protection clause. and it turns out, this is a cause for celebration for the vast majority of americans. who agree with the supreme court wrote quote limited english discrimination means eliminating all of it. it cannot mean one thing when applied to one individual and something else when applied to a person of another color. abc poll reveals 52 percent of americans, agree with the decision to overturn race-based missions. but sadly, this did not go over well with many democrats. new york congressman jamaal bowman says the court is illegitimate. and they are there to serve white supremacy and white patriarchy. >> the supreme court is here to serve oligarchs. they're here to serve billionaires come here to serve corporations, here to serve white supremacy and white patriarchy, and nativism. they want to take away our civil rights, they want to take away our voting rights, human rights, women's rights, they want to make our country more dangerous by spending

concealed carry permits. they want black people to be educated. it's a new constitutional convention. that includes all people. women, people of color, lgbtq, everyone! not just white, patriarch oligarchs. >> will: illegitimate, white supremacy. that's funny because that's exactly what i thought. a response from senator dick durbin to the court decision. durbin said, he was quite disappointed in the supreme court ruling, effectively barring the use of race. as a factor in college admissions. george wallace could not have said it better himself senator. it's almost impossible at this point to tell the difference between the racist rhetoric of the 1950s, segregationists and the self-styled antiracist of today. after the ruling, a new york city public school parent and cofounder of the advocacy group, asian wave alliance, she cheered the saying, saying, i told my daughter that today's a big day. they added affirmative

action. is that we've always been fighting for, she asked? i said yes. and why would she celebrate? because prior to this decision, there was no group were subjected to discrimination in academics, then asian americans. according to data cited in this case, harvard applicants and top academic decile the top 10 percent, had different chances of admission depending on their race. 56 percent of black students in the top 10 percent, were admitted to harvard. 31 percent of hispanic students got in. only 15 percent of white students were admitted. and just 12.7 percent of asians in the top 10 percent, were admitted into harvard. a blast in the top half of his academic class, had a better chance of getting into harvard, then an asian student or white student in the top 10 percent. one would think, a nation that takes a great step forward in judging individuals on the content of their character and

merit, and not the color of their skin, is cause for celebration. but in response to chu, former sewing on personality o'brien tweeted congrats on squaring over other people of color ma'am. it's an interesting statement. some implications. does that mean if an american, asian american parent, friends or teenagers being discriminated against, because of their skin color, that they maintain they should just shut up and be happy about being allowed into america? or is it instead, the implication here, that asians should feel a sense of solidarity with every other american above an undefined level of melanin. and if so, this exhibits a level of racism. implication that anyone above this level of undefined melanin, justin solidarity with one another. that is more aggressive than the thoughts of george wallace. in fact, this more reminiscent of the racist progressives of the early 20 century. they chased lineage that

measured and counted drops of blood of who is a person of color. and actually, this underlies entire conversation about affirmative action. who is eligible for lower standards due to race? what is race? who is black? who is white? how do you reduce someone say, mixed-race, to the appropriate check box? this is the proposed pseudoscience of the modern day antiracist. and they would have fit in on leonardo dicaprio's plantation in jango unchained. cause is already look like segregationist jim crow with separatist student unit and dorms and graduations for each race. how long before they dive back into phrenology? for that matter, if the goals of affirmative action is diversity, what is diversity? define diversity. is it 10 percent black, 20 percent black, 50 percent? is it 10 percent asian, 50 percent asian? what is diversity?

that's a question by the way. it is really only been asked by our most brilliant supreme court justice, clarence thomas. and the only answer he was given by counsel in this case, and i'm serious now, was to trust. just trust me bro. just the pseudoscientific race experts in the back room of the admissions office, at harvard. make no mistake, this decision was a huge win.a win against racism. there was a saying recently, that's been commandeered by the left on the last several years. in an attempt to explain white privilege. but is actually a quote that goes back to thomas soul. and it reads, will people get used to preferential treatment, equal treatment, seems like discrimination. that's exactly what we seen with reaction to the decision to end affirmative action. don't think the university system will just give up racism. entire enterprise has gulped down racial

