everyone agrees. this after a group of asian-american students filed a complaint against harvard and the university of north carolina chapel hill alleging that they failed to employ employee race neutral admissions practices. the majority opinion delivered by chief justice john roberts said that any student, quote, must be treated based on his or her experiences as an individual, not on the basis of race. highlighting the importance of this case in a rare move. justices clarence thomas and sonya sotomayor also read their opinions from the bench. now with justice thomas declaring, quote, at all forms discrimination based on race including so-called affirmative action are prohibited under the constitution. now harvard did in fact released a statement following the decision acknowledging that the court ruled their admissions

policies did not comply with the 14th amendment, the equal protection clause in the constitution and the civil rights act. harvard is not actually totally backing down. they may still consider how race impacts someone's life as part of the application process. while the university of north carolina said today's ruling was not the outcome they had hoped for. how did the left handle this news today? well, about as predictable as you would expect. president joey biden delivered yet another angry address. he has been very angry. i want to remind everybody this is a guy that worked with the former klansman robert kkk byrd as the former grand pool ball of the clan. in the 70s they wanted to stop segregation of public schools because joe said, his words, he didn't want public schools to become racial jungles. anyway, here is joe's full of

giant roadblock in our country's march toward racial justice. but as always the left is completely out of touch with everyday americans. take a look at your screen. according to a recent survey conducted by pew research, only 33% of americans approve of colleges giving consideration to a race and ethnicity during admissions. while just 20% of respondents said affirmative action makes the college admissions process more fair. according to a new cbs news poll conducted earlier in june, 70% of americans agree with today's ruling that the u.s. supreme court should not allow colleges to consider race in admissions. no, while many on the left spent the day whining, complaining, whining and screaming and yelling and using lots of hyperbole, many republicans actually celebrated what was a victory for equity in college admissions. and frankly for our constitution. president trump reacted on true

social today calling it a great day for america. florida governor ron desantis tweeted that the supreme court correctly upheld the constitution with the decision. let me be clear. this is a major victory for fairness in college admissions and the process of college admissions. that is admitting somebody on their race is not only by definition a racist policy, you are institutionalizing discrimination, creating what is a blatantly unfair disadvantage for millions and hard-working students all across the country. today's decision should put an end to that. although watch for harvard to work around and try to squirrel around the new decision. here with reaction fox news contributor george washington usurper city law professor jonathan turley. good to see you, professor. >> thank you. >> i think everybody in this audience would agree with me and

i think you would agree that discrimination is wrong. if you want to end discrimination, you don't institutionalize discrimination as a means of ending it. >> that's right, sean. this case is really the capstone opinion for chief justice roberts. he has maintained for years consistently that the only way to end racial discrimination is to stop discriminating on the basis of race. he is finally achieved the decision that he has long called for. this is an important moment for the court. this opinion could have been issued in 2003 in a case called router. the court split 5-4. the only reason it didn't go the way it went today is because sandra day o'connor said i will vote to allow you to consider race, but i don't think in 25 years this court will ever let you do that. you've got about 25 years. that time was almost up this

year. they are about in the 20th year. the court said enough. this is racial discrimination. it is also important to note that with all of this hyperbole that chief justice roberts said you can still have a student that talks about in their essay how they have dealt with racial discrimination. if they have got history on that. you have to base decisions on the individual. what he is really saying is you have to ban the box. you cannot have a box that checks off people according to their race. you have to look more carefully at them as individuals. >> it seems that disproportionately at harvard in particular that asian americans were being discriminated against. there was a dramatic decline in admission of asian americans. there are certain criteria. one has to ask this question. for those students in high school that dedicate themselves and sacrifice their time to

studies and they take the more difficult ap courses and they get a's in all of their classes and maybe even graduate high school with an average hire than an "a" or 4.2 gpa. those that. hard and study for the sat and act and get the highest grades. then they find out that they wanted to go to a particular school and they are denied admission, but people that did not due as well in high school or on standardized testing got in ahead of them. how would they feel? >> well, that is what was striking about the dissent, the total lack of empathy for the students who were treated in a worse fashion because of their race. the chief justice really grilled harvard on this. harvard found a creative way to sort of grade asian students on personality lower, so they could lower the admissions rate. chief justice roberts said are

