sandra smith. some are forced to drive to their destination instead. with 43 million americans expected to travel throughout the week, are the roads ready. >> bryan: jeff flock is heading down the pennsylvania turnpike as we speak. jeff, what are you seeing out there? >> you know, i don't think i've ever seen a holiday travel day that's been any calmer and better than this. take a look at the pennsylvania turnpike. we are just approaching valley forge, which is appropriate, general washington spent some time there in 1777, but it's clear out here now, despite the fact that we are facing, we think, according to the aaa, at least, record travel both by car and by air. take a look at the numbers. 50 million people, they say, aaa. bigger than at any time pre-pandemic.

43 million of those as you point out by car. and you know, the numbers really seem to bear that out. if you look at the tsa checkpoint numbers, they came out this morning from the department of transportation. they said over the friday, saturday and sunday of this past weekend 8 million people roughly went through the tsa checkpoints and friday was the biggest, busiest travel day airlines in u.s. history. maybe that's why at least in part there were so many delays and cancellations. all across the country, multiple airports, houston, newark, atlanta, a mess, partly the weather, 24,000 delays and 1400 cancellations. why was this? we asked the folks at morning consult why they think more people are travelling now. listen. >> i think what we are you know, kind of recording from our own data is increased willingness to just go a little bit further. people feeling a little more

confident financially now compared to last year because of inflation being down and gas prices being down and that really encouraging people to take bigger, longer trips. >> and the other reason may be, take a look at the gas prices, yeah. pretty good numbers right now. 3.53 is the average gallon of regular across the u.s. this time last year, 4.81. so, yeah. getting a break on the roads more ways than one. i leave you with perhaps a look out the window at the pennsylvania turnpike as we head, i'm heading toward the jersey shore, that's where i'm headed, headed east. >> bryan: i trust being in the vehicle with you jeff flock, that's for sure, and i imagine busier tomorrow as people get back home. >> i would think so. >> bryan: jeff flock as only jeff flock can do. thank you. >> molly: another unusual story the effects from the canadian wildfire, the smoke still

lingers. impact on travel very visible. alexis mcadams is live in new york city with the latest on this. alexis. >> hi, molly, good to see you in new york. it has cleared out a bit here, it's more clear skies than it has been here the past few days but not the case across the country as the heavy smoke from the wildfires has moved in, leading to delays from airports as well. you can see the four major airports across the country, what they have been dealing with here the past few days. long lines in atlanta, d.c., houston and the bay area. people are stuck waiting for hours in line at newark international, and bad weather, mechanical issues, staffing shortages, you name it, all playing a role and the heavy smoke is also to blame. officials say more than 560 active fires and many are out of

control still. low visibility on airport runways. wildfire officers say it's an ongoing issue. >> probably one of the longer, busier fire seasons that we have seen, certainly in this area in a long time. >> just yesterday heavy rain leading to severe flooding in chicagoland. cars were underwater and lots of traffic and travel delays. you can see it on the roadway. the summer storm did help shift that heavy smoke out of the chicago area, which was really impacting o'hare international airport. according to flight aware, 330 delays at airports across the country. only a handful of cancellations. but as you heard there, the wildfire officers say this will continue for the summer. so it could impact travel. another thing you have to get to the airport and when you are delayed. >> molly: thanks for keeping us up to date as folks are trying to get to where they want to go.

>> bryan: president biden is clinging to his promise of student debt relief after the supreme court struck down the $400 billion handout for borrowers. the president says his administration has a new plan involving the higher education act of 1965, and supposedly falls in the constraints of the court's decision. fox business correspondent grady trimble is live from the white house. what's in president biden's plan b for debt forgiveness. >> hey, bryan, two parts to plan b. the first, so-called on ramp for loan repayment and while that's going on, the second part comes in. the president wants another crack at cancelling student loan debt even after the supreme court overturned that executive order last week. the white house says interest will start accruing on student loans in a couple of months, september 1st. borrowers will have to start payments once again in october. if they miss a payment in the

first year, president biden says their credit won't take a hit. at the same time, that's the on ramp -- at the same time, the white house is working on a new plan to cancel student debt using another law, the higher education act of 1965. some progressives say the president needs to do more to ease the burden on borrowers. >> i do hope that the white house will make sure that the interest doesn't accrue starting in september. i know the president has said he isn't going to refer students to the credit agency. i also believe under the higher education act he can stop the interest accrual. >> the committee for responsible federal budget says it's time to put these costly cancellation schemes behind us. too much time has been wasted on empty promises and not enough time has been spent on making sure borrowers are prepared to begin making payments again. they also say the decision from the supreme court will reduce the deficit by about

