cell phone many times with no cracks and then one small drop shatters the screen. it's a similar principle. with you saying even time you drop a phone, it weakens it a little bit? kind of like this? >> exactly. right? i'm sure many people watching probably have experienced a similar sort of phenomenon where you drop a phone a bunch of times, even from a high distance, and you don't physically see any cracking but there are microscopic cracks occurring. all it takes after several of those have occurred or maybe just a couple is that that one time that it has a small insult, all of a sudden the whole thing shatters. with the sub, same sort of phenomenon could be occurring, especially one that's made out of carbon fiber, not intended for compression. it's just not stable. you can crack something made of

carbon fiber with your hand. >> trace: lastly -- got to go -- but scientists are saying this implosion happened 1/1000 of a second. would you agree with that? >> it makes sense that you have more than 400 atmosphereic pressures on this. if you look at the math presented on this and calculated the distance that the material would have had to travel to just reach the center of it from both sides, that's actually how long it would take. >> trace: yeah. it's amazing. great to have you on. thank you. in the meantime, new jersey democratic governor is now suing three of his state's school districts for adopting policies that require parents to be informed about their children's gender identity. ashley strohmier is live in new york with more on this. ashley? >> reporter: hi, trace. new policies in three new jersey school districts require teachers to notify parents if their children show signs of changing gender identity. that does include if they change their names and use different

pronouns or bathrooms that contradict with their sex. governor phil murphy's administration is suing those three school districts. the state's attorney general, matthew platkin, claims it's discrimination against transgender students if parents are told about changes to their child's gender identity because it would pose serious mental health risks adding the discriminatory policies passed by these boards of education, if allowed to go into effect, will harm our kids and pose severe risks to their safety. some parents say this amounts to a war on their rights. listen. >> you're trying to get into our kids' heads by having them think their parents are not safe. they are forcing children to turn to other people other than their own family mike children belong to me -- my children belong to me and no one else. >> reporter: while those new school board policies do include exceptions if a child's health or safety is threatened, new jersey is fighting to block the

policy from going into effect as the legal challenges play out. trace? >> trace: indeed. ashley strohmier live in new york. ashley, thank you. with more on the war over parental rights and legal aspects, let's bring in trial and criminal defense attorney lexi rigdon. great to have you on, lexi. this is the new jersey attorney general who said the following, quoting here, outing transgender/gender/nonconforming and nonbinary students against their will threatens physical harm to students including increased risks of suicide and shirks the district's duty to create a safe and supporting learning environment for all. outing. he says this is outing kids to their parents. what would you say? >> uh-huh. well, this is just madness! this honestly shouldn't be a left or a right issue. this is an issue of parents. even trans people have come out, like caitlyn jenner, fox news contributor, who has said that -- and who has obviously experience with this issue has

said that this is the purview of the parents. it's not the purview of the teachers. and the law supports that. parents have a fundamental right to parent their children based on the united states constitution. and i just don't agree with the a.g.'s take on this because this policy isn't seeking to out students. it's important to remember what this isn't. it's not where a teacher has an obligation if they see a male student with hot pink fingernails and wearing a skirt, they don't have the obligation to call the parents them only have the obligation to inform the parents in the event that the student requests a public accommodation based on their gender identity issue, changing their name, asking for a different locker room, asking for a different bathroom. so we don't want to get lost in the noise here. and if any student asks for a public accommodation on a nongender identity issue, the parents would be notified. if -- i could venture a guess if a student went to a teacher and said i need more time on this test, i can't complete the test

in the same amount of time that the other students are, that teacher would notify the parent and the parent would become involved, because the parents have rights, too. there are federal laws protecting a parent's right to review information on what the children are learning, being involved in iep's, so the parents have fundamental rights here, too. >> trace: i want to put this on the screen. new jersey's transgender guidance for school districts a parent or guardance may object to the minor's name change request. statute would may consider providing resource information regarding family counseling and support services outside of the school district. in other words, they will call your child what they want to call them and they can help them get outside resources to do whatever. quick thought on that. >> what's so ironic about this is these policies in place to protect trans kids because trans kids have a higher instance of depression, suicide. despite that, our elected officials think it's appropriate to defer to the teachers and not

the parents on this issue and to also defer to children on their own health decisions. so it's honestly madness. >> trace: we invited corey deangelis on the show to talk about a different topic. i want to bring him in quickly to have him comment on this discussion and lexi, we'll get your final thoughts. american civil liberties union argued it's unconstitutional for public schools to reveal a student's gender identity to others. angry parents could put their child in private school or home school them if they want to, said an aclu lawyer. your quick thoughts on this, corey? >> maybe they'll support school choice. the supreme court in 1925 famously ruled that the child isn't the mere creature of the state. the democrats should remember that pretty soon. they should stop trying play tug-of-war with parents over their children. kids belong to their parents, not to the government. >> trace: lexi, your thoughts on this. legally, is he right? is that a fair assessment? >> that's a fair assessment, but i also don't have a ton of faith -- i'm a jersey girl.

