recently on social media. one of them is that cocaine found in the white house was belonging to either the president or his son. are you willing to say that is not the case, it don't belong to them. >> i don't have a response to that because we have to be careful about the hatch act. >> the hatch act, and they still don't know what that is. the level of security and surveillance prevalent in the white house begs the question. why have they not located a suspect. is biden stonewalling on our investigation. the bidens never seem to get to the bottom of anything. and growing number of serious corruption allegations and maybe it is because they don't want to get to the bottom of it. despite a sweetheart pleated deal from department of justice, the congressional crowds and to hunter biden, and his family shady dealings are ramping up.

versus what donald trump did for our black community and giving black colleges permanent federal funding which was unprecedented, and the lowest, absolute lowest unemployment rates. you're looking at that and these candidates versus donald trump, assuming he is our nominee, i firmly believe he will be on the republican side. it is also very difficult to get a third party candidate on the ballot. if they tried to run a no label, and no third party candidate, it will be very difficult and is going to require hundreds and thousands of signatures to get somebody on the ballot. they are frustrated with joe biden, especially based on the video that you showed at the beginning of your segment. >> kellyanne: the new poll shows that the third party candidates do tend to hurt joe biden. you and i are pollsters, and you

have studied this day in and day out. they refused to pledge the legends, both political parties, but in practical terms who really has the advantage right now as good as the independents. >> people do not like labels, but they really do identify it one way the other. it is all about one or 2% people who are truly independent, and what we are seeing is that most people are leaning more republican, but some issues. issues that are most important revolve around the economy where republicans do much better with independents, and also on immigration, crime, corruption, all of those issues favorite republicans. that is where a lot of independents are putting on the line. the one issue or does not favor republicans is abortion and acuras down on the priority l list. >> kellyanne: as our resident foreign policy expert here, and former spokesperson at the

state department there's no question that people are concerned about international issues, and national security, and disgrace and honor that joe biden and kamala harris have brought to our nation and around the globe. how's that going to play with independents and nd 2024 election? >> we can just look at the news cycle in the past few months. at first it started with the authorities uncovering these chinese run police stations, secret police stations in the united states. and then we famously saw the chinese balloon that traversed the united states, and he collected everything they needed before being shot down. now we have news and the administration has not been able to get their story right, but we have news of a cuban spy base in cuba that is funded and paid for by the chinese. we are talking about close to american shores and having a spy facility that is funded and paid for by the chinese communist party.

i think that americans, while they may not pay attention to foreign policy like i do, i think they understand when every day see a weakness on the world stage. you and i know that we have handed the abraham awards which are peace deals. the first piece deals and 26 years and we had a dose to be biden administration. what happened and within three months hamas was attacking israel under seven months of biden's administration. taliban took over kabul, and worst war in european soil when russia invaded ukraine. every theater of this planet and down to his secretary of state and his national security leadership. >> kellyanne: it is very important it remember all of that. with our remaining time i'm going to point out that in 2020 for many americans are saying that they might look for a third party, or might not.

approve of the decision to end affirmative action. here now with reaction as the author of the new book, "trial of the century." two brilliant legal minds. thank you for joining us. professor, let's start with you. you see the reaction to the affirmative action case, student loan case, to free expression case, and now you have supreme court justices attacking the court and each other. chief justice john roberts said that we are accustomed to disagreement, but not disparagement, and what say you? >> he is absolutely right. and all three of these physicians are close cases and i am a liberal, have been a liberal for 60 years. and i happen to agree with all of these supreme court cases. i've been arguing against using race and affirmative action since 1974. i have always approved of free

expression and first amendment over all of the laws. many civil libertarians, people who are left and right support these decisions in the web case, it is a close case, and many libertarians also support the decision that says that in a democracy important decisions about spending countless money should be made by the legislature, not by the executives. these are all close cases that many liberals agree with, and many democrats, and it is extreme ads, both on the court and off the court who are screaming and yelling that this ends a democracy in america. they are weight overstating the issue. we should continue to put support, and a sport respectful way when we disagree with the decision, but not to do delegitimize one of the most important institutions and

american history, united state supreme court. >> kellyanne: talks about how even liberals and democrats agree with the outcomes and particularly in affirmative action case, sounds that many african americans do too. big polling and "the washington post" today or yesterday going through all of the data. in addition to the plurality of black americans saying that they agree with supreme court ending race as an affirmative criteria and college admissions comedy "washington post" and the institute showing pretty much the same thing. i really struck by different polls showing that pew showed that 20% of african americans say that they benefit from these type of programs, and 35% say that actually put them in a disadvantage. and where is the argument? >> you would think that elected representatives, kellyanne will pay attention to that. the sentiments of the american public, but on the left they simply ignore it.
