9:00 pm
find the perfect vacation rental for you booking.com, booking. yeah. good evening. welcome to america's late news, fox news @night. a second anonymous irs whistle blower has come forward to sound the alarm about the hunter biden tax probe. mr. x. alleges the u.s. attorney was not calling the shots and things were being run from washington. a college biology professor in texas claims he have fired for teaching biology. his now former employer says the fact of gender are religious
9:01 pm
preaching, discrimanatory. jonathan hunt has been tracking the developments. >> we have seen these debates at schools across the country. the question always similar. when is it too early to begin teaching children about sexual identity? is it the job of parents of teachers? should stories featuring gay characters be banned? >> prince and knight is no more about gay sex than cinderella and know white are about heterosexual sex. >> parents should have the right for those topics. >> reporter: on one side of the debate, parents who argued scho schools have gone too far encouraging young children to
9:02 pm
question their own sexuality. >> how can they accept a very young child can diagnose themselves without professional help as one trapped in their own body and start thinking with aggressive treatment and hormones that can change their lives forever when we don't allow them to do much less drinking. >> reporter: the debate over sexual education in schools has sparked violence outside those schools. this confrontation in los angeles earlier this month unfolding during an anti-pride protest. one father argued in maryland tonight the protesting parents and those seeking so-called for their children misguided. >> to those advocating for an opt out policy that i'm not gay because of a book or interact with gay classmate or engaged in
9:03 pm
a conversation about being gay. i am gay because i was born this way. >> reporter: one thing we can all be assured of is this debate isn't going away any time soon. >> it is not. thank you. let's bring in two of tonight's protesters. ladies, thank you for coming on. this is a protester outside the school board meeting. watch. >> what's amazing is how this opt out movement has unified the christian community. give it up for the christian community. it's unified the muslim community. how it's yununified the jewish community. >> this is proof positive that most parents are not about to be told what their kids are being taught. what did you find? >> yeah.
9:04 pm
absolutely. i spoke to a number of parents and what was really interesting was that no two parents were alike and every one came from really different backgrounds. there was one point in the evening where i was standing there talking to a muslim dad leading the protest and a christian grandfather. we were tauklking about the fac we were there because we care about kids and parents rights. what's brinteresting is all the parents are fighting for the ability to opt out. they are fighting for the ability to say, i get a say over basic part of my kids education and democrats in montgomery county are saying, no. sorry, we know what's best. i think people are sick of hearing that. >> it's interesting. you talk about opting out. i want to play some more sound from one of the gay parents at the meeting tonight. we'll get your response. >> we cannot risk the erosion of an inclusive education system
9:05 pm
based on individual comfort zones. education is about preparing the youth for the diverse world they will inherent which include all youth including lgbtq feel safe and celebrated. >> you can accept child sexuality in your class but you don't have to is celebrate it. the kids don't have to celebrate with you. what are your thought s? >> a lot of parents are saying there's an appropriate age in which to discuss these really intimate sensitive topics and sexuality and gender. i brought with me two of the books. one is called pride puppy. very attractive book and another one is born ready. the true story of a boy named penelope which is about a little boy four or five years old. that's an age where kids don't remember to brush their teeth. these are a couple of books that the parents want to opt the kids out of being introduced to at a young age.
9:06 pm
i brought with me this caution tape. this was around the parents. these parents are the nightmare for the woke army. they are the intersectional rebellion now to all of this woke politics. bethany is right. the diversity that was there far out numbered that which is on the other side. >> i want to put this statement on the screen, if i can. this is the school board. mps expects all classrooms to be inclusive and safe spaces for students including those who identify as lgbtq or have family members in the lgbtq community. i'd like to get final thoughts from both of you. bethany, you first. >> they want it to be inclusive and safe space for only for some students. student who is are muslim, religious in any other way. it's not a safe space for them. this is religion for them. for the left, this is their faith. they have decided that they are
9:07 pm
going to disregard and disrespect every one else's faith because theirs takes precedence. >> we have about 15 seconds. can you wrap us up? >> absolutely. parents everywhere have to stand up. be inspired by these parents because they overcame their own fears and courage is contagious. they went into the trenches of the culture war and stood up to stand up for their children. every one should be inspired by them and continue this across the country. that's what it's all about in protecting kids. >> thank you for coming on. we appreciate your time. >> thank you. new fall out tonight from the audio recordings of former president trump appearing to brag about having secret information regarding war plans for iran. cash patel will join us in moments. to chief washington correspondent. >> we did nothing wrong. this is just another hoax. it's election interference more
9:08 pm
than anything else. >> reporter: in battleground new hampshire, former president trump racketing to the fall out of a leaked audio recording of him talk about leaving office about sensitive national security information regarding plan to attack iran. the audio is from a 2021 meeting with an author and several staffers at his new jersey club. >> isn't that amazing. this wins my case, you know. it is highly secret. this secret information. look at this. it says president. >> reporter: the former president continues maintaining it was not a classified document. it was just newspaper and magazine articles. a point he made with brett last week. >> there was no document. it was a massive amount of papers and everything else talk about iran and other things. it may have been held up or may not but that was not a document.
