east coast. we are expecting president biden to address the supreme court 6-3 ruling blocking his student loan handout plan. that ruling already reigniting calls from the left to change the highest court in the nation, shannon bream will join us on that. welcome back as "america reports" heads into a second hour, i'm sandra smith in new york. mike, great to have you here today. >> mike: sandra, great to be working with you. i'm in for john roberts. the president's plan would have wiped out up to $20,000 in loans per person, but a lawsuit from six states and two individuals said the president does not have that authority and the court's majority agreed. that leaves about 40 million americans in limbo. one student loan borrower disappointed with the decision weighed in last hour addressing why he thinks the plan was fair. >> as someone who graduates in 2024, i'm expecting to enter a very competitive job market looking for an entry level position. that's ultimately not going to pay me that much where i can

live comfortably. i think that families that were able to save enough so their children didn't have mounting student loans after college are reaping the benefits in that their children are able to get the jobs they want to get without being limited on social mobility. >> sandra: some on the left are pushing to do more and act. he is going to speak to that. mike hillgers, the attorney general of nebraska, and you penned an op-ed about the power grab, you say, why do you take issue with this? >> thanks for having me today. it's an important day for america, two reasons. one is the president tried to spend an enormous amount of money, $500 billion is no small thing. secondly, i think more fundamentally, he tried to do it the wrong way. for 250 years in america we have said under the constitution that congress has the ability to spend money, congress only the ability to spend money.

the president knew that, he tried to go through congress, he was unsuccessful, and he had a number of different routes to try to get it accomplished. but what he couldn't do was on his own through his own pen and that's why we filed suit. >> sandra: it's really interesting the polling on this, put it up on the screen, this is fox news polling on the president taking executive action to cancel student loan debt. it was a majority of respondents who said it exceeded his authority, in december of 2022, it has come down to 49% believe so. those that say it would be him acting within his authority has risen to 44%, so it's really split, and that fox news polling also revealing when asked how much college loan debt should be forgiven, all of it, a quarter of respondents, up to $20,000 would be 37%, and none of it 36%. so, how do you address the student we just played sound of who joined us last hour who said it has gotten him into worrying

over how he's going to catch up after he gets out of college. he graduates in 2024, and he fears that he's going to fall farther and further behind trying to pay off those debts, while he starts working. >> i would respond a couple of different ways. i have empathy for anyone, especially in the inflationary environment we live in, with a heavy debt burden. and secondly, a right and wrong way to do it. right way, gone through congress and the wrong way, through an uncons unconstitutional manner. and president biden himself as well as speaker pelosi acknowledged that the president does not have the power to just simply wave away and discharge student loans at this scale, and so the last thing i would say, i know that your previous interviewee talked about fairness. and as a policy matter, the

nebraska attorney general job description, it's hard to say this is fair when 80% of the country do not have student loans, either by choice or because they paid them off and hard to say it would be fair for a blue collar worker or hotel service worker in las vegas to pay for an attorney's education. so an element of fairness but ultimately it's for congress to decide and that's what the constitution says. >> sandra: why did you call it a power grab on the part of the president. we are about to hear from him in a short time from the white house. >> article 1, section 9, congress has the power to spend money. not the president. the president tried to spend $500 billion, attempted power grab, and we are grateful the supreme court put a stop to that attempt. >> sandra: we will continue to watch. there is reaction pouring into all of this. mr. attorney general, we

appreciate your time today. thank you. >> thanks for having me. >> sandra: the ruling could throw a wrench in 2024, as this was a huge campaign promise, and william is breaking it down for us. william, who does this affect? >> sandra, big picture, the supreme court just saved, according to the cbo, federal taxpayers up to a trillion dollars. the court ruling affects 42 million americans for the last three years have not had to pay a penny of the student loan. but august 29th, the payments will resume and they have to find the 2 or $500 a month to repay the loans. one down side, that's $18 billion a month not in consumer's pocket, feeding restaurants and retail, meaning those who took on more debt could default on their car loans or mortgages. the biden plan would have wiped out loans entirely for about half of all borrowers, and reduced the amount owed from