$400 billion this year. >> isn't it an amazing thing we finally have somebody in washington who wants to cut government spending. it's not the white house, it's not congress, its the united states supreme court. it's a great day for america in terms of getting some of our bills under control. >> the president says this plan b for student debt forgiveness will take a little bit longer than that executive action that the supreme court struck down, bryan, but says this time around it is legally sound. so we shall see. >> bryan: it could be over a year or so. live at the white house. grady, thank you. >> molly: the u.s. attorney in charge of the hunter biden investigation is breaking his silence on claims that his probe was influenced by politics. in a letter sent to republican lawmakers friday, david weiss writes as the u.s. attorney for the district of delaware, my charging authority is

geographically limited to my home district. i may request special attorney status from the attorney general. where does all of this actually go from here? jonna spilbor, criminal defense attorney. thanks so much for joining us on this holiday. appreciate it. a lot to unpack here. two irs whistleblowers testifying before house republicans claim the senior justice department officials blocked prosecutors from bringing charges against hunter biden in washington, in california and refused to grant u.s. david weiss special counsel status. weiss has pushed back against the perception reiterating in a letter that he was granted ultimate authority over the matter, including responsibility for deciding where, when, whether to file charges but clarified as we just noted there that the authority lies in his home district, seemingly unless he requests special attorney status from the a.g. who offered this clarification.

listen. >> the only person with authority to make somebody a special counsel or refuse to make somebody a special counsel is the attorney general. mr. weiss never made that request to me. >> molly: what do you make of this? >> well, david weiss got tired of being poked in the chest so he had to say something, what he did. but come on, if it looks like a sweetheart deal and it quacks like a sweetheart deal, it's a sweetheart deal. why is it a sweetheart deal? in the real world any defense attorney who can negotiate this kind of deal, which is basically a unicorn because it never happens, would get a medal from all of his or her friends and colleagues. but this did not happen. this deal did not happen because of fancy criminal defense work. this deal happened because of the biden name, and you can -- and david weiss can say it didn't happen that way, say he was limited geographically, by the way, what does that even

mean? if you are in charge of an investigation and you need assistance from fellow u.s. attorneys, you don't ask for permission, you say hey, we are working together now, congratulations. you don't have to wait for them to say no, that's not really how it works. but that's how allegedly it worked in this case. >> molly: i think you clarified where i was going with the next question, miranda devine, this is a quote, the most serious charges in the hunter biden case were dead in the water because weiss did not have the authority to charge them let alone ultimate authority. but there delves into the crafted semantics from the responses, accusing weiss of putting forward this convoluted hypothetical, noting that weiss writes he may request special status, not that he did. what do you make of the word games going on here? >> i think it's definitely a word game. look, this whole thing happened

because biden administration, doj, wants america to stay stupid and wants this case to go away and they think that by this plea deal, which basically reduces what should be several felony charges down to a couple of misdemeanors and diversion, is going to shut everybody up and we'll all go home and won't worry about hunter biden anymore. that is not the case. and can we just talk for a minute? misdemeanors, the irs does not get out of bed for misdemeanors. this never happens on tax charges, number one. and number two, diversion, you know what strikes me about the diversion charge, the lying on the gun application, diversion takes a case out of the criminal lane. that's the purpose of it. you are diverted out of criminal procedure, and it's usually done with somebody who has an active drug or alcohol addiction to give them another chance. is hunter biden still actively under the influence of drugs?

switch today. >> bryan: violence in the nation's capital over the weekend as explosive devices and a molotov cocktail hit three separate businesses in 15 minutes. now a manhunt, david spunt is live in washington with more on this. do police have any leads at this moment. >> yes, a photograph of the suspect and a license plate number, unfortunately, no positive i.d. at this point that we are aware of. police on the hunt for what they believe several people possibly behind the attacks, thankfully no one was injured but several properties did sustain severe damage. it happened at three properties in northeast d.c. yesterday morning. a truist bank atm, someone detonated an explosive outside the building at 4:30 in the

morning. a nike store a few minutes later. the third, a safeway grocery store. no one injured but severe damage. the suspect threw the molotov cocktail-like object into the store. police put out this photo of the suspect and a vehicle, likely one of several suspects. a gold champagne acura tl, 17971c2k, and now they are putting together the pieces of who and why authorities are looking for this. authorities are offering that combined $20,000 reward for information leading to the arrest of the suspect. now, let's look at the car again, police have that clear picture with that maryland plate, 17971ck. any information people may have, call the d.c. police line.

