brought by a computer repair man. the decision sparked a year's long scandal inching closer to the oval office. >> dana: the laptop is at the center of the federal probe. the five year investigation culminated in a plea deal for two miss demeanor but a whistleblower said the charges should have been much stronger. >> the evidence that we collected during it still met the elements of the criminal violations and everyone participating agreed that document went forward with everyone's concurrence. >> results in this deal? >> yeah. >> bill: that whistleblower reacted to evidence suggesting hunter used his dad as leverage in business negotiations saying he tried to follow the money but was repeatedly stopped dead in his tracks. >> so that's the crux of one of the issues here is that we

weren't allowed to ask questions about dad. we weren't allowed to ask about the big guy. we went allowed to include certain names and document requests and search warrants. >> bill: team fox coverage today. byron york with analysis. first we'll send it to mark meredith at the white house. >> good morning to you both. the claims being made by this i.r.s. supervise re agent are raising more questions about how senior leaders in the government handled the investigation into the first son, hunter biden. the white house has repeatedly said it had nothing to do with this probe. attorney general garland saying the same. the u.s. attorney in delaware is the one that had the ultimate authority over what transpired but this whistleblower sat down with bret baier last night says that same u.s. attorney was limited not only in what he could pursue but where those charges could be filed. >> i was there and i witnessed this personally. he started with he is not the

deciding person whether or not charges are filed or not. >> not the deciding person on when charges were filed with hunter biden. who was? >> so ultimately this, if you follow the path of where the venue leads you, it went to d.c. u.s. attorney's office in march of 2022 and they presented this case to them. at the same time as that was occurring. >> gary shapley says he is cooperating with house lawmakers and he was prevented from taking certain investigative steps including looking at any leads involving president biden recently revealed messages appear to show hunter made it clear his dad was in the same room while he was making business deals. >> the importance of that, whatsapp message, we need to understand all the financial flows of money. so if there is money that is going elsewhere, whether it's president biden or elsewhere, we need to follow the investigative steps to insure that happens and

they were just not allowed in this particular investigation. >> you can bet republicans on capitol hill were listening to the interview last night. they will dig deeper and demanding answers from the u.s. attorney in delaware. giving him a week to turn in more information about what transpired. the white house has been saying this is still not the case at all. spokesperson telling reporters within the last few days as we have said many times before, the president was not in business with his son. we've also said many times the justice department makes decisions in its criminal investigations independently. in this case the white house has not been involved. president biden was heading out to a helicopter yesterday and reporters were shouting questions. one person asking him again about the claims whether or not he was involved at all with some of the business dealings with china and his son, hunter. the president screamed back no. he is going to be heading out again today. off to new york for a few campaign fundraisers. see if he weighs in further on this whistleblower developments.

>> bill: house speaker kevin mccarthy said if they find in their investigation that a.g. garland was lying they're prepared to start potential impeachment inquiry. mark meredith live at the white house this morning. >> dana: byron york is a fox news contributor. great to have you here. listen to one more piece of sound from the i.r.s. whistleblower from last night. call for number one. >> are you convinced looking back at this now that this was an effort to protect president biden and his family? >> there were definitely hindrances that i have never seen before in my 14 years concerning this investigation that didn't a allow us to follow through on investigation of any other individual to include president biden. >> dana: your reaction to that interview and the impact of it. in your experience of covering more whistleblowers over the years how do you stack up his credibility? >> one, it was a really compelling interview. this subject gary shapley, the

superviseor of the hunter biden investigation at the i.r.s. has a lot of credibility and has come out by name. you saw him on tv last night. so that's important. i think his credibility does stack up pretty well because there is a lot of factual documentary evidence supporting what he says. by the way, there is a second whistleblower who is anonymous, who was the actual case agent. the lead case agent covering the handling the hunter biden case and he has very, very detailed knowledge of the case. he has also testified. i think what they've done is painted a very compelling picture of two things. one, the evidence that was against hunter biden for tax evasion and filing false tax returns and two the efforts by members of the justice department, the assistant u.s. attorney in delaware, and also

at main justice, the u.s. attorney in delaware, to make sure that this investigation did not extend to joe biden. that seemed to be the top priority. >> bill: there is obviously a lot on the line here in terms of the credibility of a.g. merrick garland and the department of justice. somebody is lying here, either the whistleblowers or a.g. garland. take a look at this "wall street journal" headline painting the picture for the american public. the i.r.s. whistleblowers, merrick garland and the big guy. a quote says does mr. garland think the i.r.s. agents are lying or did he not know what his underlynx were doing? the credibility of the a.g. and his department is on the line. they'll consider a potential impeachment inquiry if they find out garland was lying here. talk about the difference here. both sides here, the whistleblower and what the a.g. are saying, both cannot be true.