preferences and shadow quotas, gulped it down with such vigor that it says, it's been swallowed up by david duke. racism is now ingrained in the dna of harvard. right after the director they had to stop using race, harvard said it was court hard day. and then, harvard's president-elect, essentially admitted the school would ignore the ruling of the supreme court. >> a supreme court decision on college and university admissions, will change how we pursue the educational benefits of diversity. but our commitment to that work remains steadfast. >> in other words you will find a new, more secretive ways to be racist. while universities will quietly look to advance their agenda, democrats will scream out loud about their agenda. after calling the court illegitimate in the clip we played earlier, councilman bowman called for the court to be expanded and term limited. >> expand the supreme court, when he supreme court ethics performed. and term limits. but we need to democracy

reform overall, which also includes ending the filibuster. >> alexandria ocasio-cortez and other democrats used this opportunity as well, to attack the court. >> was far right extremists and ballast supreme court which seeks to make history, for all the wrong reasons. >> there basically, reinterpreting congressional statute, to fit their ideological preconceptions. >> i support expanding the supreme court. because you have radical, extreme super majority as a supreme court. >> there also must be impeachment on the table. we have a broad level of tools, to deal with misconduct, overage and abuse of power. >> impeach the justices, term limit the justices, pack the court. for all the talk of civility and talk of the restoration of norms, it seems there is no institution of our republic that won't be destroyed in defense of their democracy.

jonathan turley is a fox news contributor and george washington university law professor. and he joins us now, jonathan, great to see you this evening.>> thank you. >> will: you heard of that clip, harvard say, we will be looking for new ways to pursue the ill-defined goal of diversity. what do you think will be the response of not just harvard and not just north carolina, but universities at large in response to the supreme court ruling? >> i think they're going to attempt to use race in a different way. after this decision of 77, the supreme court said it was getting rid of affirmative action and admissions, but would allow an exception for the use of race as one factor. what the universities did, they achieved essentially, same result, using the diversity rationale. that is why the court continually pushed back. it's actually sort of fascinating, is that after this decision came down, there was a human cry from university saying that

their admission of minority students would plummet. and that was interesting because in the oral argument and for the last 50 years, universities have told the supreme court that is not of putting a huge amount of race. as one of many factors. it is not a -- situation and yet, once the court get rid of race, you all these commentators and all of these colleges saying, this is going to you know, have our numbers plummet. and so obviously, race was a far more significant factor. but i think the chief justice roberts, basically laid out, how they are going to do this. as he did say that, to correctly so, that a student can discuss how he or she overcame discrimination in their lives as part of their essays. that will identify those applicants. >> but he did one universities as well. he warned universities, don't follow the advice of sotomayor and ketaketanji brown

jackson -- this is a backdoor to once again consider race. i think it's interesting that the omission about how much they were using race. i say, our numbers will plummet. i'm also taking back jonathan, but how many people said in a condescending fashion, as george w. bush once said, the low standard, racism of low expectations. how there is a sense that in this system that minorities outside of asians, will not be able to keep up with our admission standards. >> i think that is part of the whole purpose of this direction of the conversation, to avoid what we really need to talk about. which is the complete collapse of the education system. particularly in urban centers. you know, you have billions of dollars given for public education, which i am a fervent believer in. i sent all my kids to public school because i believe in public schools as part of our democracy. but that system is

collapsing. for minority families. they are graduating kids that cannot even reach basic levels of proficiency in english. >> will: right. >> consider focusing on that, and allowing all boats afloat, to try to raise educational quality, there is still an effort to check the box. >> will: yeah, not first-hand experience with that as well. having set my kids to a charter school in new york city. to see the alternatives for treatment for children who are either in low socioeconomic situation, or racial minorities. that what can be a college through essentially, a really good public education, is different from what kids can encompass. one last question, jonathan. your aoc, bowman and others talking about packing the court, term limited the court and impeaching the court. do you think there's any real threat to the future of the supreme court? >> i think there is a

thread. unfortunately, the american people have always been against court packing. that is in our dna. also supportive of this decision as you noted. so, there's not the support in the country for this. what we are seeing is a crisis of faith. members of congress, or lost their faith in the system. the public has not, and i think the you will see this in the years to come, they will be highly protective over this institution. >> will: let's hope so. this one of the few remaining institutions, have seen some sense of purpose and factor understand the founding principles of the united states in america. it is always great to talk to you, thank you. >> thank you. >> will: for some, actually of some of these people in your life. maybe it is even you. it's been said they simply cannot vote for donald trump. why? the answer you will receive his personality, character. okay, i understand. but why i would have to ask then in return, are you comfortable with joe biden?

