hot button social issues, republican congressman nancy mace will join us with her take. but first correspondent matt finn with the latest hi matt. >> mike: the house voted to amend the annual defense spending bill by overturning policy that reimbursing service members for abortion-related expenses. the house also voted to ban transgender health services in the military. in a bitter debate republicans have been arguing in part that the abortion reis burstment is a piece of the democrats woke military agenda that republicans are trying to end. the speaker of the house kevin mccarthy says democrats are trying to change the course of history. >> and for decades in america, from the most proceed-life to the most pro choice person in congress they believed in the hide amendment and that is simply what it's saying. do not use taxpayer money on abortion. and the other part would be is, what they're looking at, should

we allow wokism in our military. >> now democrats allege republicans are trying to hijack the bipartisan defense spending bill by attacking reproduct i have freedom. democratic congressman of new york pat ryan says most colleagues will vote no on the defense bill calling the republican abortion amendment a quote, poison pill. >> the far right, who's hijacked the congress and the speaker, unfortunately, has not been able to exert any leadership on this, and now we're at a point where after 62 years of a bipartisan defense bill, that's now going to get blown up. >> if republicans do pass the entire defense spending bill with their amendments tsenate is expected to take up its own version of the bill next week. aid for ukraine is also a hot continuing to. some republicans want funding cut. congresswoman marjorie taylor greene prepped a bill that would strip $300 million in aid and that was overwhelmingly

rejected. mike. >> mike: matt finn starting us off live tonight matt thanks very much. >> if you were hoping to find out whose cocaine was discovered at the white house looks like we're not going to find out after all. secret service concluded its investigation thursday for lack of evidence, some republicans are crying foul. senior national correspondent kevin corke joins us with the latest good evening kevin. >> good evening mike the secret service says it's simply not able to identify persons of interest in that investigation into cocaine gate over at the white house over quote a lack of evidence. now that news comes after congressional lawmakers were briefed on the matter during which the service revealed that weed, marijuana, had been found inside the white house in 2022, not once, but twice. and if you thought congressional lawmakers were champing at the bit to weigh in on this one, well, you would be right. >> just seems to me americans anything involving biden inc is

treated differently than everything else. >> somebody brought cocaine into the white house and the secret service has no idea who did it. that's not confidence-inspiring. i appreciate the secret service. >> they're brave men and women. but can you imagine if this happened on trump's watch? >> yeah. meantime in a statement secret service said, without physical evidence, the investigation will not be able to single out a person of interest from the hundreds of individuals who passed through the vestibule where the cocaine was discovered. at this time the secret service's investigation is closed due to a lack of physical evidence. meanwhile, president biden tangled with a reporter on thursday at the nato summit after he reported to say the u.s. couldn't guarantee its commitment to nato before quickly correcting himself. >> you can't tell me whether you're going to be able to go home tonight. no one can be sure what they're going to do. i'm saying as sure as anything can possibly be said about american foreign policy, we will

their choice then they have to live with that choice and deal with it on their own. >> mike: does your side risk going too far, too conservative in losing democratic support. >> the irony here is every single democrat knows if there's an amendment they don't like it's going to get tossed out when it gets to the senate a few hours later. so really this is sort of political gainsmanship political theater in the last hours before we vote on the ndaa. if there are things that are controversial that the majority of democrats don't want schumer will throw it out in the senate. everyone knows this, this happens every single year we go through this process and we're going to do it again tonight. >> mike: from bloomberg, far right republicans 'em perfectly house races with social demands on key defense bill. are your most conservative colleagues putting you and other swing district members on jeopardy with votes on some of these matters? >> they are absolutely. and as a woman, as a female lawmaker, as a suburban mom, as a girl mom, we can walk and chew gum at the same time. we can be pro life and be pro

woman but so far this year i'm asking my colleagues tonight and every night what are we doing for women especially in states where for example they banned abortion what are we doing to make sure women have better cheaper access to birth control instead of playing these games with whatever woke means, whatever flavor of the day woke is that day in the ndaa or any other bill we're working on we have to be balanced to show we care about women and we can be pro life. we can do both at the same time and for my colleagues that are forcing some of these votes and some of these amendments, it makes it very difficult for us to hold on to the majority because the vast majority of americans aren't with us. 90% of america is somewhere on the middle especially on women's issues and we have to show, even for pro life, that we care about women and we have yet to do that this year. >> mike: the big issue of the day tcocaine investigation at the white house is done from the secret service, quote, without physical evidence, the investigation will not be able to single out a person of interest from the hundreds of individuals who passed through