>> one of the developments that pushed kevin mccarthy, the speaker of the house, towards saying we're going to continue to investigate this and it could be part of a possible impeachment was the whistleblower you just heard from, gary shapley, said in a meeting in october 7th, 2022, david weiss, the u.s. attorney for delaware, who everyone reminds us was appointed by donald trump, said that he, david weiss, had wanted to bring charges against hunter biden in the district of columbia and california but he was stopped from doing so. so that he was not the one who had the final authority about what charges he could bring in this case. a number of democrats said look, there is no way that can be true. an i.r.s. agent wouldn't know the inner workings of the justice department. that's just not true. well, what happened was that shapley said first of all that

he, gary shapley, heard it with his own ears. he was in the meeting. then he produced the names of 4 or 5 other people, the names of people who said they were in the meeting and they also heard david weiss say this same thing. so that really gave this allegation a lot of credibility and after that, kevin mccarthy sent out a tweet saying we have to get to the bottom of this and we have to have testimony from david weiss to congress and then we'll find out what's going on. >> dana: a.g. garland set to testify september 20th. a ways away. i wanted to ask you about president biden's new tack. he will embrace his age and try to push forward on that. we had the video this week of rfk junior at 69 years old doing some push-ups and been nch pres trying to show a contrast. what about biden embracing the inevitable and what everybody

can see. he is an older american man. >> no doubt about it, he is 80 years old. 82 years old if reelected and 86 years old if he serves a second term. that's absolutely unprecedented. we have so many polls showing that the american people either say biden is too old to be president or more concerning for biden they say they have doubts about his physical and mental abilities to do the job. in other words, it is not specifically the number of his age, but whether he is really physically and mentally up for the job. we have reports that jeffrey, a hollywood mogul, big democratic donor, suggested to biden own your age. don't try to run away from it. make jokes about it. ronald reagan, who was a lot younger than joe biden when he was in the white house, ronald reagan made jokes about his age and it worked. so you do it, too. we have seen in the last several

days joe biden making jokes about his age, basically exaggerating his age saying, you know, listen to me, i have a lot of experience, i'm 200 years old. i knew this guy 300 years ago, that kind of stuff. audiences laugh but we don't know whether it will allay those concerns of voters who say they are concerned not so much about the number of his age, but whether he is physically and mentally up to being president of the united states. >> dana: indeed. we'll see more polls come out as this campaign heats up. byron york, great to see you as always. >> thank you. >> dana: u.s. officials confirm the chinese spy balloon that flew over sensitive military bases was using american technology. "wall street journal" reporting analysis found the balloon was crammed with commercially available u.s. gear to collect photos, video and other information to transmit back to china. preliminary findsings show the craft did collect data but didn't appear to transmit it.

unknown whether the american gear was sold illegally to china. more on that as we find out. >> bill: president biden set to visit new york city today for a pair of campaign fundraisers. that visit coming following recent trips to chicago and san francisco. the three cities we're talking about here all face a combination of empty offices, a rise in remote work, and increase in crime and homelessness, a cycle that economists are calling a doom loop. fox business's lydia lou is here to talk all about it. >> great to see you both today. economists are having growing concerns about these so-called doom loop cycles. the impact is expected to be more prolonged and more profound than initially estimated. they say the problem is that people aren't returning to the office work space like they were anticipating. new york city for example, occupancy for commercial buildings is 48%. it was 98% before the pandemic. that means fewer companies are

renewing leases. accommodating people who want a hybrid work schedule. leasing activity in new york fell in the second quarter of this year down 34% from the first quarter. that means less money flowing from tenants to landlords between 2019 and 2022. economists show that revenue from leases fell more than 18%. next they say low occupancy decreases the value of the building. here is where we get into the doom loop cycle. office stock in new york city fell 69 billion from last year. that will impact tax revenue. projecting into 2029 economists say losses in property value mean new york will lose 6 1/2% tax revenue. what happens next? cuts to city services. to fill the gap they would expect the city to increase taxes and fees for people who live here. making big cities like new york and others much less attractive to live in. we know the exodus is happening.

