decision. first what the president just said, speaking live from the white house, i strongly, strongly disagree with the court's decision. he said the court walked away from decades of precedent and called this not a normal court. what was your reaction to what you just heard? >> my reaction is that actually the supreme court is finally bringing into alignment education law with employment law. for over 40 years the supreme court has been more conservative on employment law and has restricted use of race motivated by interests like diversity or equity or systemic racism or societal discrimination. so really, i find the court's opinion today really to just be reaffirming what the court has held in other areas the fact we should not use race as a justification for any decision-making. >> andrew, we got word from the justice department and the attorney general with a statement, the supreme court's decision undercuts efforts by universities across the country

to create a diverse group of graduates prepared to lead and increasingly diverse nation. it will significantly set back efforts to advance educational opportunity for all americans, up ends 50 years of precedent. doj remains committed to promoting student diversity. what do you think of that statement and why do you think universities will go from here? >> well, i think universities may try to pivot into decisions that are not as overtly based on race. they'll try to hide behind other factors, but i think that's unfortunate. when you are making explicit race decisions or if you are trying to hide behind other things that you are still seeking to make race-based decisions, you are eliminating everything that actually makes people diverse and unique and stripping them down to a single characteristic. and i hope that they'll consider other characteristics that are not protected but actually would enrich the uniqueness of each

person and the university composition in ways that aren't just relying on characteristics like race. i'm interested in the interest of employment law as a commissioner. >> sandra: can you make a prediction on that, that seems to be a growing discussion at this hour. >> about the impact on employment law? well, look, it's not going to change the standards in employment law, really bringing it back into alignment with employment law, always more restrictive in the use of race. extremely restrictive in the employment space. it's a wake-up call for employers. today is the best time for lawyers to take a look at the lawfulness of their pursuit programs, even though many employers don't use the word affirmative action, it's rampant today, pretty much everywhere a ton of pressure at the top 100 across corporate america to take

race conscious decision-making, race conscious actions in employment law, it's been illegal and still illegal. >> do you think with the supreme court ruling we will see challenges to that? >> yes. i have noticed an increasing number of challenges to corporate dei programs and i would expect this decision is going to shine even more of a spotlight about how out of alignment some of those programs are. and to be clear, i'm not criticizing all diversity programs, it really depends on how they are structured, but the extent they are explicitly or implicitly taking race into decision-making for employment decisions, race restricted internships, race restricted mentoring, race focused promotion decisions, etc., there's a host of employment decisions, if you are using race as any factor in your decision-making, you are already violating the law.

and i expect that you are going to have a rising amount of challenges as this sort of raises that issue back to people's attention. >> sandra: as far as reaction coming in from the attorney general, merrick garland, on the supreme court's ruling, this is just in to us now. the supreme court's decision under cuts efforts by universities across the country, a.g. says, to create a diverse group of graduates prepared to lead an increasingly diverse nation, and set back opportunity for all americans and finishing the statement, the department of justice remains committed using all available legal tools in the coming weeks we will work with the department of education to provide resources to college and universities on what admissions practices and programs remain lawful following the court's decision. i'll let you tell us where you think that means they are going with this while also alerting our viewers that we are going to

be getting a press conference top of the 2:00 hour, we have now learned on the group that brought this to the supreme court. the students for fair admissions. so we will see what they have to say live top of the hour. but first, your reaction to the attorney general's statement. >> yeah, i think that it -- to some degree it's a concession. only proceed on promoting diversity in legal means, that means race neutral characteristics like socioeconomic status or adversity or something else, and the court did indicate that as long as you are actually looking at those characteristics and not using them as proxy for race that could be ok. so i think -- the law is pretty clear now and the law is pretty clear in other contexts and people are just going to have to pivot away from using race to make decisions. so there's a lot of other ways to get at robust diversity that

don't use illegal decision-making like we have seen explicitly or as a proxy for race. >> sandra: andrea lucas, appreciate it, andrea. thank you. rich. >> sandra, today's ruling will have an impact far and wide. california where voters based race-based admissions in 1996 could provide a lesson to the states that relied on affirmative action for admissions. william is in los angeles, what can we learn from california, william? >> rich, one thing i didn't hear the president address, majority opinion the road to diversity in higher ed has had a reverse discrimination impact on asians, and secondly, not just to public universities but private ones as well, 72% of all four-year colleges, they have to rewrite the admission handbook. california banned race in admissions almost 30 years ago