hilton, ritz carlson and intercontinental, stepping in as dishwashers, cooks, and bellboys out on strike. >> people are not able to live in l.a., we are not paid appropriately. >> cannot afford to live in l.a. because of how expensive it is. >> the union wants more affordable healthcare, higher pensions and wages, workers making $20 an hour would jump to 22.50 under the hotel proposal. the union wants 25 an hour. by 2027, the hotel bumps that to 26 an hour, the union wants 31. plus, the union is demanding management stop checking their immigration status or criminal record. hotels want the union to drop support of an upcoming ballot measure that would force hotels to rent empty rooms to the homeless. this comes as the writer strike and follows the l.a. educators and dock workers walking off the job earlier this year and actors

>> molly: over to the 2024 race for the white house, republican candidates are embracing the supreme court after it handed down a number of landmark decisions last week while the left is ramping up attacks against the nation's highest court. constitutional law expert jonathan turley will break it down, political fallout. but first, chad pergram is following the candidates in washington for us. chad, what are they all saying about the decisions to you? >> molly, a lot. they are using the rulings for their own political benefit.

former vice president mike pence highlighted the ruling overturning the plan to forgive student loans. >> so you are going to say to working americans, to truck drivers, people working in the trades, we are going to take your taxes and pay down a part of the student debt of doctors and lawyers and ph.d.s. this was not about the middle class. >> vivek ramaswamy applauded the ruling to strike down affirmative action programs in higher ed and promises to end the department of education. >> we will shut it down, starting with agencies that should not exist, like the u.s. department of education. we will shut it down. >> republicans wanted to abolish the department of education in the 1980s. and former president trump reminded pro life voters justices confirmed on his watch

changed abortion policy with the dobbs case. >> one year ago they ruled against roe v. wade, something said never going to happen. and you have to know how to discuss this, giving pro lifers a tremendous power to negotiate, and moving this issue back to the states. >> of course, democrats seized on the abortion ruling to their political advantage last year. expect democrats to run against the gop and the supreme court in 2024. molly. >> molly: chad, thank you so much. wonderful to see you. happy 4th. >> you, too. >> everything should be on the table, reform and expansion. >> it's not for unelected judges to override what the court has passed. it's very dangerous. >> the courts, if they were to proceed without any check on their power we will start to see an undemocratic and frankly dangerous authoritarian

expansion of power. >> bryan: democrats are calling for major somebody reform, some on the left have called for expanding the number of justices and others have suggested impeachment for some current members. g.w. law professor and constitutional law attorney jonathan turley. appreciate it. you hear the democrats after the three landmark decisions, they say they want to institute term limits, they want to pack the court, ethics guidelines, and words like authoritarianism, undemocratic. what say you. >> well, it's pretty ironic that the supreme court just handed down a major decision reinforcing the authority of congress. that's what was involved in the loan forgiveness case. the court said you have to go to congress to spend almost half a trillion dollars and these members are outraged that the court would do so, that president biden would have to come to them and get actual

legislative approval. i mean, president biden made no secret of the fact he knew he couldn't get that approval, and so he decided to go it alone. that's the definition of authoritarianism when you go it alone. what's also amazing about this. this is a court that not only handed down most of its rulings, unanimously or near unanimously, but delivered a number of victories to the left as well as to the biden administration, including a huge victory on immigration, and yet that's not enough because they disagreed on other cases. these same members want to pack the court, to add members until they have a liberal majority. >> bryan: i want to talk about the point about danger, they keep using the word dangerous, democrats do, about these decisions. primarily, the lori smith case. you called that an amazing moment for fwree speech, the website designer ruled in favor

to deny services to whoever she wants to deny services to, a gay couple. concern this means anybody can be denied services based on their race, even those in interracial marriages. is that danger real, is that something that people should be concerned about? >> well, the coverage of that case in my view is other worldly. it is so disconnected with what the case actually said. it is a major victory for free speech. it was a case written by justice gorsuch who said we have to be able to tolerate the views of others, have to be able to speak those views, cannot be forced to give the views that they don't believe in. now, that protection applies to lgbt people. so if you are an lgbt web designer or a baker, you cannot be forced to say things that you find are deeply offensive. this is speech neutrality. it means that we are going to allow this protection regardless

of the inherent views. these justices weren't applauding the views of this particular business person, what justice gorsuch was saying is free speech runs to the core of who we are, and it is really astonishing people saying it ends public accommodation laws. that's as far as you can get from the truth. what we are talking about are just those products that are expressive or creative. so, all of the people involved in these cases, including masterpiece cake shop, the earlier case, said they will accommodate anyone, regardless of their status, for products that are premade. but if you want them to create something or to engage in an expressive product, they will not do so if they disagree with it from a moral, political standpoint. >> bryan: sorry to interrupt, john, one other thing in on the heroes act, because that's important here.

