"the five" that's going to start right now ♪ ♪ >> hello, everyone. i'm judge jeanine pirro, along with richard fowler, joey jones, kellyanne conway, and tom schilu. it's 5:00 in new york city. this is "the five." it may be the day before the fourth of july, but patriotic americans all across this great country are already getting their celebrations on for america's birthday. the a record 50 million people hit the road or skies this

weekend. beaches are packed and grills ready to be fired up. and fox nation host abby hornacek is gearing up for fox news' big independence day show, out in west jordan, utah, right now. abby, how's it going? >> judge, it couldn't be better. kind of like you mentioned, we are here all weekend long, because obviously the fourth of july is meant to celebrate for the whole weekend. it's not just about the day of. it's about all the day beading up to it as well. our time kicked off at the stadium of fire, where patriotism definitely took center stage. tens of thousands of people gathered to celebrate family, faith, freedom, music, and of course fireworks. the night started with a flyover by f-35s as fireworks burst into the air, people cheered, and even told me it was their favorite part of the night. there was a special performance by the legendary people band,

which people absolutely loved. for the grand finale of the night, they did light things up with the largest stadium fireworks show in the country. it did not disappoint. neither did the balloon fest, by the way, which is where we were this morning. thousands of people showed up to watch 30 hot air balloons launch into the air after sunrise. a pilot, a cofounder of the event, was kind enough to take me up in a balloon named the eagle. just like its name suggests, it was very patriotic. as soon as we touched down, we walked around to find out what makes people proud to live in this country. take a listen. >> what inspired t this morning? i love this country. i'm a first generation immigrant. i love the u.s. i love the flag. you come to my office, you see the u.s. flag everywhere. >> i'm from brazil. ever since moving to the u.s., this has been home away from

home. the this is patriotic, and we come together for the greatest day. we love it. >> such beautiful answers by people who didn't necessarily grow up in this country, but they talked to me about what it means to live in a free country, have that freedom of speech. speaking of proud americans, i also had the chance to catch up with world war ii veterans, who talked to me about their stories. they even got sentimental when i asked what it means to them to wear the red, white, and blue. awesome moments this weekend. you'll see that tomorrow in our special coverage. right now we are about to film another package at the western stampede rodeo. these are the fairgrounds right outside. before we get a little bit of an adrenaline rush at the rodeo, we have to test out this ride, called the seven seas. i don't know. to me it should be called from sea to shining sea maybe. those cowboys at the rodeo know how to have fun. we have to have fun first. i'll send it back to you guys.

the good for you, abby. it is cold in here. fourth of july is the, but dependence is the reason for the celebration. this is incredibly important to all of us. we take our liberty and freedom for granted. there are many people, particular women around the world, who don't have the freedoms that we have. i love it all. i have to say, as somebody who travels this country extensively to every nook and cranny, there are constant signs of patriotism and love of this country and her beautiful people everywhere i look, everywhere i go. may not be very obvious when the noisy bossy people try to put america down and stomp all over the flag and whatnot. but most americans absolutely are very proud and know what a gift and a blessing it is to be here in america. happy birthday. happy 247th birthday, america. >> joey, what are reaction to abby, what's going on there? >> number one, i want to be on that ride with her. looked like fun.

skull and crossbones? i'm a fan of fun, you can almost die doing it. it's independence day. we can't forget. i'm not trying to be preachy. we can't forget that fourth of july is the celebration of freedoms and liberty and fun. we're going to grill out and set off fireworks and love our country. fourth of july is independence day. so always use the term depeindependence day, because tt reminds me generations of americans fought for it. it was to get closer to perfect, pursue it every day, and i think that's what we do. >> richard, your reaction? >> joey is right. we get closer to getting it. it's important to look back at the fourth of july. we didn't sign on this day, but it's a larger, bigger

celebration about freedom and independence. it's important to look at our history, look how far we've come, how far we have to go. >> all right. the rocket's red glare is going to look different tomorrow night in some cities, because they're swapping out amazing fireworks displays for environmentally friendly drone shows. it's happening in fire-prone areas as a way to alleviate air quality concerns. u.s. forest service managers in the drought-stricken southwest are urging people to swap their fireworks for silly string. all right. so, tom, i'll start with you. in 2020, newsom banned fireworks as a covid measure, and the city responded with fireworks. do you expect the same thing to happen tomorrow night? >> yeah, in those cities. they're taking the fun out of