and tells us what could happen. california uses now 13 factors to judge who gets in, and who doesn't, from class rank and gpa to personal achievement. race is not one of those boxes. so, being when voters banned affirmative action, black and hispanic enrollment like ucla and berkeley fell by 40%. last year's am ning class, 3% black, 20% hispanic, less than half the statewide population figures. but 43% were asian, three times higher than the statewide population. experts say universities will adjust by using algorithms to compensate for race, looking at crime and poverty rates of the applicant's zip code, family income and education. >> if you look at the hundreds of other factors you can create something that will have the same effect of -- as affirmative action without even looking at race once and that's what i expect to see across all the elite private colleges. >> so here is a snapshot of

where some of the top public universities currently are. georgia, 36% of high school seniors are georgia, but u.g.a., smaller. texas, 52% of graduating seniors are hispanic, compose just 29% of its freshman class. colorado, arizona, kansas, do slightly better. asian students do score higher and perform better academically than all students, whites to a lesser extent. california has spent $500 million on outreach and recruiting and yet even drop the standardized act and sat tests to level the playing field but it has barely moved the needle. >> william, thank you. sandra. >> sandra: and coming up top of the next hour, we are going to have more from our panel reacting to the supreme court

decision, carrie severino will be joining us, jessica and garrett, and rich, important to point out where polling is on this issue. and where it was heading into this decision today. american support for affirmative action, according to pew research latest polling, those that disagree or disapprove of colleges giving consideration to race and ethnicity, 50%. those that approve, 33%. unsure, 15%. on americans on whether affirmative action makes admissions more fair, 49% believe it makes it less fair. so, this decision would be in line with a lot of the polling heading into today. and finally, when asked should scotus allow colleges to consider race, this is a cbs poll, 70% said it should not be allowed. this was the thinking heading into thinking, and we'll get our

panel at the top of the hour. >> 70%, the court deciding with the majority opinion in the united states here and this is also a court that has gone through a lot of criticism like many of the other institutions in the country that has seen its own polling numbers falling. we'll see if there is effect with this there. >> sandra: and now this. >> two days of people not getting off the ground and -- in the airport, people on cots back there. >> i miss the waiting. i miss the wedding sunday. >> whose wedding was it? >> my mom. >> i just want to get away from the airport. and they lost my luggage. >> our flight was, they delayed it, delayed it again at 12:30, delayed at 1:30, and finally said the trip is totally canceled. >> disaster. everybody is calm. they keep cancelling everything. >> sandra: delayed passengers, fireworks ahead of the 4th of july, stranded flyers, and there

are more than 2300 delays so far, more than 400 cancellations happening coast to coast. that's just today alone. and things could be getting worse this weekend with more disruptions expected. it comes as the tsa says air travel will pick up today and reach its peak tomorrow, with millions of americans flying to their destinations to celebrate independence day. erin will join us in a moment to share a disastrous experience from over the weekend, but c.b. cotton is live with more on the travel trouble. how are things looking there? >> sandra, travelers are hoping the airlines can get a grip on the backlog. people at laguardia, some had them canceled earlier in the week, but some travel chaos will

continue through the weekend. severe weather here in the northeast has caused a domino effect of travel headaches along the east coast. problems continued through wednesday for those with ground stops at major airports in new york, new jersey and boston, the future continues to be uncertain, though, even for those out west one stable weather conditions in the forecast there. air traffic control towers can change flights at a moment's notice if smoke from canadian wildfires reduces visibility. and thunderstorms in the midwest could create challenges for air travel. topping all this off, staffing issues with air traffic control and airlines have left passengers in limbo, some forced to sleep on airport floors, hoping to snag a seat on a departing flight. and flight attendants have been waiting hours on end to find out flight assignments. united airlines was hit the hardest with cancellations, one of its hubs is at newark airport

in new jersey. backed up lines, and speaking of stranded travelers, darius is from arkansas. you arrived over the weekend but bad news on tuesday morning. >> my friend got alert on his phone that said our flight got canceled, so we got a lyft and came up here to the airport to see why our flight got canceled, and they told us weather. so we was like do you have a voucher for us, and they are like no, due to weather we don't give out vouchers. >> so you are stranded here in new york. what do you have to do next? >> get hotel, and that was $1,000 extra out of our pockets with. >> $1,000, a lot of money, money that not everyone has. so you get the hotel, here for two extra days. good news on the horizon? >> yes, our flight leaves tonight at 6:15, so praise the lord that it will -- we will get