9:09 pm
i didn't have a document, per se. it was nothing to declassify. >> reporter: on fox, presidential candidate nikki haley called this matter a distraction from more important issues. >> if the indictment is true, i think it's reckless. there's going to be a trial. trump will have the ability to defend himself. we can't keep chasing every drama that surrounds trump. >> reporter: at the white house, a spokesperson would note say if president biden has heard the newly released trump audio. >> i'm simply not going to g h -- go here and refer you to the doj. >> reporter: this audio has two potential impacts. at some point, a jury hearing the former president's classify documents case. then there's the political aspect whether it takes him off message and if voters consider a distraction from republican efforts to win back the white house. trace. >> true, indeed. thank you. let's bring in former defense department chief of staff cash patel. great to have you on. the former president says he did
9:10 pm
nothing wrong. now you have prosecutors saying this tape is damning. where do you come down on this? >> as a former prosecutor and defender, after reading the indictment a few weeks ago, i was one of first people to say that i don't believe they have the document in question. when you bring case, you have to bring the goods. you have to bring the body in a murder case. when you bring a case you have to have that document. they didn't say that in the indictment. it was written very poorly. this instance, now arising through this conversation and audio tape, in my opinion, exonerates trump. i don't think the doj would have allowed this audio tape to break if it -- leak if they didn't want to counter a nartive. i don't think they have the document in question. having been around president trump, his unique ability to bring seriousness of times allows people messages to be heard and allows his position to be heard. i think you heard et clearly in
9:11 pm
audio recording. >> i want to move onto the hunter biden thing. there's a second whistle blower. he said the u.s. attorney said he was not the decision maker in the hunter biden investigation. your thoughts. >> yeah, this comes on the heels of, we have to remind the audience, the doj kicked off the entire irs investigating team of five years into the hunter biden scandal. now the whistle blowers are coming forward. remember when they subpoenaed every one under sun and it came to nothing. in this instance, you have six people, two u.s. attorneys, two senior fbi agents, a senior irs agent and others should all be subpoenaed by congress and the documentation should be provided and the testimony should be provided. this sounds like seriously credible reporting and it contradicts what merrick garland told the american people in congress that there would be no interference from the doj.
9:12 pm
>> what are your thoughts? do you think there's more to come. everyone thought it was put to bed and now it pyres appears if can find evidence that joe biden knew about the businesses, it's a blow to the administration. >> there is. i don't think lit be anything to come of it from the doj. i think what congress needs to do is build case for purpose of impeachment of garland and wrey to put the documentation out. this is damning information about an attorney general and fbi director lying about the fbi burying and worm holing an investigation during a political election cycle because it was about joe biden and not ant president trump. more importantly, it destroys our single tier system of justice and any faith that we have in fbi going forward. there's a lot more at stake than presidential elections. law enforcement is at an all time low because of failed leadership. >> i want you to put your department of defense hat on
9:13 pm
fefor me. is there a sense there's this effort to ramp things up because maybe russia is weakening because of this whole debacle this weekend? >> i never thought they were weakened this weekend. i thought it was staged by putin. he eliminated his number one adversary and now he's goaded us into a long term conflict. our response, send billions of more dollars and we're headed towards another haafghanistan which is tragic this administration will embed us in a two decade long war. >> great to see you. thank you. >> thank you so much. the supreme court dealing a blow to state lawmakers. rejecting north carolina's congressional redistricting plan as excessively partisan. the vote was 6-3 with chief
9:14 pm
justices roberts and barrett siding with the high court's three liberals. the top contender for the republican presidential nominate was in hnew hampshire as one candidate takes a stumble and the first fox news power rankings of the campaign season. we have them. good evening. sflp it's heetsing up. that first power rankings find a rematch between biden and trump on the horizon. it's these five states that could make the difference. president biden only won these of those by less than a single percentage point. republicans are banking on the president's low poll numbers to swing these states in their direction. the latest nbc poll gives president biden a net negative nine while vice president harris has a net negative rating of 17 which is the lowest in the
9:15 pm
history of any vp in the poll. >> he's running on '24, the same thing he ran on 2016 and didn't bring to fruition. >> why don't you attack others? because they're not in second place. soon, i don't think he will be in second place. >> he was asked during radio interview about religious persecution in china. >> i'll look at what it was. what you call it, a weeble. >> the uighurs. you really need to know about the uighurs. >> he claimed he did not recognize the pronounceuation used in that interview. >> bit of a stumble.