about 30 grand to 15 grand for the other half. 26 million had already applied for the program. eliminating up to 20 grand in debt per student. wiping clean both principal and interest payments averaging about $400 a month. and turns out the plan applied to more borrowers over age 50 than under age 24 and much of that relief went to top earners, making more than 75 grand. now, supporters justified it because so many right now are behind in payments. 52% are underwater, meaning they owe more today than they originally borrowed, hurting their ability to start a family, buy a house, grow the economy. critics argue those loans were a choice and those who did pay their loan or did not attend college should not be forced to subsidize those who can't pay their bills. so rather than save the money, sandra, those student loan borrowers took another $1,200 in debt so many are not going to be able to absorb those new

payments. so you could see more delinquencies. back to you. >> sandra: live from los angeles, thank you. mike. >> mike: shannon bream, fox news sunday anchor and chief legal correspondent. easy season for you, shannon. >> good to be with you, mike. >> mike: president biden, in 90 minutes or so, has to say something to his base about the student loan fiasco that blew up at the supreme court. elizabeth warren, excuse me, is among those putting pressure on him saying "the same supreme court that overturned roe now refuses to follow the plain language of the law on student loan cancellation. this fight is not over. the president has more tools to cancel student debt and he must use them." so what do we expect to hear from the president. >> this is really interesting. obviously he had a lot to say after yesterday's ruling he did not agree with, that said you cannot use race in higher ed

admissions decisions. interesting to see what we get from him today because what the 6-3 majority found, the statute does not give the education secretary any kind of authority. it does to waiver modify part of the statutes in play but not rewrite it from the ground up. those are the words of the supreme court. said a big overreach by the executive branch and you know a couple weeks ago the house and senate passed measures condemning this plan by president biden, so you know, legislatively they don't want to do it, he's going to try again through executive action but this court has made it clear the way they tried this last time overreached what they believe the president has the power to do. >> mike: three big cases upsetting the progressive left. affirmative action, student loans as well, and then an lgbtq case that affected the left, the progressive left. hakeem jeffries, the democratic leader in the house is calling the supreme court right wing extremists.

what about that case? >> so, yeah, and just to give a little context. 3 or 4 days ago there was a case that came out that had to do with limiting state legislature's power to draw districts that could be considered political or specific in nature to disadvantage a particular group or group of voters, and that day all the press releases i got from folks on the left, the court saved democracy, did the right thing. today they are not happy with the opinions and the 6-3 and the way they came down. that case had to deal with a colorado web designer who said i'm an independent artist, and happy to serve anybody that came in, and she works with clients who are lgbtq, that is not an issue for her but the customs designs that would, she feels, be an endorsement of a same-sex marriage event or something else she disagrees with in conflict with her religious views, she said i should not have to do those custom designs and they found the government can't make

you sanction messages that you may personally disagree with. it's a violation of your free speech right. so clearly they disagreed with that, they are couching it as you'll be able to deny service to people based on their status as a member of the lgbtq community, the court says it's not that, you have to serve everybody who comes in but you cannot force them to endorse a message that violates their first amendment rights. >> mike: and the president was asked about the high court, here is what he had to say. >> president biden, the congressional black caucus said the supreme court is questioning its own legitimacy. is this a rogue court? >> this is not a normal court. >> should there about he term limits for the justices, sir? >> mike: and there are those on capitol hill calling for term limits for the justices. final thought, shannon? >> they are talking about all kinds of things. this started yesterday with it's time for legislation to pack the court, to change the seats, that's the only way we are going

>> mike: the problems just keep piling up at airports across the country as fourth of july travel is expected to break some records. jetblue is the latest to join united in blaming the faa for this week's flightmare. grady, how is it looking? >> hey, mike, it's busy, a lot of people, but for the most part their flights are taking off on time. at any given time throughout the day today there have been maybe

a dozen to two dozen delays on the departures board here. yesterday, though, there was a ground stop because of that smoke from the wildfires in canada. this afternoon we are expecting some storms to move through the area, so that's something to watch because we have seen that problems in one area can cause problems all through the system. i want to show you the flight aware map with the latest delays and cancellations. more than 3300 of them across the country. some of the problem airports that we are watching right now, new york, chicago, salt lake city, dallas, houston, they are all seeing some delays and cancellations. but it does appear that the airlines are recovering after a combination of weather and staffing problems caused the mass delays and cancellations earlier in the week. you mentioned united was the first to point the finger at the faa and the lack of air traffic controllers for making the problems worse and now jetblue is saying the same thing.