just asian americans less patriotic or personable? why would they be marked so lowly? many of us knew that this was a way to engineer that resolve. but what is really fascinating is many of these asian-american students come from middle-class, lower-class families. many are first-generation, second-generation. their families worked very, very hard. that's the diversity i find most useful in my classes. i love a diverse class. but what i get out of classes, when i have those wow moments when students make an observation about the law, it is coming from students who came here from impoverished circumstances regardless of their race. they have the most interesting insights. it's not just between diversity and non-diversity. it's about how we put together these classes. >> professor jonathan turley, great to have you. thank you. more reaction on the ruling. the author of the new book the

politically incorrect guide to the supreme court. university of california law professor is with us. john, how are you? let's get your reaction to today's ruling. >> i think chief justice roberts greatest opinion and i am proud of the court today because it returned us back to the colorblind principle that started with the declaration of independence for which people fought in the civil war and fought again in the civil rights movement. finally today the supreme court said the use of race is over. the government can no longer classify any american based on their skin color. it's a long time coming and it finally took over 200 years for the court to put an end to it. >> i have made the case and i would like to get your thoughts on this. if you look at blue states and blue cities around the country. for example i will pick the city of baltimore. remember per capita as a country

we spend more per student than any other country in the industrialized world with some of the worst results. you have 13 high schools in baltimore, maryland. again, the unholy alliance with teachers unions and the democratic party all based on financial constitutions to democratic party candidates. they have institutionalized failure and at best making mediocrity in our schools. they don't have a single kid in 13 schools that is proficient in reading and math. if we care about education, the minorities in this country, why have they allowed this failing system to continue forever and ever? i know the republican party wants school choice. they want charter schools. they want parental involvement. they prefer to stick with reading, writing, math, science, history and computers and stay away from gender identity, a

value system that contradicts layers and crt, et cetera. >> i couldn't agree with you more. the answer to this humiliation we are suffering in the inner city schools is choice. vouchers, charters, school choice. i'm glad you raised this. this ties in directly with one of the most important themes in the supreme court opinion today. i talk about it in the book, the politically incorrect guide to the court. this court does not trust bureaucrats and experts anymore. 25 years ago they took the educators word for it that affirmative action, racial preferences was a good thing. that racial diversity was necessary for better teaching, for better research. today the court says we defer no longer. chief justice roberts says quite clearly we are not going to take your word for it anymore teachers and administrators. judges refuse common sense to review and demand. is there any proof that racial

diversity leads to better education? any proof it leads to better research? shouldn't we apply common sense solutions to these educational problems we have throughout not just colleges and universities but as you said k-12 were it's even worse? >> my only surprise is that you are at the university of california school system at all. i cannot believe you work there. anyway, thank you so much. we appreciate it. following today's decision 2024 presidential candidate vivek ramaswamy reacted on twitter saying it is, quote, time to put a nail in the coffin of affirmative action. in studio, i never met you before. great to see you. how are you? we have enjoyed having you on. let me just say this. i am off-topic, but chris cristi is not a serious candidate to me. he is running because he hates donald trump and wants to be basically used by the democrats. you are running because you have a belief system you are fighting

for. any candidate that is serious about the issues that are facing this country, your voice is important to me. his voice is meaningless. now let's get your reaction to today. >> one of those values that defines the american values themselves is meritocracy. you get ahead in this country not on the color of your skin but on the content of your character or contributions. i have lived that american dream. that means something to me. adding the supreme court stood on the side of justice today. that is on us. this is a step on the way to eliminating race-based preferences in every sphere of our lives. on the day and launch my presidential campaign this february i pledged to rescind the executive order written by lyndon johnson that creates affirmative action race-based preferences in the economy. that requires any company that does business with the federal government, over 20% of the u.s.