out and fly tonight. >> and darius, you have some children waiting for you at home, a job waiting at home, how eager are you to get back to arkansas? >> we are so ready to get back. the two extra days have killed us both financially and like drained us. >> darius, sorry about the travel headaches you have had to endure. we hope you get home safely. a lot of headaches for travelers here in the northeast and just a waiting game to see how this continues to play out from today through the weekend. >> sandra: i felt like applauding that he's going to get out, he's going to finally get out tonight. we are so happy for him. oh, man, there's nothing worse. >> we are so happy for darius. >> sandra: he's been through a lot. c.b. cotton, thank you so much. our best to him. it's been an expensive trip. our next guest had one flight canceled, another delayed this past weekend, eventually hit the

road to get back home. erin joins us now. probably sounds familiar to what you were hearing there. what was your travel chaos like? >> it was a journey for sure. initially had a flight out of detroit. i was told that it was delayed and then i was told by text message that it was canceled. but all of the screens at the airport still said delayed, so i opened up the chat, talked to someone for three and a half hours, and at first they said it was a payment issue on my end, which was impossible, and then said it was delayed, but then they said it was canceled, and went to the counter, they said service canceled, the chat said it was delayed, it was very confusing for sure. >> sandra: so you decided to hit the road. how did you do all that? >> yeah, i took a greyhound bus from detroit to cleveland, ohio, with a stop in toledo, and then i got a flight out of ohio, which was eventually postponed until the next morning. i didn't want to put it all up

in the air, literally, so i decided to take a greyhound bus from ohio to new york city. >> sandra: what was the first thing when you get home, i always wonder. we all know, we have travel disasters, able to get home, kick off your shoes. how did you spend the next few hours after all that? >> oh, my god, it was so funny. as soon as i got home, my luggage broke outside my building and i was like of course this would happen. so i walked up my three flights of stairs out of breath, so tired, and i just laid on the couch. i was exhausted. i got no sleep. >> sandra: why do you fathom all this is happening? >> i was told it was weather-related, they would not give me any vouchers, so i was told it was due to weather but got text messages saying the things with the faa, so i was told weather but looks like it was a lot of other reasons as well. >> sandra: have you second guess

your travel going forward? >> i want to be hopeful, i don't want to lean into the negative. but it was an experience for sure. i had a lot of adventures, spent the day in cleveland, getting hotels and out of hotels, adventure for sure and i hope that my next ones don't include all these flight issues. >> sandra: seems you are at the point you can look back and laugh about it. i'm sure it was not like that at the moment. we appreciate you coming on and telling your story. so many thousands of travelers are experiencing this, appreciate it, thank you. >> thank you. >> the wall street journal is reporting the probe into the chinese balloon that hovered over the united states showed it was in fact used for spying, not weather purposes, and the technology it was using is raising some concerns and stunning new details from a top gop lawmaker. what did u.s. attorney david weiss know about the fbi form containing bribery allegations

david spunt is live at the justice department. still going on? >> still going on, more than f four and a half hunter biden has been inside of this law office, video taped and transcribed, don't know if the tape will be released, maybe not while the case is still going on. nothing to do with the federal plea deal between the justice department and hunter biden. we were there as hunter biden got out of a black suv and walked into this law office in wilmington, delaware with his legal team. the deposition as i said transcribed, it's a civil suit brought forward by john paul mac isaac, the former computer repair shop owner who claims hunter biden dropped off the laptop and never came to collect it. mac isaac says he gave it to the fbi 2019 around the holidays, been in federal custody ever since, coming up on four years. turns out the laptop not russian disinformation, despite what 51

former intelligence officials wrote, hunter biden's legal team has played with some wording and makes it seem as it's the content on the laptop but may not be his laptop. now, the other more pressing investigation involving hunter, talking about it since last week, appears to be over at least from the justice department angle, if the judge accepts a plea deal, irs whistleblower gary shapley told bret baier the hunter tax investigation was botched from the beginning, thanks to politics. watch. >> i'm not frustrated about the outcome, right, it's out of my control, but what i am frustrated about is that we were hindered whether we were conducting this investigation, and i think that it really hid the true scope of what happened in this investigation. >> hunter will appear before the federal judge in delaware on july 26th, but the house is continuing its investigation, the head of the ways and means

committee house judiciary and house oversight sent letters to attorney general merrick garland, head of the secret service and others saying they want transcribed interviews with multiple officials to do their own investigation if it's over when hunter biden enters the plea in a few weeks. >> sandra: david, thank you. rich. >> rich: house republicans demand more than a dozen federal officials, including the attorney in charge of the hunter biden investigation to appear before multiple congressional committees for transcribed interviews. they are conducting a joint investigation into allegations of politization and misconduct into the years' long probe into the president's son. bob cusack, editor and chief at the hill. thanks for joining us. so many different legal issues with the president's son and now republicans are in control of the house, they have subpoena power, coming to a head. do you think politically this is beginning to break through?