people flying today tell us they are a bit nervous because they have been hearing about the flight issues all week, along with the subsequent blame game. >> faa should have their act together. they should have everybody -- of this been short staffed for 15 years. >> i think it's human nature you blame the other party. i think there is blame all the way around. it's really not blame, people are not going back to work. >> you know, it's never the government's fault. i'll leave it at that. >> more than 4 million people expected to fly today and with all of the problems we had earlier in the week, mike, it is good news largely that we are reporting, even though there are still thousands of delays across the country right now. mike. l>> mike: grady live at reagan national. thanks a lot. >> sandra: a dangerous heat wave has widened across the south, bringing triple digits to parts

of texas for the july 4th weekend. at least a dozen deaths in texas have been blamed on the excessive temperatures. in laredo, texas. when can we expect relief for the south? >> the heat we've is expected to move east, devastating, 11 deaths happened here at webb county, and the fire station has responded to over 70 calls, compared to the 19 last year in june. the heat is something to take seriously. >> i've always been taking it seriously. i experienced heat stroke once, i realized staying hydrated is really important. >> because it's so hot, cooling shelters are open to people in laredo but have not seen many taking advantage of them yet. however, in the rural areas we see a lot of people that don't have those kind of resources, whether they don't have air-conditioning, they do have

electricity, but some don't as well. so we do have different situations where we are trying to get these people. people with a.c. need help, too. the owner of this home told me off camera she's kept her unit maintained but noted this heat wave was too much. >> the system is older, it can't really keep up with today's heat. we looked at everything, everything looks good, except that it's just not keeping up. so we are looking into redesigning her duct work and putting in a bigger a.c. system. >> meanwhile, some are making the best of the hot weather. >> the sun beating down on me, even though i'm used to living here, this is -- >> all right. it's hot, the temperature currently at 98°, but feels like it's in the hundreds now, the fire department is stressing to look out for the elderly and younger ones and not ignore any warnings or feelings of heat exhaustion.

parents should have more say in their kids' education, and there are some 700 concerned parents at the annual joyful warrior summit hosted by moms for liberty here in philadelphia who have listened to candidates, florida governor ron desantis and ambassador nikki haley earlier today. they listened to desantis talk about how he's banned sexual orientation and gender identity -- ideology in k-12, as well as critical race theory, and central to desantis campaign is war on woke, distinguishing himself from rivals, former president trump who said he doesn't like the word woke and former vice president mike pence who recently attacked desantis over his feud with disney. listen. >> i know some people dismiss the idea that we should be concerned about woke ideology, some people don't like to talk about it. i will fight the woke and the corporations, i will fight the woke in the schools, i will fight the woke in the halls of

the moms for liberty co-founder tells me the designation by the splc is dangerous and ridiculous. they just want to stand up for parents' rights to direct how their children are brought up. sandra. >> sandra: a lot coming out of that summit, we'll keep monitoring it. thank you. mike. >> mike: sandra, there are reports president biden rejected political advice to keep his distance from son hunter whose growing scandal is weighing on the president's re-election bid. mark meredith is live at the white house. will the biden administration be forced to answer questions about first son hunter? >> mike, good afternoon. if members of congress get their way, they would. they imagine the biden administration would have to answer questions about what's been happening behind the scenes when it came to the investigation not first son, hunter biden. the president's son recently reached a deal which allows him to pay back taxes without

spending time in jail. republicans on the hill are seeking testimony from at least 11 federal employees who may be able to shed light behind the scenes the last few years at both the irs and the department of justice. three top house republicans say there appears to be a double standard when it comes to hunter biden. they write the federal government is supposed to work for the american people. whistleblower evidence shows the federal employees were working overtime to cover up for the bidens. now, as you mentioned, there are reports the president has been telling aides he does not want political advice how to handle the scandal involving his son. the president was on msnbc, and great length to keep from the justice department. >> i have not spoken once with the attorney general on any specific case, not once, and -- but i do talk to him about law enforcement and all those other things. but the point is that i just think we -- there is -- interfering in institutions. >> the attorney general is

expected to go up to the hill in september to testify before the house judiciary committee. we'll see if there's any response to this letter involving what the members of congress, who they would like to testify fairly soon. the president will be speaking on camera talking about the supreme court decision. mike, it's always possible he could take a question involving this. mike. >> all over it, mark, thanks a lot. sandra. >> sandra: meanwhile, the push for return to work in-person continues as the wall street journal is reporting more and more bosses are pushing to get their workers back in the office, especially on mondays. they say it creates good energy and it booster productivity. however, many employees who have gotten used to work from home they are hesitant, pushing back to work remotely. kennedy and abby will react. standing by. our next guest has struggled getting his staff into the office on mondays. jeff joins us now.