the vestibule where the cocaine was discovered. are you shocked? it's over just like that. >> yeah, the cocaine caper will never be found. for me, as a member of congress, it's very rush straith. every time we see something at the white house that has happened that is unsavory or perhaps corrupt or illegal, the white house also seems to lie about it and try to cover it up and no one ever gets caught, no one is ever held accountable and it's very frustrating to see the most secure location on the planet with the most trained law enforcement security agents on the planet can't figure this out. it's very frustrating and now case closed and we will never know what happened. >> mike: your colleague jamie raskin of maryland is ready to move on. let's play him. >> i'm satisfied that the secret service and the white house are on top of it. some people are saying everybody should be drug test order the way into the white house and, you know, these are the same people who were opposed to covid-19 tests. >> mike: can you imagine if the cocaine was found in the trump

white house. >> right, imagine the headlines if that had happened. and to his point, though, you can't drug test everybody without some sort of a warrant from a judge. so we've got to agree on due process and civil rights here. and there are hundreds if not thousands of people that come through. but it also goes to show weakness and operational security for the west wing and that has to be addressed as well. >> mike: congresswoman nancy mace thank you. appreciate your time. >> thank you. >> mike: california sided with schools over parents today when it comes to kids and their gender identity. correspondent marianne rafferty is here with the details. hello marianne. >> hi mike. the ruling has been made but the debate is far from over. u.s. district court judge john menendez ruled in fair of the school district policy that staff did not inform parents if their child wants to change their gender identity instead leaving it up to the child to decide whos no. he wrote quote the issue before this court is not whether it is a good idea for school districts

to notify parents of a minor's gender identity and receive consent before using alternative names and pronounce but whether the united states constitution mandates such parental authority. this court holds that it does not. aurora regino sued the school district for keeping her in the dark when her daughter started talking about being a boy. >> just to assume they're protecting them from an unsafe environment is jumping the gun. in my situation them taking that initiative made the situation worse for my daughter. >> mark tram he will executive of the organization representing her says it is a constitutional issue and not just this case. he says this secrecy policy represents a growing trend in schools across the country violating a constitutional right for parents to raise their children free from unreasonably government interference.

they expect the decision to be appealed which means the case isn't over yet. mike. >> mike: maryanne rafferty, thanks very much. >> let's bring in senior legal fellow with the independence women's forum may mailman and defender of parents, nicole neily welcome both of you. >> thank you. >> mike: from the judge's ruling the court is not the venue for this political debate d issue before the court is not whether it's a good idea for school districts to notify a parent and whether using alternative names and pronouns but whether the united states constitution mandates such authority this court holds that it does not. nicole, how do you assess it? >> this is appalling and what's frightening is what's taking place in chino is taking place in districts across the country. my organization has identified over a thousand school districts across america and counting that maintain these parental exclusion policies. we believe it is both immoral and unconstitutional and we're challenging a similar policy in

a district in iowa right now. >> mike: from jennifer chew an attorney with the aclu of northern california, quote, the court has affirmed that in california, trans and non-binary students get to decide on their own terms when and how to have conversations about gender and identity at school and at home. nicole, what about parents? >> parents have to sign permission slips to give their children aspirin at school, sun screen, bug spray. so for schools to be going to these extraordinary measures to cut families out of making significant decisions about their children's lives really denies us of the right to raise our children as we see fit to make medical decisions as we see fit. it's appalling. >> mike: let's hear from the mom in this case. >> i just want them to stop, stop keeping parents in the dark. they were talking to my daughter about different support groups in town to help her with her transition, and then discussed