born and raised. love jersey. i don't have a ton of faith also because it's a very liberal state that tends to side on the issues -- tends to side on the issues in a certain way so i don't believe it's any type of discrimination based on the law against discrimination in new jersey but that doesn't necessarily mean the policy will stand. >> trace: yeah, lexi rigdon, corey deangelis, we'll see you a bit later. thank you, both. first up in tonight's real news round-up, new statewide poll shows 40% of californians are seriously considering moving out of the state. the majority sided cost of living for the main reason for wanting out. california's population has been in decline for three straight years. hundreds of hotel union workers rallied in los angeles today demanding higher wages. the rallies left nearly 200 people in handcuffs including two l.a. councilmembers as protesters blocked traffic near l.a.x. airport. the workers are fighting as you might manage for a new -- imagine for a new contract.

college baseball team is the target of a doctor's group because of its name. the macon bacon were sent a letter by the physician's agency for responsible medicine that promote plant-based eating that called out the team for promoting the unhealthy food them put up a billboard that reads macon keep bacon off your plate. the team's president responded this way. >> there's no way possible. we sent a statement right from the beginning we're not going to change our name ever. we sell a lot of bacon. we've got six degrees of kevin bacon sandwich. we've got bacon wrapped bacon my daughter came up with. we've got a little bit of everything. >> trace: the fox news @ night commonsense department thinks these big entertainment executives should remember that people actually live outside of los angeles, new york and d.c. and some of those people even watch television. common sense brings this up because taylor shared in the creator of paramount's hit

television show "yellowstone" says he first offered the show to hbo pitching it as the godfather of montana, but hbo took a pass. with one executive saying the show, "feels so middle america." that exec went onto say hbo is an avant-garde trendsetter and ended by saying that no one should live in montana. it should be a park or something, interesting because one of the show's hbo decided to greenlight is called "the idol." a soft porn series riddled with graphic section sex, unnecessary nudity and really bad acting, in other words, trendy and avant-garde. common sense wonders in avant-garde is french for no viewers because on sunday need. the idol pulled in 133,000 viewers. the cooking channel got more. and "yellowstone" that also airs on subbed got 12.1 million viewers in its season premier, nearly 100 times more. common sense is baffled why so

>> trace: well, new tonight, hunter biden's attorney is slamming what he calls the selective repleas in a as what app message from the president's son to the chinese businessman that invokes the name of his father, joe biden, of course. kevin corke has more. >> reporter: knights nice hoemage to the great paul harvey. good evening, my friend. the white house hoped, trace, tuesday's big announcement a plea bargain in the hunter biden investigation would mark the end of questions surrounding what the republicans call the biden family business, they were wrong. really wrong. according to newly-released congressional testimony, there's a 2017 whatsapp message showing hunter biden shaking down a chinese business associate for payment. here's the key, he invokes his

father's name in the process. "i'm sitting here with my father. we would like to understand why the commitment made has not been fulfilled. i will make certain that between the man sitting next to me and every person he knows you will regret not following my direction." the allegations, of course, undercut consistent claims from the president that he knew nothing of nor was he a party to his son's foreign business dealings. >> i've never spoken to my son about his overseas business dealings. >> reporter: uh-huh. well, that was then. this is now. needless to say, congressional republicans weren't buying it then and they're not buying it now. >> that i think is pretty compelling evidence that it looks like joe biden was involved in this somehow. >> reporter: compelling evidence indeed. the next step for republicans is obvious, finding out if joe biden himself benefited from his son's business dealings. that investigation, trace, continues tonight. >> trace: indeed t does.

kevin corke live for us in d.c. kevin, thank you. with us now is the dean of pepperdine university school of public policy, pete peterson. pete, great to have you here. kevin laid it out nicely there with the what'sup message where you have hunter biden saying, "look, my dad's next to me and we need to figure this thing out right away." the washington free beacon is putting up the pictures saying there's now evidence that hunter biden was at the wellington house with his family, driving dad's corvette on the very same day as the who's app message. it's not -- whatsapp message. it's not the smoking gun, pete, but it makes it very interesting. >> points out two things about this story. first, it's obvious the doj has fought to squelch this information. this has been an irs whistle-blower that's come forward with this information and at the same time, to see what happened at the white house today with john kirby who is essentially the spokesperson for the national security council, dodging that question, we're talking about china here this wasn't some discussion with somebody in brazil or venezuela. this is really a message and an

exchange that happened with really our significant competitor, if not world enemy on the stage. >> trace: yeah, that's exactly right. reuters/ipsos poll says hunter biden receiving considerable treatment. 50% say yep. 30% disagree. 21% don't know. the 50% number could be in the end, it'll be american voters making some of these decisions certainly as we begin the primary season beginning in january and certainly what's going on with the bidens and how they're being treated by the doj is certainly having an impact on how americans view how former president trump is being treated by that same doj. >> trace: yeah, gathering today the republicans, i want to put this on the screen, "trump is still king of the evangelical

cattle call. any preference among evangelicals to find a new detroit, drama-free standard bearer of the gop hasn't led to a concerted effort to do so" i mean, you know, talking to all of these evangelicalcals today and chris cristie came out after president trump and didn't get a very nice response. >> no he really didn't. he really did tear after president trump. he showed really if you watched that speech -- as i did today -- he definitely went after him on a personal basis but wasn't able to connect the personal attacks to the policy attacks and that really is going to be what the other republican candidates are going to have to do. cristie is very effective at attacking him personally but you've got to tie the personal with the political and, um, we've yet to see that being done effectively by another republican candidate. >> trace: i wanted to get your take on this since we have you. 2024, i found this interesting. this is the axios poll. good on crime and public safety? republicans 22%.