the administration now thinking they want to use the route of the higher education act of 1965 to try to justify the $400 billion in student loan debt, the plan they had of student debt relief. what do you make of that? is it just as obscene as you thought the heroes, using the heroes act was? >> well, remember, this was plan b. heroes act was viewed as the stronger case, and what the new path the president is taking is like going from d.c. to new york by way of l.a. he just has to go down to the street to where congress is located and ask them for the money but he doesn't want to do that. >> bryan: ok, jonathan turley, thank you for that, i really, really appreciate you being here. happy fourth. and an actor of "sopranos" fame, he said hate and ignorance is not a legitimate point of view. america is becoming dumber by the minute, he said that on -- and he said he was going to

sarcastically say forbid bigots and homophobes -- >> molly: and charles barkley, people are passionate, this is regarding affirmative action ruling, he says in my will i'm leaving auburn 5 million. i'm going to change it to be just for scholarships for black students. so, for a lot of people this really kind of struck to their core a number of different rulings and in the sense, putting money where your mouth is, trying to take some action on it. >> there's a concern it's going to creep into other aspects of people's lives and as people try to digest what this means, we need jonathan turley and his expertise, and affirmative action, there is concern how it's going to affect private businesses. does this mean diversity and

>> molly: new accusations of gambling as the nfl suspends four players, three indefinitely for betting on games last season. steve harrigan is live in atlanta with the latest. >> molly, two of the players are indianapolis colts, one is a tennessee titan, and one is a free agent. three out of four will be gone for at least one full season, and possibly longer. one of them will be losing a salary of $2 million a year. this as the nfl is trying to send a get tough message on players who gamble on sports. >> a lot of these guys, you will

propaganda victories. this would be another one like the blinken visit was a propaganda victory. >> bryan: let's bring in grover norquist, president of americans for tax reform. grover, appreciate it. let's start off, she says the goal to stabilize the relationship, we need channels of communication. at the same time the biden administration has been preparing for months an executive order to curb investment, to cut off the chinese from receiving technology that doesn't seem like china wants anything other than, they don't want those. where do we come to an impasse here? looks like the chinese are not going to want that at all. >> the u.s. economy is not doing well, but inflation was not caused by china, it was caused by janet yellen and joe biden's spending plans. if she wants to look at the problems we have in the u.s., look in the mirror. yellen and president biden and

the modern democratic party want to take the corporate income tax now lower, the republicans lowered it below china's. they want to take it up higher than china. so all american goods and services will be more expensive than in china. the capital gains tax, yellen and president biden and the democrats say they are going to take it to twice, more than twice what china's capital gains tax is. so, these are self-inflicted wounds that janet yellen and joe biden and the modern democratic party have done to the american economy. i don't know what they are talking to china about. they could solve those problems today. >> molly: and grover, it's molly here. one of the questions or one of the strategies that supposedly the u.s. is taking by making these types of visits and keeping communication open is as national security advisor jake sullivan put it, engaging in derisking, avoiding not just

economic strife but other strife, military challenges somewhere down the road. >> well, one of the challenges we have is that xi, the leader of the chinese communist party, watched as joe biden pulled the rug out from under the american army and the afghan government and handed it over to the taliban. afghanistan is right next to china. they have a border. china saw biden's weakness and self-destructive policy there, so it's not surprising that he thinks he can push yellen and biden around. >> bryan: grover, vivek ramaswamy, one of the presidential candidates, he had this to say about this upcoming visit. take a listen. >> i would ban most u.s. businesses from doing business in china unless and until the ccp reforms its behaviors. >> that would have serious economic consequences in this country. >> i think it would have some

weekend. it started saturday morning when musk shared this tweet announcing the new rate limits. he said "to address data scraping and system manipulation, we have the following limits." limited to 6,000 posts a day and new unverified to 300. after the backlash, musk had to increase the limits and now they're at 10,000 for twitter blew and 1,000 for those unverified. you might be think, 1,000 tweets per day. more than enough. for dedicated users, they can hit that easily in a few hours of scrolling. for context, data scraping is where automated services scoop up all the publicly available data on a website. these are the bots that musk has been railing at. he expressed a lot of frustration with the practice when twitter began users to log in to retweet tweets. he said almost every company
