claiming what ever happened in the past would not happen in the future. but the future has come and it is still happening. as they continued to suppress free speech, target americans using pfizer, there's a whole host of wrongdoing. you mentioned the hunter biden investigation. i put most of that on top of the department of justice because the irs and others were trying to do the right thing there. clearly the department of justice is cutting a sweetheart deal for him. but there will be lots of questions. the biggest question will be why should we reauthorize fisa 702? why should we continue to give this man the ability to use a foreign excuses to spy on americans? eric: give me some examples of what you're talking about exactly what troubles you so much about that? >> it happens under the faisal out much of it was expanded after 911 is the fbi can't essentially, working with the

cia pick a foreign national. someone that is not an american citizen in america. and then trace back all of their communications with americans. eventually spying on americans. one of the examples of course was using the fake, clearly known to be false, assumption of worker collusion with the russians. they basically spied on the trump campaign. eventually leading to prosecutions for lying. but in fact they did not have a predicate. the special investigation show they did not have a predicate. and yet they clearly did it knowing they were doing wrong. that is a good example of misusing a very special law, circumventing your privacy rights under the constitution. so it happens to be trump. but if you can go after a presidential candidate and ultimately a president, you can go after any american. our job is to protect every american. eric: they of course was said

truth. they are interested in getting the surveillances and keeping them for long periods of time. it is a problem. it is one of the many areas in which ray has said they have made reforms. but those reforms clearly are not working pay that is a big part of what we ask about. eric: you mentioned at the beginning of the interview my words, give him a pass. in other words not really go after him on hunter biden. what do you think potentially the bureau and the justice department could be culpable on that investigation? >> a while, they should be doing a thorough investigation. when you have a u.s. attorney assigned to at the department of justice, when his hands are tied by higher ranking people in d.o.j. you really have to follow that. one of the things i avoid doing and always have as an investigator in congress is a vote to low and getting people who are just obeying orders. in avoid go to high and accusing the big guy if the big guy
11:12 am
cannot be shown to have done. that practice has bowed well to get to the right people to make a change. in this case there are people at d.o.j. that are clearly fording the u.s. attorney and special prosecutor in this case. he has said it. with a whistleblower who said under oath. we will be processing that. those questions may come up in front of director rate. i would sate many of the questions will be on why should we trust the fbi when there is a series of wrongdoing that they have been directly involved in? eric: and where do you think the hunter biden investigation will eventually wind up and go? how do you see that potentially playing that out considering the players? >> ultimately and this happens often, the truth will come out sufficient that voters will ultimately decide if they're going to hold the president accountable for what he aided his son and doing. whether hunter biden is ever jailed or not, he is a second

drug user with lots of problems including obviously a propensity for criminal behavior and the millions of dollars. but, at the end of the day our goal is not to go after -- we are not prosecutors we are people who want to get you the truth. and then let you make decisions. and sadly some of those decisions are purely the voters at the ballot box. and for chairman jordan one of his big things is we want to make sure the next election is free and fair. the first amendment is not violated. the truth is not suppressed. that will be a big part of this and other hearings is to get people the ability not to go on social media at only get one side of the story because the fbi or other agencies are telling social media what to basically make sure you do not see. eric: you mentioned the president aiding his son, the president has denied any wrongdoing that he has talked to a son about this, do you buy that? >> with the sun pleading to even if they are misdemeanors fairly significant criminal things that

he did in tax evasion, why in the world would you go out of your way to have him at the white house showing he is still very connected to the big guy? i will not even get into hunter bided with a history of coke and now we have coke in the white house. but we really do have to ask why does he continue to put them on air force to an air force one? why does he do things that create the appearance that he has real connections with his father. real ability to affect his father. and let's remember if he does not know what his son is doing but his son is asking him to do certain things and he is doing them in fact his son is getting the outcome people have paid millions of dollars to get from hunter which is influence with his father. eric: the present will say obviously he loves his son very much given the fact they lost boat. we will see how that investigation place albert fell before you go congressman the news of the tragic airplane

eric: secret service expected to wrap up its investigation to that cocaine found at the white house less than president's press secretary they continue to face questions about that. the latest jobs report on the controversial decision by the president to send cluster bombs to ukraine. lucas tomlinson on top of all this and the latest headlights from the north lawn of the white house. -lucas. >> hi eric. officials say the investigation to who brought cocaine into the white house could be wrapped up as early as early next week.
11:21 am
now, officials are wondering how cocaine could be coming in here to the white house. our colleague mark meredith in the briefing room yesterday asked an important question. if cocaine can be smuggled into the white house what does that say about the security here? or perhaps who is working here who is visiting. what was there any risk to security, the present, your staff anyone who worked in this room for stuff to be so close to where you work? >> there is no issue with that tuition room relative to this. rigorous drug use policies are the white house. we take us acutely seriously. we will let the investigation unfold. if it involves someone from the white house, the appropriate consequences will ensue. white house press secretary said the left the white house when this is found. did not leave for camp david until 6:30 p.m. that friday night on june 30 however but here's a map to show the crime