breast with my daughter that i had no knowledge about. the goal is to make sure this doesn't happen to any more families and kids. >> mike: may can you blame her? >> no, in this case the school counselor talked about gender ideology with kids, asked a fifth grader for her boy name and then as the mom explained, talked about breast binding with the fifth grader. so as you mentioned, one of the reasons that the judge dismissed the case is because he treated this as a matter of, you know, well, it's just calling kids what they want to be called as if we're talking about nicknames. but this is not nicknames. these are fundamental decisions about upbringing, and in america, the supreme court has ruled that there's no co-parents. that parents have the authority to raise their children, and that is long standing precedent from the supreme court. >> mike: i want to read one more from the judge's ruling. quote the regulation refrains from interfering with the established parent/child relationship by allowing

students to disclose their gender identity to their parents on their own terms. may, what about that? >> well, there's multiple problems here, right? so it's not just that california its forcing children into decisions without their parents' involvement, but it's also that woke parents have more rights than parents who care about truths. so other courts have recognized parents' right to put all sorts of puberty blockers into their kids because they cite the supreme court rule that parents have rights over their kids. but here you've got a mom who doesn't want to put any sort of chemicals, doesn't want to castrate her children, she just wants to know what's going on in her school, and she doesn't have the right to parenthood but somehow woke parents do. >> mike: nicole you make the point that it used to be the schools partnered with families in the best interest of a child but you argued that has changed. would you explain? >> yes. you know, when a child used to be in trouble, you know, they would call the family in, they would work together to figure

out how to get the child back on track. yet now we see a very adverse summarily relationship between schools and parents where we have district administrators that are making assumptions about whether parents are a good parent, would be supportive based on characteristics such as political affiliation or religion. we are a nation of laws. we believe in due process. that is an extraordinary thing for an unelected individual to try and interfere in that parent child relationship so it's appalling that a school district could do that and for them to do it with a family with their tax dollars behind their back is insult to injury. >> mike: may, chance for a final word. >> yeah, so i think all i would ask for is that parents who care about truth to have the same rights as parents who want to chemically castrate their children. we have three district judges in arkansas, in tennessee and in florida who have struck down democratically elected state laws on the basis of parental rights. if a judge can go in and make

that a parental rights decision, which is crazy, then at least you can let parents know what's going on as far as therapy in their schools. >> mike: may, nicole, thanks very much. >> thank you. ♪ >> mike: first up in tonight's real news roundup a group of waste collection and landfill workers are seeking $300 million after allegedly being exposed to toxic chemicals in california's nasa county. they were cleaning up areas in the 2020 glass fire and claim they were not properly prepared. jeff ellsworth a former local mayor chalks it up to politics saying he warned both governor gavin newsome and congresswoman nancy pelosi, who have vineyards in the area, that a nearby landfill had the potential to pollute water and agricultural land in the valley below. >> we don't own a private jet. i don't own a private jet. i personally have never owned a private jet. and obviously it's pretty stupid

the surcharges are not limited to restaurant related costs, however. california law permits a one percent fee to combat, you guessed it, climate change. >> they say the show must go on, but this time it's not going to, at least for a while. actors have voted to walk off the job after negotiations with industry executives broke down. writers have been on strike since may, meaning the constant production that's continued will now come to a standstill. chief correspondent jonathan hunt has the details. >> sag on strike baby, first time we struck together since 1960. >> mike: hollywood in crisis tonight every film and tv studio effectively shut down now that the actors union sag has joined writers in striking. >> we had no choice. we are the victims here. >> the main issues for the actors are the same as they are for writers. they want a better and guarantied share of income from the streaming of movies and shows.

and they want guaranties over how ai might be used in future productions. >> most of those actors are making a middle class living, they're just trying to make their mortgage payment that month. >> we just want a fair contract and a living wage. >> the studios say the demands, particularly on revenue from streaming, are unrealistic given that many streamers are struggling to make a profit. through their umbrella organization, the alliance of motion picture and television producers, studio executives accused the actors union of intrans generals saying rather than continuing to negotiate sag actor has put us on a course that will deepen the financial hardship for thousands who depend on the industry for their livelihoods. the joint strike actions mean the production of movies and shows and the promotion by actors of anything already made has now ended, and depending how long this goes on, it could cost the entertainment industry