new york city losing about 5% of the population between 2020 and 2022. portland losing 3%. san francisco losing about 7 1/2%. so adding issues like crime and homelessness and it is a cycle hard to recover from and an issue not just in the city should be concerned about but across the country. it could ultimately lead to a banking credit crunch if people can't pay the banks across the country. a big problem for president biden to wreckion with. >> dana: the lockdown made everybody leaves the buildings and they are going to say the government has to try to make them whole. something to watch. >> right. we also have crime and homelessness that is a big part driving the problem. >> bill: doom loop is an appropriate name. >> dana: not a ride at disney world. nice to see you, lydia. it could be a big day at the

>> dana: fox news aler. hunter biden is now -- just entered, we got this video in, heading into a defamation case where he will be deposed. you remember the guy that he gave the laptop to, he came out and john paul isaac and hunter biden is accused by john paul isaac of defaming him. now there is this lawsuit that hunter biden is dealing with. that deposition ongoing right now. >> the supreme court seems poised to roll back affirmative action in college admissions. if the justices put restrictions in place the state of california could set an example on how

higher education handles the push for racial diversity on campuses. william la jeunesse live in l.a. with more. >> that's because when california banned affirmative action black and hispanic enrollment immediately dropped. some schools by 40%. here is what parents and students need to know. 41 states currently use race in admissions. today's ruling for public and private universities could change that. >> the group that's most likely to be helped is going to be asian-american students. in terms of the group that will see the lower enrollment is most likely going to be black and hispanic students. >> even where race currently is a factor black and hispanic enrollment is well below state averages. georgia, 36% of high school seniors are black. uga, 6% of the freshman class is. florida, north carolina and michigan are smaller but have

double digit gaps. take hispanics not much better. texas, 52% of graduating seniors are hispanic, compose just 29% of its freshman class. colorado, arizona, kansas do slightly better. the worst is berkeley which cannot use race in admissions. >> through my entirety of being at berkeley i have only met two other black students within all of my classes i've been in. >> everyone agrees, the fact is that this is in colleges, blacks are underrepresented especially at a place like berkeley. >> asian students that test higher than all students represent 43% of the class at berkeley, blacks just 3%, point is, if other states adopt the california model they'll use class rank and grade and zip codes, poverty and crime rates family education to account for race. >> bill: we wait for some of the

supreme court decisions coming out at 10:00 eastern. affirmative action potentially one of them. william la jeunesse live in l.a. thank you. >> dana: is the u.s. becoming too expensive? more than half of americans say yes. look at these numbers from moody's. typical american household spends 768 more every month than in 2020. and rising prices taking a bite out of your fourth of july barbecue. the cost of frozen vegetables up 19%, bread rising to 12.5% and condiments spiked 9.5%. i'm sorry for the ketchup lovers out there. >> president biden: bidenomics is working. it is about building an economy from the middle out and bottom up. bidenomics is about the future. bidenomics is another way of saying restore the american dream. i didn't come up with the name. i really didn't. i now claim it. >> dana: president biden is trying to sell the public on his economic policy. reality of bidenomics shows

inflation is stubborn and stuck market busted. let's bring in maria bartiromo. i stole your read, bill. sorry about that. president biden's approval on the economy is lower than his overall approval rating at 34%. people are frustrated with the higher prices. are they going to buy bidenomics. that was an insult that republicans were using and now embracing it. will it work? >> these are all really important questions, dana. i'm not surprised that the president is making bidenomics his centerpiece of his campaign for 2024 because actually consumer confidence is starting to tick up. the other day we got a consumer confidence level highest in 18 months. that was a positive. no surprise he is using the economy as his centerpiece. let's be clear about what bidenomics really is. the economic plans out of this administration have been very

clear, spending, regulation, and higher taxes. that's what bidenomics is. spending. they spent $6 trillion in the two years under joe biden when kevin mccarthy, the speaker of the house, was negotiating with joe biden for the debt ceiling debate, he kept saying that joe biden kept pushing higher taxes. we need revenue. we have to get the revenue from somewhere and raise taxes. we all know regulations have become a lot more strict and that is one of the issues for business today. i spoke with a consultant the other day. he said right now businesses are in freeze mode. they aren't committing new capital to i.t., to r & d. they don't know what's around the corner. having said that economy is doing better than a lot of people expected. gdp was better than expected. 2% growth. that was positive. look at the trend, dana. when you go back to 2022 in the third quarter of 2022, growth

