flight delay and cancel llation stacking up meaning the domino affect is under way. ashley is live in new york, the country's biggiest air traffic hub. it's kind of a mess out there. >> reporter: it is. the severe weather and staffing shortages are contributing to scenes like this at airports across the nation. more than 28,000 flight s were delayed wednesday and 2,000 were cancelled. some travelers have been stuck at the airport for days. >> i am so mad but i'm trying not to explode. >> they just told us it was delayed and they delayed it and they delayed it. at 4:00 a.m., they said it was cancelled. >> reporter: could you imagine. united had the most cancellations. the ceo putting the blame on the faa for staff and overall inexperience but the flight agency fired right back in a statement saying we will always collaborate with anyone seriously willing to join us to

solve a problem. in denver, set up 3,000 cot and stranded passengers, it was all for them. cell phone video taken at jfk shows group of people demanding answers from american airlines staff. over in charlotte, a mechanical issue on this delta flight led to a very scary landing. here is what transportation secretary had to say about the chaos at the airports. watch. sdplp it is important for airlines to create enough cushion and resilience in the system. when you do have a disruption caused by weather, you can absorb that and work through that. a lot of the work that's been done has been paying off this year. >> reporter: travel problems are not just limited to the sky. another train deraderailment happened today. informs in southern california where nearly 200 passengers had to be led off after it collided with a county water truck.

it pretty much takes about three years to get the controllers fully trained. we're at levels, staffing levels from about a decade ago. >> three years will not help us this weekend. what's the solution short term. is there any way to move people from place to place? >> you know, a will the of these control towers, especially smaller airports like here in new jersey, we have small airports that after dark, the airports have very few operations but they have two controllers until 10:00, 11:00 at night. they need to be proactive and look at all these individual airports around the country. you could move controllers from smaller airports to big airport. there's also something called non-federal controllers that are not government employees. >> transportation secretary is

talking about this f5g, how it may be interfering. do you buy that? is that a big concern? >> i don't think it's a horrendous concern. the bottom line there's 40 countries that have this 5g and it's in place. from what we see, there's been no achkffects on safe air trave. this will go into effect july 1st. the six-month buffer will go away. about 90% of the current airline fleet are compliant with this new regulation. it would be the smaller plane, the older aircraft which we might see that do not have this updated fix to the equipment or new equipment on board that airplane. >> i've got a little bit of time left. i want to play some of these miserable passengers, and i'll get your final thoughts. >> i'm exhausted. i want to get to where i'm

interview with brett and supervisory special agent is honorable. he appears to be highly credible. he is the supervisory special agent. that means he's overseeing the special agent, the case agent who is overseeing this investigation who is a whistle blower. these are the people that are most involved with the intimate details. when you're there on the ground level as a rank and file agent, you know more about the case than anybody. if he says these are the details of the investigation, he's highly credible. he took an oath. the truth shall make you free. when you see something that's not right, he has a moral obligation to speak up.

>> it's evasion for false return and 2019. >> what of those things left out jumps out to you? >> it's the slow walking of the investigation. they went so slowly that by the time they emerged, time had run out to bring charges back in 2014 which were the most substantive years of hunter biden's income. they give him a pass on cases that seem like they were readily prosecutable. >> your final thought, nicole, on what was taken off the table and the limits that were placed on these investigators? can you imagine them saying this stuff is off limits. >> it's entirely inappropriate. i can tell you as a case agent when you're putting your blood, sweat and tears sinto a case an

they are denies prosecution whether it's denying conducting interviews, they had probable cause for search warrants. people were tipped off. i understand the fbi tipped them off. it's inappropriate. as a case agent, you want to gather evidence, present it to the united states attorney's office and make sure that justice is served. that's not what appears to have happened. >> you just want to do your job. great to have you both on. thank you. >> thank you. the future of affirmative action could be in jeopardy. the supreme court will rule this week on how colleges can into admissions. >> california bans affirmative action unlike 41 other states

that use affirmative action to boost black and hispanic enrollment. this ruling could change that. >> the group that's most likely to be helped is going to be asian americans students. in term of the groups that will see the lower enrollment is most like going to be black student and hispanic students. >> reporter: even where race a factor, black and hispanic is well below. 36% of high school seniors are black in georgia but at uga just 6% of incoming freshman. florida, north carolina, smaller margins but still double digits. hispanic enrollment not too much better. texas, 52% of graduating high school seniors are hispanic but ut class just 29% hispanic. colorado, arizona do slightly better. on the worst is uc berkeley which cannot use race in