party candidate. let's bring in lee carter president and partner and lesley marshall fox news contributor and syndicated radio talk show host. welcome to both of you. >> thank you. >> mike: let's start with green party candidate cornell west. >> i'm thoroughly convinced that the 2-party system stands in the way for the empowerment of precious poor people and precious working people and i am fundamentally committed to the plight of the least of these, not just here and around the world. >> mike: lesley, is that sounding alarms down at the white house and at the dnc? >> well, there are a couple of things here, and these are two things to, you know, to unpack. one is a third party. until you don't have an electoral college, a third party doesn't really have a chance of winning the presidency. but when you look at how is it going to affect, you know, the

current candidates and the front runners, it certainly would pull away more from president biden than it would from former president trump donald trump. when you look across the board at independence, it would pull away from joe biden, and then when you look within the democratic party. now, cornell west, with all due respect, i have a lot of respect for him as an educator, writer or speaker, but politically his numbers just aren't that scary. now if you go to the other side, mike, and if you had donald trump say if he doesn't get the gop nomination i'm going to run as an independent republicans should sweat a lot. >> mike: lee then there's west virginia senator joe manchin. let's play him. >> common sense discussions to find out what the american people would like to see accomplished not just basically the toxic atmosphere we have because of political parties. that's all this is about. >> are you ruling out a third party bid? >> i've never ruled out anything

or ruled in anything. >> mike: is man shin a threat to president biden lee. >> i think he is. when you look at the enthusiasm for joe biden he has a real problem because only 41% of his supporters are very enthusiastic about supporting him so a viable candidate that might be an alternative that seems moderate that also might be pro choice is going to draw some people away. one of the things we know nine in ten democratic women are saying i'm going to vote on abortion but i'm not necessarily excited about voting for joe biden so if they have a third party candidate it's enough to maybe pull votes away in those five key states that matter. >> mike: among the issues, questions about the president's age and his job performance, 44% approve, 55% disapprove in the latest fox poll. what about that lesley? >> i have to say something about joe man shin. republicans view him as a democrat and democrats view him as a republican. the guy who votes against the party and hasn't supported the

president, i don't think joe manchin would have a chance. when you talk about joe biden's age, certainly age is a consideration but last time i looked donald trump wasn't pushing 30. and in addition to that, if you're going to look at popularity, i can't believe all the polls, mike, and not just because they don't say what i like because of what happened in the midterm. we had the president showing he wasn't popular, we had polls showing that i would be drowned by this red tsunami and it just didn't happen. we see a very slim majority by republicans in the house, no majority by republicans but rather majority by democrats in the senate. so the popularity number has not affected joe biden. and i don't think it will even though it's a long time until the election next time around. >> mike: all right senator brian says quote i think it is worth freaking out about because i think this elections likely to be close and even if these idiots get 3% that could be 3% that throws the electoral college in the wrong direction. final thought lee. >> no doubt even if it's 3% of a

vote it's that close of a race and it's closer than anybody thinks. joe biden is not popular. donald trump is not popular either but donald trump's support has really increased since the indictment. but 18% more likely to consider donald trump after the indictment. there's a lot of people out there saying things seem unfair and they're more likely to rally behind him than they were before and that's a big shift since the midterm. so i would expect to see a big shift there and i think a lot of surprises are to come. >> lee carter lesley marshall, thank you so much. >> thank you. >> mike: there is a lot of talk about artificial intelligence or ai these days and much of it's centered around fear but can this technology be used for good? some religious leaders say yes, chief religious corps aren't lauren agreed has the story. >> we don't believe god is surprised by ai. >> he sees the potential for good. the founder and ceo of glue a

injured shot in the chin during this. this claim that somehow it's offensive that they stored this in, not really even a prominent spot within a bicycle repair room, it is a completely contrived controversy pushed by folks who want to demonize the police. >> mike: what's the deal with these dangerous so-called side shows doing extreme stunts with their cars in oakland? >> reporter: yeah, what we are he a seeing here, really it's not just in oakland we are a seeing this all around the country, young people getting together, usually using social media to gather to let everyone know where to show up. they're doing these car stunts in large part because they can get away with it. on the one hand, you have police departments that are depleted, they're not able to get there in time, and even if they were it's so chaotic you can get away pretty quickly. and because most of the time these are juveniles and young adults responsible, they know there are no real consequences, we createed this culture of lawlessness and they're taking advantage. >> reporter: finally in seattle
