the night before the fbi notified secret service we are going to do that interview tomorrow. the fbi was then told that hunter biden would be given the phone number of an fbi agent and if hunter wanted to talk to them, he would call him. next morning, agents waited outlines of hunter's house and his lawyers would not let him speak to the fbi. >> ainsley: well, i mean in this situation we don't even know if he would have interviewed but they had an opportunity to go in, surprise him and say we need to ask you a few questions. we need to interview you. that would have been the fbi. and he got the tip, secret service got the tip, his people got the tip, of the transition team, and they got his lawyer involved. you know, if fbi knocks on your door you are probably going to say talk to my lawyer or i'm going to get a lawyer because i'm not talking to you without representation. but general flynn didn't do that remember at the white house when the fbi went in and talked to him, he spoke to them. this was a chance to maybe get some answers from hunter biden. we don't know if he would have

>> yeah. biden's new plan, steve, is no more lawful than his first plan that was struck down, of course as blatantly unconstitutional. in fact, it's worse than the first plan. biden invoking as you say the education act. take a look at it. it's even more restrictive in how loans can be forgiven than the hero's act. it's narrowly tailored, very specific, limited conditions for waiving the debt of individual borrowers, not a massive borrower. it's not millions of borrowers but biden is ignoring all that and what's more he well knows he is exceeding his power because the white house first considered the education act. they rejected it. advisers saying you can't do this under the constitution and the law. it simply does not give the president blanket authority to forgive debt so he is sort of contorting the law, usurping the power of congress and is he certainly treating the supreme court with contempt.