workforce, to adopt the same race-based systems. as u.s. president i would take a line and cross out that executive order. we are done judging you on the color of your skin. we are restoring merit and putting that merit back into america. >> if we care about our kids, i did learn latin and went to catholic school for 12 years. i had to study latin and theology and go to mass every day when i showed up. that is to school. not only mass. the word education is the latin derivative is to bring forth from within. to me, that is predicated on a belief that god created every man, woman and child on this earth. i believe that with all my heart. inside every individual, like we all have a unique fingerprint, they put talent in every individual. a good educational system should not be cramming information in their heads, but offering the water and nutrition and the

sunlight to bring out of them that which god put in them. we are not doing that. we are failing these kids spectacularly and this unholy alliance with the democrats and teachers unions drives me nuts. why have we allowed that to continue? >> you said it beautifully, sean. one thing we have to do is define merit. what does merit mean? you said it really well. it means a system where everyone, no matter who they are, can achieve their own god-given potential. some on sports field where we don't apply race-based preferences. some in the classroom. sum and music. whatever their god-given potential is to achieve that without any human bin standing in their way. that's what a meritocracy is. that is what america was founded on. a big problem starts with the department of education at the federal level. what did biden say today? as soon as the decision came down he said he would direct the department of education to find alternatives. that's why a said that as u.s.

president i would shut these bureaucracies, including the department of education. i will shut it down. that's actually a source of these race-based preferences that finds its way into our schools. >> how did joe biden in this campaign in 2020 get away with the truth that he had partnered with a former klansman, a guy he praised often, robert byrd, and fought against the integration of public schools because he didn't want public schools to use his words, racial jungles. your president said that. does that surprise many of you? >> it does not. >> you know joe. >> here is the dirty little secret. affirmative action is a form of psychological slavery designed actually to stop minorities from outperforming. this is their excuse, sean, for exerting power of dominion and control. if black americans prosper, they

would no longer have an excuse to implement policies that had very little to do with empowering anyone. affirmative action has been disastrous. it hasn't helped black americans, white americans or asian americans either. that dirty little sordid side of racism from before is not a hypocrisy. it is actually part of the same vision of holding minorities down if that is what will allow the democratic party to get ahead. is the democratic party that offered slavery and support psychological slavery today. >> if you care about kids education, start young and every child should have choice and the parents will choose the schools that offer a superior education. >> that is true equality and opportunity. it means group equality and meritocracy. they are not compatible see. >> great to meet you. you get to throw us out. coming up, a new report says joe biden is trying to silence his aides from giving any advice about zero experience.

their efforts for this new probe. they are now requesting transcribed interviews with everyone involved from the u.s. attorney in delaware to biden appointed u.s. attorneys in california and dc that allegedly now blocked charges against zero experience hunter biden who is making a fortune and plus the employees of the fbi, the secret service and the irs. they liked me a lot. john solomon just interviewed one of the irs whistleblowers who pointed to pretty clear signs of what is government interference in this investigation. in other words, a weaponize department of justice that protected the entire biden family. take a look. >> taking these to dc and to the california u.s. attorney attorney's office and being denied was obviously the injection of political influence and of course those two u.s. attorneys were appointed by the

and the authority to go further in the investigation, he was stopped and stymied in every situation. right? >> absolutely. by the way, it was interesting that you told me that everyone from david weiss down to the tax division and career agents, everybody agreed that hunter biden should face far more serious felonies. they recommended those cases to both u.s. attorneys in california and washington, d.c. both appointees of joe biden and they got turned down. the agents got turned down for search warrants. they got turned down for permission to interview witnesses. they got turned down to ask questions about joe biden. i had a question for hunter biden's children. they were told it is not in your career interest to go and interview joe biden's grandchildren. they were thwarted at every search warrant. and then the two most serious charges that gary shapley said to me in the interview, john,

hunter biden to this day still hasn't paid taxes on $400,000 he got from the ukrainian company in 2014. think about that. everyone is pretending there is justice served. hunter biden has not repaid the american taxpayers $150,000 of taxes on $400,000 of income he got from the ukrainian oligarch according to the tax agent who worked at the case. >> let's go through more about what we know here. if this were any other taxpayer, if this was any company, this whistleblower that you interviewed was very clear that they would have been charged with felonies. >> yeah, no doubt. hunter biden clearly got treated differently over and over again. it began with just cutting off the investigative tactics. even when they did get to the evidence of wrongdoing they can bring the charges. everything he says is in direct conflict with merrick garland's testimony and his answers to senator chuck grassley.