>> i do, and i don't think it was earlier this year. the irs whistleblower who just saw, gary shapley, i think is a credible witness. now, is he telling the truth, we don't know. it's going to be interesting what the interactions and communications were between the whistleblower and weiss. because remember, attorney general merrick garland has said weiss had the ability to do whatever he wanted in the case. the whistleblower says not really the case. so i think -- i think this does have legs and the question is, when will congress actually subpoena hunter biden and have him testify? >> and this alleged disconnect, let's look at some comments. attorney general saying weiss could do whatever he wanted and the whistleblower saying the opposite. >> i would then have to, you know, authorize it and permit it to be brought in another jurisdiction and that is exactly what i promise to do here already, that if he needs to do -- bring a case in another jurisdiction, he will have my full authority to do that.

>> david weiss october 7, 2022, said the d.c. u.s. attorney's office will not allow us to charge there, and requested special authority and was denied. in the meeting i had him repeat that, i knew how important that fact was and i wanted to make sure i understood it. >> bob, do you think this ever gets resolved, or a he said/he said thing. >> it remains to be seen. speaker kevin mccarthy says someone is lying and the house republicans will find out, and a time when the president's poll numbers are not great and questions for democrats privately i have talked to, wondering why hunter biden is hanging out at the white house, that shouldn't be happening because he's a political liability and he's only going to become more so. i think the house republicans want to set the stage, do the investigation, and kevin mccarthy says impeaching garland is on the table potentially. >> all of this comes when you have americans who have less

trust in institutions, especially the fbi, the latest fox news poll, 59% of americans have confidence in the federal bureau of investigation, down from 80% just in 2017. do you think this is because you've got politicians trying to take advantage of these institutions or have there been real missteps from the fbi and others? >> combination. fbi and doj caught up in the politics of 2016, 2020, and 2024. james comey made some mistakes, missteps were done and no one is wearing the white hat here. there is no good guys and bad guys and the fbi really says ok, we are fixed now, but a lot of people obviously from those polls don't believe it. >> so just a couple months away from the first republican debate, august on fox news, by the way, latest poll numbers show president trump has a commanding lead over the field.

yes, it's early, does he have this thing sown up? >> i don't think so. i think it's very early. if you look at history and front runners usually don't do well. however, this is donald trump and counted him out so many times. i think it would be a mistake to skip the first debate, i think he might skip a debate but i don't think the first one, but a long way to go. without a doubt, trump is in clear control. >> and quickly on the democratic side, kennedys like challenging sitting presidents. does he have a chance? >> no, he has a venue, frustrating for the white house, nuisance, but joe biden will likely be the nominee unless a health issue. >> rich: sandra, back to you. >> sandra: protests erupting all over france, police arresting more than 150 people.

everyone. >> sandra: so now they had bar the use of race in college admissions. your thoughts. >> we'll see. president biden just spent 20 minutes before that question suggesting that colleges ignore what just was handed down from the supreme court and harvard has already sent a release out to all of its grads and other folks saying they think they have ways around it. essentially that's what they are saying. you know, and president biden wants that to be the blueprint for other universities. i think the decision itself was amazing, great. i've been waiting for a decision like this for at least ten years. because it is the ethos of america. he used the word fairness in 2 or 3 times in the press conference. how is this fair to bar students who have worked their ass off to get the best grades out there to sacrifice so many things and say no, you don't get it because maybe your family had money? you know, and particularly the asian kids in the country have been dominating. the best news for black americans, it can be, it can be

if we allow. because maybe now we will demand strong education for our kids beginning in kindergarten, so this is a moot point. we should never have to consider this, if it was not bigotry of low expectations by liberal cities that do not think highly of black people. oh, they like us, but they don't think we are smart. watered down education, kids will graduate 12th grade with eighth grade reading level but we'll make it up for you, housing, food stamps, put you in jobs you may not be qualified for. i have a lot more on this on my show, by the way. >> sandra: fascinating point of view on that. charles, we'll definitely be watching. thank you, charles. rich. >> rich: blistering heat posing a deadly threat along the southern border, not stopping migrants from making the journey. a live report ahead. plus this.
