11:06 am
the higher education act of 1960 bag as a secretary of education broad authority to waive or release student debt what do you make of that legal argument rethink that post? >> brantley problem under the heroes act enables to modify altar based on emergency the supreme court repented made it crystal clear does not give him carte blanche to waive away expect the administration is going to have the identical problem. i believe that law, similarly will provide for individualized circumstances based on emergencies, based on things like a pandemic and other emergencies. but the emergency aspect of the pandemic is largely over fortunately.
11:07 am
it's going to allow for modification alterations but not a sweeping cancellation. >> yes. you didn't touch on this the call that major powers, questioned doc which shows essentially look, congress has to be very specific about his intentions when it passes something. they do not want things to be misinterpreted essentially. i guess that is what you're saying here. they could read into the same problem with the president decide to go down this route with a higher education act of 19625. >> that is exactly right. the point is under the matrix of these statutes a lot of times you do have to go back to congress exactly as you just said to get approval for such a massive and sweeping change. to boil it down to its emphasis form the bottom line is congress controls the purse strings for the united states constitution obviously.
11:08 am
and so in a statute provides for individualized emergency circumstance type thing, that does not equate so explain the opinion clearly does not equate to canceling hundreds of millions of dollars. if you want to do that you have to go back to congress, your exact point. bryan: lester to the affirmative action decision the supreme court finding the consideration of race in university admissions is unconstitutional. but they didn't leave the door open for colleges to essentially consider socioeconomic adversity or students could potentially write about the adversity they face based on the socioe socioeconomics. even race in the student essays. i'm wondering though, this seems like a very gray area. how do you see this moving forward for colleges and the potential of more legal action? >> well, it has always been a great area. even after the case the case years later.
11:09 am
how to implement the exes and i was of the spring the supreme court has made pretty clear all throughout you cannot check a box based on race. he cannot have 20 extra points on their application calcu calculation. simply because of the color of their skin. but as you said there is nothing wrong with having someone puts their own individual circumstances, their background, it race may become perfectly apparent from that. it's a very gray area for colleges and universities are going to be striving for div diverse. the guidance is more on the nuts and bolts not going have boxes being checked scores being increased based on someone's skin.
11:10 am
we can account everyone's background. two parts what is this mean legacy admission? there's a lot of people saying look you cannot give preference to alumni based on the sets and eczema going to go after. the second part of this is how does this affect the hiring practices in the private sector? are we going have businesses that are not going to bail have diverse inclusion or specific internship programs based on race? >> well, first part of the question as there is definitely a problem. which is based on human nature and elitism, let's face it for hundreds of years with the topmost elite schools by the wealthiest most prominent citizens and families and their offspring. they oversee admissions, big financial contributions, donating buildings and all of that prevents a problem that has to be addressed. with the supreme court said though is the way to address it to not engage in further discrimination and this case
11:11 am
against asians is just not ri right. but to your question i do not think it's going to impact so-called diversity programs and hiring incorporations as long as they steer clear of carving out specific quotas, real specific equations giving people benefits simply and solely because of their racial background and so forth. but again your point is really key and that's a take away from the decision is let's not everybody get totally over the skis with the social and political comments about it and how it's going to set everything back and destroy diversity. because it is not. it's really more of a signal they did not want specific favoring one race over the other. because under the 14th amendment to the constitution discrimination and to be fair about it. but again i don't think it's going to seriously curtail
11:12 am
hopefully movements in the right direction. bryan: we will see i know there are nine states that have their own laws essentially had already banned affirmative action. huge college systems and texas, california, michigan, florida that essentially said we are not going to do affirmative action and the results have been mixed there. we will see what this does to diversity in colleges and again we'll see if there be any more legal challenges after the supreme court decides with this decision generally is time to move more towards a meritocracy i guess we'll see how this plays out. >> yes, no question about it. it's in there is the keion his flavored way you talk about legacy and people whose families gave a million dollars to a school, look at their record. what is her gpa? what are their test scores customer compare this to somebody else. if some to give a million dollars but their scores and their gpa is lower, then don't let them in. that's the type of area we need