unless you fire that prosecutor. okay. you have six hours to do it. son of a be they fire him, to quote joe. and then guess what? hunter continues to be paid for work that he admitted on good morning america he had no qualifications for. >> the amazing part is what we are seeing in action is a president of the united states wrapped up in the american flag dictating that a prosecutor be fired. the prosecutor is investigating hunter's business. ironically, now with this 1023 which is unclassified, which christopher wray the head of the fbi didn't want to give us an unclassified document. he makes it clear they have tapes where the guy who was running the company is saying i have given you 5 million and giving your father or the two of you $5 million each. i am keeping a tape recording of this because i want to make sure i get my moneys worth. we want those tapes. why is christopher wray still the head of the fbi? >> we love the judge.

program. i want to go to the issue. i have grown to respect vivek ramaswamy. i like him a lot. he is serious and substantive. he is running and is passionate and bringing ideas. tim scott, nikki haley. asa hutchinson, not really. chris christie in this pole is at 1%. it seems all he wants to do is go on abc, fake news cnn, bash trump, bash trump and then get into debates in the hopes that he has another opportunity to bash trump to and aggrandize himself. am i wrong? >> you are not wrong. he is indulgent and likes to hear himself talk turkey sucks all the air out of the room. everything else out of the room, obviously. chris christie is doing this for himself. he is doing this because he likes to see himself and likes to talk to cnn and msnbc and all the liberal outlets that hate

it's hard to convince me that the primary voters in the gop have more appetite for chris christie than they did the last time he ran. his last candidacy is and argument against this one. he says this time i know all the flaws that donald trump has and i will prosecute the case. he is giving it a try. he could have done that last time. he didn't. >> when he closed the beaches in new jersey and then got himself a nice comfortable beach chair and plopped it down and sat his ass down on the chair, i think he has his own problems and a lot of the adjectives he is using against donald trump we could put right back on him. >> it is part of the trick of this is how does someone prosecute a case against donald trump who is quite popular among gop voters? there is a way to do that. one way he might do that is talk about how you didn't close beaches or how you stood up for

freedom in those moments. that takes away one of his arguments. i have a feeling that some of this is just getting on the debate stage and wanting to debate and rhetorically pounded someone. >> he will go after ron desantis. the guy left with a 14% approval rating in new jersey. you really have to be awful to leave with that low of an approval rating. >> he is almost as bad as kamala harris. that is interesting. you didn't know they had that in common. no one likes kamala harris and no one likes chris christie. let's be honest. every other contender minus a couple like mike pence actually has a shot at being something within this movement, within this america first gop resurgence conservative movement. they all have a place. >> mike pence is a serious guy, a serious candidate. he's been a governor and congressman. he may have disagreements

obviously within the administration with trump, but he is a serious guy. he is in this for his reasons. >> he certainly is. i think he is unserious when it comes to getting the nomination and i don't think he has much of a future within this new conservative movement. everybody else by and large does. chris christie certainly does not. he is therefore himself and he is indulgent and narcissistic. this is all about chris christie. they are putting him on tv because he is willing to bash trump. that's the extent of it. >> i would rather do a town hall with rfk junior because he is far more interesting. one of the few democrats that actually believes in securing our borders and doesn't support men and women sports and he has got some interesting views that everyone wants to call him a conspiracy theorist on which is worth exploring. anyway, thank you both. when we come back we can have a discussion about these things and not yell at each other.