democrats 14%. latinos. republicans 14%. they're also kind of say you know what? the republicans are better at this whole crime thing than -- that really plays a big part because hispanics are going to be a huge voting block come 2024. >> it is. it's not just crime. you also have to look at the economy and when that same poll looked at the economy, again, hispanics trust republicans to do a better job on the economy. things like inflation, cost of living and jobs, all of those things, especially among hispanics, go the way of the gop >> trace: yep, pete peterson, great to have you on, thank you. a new nonpartisan study found charter schools in most cases are doing better than their public school counterparts. surprise, surprise. corey deangelis for american federation of children is joining us now. charter school studies show that they're making significant

gains. >> students enrolled in charter schools get more learning in a year's time in both reading and mathematics than they would have gotten had they gone to their local district schools. >> trace: i don't think this really surprises a lot of people, certainly not you, corey. your thoughts on this. >> of course, underperforming charter schools shut down. underperforming government-run schools get more money. in fact, charter schools nationwide get a lot less funding per student than the kids in the government-run schools so they're doing more with less. in new york city, for example, the latest data i've seen shows that charter schools receive about 19% less funding per student than the government-run schools yet they're outperforming them. one other thing is the study only focuses on test scores, which is important. we want the kids to learn math and reading, but families choose charter schools for a lot of different reasons including they want a safer environment for their kid and they want a school that aligns with their values so school choice benefits families in ways that go beyond the standardized test scores as well. >> even more interesting, the "wall street journal" writes the

following, quieting here, the latest study shows black and hispanic students had some of the largest gains and that they advanced more than their public school peers by large margins in math and reading. ditto for children in poverty. i mean, if you're parents in underserved areas this has to be a wake-up call for you. >> that's right. the least advantage. [indiscernible] happen to be stuck in government-run schools these days. government-run schools discriminate in the basis of zip code. if you live in the wrong neighborhood, you don't get access to the "best schools in america." charter schools have to accept all that come with a random lottery basis. they have to attract their customers and do a good job. >> i had to get your take on randi wiengarten, the ones that kept the schools shut and lied about reopening and said she really wanted to reopen them and now dhs is appointing her to the

academic council. this is pure politics. your final thoughts this, corey. >> when i first tweeted this out, everybody thought i was joking but it actually is true. we live if a clown world right now. what's randi wiengarten going to do with blatch dhs? going to shut it down like she did with the schools? that's what she's an expert in, right? she lobbied the cdc to keep the schools closed and even threatened safety strikes in response to republicans pushing to keep -- to reopen the schools so, um, it's just totally bogus. i mean, this is the very definition of failing her way upward. she's got no business being at dhs or advising dhs. she can't even handle the school system. why give her another role? >> trace: yeah. it is politics through and through. corey deangelis. thank you for the double duty tonight. we appreciate it. >> totally. thank you, trace. >> trace: coming up, the latest details on the suspect who repeatedly rammed his vehicle into an l.a. county sheriff's patrol car sending him to the hospital.

>> trace: first up in tonight's crime round-up, san diego is debating whether to use smart street flights help fight crime. police want to use the street light video cameras and automated license plate readers to help criminal investigations but the city council's privacy board voted unanimously to reject the proposals some residents agreed. watch. >> our biggest concern is that this money should be going towards communities, not towards cameras and surveillance. we all know that it's not cameras that keep us safe. it's youth drop-in centers. it's community health centers and mental health services. >> in san francisco, adopted son of an elderly couple allegedly

killed his 46-year-old mother and moved towards his 84-year-old father with a knife when police fatally shot him. police also found a dog stabbed to death inside the home. and the bay area rapid transit system or bart now approved $8.5 million in additional funds for transit police. the extra cash will help fill empty spots, give officers raises and put more officers on trains. good. now to a story we first brought you last night of a driver repeatedly ramming the cruiser of a los angeles county sheriff's deputy who, in turn, opened fire. the suspect was treated for gunshot wounds, in the hospital, but was listed in stable condition. the deputy was also treated for injuries, and he was released. let's bring in republican california state assembly member bill. bill, you watched the video -- we watched this and was baffled by it last night, because i brought up the "l.a. times" headline and the "l.a. times" headline said this, l.a. county deputy shoots driver who was doing donuts and rammed patrol