was at 3.2%. fourth quarter 2.6%. today we get the new numbers, 2%. it is going lower and has everything to do with all those issues in bidenomics, spending, regulation, higher taxes. >> bill: look at the stock market. just under president biden's term stock market down 687 billion so far. bidenomics not exactly working too hot for 401ks. >> i'm glad you brought this up. the stock market is down under joe biden. this year the market has been on fire. it is really a narrow rally. the nasdaq is up 30% year-to-date. the end of the first half this week friday will be the end of the quarter and first half of the year. we're talking about technology being the winner. nasdaq up 30% because of artificial intelligence. 7 or 8 stocks involved in making chips for a.i. and those stocks are on fire. big tech has taken the leadership after losing the year before. so yes, under biden the market

has lost value but this year things have come back in a big way. i think that's why consumer confidence is up. >> dana: call for number four here, hourly earnings falling under biden at 3.16%. when you talk about the election as larry kudlow says it will be a pocketbook election. isn't this an important number? >> it is. when you look at wages where they are right now, they are growing less than inflation. so inflation has been the main issue with this economy. 40-year high inflation. we're off that certainly. we're looking at better numbers but you are still talking about inflation outpacing wages as you point out. >> dana: maria bartiromo we love it when you're here. great to have you. there is an unfolding travel nightmare at the nation's airports leaving passengers stuck on the ground ahead of the holiday weekend. the latest on the chaos next. madonna hospitalized with a

>> dana: update on a story we've been following. jordan williams will not face charges in the deadly stabbing of a homeless man on the new york city subway. the charges were dropped after the grand jury saw it as self-defense. on the very same day daniel penny was arraigned for second degree manslaughter in the choke hold death of jordan neely. >> these two incidents happened one month apart pretty much. striking similarities between the two of them. mainly there was an emotionally and mentally disturbed person threatening them and others on the subway. williams and his girlfriend were physically assaulted before he stabbed and killed the homeless man june 13th. the judge released williams

without bail. his attorney says his client only acted after the homeless man verbally harassed him as his girlfriend and pulled on her earrings drawing blood. it reads the charges are dropped because under new york law a person is justified in using deadly physical force when they reasonably believe it is necessary to use such force. this next part is important. to defend themselves or others from imminent use of deadly or unlawful physical force. that has many wondering why marine veteran daniel penny is still being charged. he pled not guilty to manslaughter yesterday. penny put jordan neely in a choke hold after witnesses say neely threatened to kill them. >> there won't be a single person on that jury that hasn't ridden the subway that hasn't seen or can't imagine an

environment like this. it is just a reality of daily life in the city where we have thousands of emotionally disturbed people on our subway system. >> penny is due back in court october 25th. his lawyers will try to prove there was an imminent threat of unlawful and deadly physical force. if there was, his actions would be justified. >> dana: hard for people to see this as fair. thanks for the report and we'll keep an eye on it. thanks. >> bill: the nationwide travel nightmare continues today. u.s. airlines recording more than 7,000 flight delays yesterday alone. that's according the flight aware. along with nearly 1200 cancellations. the tsa projects today and tomorrow will be the busiest travel days of the holiday weekend. new york city likely to bear the brunt of the airline chaos. cb cotton is live at laguardia. how is it looking so far?

>> we hope the end of the travel chaos is in sight. tens of thousands of cancellations and delays from impacted the country's largest airlines since sunday. united airlines was hit the hardest with cancellations over the past three days. the airport has seen lines backed up with people trying to reschedule flights and others sleeping on the floor waiting for departure time. severe weather earlier this week caused a domino effect that hasn't let up for travelers along the east coast. there may be relief in sight. united saying they are on track to restore operations for the holiday weekend which will be welcome news for those who are stranded. listen. >> the flights were all canceled from here to charleston and all over the east coast apparently. but everywhere we look on the weather, it looks like it is fine. >> the travel nightmares were made worse by air traffic

united states. now their journey is more dangerous than ever record re before. record high temperatures rage along the texas border. casey stiegel with more. >> good morning to you. the heat wave gripping most of the lone star state has been especially brutal as you well know further south, with heat index values anywhere from 120 degrees or higher along parts of the texas/mexico border. it has been a scorcher. those unforgiving conditions have translated into heat-rae lateed illnesses for a growing number of migrants illegally crossing. in eagle pass alone the fire chief says they have to transport more migrants for medical treatment. more than 120 emergencies in recent weeks. cbp says agents have also been responding to a spike in rescue operations.