scene. the cocaine was found on the ground floor of the west wing near where visitors take tours and are supposed to leave their mobile phone. x marks the spot. also the west wing's and biden spoke to cnn on what is in controversial decision to send america cluster bombs ukraine. >> we are in a situation where ukraine continues to be brutally attacked across the board by munitions, by these cluster munitions that are very high. that are a danger to civilians. number one. number two, the ukrainians are running out of ammunition. >> now, some critics are pointed to the president saying he's too slow in releasing these weapons to ukraine. weapons had been badly needed they say including long-range rockets and missiles. also air support sent u.s. officials that asking the ukrainian forces to launch the counteroffensive without air superiority can be suicidal, eric. >> all right lucas, thanks so

much. ask eric and lucas thank you. president biden's cluster bomb decision sparking concerns among nato allies and outcry from human rights groups. more than 100 nations have banned cluster bombs. they are notorious for spreading unexploded munitions over wide areas that designate years later let's bring in found executive director of national security institute. he is also a former counsel to the assistant attorney general for national security at the justice department. so let's start here. is it a good idea for the u.s. to send cluster bombs to ukr ukraine? >> look arthel, the united states has supported ukraine in its war against russia. russia started this war. russia has been using cluster bombs and massive amounts these are not ideal weapons but part of the problem here is we slowly walked our support to ukraine in this entire conflict. never been covered with them too and would not give them the weapons they need. now we need to put in a
11:24 am
significantly different type of weapon that's part of the challenge here. if we had given them tanks, missiles, f-16s early on this conflict might very well be o over. arthel: meanwhile as you alluded to, russia has been committing war crimes throughout ukraine. so why isn't controversy for the u.s. to send cluster bombs ukraine? >> the u.s. has started to reduce our use of these weapons. we did use it in afghanistan we can use them and iraq. we decided the danger to siblings a significant enough to want to be careful how we use them. at the end of the day we have 3 million rounds of these approximate in our stockpiles and given the ukrainians are in a fight for the very survival of their country this is what they need to take the fight to the russians and ultimately get them out of ukraine and invasion the russians himself triggered in 2014 and again last year. arthel: the awesome bands under two ukraine was on last hour i want to play the sound and talk
11:25 am
to about it. >> we will use them in a very responsible way. we are fighting on our country but we are liberated our own villages and towns. we take care about our people and our military has already shown how they are capable of being in our towns without huge damage or destruction contrary to the russians who are simply occupying, destroying, rape and killing in every thing else. i know it is hard decision. and i know it's difficult weapons but we do need them and we are very grateful. arthel: you able to understand what she said and what is your reaction? >> the ambassador is right. at the end of the date ukrainians need every weapon they can to win this fight. this is a situation, arthel, where our adversaries across the globe china, russia, iran are cooperating to invade ukraine. this is part of the challenge. it got to treat this as a threat it really is. this is about the safety and
11:26 am
security of europe and her allies along the grosvenor adversaries come up against its that's why we need to give the agreement everything need to win this war and win decisively. arthel: while i have you, issue know you've got $700 billion in yearly trade with china u.s. treasury secretary ellen says the two largest world economies can interact in ways that are uncontroversial to both governments. this of course but the backdrop of china sending warships and fighter jets near taiwan. so, is it necessary and okay for both to happen at the same time? >> well, you know part of this is a challenge, arthel. china is seeking the ultimate defeat of the united states. they do not to cooperate or collaborate with us. what they seek is an end to u.s. leadership of the world. and their replacement of us as leaders of the world but we have to recognize taiwan, just like ukraine, as part of that effort. the russians are with ukraine's as our other adversaries but we
11:27 am
need to recognize when china says we want to talk about trade investment they are talk by using american dollars to finance ultimate effort to defeat the united states. we need to recognize it for what it is. arthel: so then talk about the posture the u.s. military is taking in response to china's warships and fighter jets near taiwan. >> you know, the biden administration has been at times tough on china to put restrictions on their semi conductors for we have conducted freedom of operation and that region. the present himself as talked about will support taiwan with troops. the problem is that every time you walk that back for the president says will send troops the white house assess what we meant was what the president meant wasn't were going to send weapons. we talked about sending semi conductors the cia director, secretary announced to treasury to make up for and apologize to china's able to collaborate on trade investment. at the end of the day, arthel, is the key china views this as an adversary we have to recognize that's what they're saying to the people we have to recognize that's what their doing. but he should treat them as s
11:28 am
such. arthel: in the last 30 seconds as things stand now between the u.s. and china, is there a national security risk? >> absolutely by the chinese have threatened taiwan over and over again for they set missiles, jets, they threaten american warships in the region and threaten american airplanes in the region. we have stood by let happen. we have to understand they are likely to come after taiwan whether that's now in two, three, four years from effort we have to decide or we going to be there to defend our friends in taiwan just like with support our allies in ukraine. we need to do that and more for taiwan because in the end of the day, china is a large threat to our country the long run. arthel: quite a predicament. former counsel to the assistant attorney general for national security. thank you as always. eric: it has been 100 days since wall street journal has been detained in russia. and now the u.s. says it is in talks with moscow about a possible prisoner swap will have