everything. silly string? that's what you do waiting for the fireworks to start, spraying it in people's pair, things like that. it's in the national anthem, the rocket's red glare, bombs bursting in air. what happens? the smoke clears and we can see the flag. that's part of the whole thing. the smoke will clear. all right? the end is not going to end because we blew off a couple of fireworks. >> environmentalists cried foul when the u.s. forest service advised people to use non-biodegradable plastic silly string instead of fireworks. how ironic is it that on the day that we celebrate our freedom, tthey're advocating now for sily string. >> you can never make them happy, which is why you shouldn't try. many americans try to buy fireworks legally and set them off. we saw the viral video this

week, the entire family, where that's not the way to do it. i'm struck how many millions of dollars people spend to have their own private celebration. i think we're talking about the exception, not the rule. this is a time-honored tradition of all the things people are trying to cancel and go woke on. this is one i think the way we celebrate independence day will continue. >> okay. you know what, this fireworks, the fourth of july products, are $100 million business just this year. they project it's going to be even more going forward. >> yeah. there's a reason why. it's the same reason people love guns. to have the awesome power of something, that they can blow up in their hand, and part of freedom is the danger of freedom. people are infatuated with doing dangerous things carefully. that's part of the american spirit. i mean, the fight for independence was not guaranteed. the fight to have your own country -- i mean, we talk all the time about it's easier to talk about something than to go

out and do it. it's a lot easier to stand in parliament or a convention and say -- and say something as opposed to go out and fight for independence. and so i think the setting off of fireworks and the awesome power and the percussion of it is more than just a spectacle. it's a reminder of what a fight for independence really was. so if that means to go out and buy fireworks, i'm all for it. be safe, learn to be safe. same thing i'd say about gun ownership. >> last year in 2022 gallup indicated there were 39% of americans that expressed extreme pride in the united states. this year we're up one point. there are some people -- >> ha-ha-ha. >> -- so disgusted with the fourth of july, they are going to other countries, so they don't have to be here to celebrate it. how does that strike you? >> i don't know. i'm here with you, judge. there's that. on the fireworks, it's an interesting story. look, i get it, people are going

to buy fireworks no matter what. my mom is a registered nurse. i was raised by a pack of wild registered nurses. i told them about this segment. they work in the emergency room, on the fourth of july. they love going to work, but hate going to work, because they deal with the fireworks industry. i asked them for a couple of tips. number one, have a bucket of water indonesia. number two, never throw fireworks at anybody. that happens. number three, keep fireworks away from buildings or trees. number four, light fireworks one at a time. number five, a big one, if it's a dud, it's a dud. don't pick the dud up. don't try to relight the dud. they recommend throwing water on the dud, because they say oftentimes people pick it up, they will explode, and they end up in the emergency room. keep the fireworks away from children, especially sparklers. they are 2,000 degrees, and kids up igniting their clothes on fire and end up in the emergency room. that's from your nurses.

don't agree with and oppose. maybe he could use mindful breathing and not ending sentences in prepositions. judge, i just heard aoc use a term that has a great deal of meaning in this country's history. she said we have judicial review. yes. in 1803 the chief justice said we have three coequal branches of government, and jew backdoorary review means a law repugnant to the constitution is void. it is the job of the supreme court -- that's the judicial review -- the supreme court reviews laws and executive actions like the one taken in the student loan case, and sees if it is compatible with the constitution. >> well, these people have no idea -- the people we just heard

from. one talked about reinterpreting congressional statute. they're very upset about that. look, the supreme court has a job. the job of the supreme court is to look at legislation that's brought up before them and decide whether or not it's constitutional or not constitutional. the fact that they don't like that is their problem. if you don't like it, go get another law passed. you're in congress, aoc. you should know that. that's what you do every day, i think. the whole idea of someone saying, well, you know, this is about the will of the people. i think it was pressley who said that one. no kidding. the will of the people, 52% of them, was to overturn affirmative action, so you're wrong on that one, too. by the way, as it relates to affirmative action, there was literally no congressional statute to interpret. so these people are clueless. the idiocy stuns me. >> richard, i'm concerned about

the assault on institutions when people don't like happens with that institution at that moment. we are castigating and denigrating the supreme court as being center right. we should pack the court, have impeachments of certain justices. this was a mild reaction compared to the assassination attempt last year on justice cavanaugh while he and his daughters were sleeping in their home. what can we do to convince people, particularly members of congress, whose job it is to make the laws. that's not the supreme court's job. to turn down the temperature. if you don't like the outcome, tell them to pass a law. >> i agree. we should be passing laws. congress should pass more laws. supreme court shouldn't interpret as much as it does. with that being said, the rulings that came down this week, i almost agree with the judge. we should be having a conversation. look, especially the aaffirmative action -- >> it was hard to say that, wasn't it? i almost agree with the judge. that was hard. >> there's been bluster who it