was born. he took ms. roberts, the mother, and the child off of his health insurance not long after she was born. and then after that, he says, wait a minute, i can't afford to pay the child support payments monthly. you're asking for. you know, the guy who will remember, he made millions of dollars in ukraine, and china for services we still don't know what those services were exactly. and then he became leonardo da vinci when he never painted before in his life. admitted to $500,000 for painting there. so, how you can afford to pay child support and the grandparents joe and jill biden won't even acknowledge this child, is just rancid. the only word that comes to mind. >> will: disgraceful, true failure of one's test of character. you mentioned it, you mentioned advisors. i'm just curious, what is your explanation for this disgraceful behavior, why? why deny this child, even the name, biden.

>> are they from political perspective, if you read the new york times piece, it is seen as obviously, something the bidens don't want to broach because it hurts them politically. because it pierces the whole image that joe biden is the caring one, jill biden is a caring one, and obviously, there was about family, except when it is inconvenient.this piece by the way, it falls between laughable and borderline disgusting because it somehow mentions the name trump. get this, 14 times. 14 times in this piece. a story about hunter biden impregnating a woman, after the child is born, all the things that happened since, and i got to read the name trump 13 times and the whole application was that, one point donald trump jr. actually went hunting with the lawyer for ms. roberts. therefore, somehow they have their hands in all this and it is just amazing how even in the story, trump can be worked into it

(inspirational music) struck down joe biden's plan to forgive up to $10,000 in student loan debt last week. the court ruled not surprisingly, the president does have the legal authority, to raise the debt. even joe biden knew that when he proposed the plan. but he decided like any good -- to sell the american people on the lie anyway. truly is odious. but there are still more than 48 americans with student loan debt. together $1.8 trillion in debt, which is where the any other type of debt except for mortgage debt. the problem goes beyond anyone supreme court ruling. how did we get here? one reason that college and

the price of college, is so expensive, is because of debris and inflation. nearly 75 percent of all new jobs require a bachelors degree. there is little evidence these folks actually need the skills or knowledge obtained by for your education. a recent survey by resume builder found that over one third of employed college graduates could have gotten her current job without a college degree. 2017 report by harvard business school found that over 60 percent of employers, rejected otherwise qualified candidates simply because they did not have a college diploma. the report also found millions of job postings listed degree requirements even though the very same positions, were currently being held by people without degrees. in other words, millions of americans told they have to spend hundreds of thousands of dollars on degrees that they do not need. today's masters degrees yesterday's bachelors. in a few decades, it might not be worth a high school

education. -- put it kids are brainwashed 18 years to believe going to college is mandatory for a life with and a shred of dignity. there was a 17-year-old with no understanding of personal finance to decide to indenture themselves with the option of bankruptcy, probably for decades. one person we can thank the interestingly enough, is joe biden. in 1978, joe biden supported a bill called the middle income student assistance act. as intercept noted the bill eliminated income restrictions for federal loans to expand eligibility to all students. so it made it easier for students to borrow money, regardless of whether or not they be able to pay back the money. in just 12 years, student borrowing went from just under $2 billion, to $12 billion in that year joe biden also brought a bill in tennis is to stop them from using bankruptcy on

the longspur 2005 by the support of the bill that essentially prevented borrowers from limiting student loan debt when filing for bankruptcy. and they represent delaware, home to all of the credit agencies and credit card companies. now he wants to play the part. the student loan fireman after spending decades in the senate as an arsonist. how do we solve this problem? for one, would commit college and universities have some skin in the game in the loan game. right now the student loan business is a borderline racket. colleges and universities get all the benefits, from federally backed and student loans. and enrollments directors, more money goes into the pockets of the lenders and colleges and taxpayers are being set up to bear the risk of the students failed to pay back their loans. colleges and universities collectively, also sit on over 700 billion in tax free endowment funds. if these institutions are so sure that the degrees offer worth the price of