admissions. >> through my entirety of berkeley, i've only met two other black students within all of my classes i've been in. >> every one agrees, every one admissions is uneven. blacks are under represented especially at place like berkeley. >> reporter: just 3% of the freshman class is black, that's 277 students out of almost 7,000. 20% are hispanic. black and hispanic enrollment fell. what should parents look for? colleges will start using crime data, zip codes, family income and education. those are other factors they will use as they try to build the freshman class. >> until you look at numbers, you don't realize how bad the

by the allen, texas police department. it shows the moments officers neutralized the texas mall shooting suspect last month. he was shot and killed by police after killing eight people at an outlet mall in may. ten others were injured. the officers were praised by the police chief for running toward the gunfire savoring cing count others. >> shots fired. >> dash cam video shows a georgia teen taking sheriff's deputies on a wild ride. the suspect fired five shot at the patrol vehicle. the pickup wrecked near an apartment complex. the driver is facing multiple charges, including attempted murder. u.s. marine veteran was in court today for his rainment on charges that he choked a homelessman to death. prosecutors are revealing brand new evidence that could dramatically change the case. vic is here with legal analysis and later in the night cap, the

break news, the wall street journal is reporting the spy balloon used american equipment that helped it collect photo, videos and other information. it's citing preliminary findings from a closely held investigation. closely held is right. we heard zero about this.

the analysis found the balloon has commercially available u.s. gear. some of it for sale online. the findings support a conclusion that the balloon or the craft as the journal saying is intended for spying. not for weather monitoring as beijing has said. it's notable few days ago, president biden said the chinese president did not know the balloon was spying. we have been given zero to little information on what we found. marine veteran has plead not guilty to a manslaughter charge. prosecutors reveal they have a lot more video of the deadly confrontation than previously

seen. >> reporter: he is now free on bond. penny is charged in a new york state supreme court indictment with one count of manslaughter and one count of criminally negligent homicide. prosecutors say penny put 30-year-old kneely in fatal choke hold, restraining him for several minutes until and after he stopped moving. one video of the deadly incident went viral but prosecutors claim, in gnawly filed document, they have five cell phone videos from three different witnesses which they plan to introduce as evidence. defense attorneys argue the case is bigger than penny alone. >> he won't be the only one on trial. the right and duty to defend one another will be on trial too. >> reporter: penny claimed

kneely was threatening to kill saying he was prepared to go to jail or die. the erratic behavior happening on a moving train. penny claims he had to act to protect himself and the other passengers. >> the reality is there's not living, breathing soul that has not experienced a variation of not only mr. penny but the other individuals experienced on that subway car on the day in question. >> reporter: attorneys for kneely's family slammed those that have donated to his defense. >> he took a life and for every one who thought donating $3 million would somehow make this go away or buy his pass, it's not going to happen. >> reporter: penny was released on $100,000 bond and expected to return to court on september

6th. >> he's talking about the jury selection. watch this. >> the fact that it's a manhattan jury is obviously very good for us, for the defense because manhattan jury tend to take subways and they understand what it's like to be on a subway. what it's like to not be able to leave when faced with a threat. >> i think he made a fair point that the jury would know the subway system but in new york the jury is likely to lean left, to be liberal. i'm not sure that bodes well. >> i disagree. i understand that's factor to consider. politics are thrown out of the window when our personal experiences are involved and anyone who is on the subway there has experienced this kind of threat or recklessness or mental instability can sympathize with daniel penny. didn't matter that the prosecution has 5 or 10 or 15 different types of video tapes

or cell phone coverage. they corroborate everything he's said twice publicly. no one can wish for death of another but when you look at time line or when the movement stops with the deceased to when he releases control, combined with the fact that others were helping to restrain the same individual for that am of time, it doesn't bode well for the prosecution and it really strengthens the defense case. >> here is daniel penny one more time on why he held jordan kneely. >> the three main threats he repeated over and over i'm going to kill you. i'm prepared to go to jail for life. i'm willing to die. i was scared for myself. i saw women and children. he was yelling in their faces saying these threats. i couldn't just sit still. >> i played that because today in brooklyn, jordan williams case, it's a case of man who fatally stabbed a homeless person.