migrants either -- more than 150 rescue events in the last 72 hours. what's more, large groups are also making a return. yesterday more than 100 venezuelans illegally crossed in eagle pass and under a fairly new policy texas dps arrested the single adults, 41 in all, for criminal trespass. turned more than 66 family groups over to border patrol. this as more razor wire, shipping containers and other barriers are installed on the u.s. side. >> the reason why we're trying to add more infrastructure and repel the large groups across is to prevent any potential deaths, drownings. it is not safe to cross the river. not a humane process. >> troopers and national guard soldiers are now warning those who attempt to cross to turn around. although our cameras in eagle pass have captured some migrants camping out in the heat on the

u.s. side. some with children who say they have been unable to make their online appointments like they are supposed to to try to enter the country. bill. >> bill: no matter how hot it gets the migrants don't stop coming. casey stiegel live in dallas. >> dana: former president donald trump holds a commanding lead in the republican party's presidential nomination race. according to fox news poll he leads florida governor ron desantis 2-1. the rest of the fail trailing in the single digits. chris sununu is joining us now. call for number one. this is who republican voters say they would never vote for, okay? mike pence at 35%. nikki haley at 20%. ramaswamy 16%, trump is only at 13%. and i think in some ways you can look at the fact his numbers went from 53% approval to 56%

approval after the indictment. in some ways do you feel like this is getting way out of reach for any of the competitors to try to touch him? >> no, no, it's not. we're still two months away from the first debate. the average voter will make their final decision about 3 1/2 weeks before their primary. in new hampshire around new year's. people spend new year's and christmas with their families. there is a lot to play out here. i remind folks back in 2007 i think fred thompson was leading in the race around this time in 2011, i think michele bachmann was leading is race or something like that. candidates out there that just a few months later disappeared. i will tell you this, i'm going around with a lot of the candidates now. i was at a nikki haley event. i have been out with several of them. trump supporters show up at their events. they're there. when you see these polls, there is clearly support for the

president given the politicalization of the d.o.j. and what's happening with the indictments. folks are connecting with him and feel like he is getting beat up and showing support. it doesn't mean they'll vote for him. folks hearing what the other candidates have in store that are clearly with trump but not necessarily going to be there in the long run for the vote. so i just maintain a lot of confidence that the system is still fundamentally the right system and people are going to look at the debates and look how folks retail campaign and what happens in iowa and new hampshire. there is still a lot to play out here. >> dana: desantis seems to have stalled out. he was on "the story" yesterday talking about new hampshire. listen here. >> new hampshire voters want to meet you and see you. so we're building support, people are appreciative of my story and our philosophy. we are going to get it done but in is a long road and rome wasn't built in a day. stay tuned. we'll be up there a lot meeting the folks.

unresponsive. what, if anything, can we glean from that? what kind of bacterial infection can we be talking about? >> 1.7 million people in the united states get sepsis every year where some kind of bacterial infection causes your blood pressure to go down or you get out of it the way she was. go to the icu or get on a ventilator. that is not confirmed. testament to the united states medicine and specifically new york city, where she is, is that only about one in seven people in this life threatening condition actually die. six out of seven recover. the most common causes would be rest prio tear or urinary. my suspicion. i don't have information on that. would be urinary more likely in her case because she responded so quickly. the that bacteria that cause that respond more quickly.

and blood pressure goes down and affects your heart directly. you have to bring the blood pressure up. antibiotics, the quicker the better. intravenous antibiotics. we have a smorgasbord that cover it. until we know the bug we treat across the board. we don't want to under treat and the end to over treat with a big success rate. once we figure out which bacteria it is we narrow the coverage. >> bill: how quick could her recovery be? >> it depends on what the source is. if it's urinary a couple of weeks. celebration toro was supposed to start 80 shows july 15th. that's not happening. i could see her, given her vitality and how strong she is back in the show tour maybe in a matter of weeks or a month. especially if it's urinary. again, i don't know the details. expect to see her sooner rather