benefits, who it didn't benefit. the assumption out there is that somehow people of color are benefiting tremendously this law. black population is 6.6%. there's good news happening today, because there was a complaint filed against harvard university going after their legacy program, which 40% of the students at harvard university are there because either their parents went there or they're a millionaire or billionaire and can by a building. it's the beginning of the end of standardized testing, because with the a a.c.t.s and s.a.t.s, kids are taking the s.a.t. prep classes in the eighth grade, because they can afford to do it. if you're poor, you can't afford

to do it, you're sitting for a test that somebody has been paying for six, seven, eight years, and that is a barrier to entry. leveling the playing field, let's not go after the student body at harvard university, but go after -- >> we see people talking about these outrageous quotes -- here, if we can read that. she's basically saying that the asian americans are complicit in white supremacy. >> that they're carrying the water. >> yeah, trying to exclude african american students, when they're trying to be included based on merit. joey, let me ask you this. i'm concerned we've got these dissents of snarkiness now. you had one, you have justice sotomayor and i think justice gorsuch going at it. listen there's disagreement,

which we respect, and disparagement. he's asking them to calm down. >> to move on from that, also, let's not give jemele hill any attention. she wants to make people hate each other. that's what she stands for. when it comes to the supreme court, i agree, in the same spirit of kumbaya, i agree with joe biden and aoc on this. joe biden said he doesn't agree on packing the court, making it more divisive and polarized. with aoc, i love any notion of bringing ethics to people of power. i really do. add it to the supreme court, the executive branch, especially when presidents and their sons go out and make deals with other people, bring ethics to power. number two, i love the idea of term limits. i love the idea of term limits. somebody is falling asleep

sitting there, do they have their faculties about them to be a supreme court justice? that also applies to the presidency. you know, do you have the faculties to be president? a lot of these things they're throwing over at the supreme court, they don't want to apply to the president. they expect more from the supreme court? okay. i do too. if i'm going to expect more from them, then i'll give them more respect. looking at these decisions, if i'm going to be an actor, i'm going to take issue with something as intellectual and academic as how the law works, i'll take the time to understand it. now i get to be a bigot and tell you you can't watch my movies. the supreme court decision didn't say she gets to decide who looks at her website. she gets to decide how chesssheexpresses in her art. that means he never has to play a conservative in a movie. >> he's wrong about what that case means.

the court uphold its rationale that you don't compel speech by you that offends your religious beliefs in this case. let's broaden this out. a year ago after the dobbs decision, people said the court was bold in up-ending roe v. wade. this year the court was asked to overturn six cases and did not. they basically agreed with the lower courts on these seminal cases. how do you characterize the end of the term? >> this idea there's supposed to be democrats and republicans everywhere, like we have them in congress, you know, we don't need them in the judiciary. i'm not kidding when i say there shouldn't be any liberal judges. am i out of line in saying that? >> no. >> the judges should be without politics and interpret the constitution like you said. this idea we're supposed to have balance. we're not supposed to have balance. >> these democrats don't know

time for a tune-up. a new politico piece arguing, president biden needs somebody who can make him prove he can still run the traps and beat whichever republican he faces. biden has challengers like rfk jr. and marianne williamson, but other names. as the piece puts it, quote, just as any heavyweight under the age of 75 with the pugilistic skills of putting them 12 rounds. tom, you're a big boxing fan. you're big on that. >> i'm a pugilist. >> tell me about this idea that rfk jr. isn't that person. >> they want to ignore him. they're pretending he's not a competitor, faking his numbers.

the last poll, said he had 1.5% in new york. they fudged those numbers. he has support out there. not just the left, but freedom-loving people on the right who kind of like some of what he has to say as well. i agree with this. the premise of the article that it makes you stronger. i remember when i was a kid, and ted kennedy ran against jimmy carter. then jimmy carter defeated him. he becomes more powerful as a result. then ted kennedy had to suck it up and support the president. if you win, you win against a tough opponent, it's going to make you stronger. in that way, i agree with that. >>ke talk about polls. one of the things that doesn't sit well with me, democrats love to point out that trump was -- there was no base for him going into 2020. what they seem to always overlook, one poll here, isn't a direct parallel, but trump never had under 40% approval rating