welcome to you. so, why have you having a hard time getting people back to the office. >> thanks for having me on. it was kind of an interesting shock to be contacted by the wall street journal about this, so we are an independent non-partisan think and do tank in philadelphia that focuses on fostering inclusive and equitable growth. so we are a small group. 13 of us. and i hired every single person on the staff during the pandemic. so we have been remote for a while. 115 years old but this is a completely new staff, incredible, smart, young, diverse team, and my view is that building organizational culture is difficult enough in-person but doing it remotely especially when you have no experience of being together is particularly difficult. so -- >> sandra: very interesting point. i just brought this up to our

panel that will join us in a minute, is it can be very different, someone who is hired, right, to work from home versus somebody who worked in the office before, went to work from home, already knows the office culture, knows their work colleagues, and then you know, whether or not they want to come back. so, jeff, what are these workers telling you? why is it they would prefer to work from home on a monday, for example? >> so, i don't think it's a hang-up about a monday, per se. although some of my staff would rather do other days. i mean, i agree with the quote that ann marie that you just showed from ann marie's article that mondays are just the day to start the work week. until we no longer start work weeks on mondays, i'm going to be insistent that monday is the day. we are a very flexible organization, give people time off, flexibility how they do their work, we work hard but i

also want people to have time for themselves. but the teams, my experience and i'm really, i'm 56, the next oldest person on my staff is 40. so i've been in the labor force a little bit longer and i'm also -- it's my job to make sure we build organizational culture. so, some people would rather never come -- >> sandra: i say monday, wall street journal said mondays are the new office fight, pointing to a statistic, more and more people are coming in but mondays still lag behind tuesdays, wednesdays and thursdays for office attendance, friday has fallen off a cliff, but the monday before memorial day as an example, this memorial day, the office occupancy rate, a company who tracks it by card swiping to enter your building or your office, the office occupancy rate was 45% of pre-pandemic levels. that is pretty remarkable that we are still there this many

years after the pandemic began. quick final thought, jeff. >> in philadelphia, it's 53% in general. the big firms like comcast are starting to mandate. we are not into mandates. we are experimenting with what works, we'll do mondays for a while and if that doesn't work we'll pivot. but i think the staff, you know, wants to feel like there's a good reason, and i think that's what companies need -- need to give folks a good reason they are coming in, on whatever day it is. >> sandra: sounds like you put a lot of thought into it. appreciate it. >> thanks so much, appreciate it. >> sandra: kennedy is here, host of the podcast "kennedy saves the world," and abby. this is our friday panel. what do you think about what jeff just said, kennedy. the businesses are trying their best. they have to manage their way through, and if he feels as the boss that he needs to get more people back, he's got to tell them they have to come back but he does not want to mandate it. >> to a degree and some point

you have to mandate it, be the boss, lead by example and rip the band aid off and sure it's uncomfortable a couple weeks but people get used toit. monday is the day you should be shot out of the canon and you have to show that, lead as a boss and if that's your corporate policy that's your policy and stick to it. you know, one of the things that is going to course correct here is a looming recession and that means a tightening labor market. the fed is not going to slow down soon and part of the aim of the fed raising interest rates is to create more unemployment, so we have had a proliferation, and the choice to dictate when they would like to come to work. this is america, we are the land of productivity, that's not going to happen. >> or is it possible these companies can figure out a way to have so many people who do enjoy some people want to get the heck out and go to the office, others manage their families and household work if they can stay home and not have

a commute, for example. one of the workers quoted in the wall street journal says you know, it's hectic, chaotic, the commute on monday mornings, he's more productive if he can get his work done at home. >> of course he's going to say that. i'm with kennedy, you have to kind of make people do it and then you learn. the biggest issue is we have created these trendy words to label lazyiness like quiet quitting, sunday scaries, what now, bare minimum mondays, and why are we saying this. i'm a firm believer in flipping the switch in your brain and teaching and rewiring your brain. once you do that, everyone's life will be easier and productivity is going to be up. >> sandra: to quote kennedy, some things are hard. but sometimes you just got to do hard. >> one of the ceos in the article said i look at monday as new year's day. you had a year past, new year's eve is done, start a new year with endless possibilities. >> monday is a huge breaking