enrollment, then they shouldn't be forced to cover the cost of defaulted loans, that maybe they wouldn't have a financial interest in making tuition more affordable, they are also making sure students obtain useful degrees, that would enable them to actually pay back the loans. in short, the return of investment is awful and you have to pay back the debt. you cannot discharge in bankruptcy.thanks in large part to joe biden. charlie is a fox business senior correspondent joining us now. charlie, great to see you. why is college outpacing the rate of inflation, why is college so expensive? >> we have a whole program dedicated to this. everybody knows who went to college. one reason is because it was free money. anytime a free money something, if i could just borrow unlimited for anything, and you can, remember, there's no qualifications, didn't look at what degree you're getting, what your job might be when you get out. when you can pay back the loan. there is none of that. if you apply for a

mortgage, there is a lot of that. they look at your credit score. that is part of it. i think the other part is that universities have begun these huge sort of institutions, the get involved in everything. if you look at the numbers in these colleges, not a lot of money spent on actual teaching. they do a lot of other stuff and maybe we should go back to teaching. maybe professor should spend less time on these woke papers about whether diversity adds to the corporate bottom line, and more time spending time teaching basic economics to kids. there is this whole racket with the sort of colleges and their structure, as the banks, is the federal guarantee, through the altogether and you got a noxious mix. the question is, i don't know how you put the genie back in the bottle. this is where i'm a conservative, libertarian or people to pay back their college loans, but some people simply can't.

and that is the truth. >> is a practical problem that is appropriate by the government as you point out. if you subsidize anything gets more expensive. look at healthcare. the question is, as you said, how do we put the genie back in the bottle and solve the problem? many have pointed to these multibillion-dollar endowments. that these universities get to treat tax-free. can we call clawback some of these, can we taxes endowments, can we make the universities tap into these ungodly sums of money that they have while they settle students with debt free. >> and manage their money. they have that money. just think of the supreme court case if we were going to force the colleges to pay off some of the student debt, it will be pretty amazing. you know, i don't think there's an easy answer to this and its -- >> yes. i come from a blue-collar family, just so you know. while there was an iron work and i was the first person to graduate from real high school. not just college. when i went i went to an

interesting thing and look at what my salary might be when i get up. and i looked at the schools and how much they might charge me. and he went to the best school, university missouri that charged the least of the three best that charged the least and i know i could repay my loans. there's gotta be a degree of individual responsibility. >> i agree with that. that's why people have to pay back their loans. >> i agree. i think social should also step in and stop these predatory lenders for selling degrees for hundreds of thousands of dollars. >> that's true. >> great to talk to you. >> so true. you got it. >> kamala harris is the least popular vice president history, it's fact. but with every new gaffe that shows job it is's declining mental state they show her as a president close to allopurinol the american people are not ready for president kamala harris but is she even ready for president? >> i have a question is that enough for you as a political actor, to establish yourself in the

the police, louisiana criminals, put human restorative justice programs, instead of jail, we sent a message.as much as we are starting to see some liberal cities walk those policies back and invest in the police departments, a cultural shift doesn't change overnight. it's going to take years and years to see the changes. and the depleted police forces including baltimore, where they are deeply understaffed, that will take like a decade to fix. this is just going to go away. >> such a great point, jason. when rudy giuliani and bill bratton revived new york the 90s was about prosecuting small crimes, they didn't metastasize into big crimes. that's a cultural shift. you are talking cultural shift in the other direction that you said could last decades. >> absolutely! when you send the message is such a big way, and it was granted so well by democrats that you could not escape it. and it didn't matter whether you lived in baltimore, or dc or seattle, portland, la.

that's a near record low. i'd like to share what i think is so special with america. for starters a founding document and founding fathers were truly geniuses. a giant leap forward for mankind. to lay out a series of negative in a noble rights endowed by your creator, free from the interference of government. freedom of speech, freedom of property and freedom to pursue happiness. other countries make promises of happiness. they give away gifts and entitled you to positive rights to healthcare to your home and recreation. but all of those rights come at the time of negative rights. your property sacrifice for another's home. your labor sacrificed for another's health. your speech sacrifice for another's happiness. these founders were geniuses who stood on the shoulders of thousands of years of western enlightenment from judeo-christian enlightenment to james madison. special. but even more special is our culture, our people. one of the most distinguishing characteristics of america is that we are a nation of