9:16 pm
thank you. the fox news at night common sense department just found out the pandemic eviction ban for tenants is ending next month. it lasted three years. for 36 months in san francisco, oakland and berkeley, renters were not required to pay rent because politicians decided tenants were all needy and landlords were all greedy. many say the policy kept them indoors but many landlords says the policy left them in the cold either drowning in debt or losing properties all together. while the landlords were forced to forgive renters, somebody forgot to remind the banks to forgive the landlords. we're told shoppers were not obligated to pay for merchandise. in california, shoppers are not obligated to pay. point here is when it comes to housing, the villains are always easy to pick out.
9:17 pm
the san francisco chronicle quoted one politician bemoaning the end of the eviction ban saying residents are industill struggling and need protection against ruthless landlords. common sense thinks maybe that's just republican landlords. let's bring in retired army lieutenant. it's great to have you on. the landlords have gone without income in the bay area for three years now. what do you think about this? >> well, when people in san francisco and california dekri t dedekri -- decry. who would invest in a multi-family dwelling in california if you thought politicians would say that rent
9:18 pm
you collect, you can forget about that for three years. this is ut erply rterly ridicul. the whole rhetoric about greedy landlords, it's any wonder why there's any buildings left standing in california with this sort of rhetoric. how are people even paying to renovate or maintain these buildings. much less pay for utilities and the mortgage, the payment on their debts. >> yeah. it's exactly right. i was thinking the same thing. they chkeep talking about this housing crisis and give landlords the raw end of the deal. california used to be the model for the nation. now the brookings institute says every state in the country other than california is saying i don't want to become california and every other city is like i don't want to become san francisco. now california has suddenly become housing and a lot of other factors a cautionary tale?
9:19 pm
>> it has. you see in california the weaponization of things like zoning or the california environmental quality act where especially in you see it being manipulated by power of and wealthy interest. labor unions that will take and object to a new development until they say, well, we will build this with union labor or we'll buy thousands acres over here and we'll have that as environmental remediation. it's used of green mail, trace. >> it's green mail. you're exactly right. texas gop congressman, your neck of woods, has introduced a no reparations act quoting american taxpayers shouldn't be forced to pay for radical race based reparation payments to please the woke left. could this gain some steam, do
9:20 pm
you think? >> i think it wocould. i think that reparations payments may be a violation of equal protection under the 14th amendment. this is crazy to think that americans who have no connection to slavery, might be forced to give money, give their teax mony to individual who is they have a tenuous connection to slavery in america to begin with. slavery is still a worldwide fe phenomenon. it didn't end in the civil war. we still have a significant problem on on the border of mexico where you have human trafficking and modern slaivery to people owing thousands of dollars to the drug cartel and heaven help you if you don't pay it. >> read it on fox news. what nigchina is doing in cuba

biology. the college alleges you pushed personal opinions that were offensive to many in the classroom. it appears the x and y chromosomes are personal opinion. what are your thoughts? >> i've been teaching the reproductive system as part of my college teaching and the reproductive system i would mention our sex is determined by x eggs and x chromosomes and if they are x and x, that person will be a family and x and y it's a male.
9:30 pm
i will say the continuation of human species the sex has to be between male and female. then the conception sperm joins with egg that's when a zygote is formed. if you give that to grow for 38 weeks, we get a beautiful baby. when i mentioned all those things four of my students just walked out of my class. then later, the vice president of the school, academic affairs, he sent me two e-mails. the first e-mail was that they are doing an investigation and without telling me complaints, the second e-mail was a termination letter. >> he needs to be reinstated now. what's the basis? >> well, the college has

violated a number of laws, including the constitution, the freedom speech clause, the free exercise clause, title vii that says you cannot fire someone for their religious expression even though he does not profess to have been talking about religion police chief. -- lebelief. even if the college views his idea that, for example, life begins at conception as a religious conviction, they still can't fire him for it. ultimately what we're looking at right now is a destruction of truth. >> i've only got a little bit of time but i want to know because everything you explained is the same biology that i learned. were they telling you that you were not presenting facts or did they just have a different opinion of what you were presenting? >> no, they didn't tell anything. they didn't know the nature of the complaints and they were

saying is i was doing a religious preaching in my class based on the facts that i taught for the last 20 years from the same textbook that the department gave. >> yeah. what do you think? do you think he has chance to be reinstated? we have seen a lot of these cases across country and they tend to battle these things out for a while. what's your thought? >> i can tell you that regardless, we're going the fight. we plan to sue if he's not reinstated according to our letter. we plan to win. >> yeah. great stuff. thank you so much for coming on. we appreciate it. congestion pricing means less traffic, better transit,
